Annual Report 2016
Preamble
3
2016 was not an easy year for our association and we – like most of the other industry asso-ciations – are being faced with the question if we will be able to continue our operations in the future. This development is understandable as the majority of our members are focussing on saving costs. And when attempting to save costs, people quickly start to become «forget-ful» when it comes to reviews and assessments. They look back on recent months, or maybe one or two years, and consider what the asso-ciation has done for their organisation in this period.
An internationally active company relying on exports can therefore quickly come to the conclusion that it no longer requires a Swiss association as over the past two or three years there have been more serious problems (which, indeed, the association has no influence over). However, the association’s services with regard to exports and regulatory requirements are particularly extensive and measurable.
An importing company may also conclude that Swiss legislation is no longer as relevant thanks to Cassis-de-Dijon, and that legislation is continuing to be harmonised. And yet, a strong, representative industry association such as SKW is stronger than any corporation in this respect. Plus, who is driving the harmonisation of legislation, if not the associations?
Membership of an association creates «toge- therness» and helps members to develop a group with a critical voice in the political pro-cess. It also creates synergies – and that is an invaluable asset of the Swiss Cosmetic and Detergent Association.
The achievements this year are therefore par- ticularly positive and give us the momentum to tackle the challenges that lie ahead. I would like to draw your attention to two of these achievements:
• Swissness industry ordinance Our industry association is the first of its kind to have developed and enforced its own substantial ordinance based on the new Swissness ordinance. The Federal Council enforced the cosmetics industry ordinance on 1 January 2017. I would like to sincerely thank all of the persons involved, the nume- rous members who have cooperated in this project and, of course, Simon Holzer, lawyer, and Bernard Cloëtta, our Director, for the professional implementation!
• Joining forces for the new, strong Work Group Professional Cleaning The new members VAN BAERLE and STEIN- FELS CLEANING SYSTEMS have strengthened the existing work group, which represents the interests of these members. The closure of the work group could thus be prevented. In the political sector, the representative status of an association or work group is the relevant factor.
As you can see, We are intensively dealing with the requirements of the various member groups and are continuously adjusting our strategy with regard to areas of activities for our target groups. The cost/benefit ratio over the past 5 to 10 years for our members is extremely positive, which is reflected in the Annual Report.
This would not be possible without the con- structive discussions of the Management Board, the questioning of the status quo and the ad-justment of our services to meet the dynamic requirements placed on all of our members.
For this, I would like to sincerely thank my colleagues on the Management Board and the active team supporting Dr. Bernard Cloëtta at Breitingerstrasse!
To you, dear members of SKW, I would like to extend my warmest thanks for your loyalty and trust and wish you a successful 2017! Together we are strong!

ion Swiss Legislation
The focus was on the total revision of the foodstuffs and cosmetics legislation (Project LARGO). The concern of the cosmetics industry was clear: alignment with the correspon-ding EU laws to the extent possible for a country not a member of the EU.
The industry had the same concern with regard to the im-pending revisions of the legis- lation of chemicals. Importers and exporters also wish to know exactly where they stand in this respect without encountering unnecessary trade barriers.
The cosmetics and detergent industry is extremely keen to initiate the comprehensive re-alignment of the VOC incentive tax as soon as possible.
Over 50 SKW members produce part or all of their products in Switzerland. They follow the «Swissness proposals» in Parlia- ment and the efforts of SKW regarding the issuance of a «Swiss made Cosmetics» indus- try ordinance by the Federal Council with particular interest.

Revision of Cosmetics Legislation(«Project LARGO»)
On 16 December 2016, the Federal Council resolved to enforce the new Swiss foodstuffs and cosmetics law on 1 May 2017.
Nearly all of the concerns and arguments put forward by SKW during the consultation and numerous talks with the responsible federal agencies were fully implemented. Particularly the request of the cosmetics industry to con-sistently harmonise Swiss legislation with EU law was met.
The introduction of «dynamic references» to EU law is a new way of implementing amended laws in Switzerland within the required period and to match their content. This particularly affects the appendices of the EU Cosmetics Directive. Exceptions from this principle are now being explicitly communicated by the federal agencies.
These are the key points of the new Swiss cosmetics legislation:
• No product notification in Switzerland apart from CPNP, registration in the EU• No Swiss address on products• No country of origin stated on product• The specified warnings may be applied in a local or other language if this provides con- sumers with sufficiently clear and unambi- guous information.• Product information files may be written in a local language or English. They do not have to be physically stored in Switzerland, but may also be made available from other countries. • The requirements for safety assessments and assessors have been assumed from EU legislation.• Switzerland will not launch its own cosmetics monitoring system. Like before, undesirable effects have to be reported to the responsible federal agencies.
The regulations for essential oils will also be fully adapted to match EU legislation. In other words, it will depart from the previous fixed rule of 3%. Self-controls and corresponding safety reports will now be required.
The only exceptions from EU law currently per- tain to hydrogen peroxides for tooth whitening agents and furocoumarines. The responsible federal agency requests up-to-date and mea-
ningful dossiers for the latter. The SKW needs to act as a coordinator as this restriction is hard to trace and difficult to implement for many members.
The existing and partially disputed «FOPH criteria for demarcation» for medicinal and biocidal products should be reviewed.
The transitional periods after the enforcement are different for each regulation. As reques-ted by the SKW, a transitional period of four years has been set for adjusting safety reports to meet EU standards, an undertaking which is creating major financial and personnel expenses for some Swiss manufacturers.
«Modernisation of Swiss Legislationof Chemicals»
On 11 September 2015, the Federal Council resolved the «modernisation of Swiss Legisla- tion of Chemicals». The objective of the further development of the legislation of chemicals is to further increase the protection of humans and the environment against chemicals in Switzerland, taking into consideration new scientific findings and international regulations. Trade secrets should be avoided as much as possible and the cooperation between scien-tists, technicians and foreign and international government agencies in the chemicals sector developed. The Federal Council ordered for the responsible departments to draft the amendments required to the ordinance and to present the bill by the end of 2017.
At the beginning of 2016, the FOPH ordered an assessment of the consequences of the regu- lation for this purpose. The SKW coordinated a respective online survey and forwarded it to the affected member companies. Several stakeholder meetings also took place during the course of the year (see «Network» section). Based on the assessment of the consequen-ces of the regulation and comments made by stakeholders, the federal agencies presented the following potential measures during the impending revisions:
«Innovation is the bedrock
of KMU’s and Wetrok’s
competitive position.
The SKW is more than just
an information point for
professional and legal
questions – it is a crucial
partner that voices and

of our industry.»

Planned revision of the Chemicals Ordinance (ChemO) 2017
• Reporting duty for intermediate products• Introduction of a UFI (Unique Formula Identifier)• Requirements for testing individual EINECS substances• Reporting duty for professional users and/ or manufacturers of nanomaterials• Requirements for the assessment of individual old substances
Planned revision of the Chemicals Ordinance (ChemO) 2019
• Compulsory registration of all old substances • Compulsory registration of all nanomaterials circulated• Components intended for manufacture and cosmetics products for further processing (packaging) are subject to the Chemicals Ordinance (compulsory registration, classi- fication, labelling) as well as nanomaterials, which are licensed in accordance with the ordinance on cosmetics products.
Compulsory registration of nanomaterials which are explicitly permitted in the Cosme-tics Ordinance is incomprehensible for the industry and would primarily disadvantage Swiss manufacturers. The SKW and other affected industry associations will be required to act with regard to this issue.
Planned revision of the Ordinance on Biocidal Products (OBP) 2018
• Assessment of requests for active ingredients or union approval and corresponding fees • Introduction of a concept for parallel actions for biocidal products with transitional licenses• Electronic publication of the lists of active ingredients• Amendment of the biocidal products imple- menting ordinance to match EU develop- ments
Revision of the Chemical Risk ReductionOrdinance (ORRChem)
In Switzerland, the provisions of Appendix XIV of the REACH Regulation («Substances of very high concern» (SVHC) requiring licensing) are regulated in Appendix 1.17 of the Chemical Risk Reduction Ordinance. The circulation and
use of these substances is generally prohibited. Licenses issued by the EU Commission are also classed as exempt from this prohibition in Switzerland, as long as the substances are circulated and used in accordance with the EU license.
The federal offices plan to include eight sub- stances in Appendix 1.17 to the Chemical Risk Reduction Ordinance, in line with the EU. The affected parties will be given sufficient time to prepare for the new regulatory requirements. The SKW issued a statement on the effects on the industry.
VOC incentive tax
Article 9 of the OVOC stipulates that VOC emissions that are not fed through exhaust air filter systems must be reduced in accordance with Appendix 3 in order for stationary systems to be exempt from the VOC incentive tax (requirement to use state-of-the-art technology only). In accordance with the provisions of Article 9c Paragraph 2, Appendix 3 is to be adjusted to reflect technical developments.
The SKW rejects the proposed wording: The criterion of the annual volume of diffused VOC is stated as an absolute figure without referring to the total VOC volume of a facility and the annual VOC volumes are not differen-tiated on the basis of the substance classes of the VOC.
The SKW, like other affected industry associa- tions, generally questions the benefit of the VOC incentive tax. The incentive target was achieved some time back, but certain pro-ducts are unnecessarily taxed in this manner without this achieving the incentive target. This increases the attractiveness of purchasing products in neighbouring countries. This, in turn, further dilutes the incentive tax and the increasing cross-border traffic places an addi-tional burden on the environment. Together with other stakeholder groups, the SKW is therefore searching for a constructive solution to suspend this incentive tax.
«Precursors for explosives»
On 1 September, the Federal Police (Fedpol) invited relevant stakeholders to a round table on the topic of «precursors for explosives» where it presented the latter with a regula- tion proposal to improve controls for the sale

of precursors. This directly affects seven sub-stances whose purchase should be subject to compulsory registration or licensing, depen-ding on their concentration.
The SKW agrees with Fedpol’s pragmatical actions as they are the same as in the EU countries. The SKW rejects the additional re-quest for tougher sanctions on commercial purchases (industrial and agricultural sectors). The member companies can guarantee that the purchased products can be traced right back to source. Misuse can therefore be ruled out. Products are supplied only to known cus-tomers which actually require these products for their operations. These products are not sold to private individuals. These hazardous products are already banned from sale to private individuals.
It makes no sense for Switzerland to introduce tougher sanctions than the EU.
Environmental Law
The Green Party, supported by the Swiss Social Democratic Party (SP), Green Liberal Party (GLP) and Evangelical People’s Party of Switzerland (EPP), submitted a popular initiative against the «overuse of natural resources» with the name «Grüne Wirtschaft» (Green Economy).
The Swiss electorate was not deceived by the likeable name of the initiative and some of the curious and impossible promises put forward by the initiating parties. The initiative failed significantly with merely 36.4% yes votes and only one cantonal vote (Canton of Geneva). The result is not a rejection of a sustainable economy, but a rejection of a radical initiative with unforeseeable consequences.
«Swiss made Cosmetics Ordinance»Draft
The new ordinance on the use of Swiss indica-tions of source for cosmetics products («Swiss made Cosmetics» industry ordinance) regula-tes the use of Swiss indications of source for
cosmetics products and certain ingredients of cosmetics products.
Based on a draft by the SKW, the Swiss Federal Institute of Intellectual Property (IIP) initiated the consultation procedure for this draft ordi- nance on 29 August 2016. It was met with approval by the parties involved.
The ordinance requests for the majority of Swiss cosmetics products to be manufactured in Switzerland. In the future, in addition to the 60% of the manufacturing costs, which are defined in detail by the ordinance, of a cosmetics product that should be incurred in Switzerland, a minimum of 80% of the costs for research and development as well as pro-duction should also be incurred in this country. In addition, certain important activities parti-cularly relevant to the quality of a cosmetics product must also be carried out in Switzerland (bulk manufacture, packaging and quality control).
The SKW will maintain a list of raw substances or preparations produced in Switzerland for the manufacture of cosmetics products. This list will be uploaded to the association’s website at the beginning of 2017 as soon as the first entry is ready. Interested suppliers are invited to register their products.
The new Swissness legislation comes into force on 1 January 2017. Industrial products manu- factured before this date that meet the requi-rements under previous law will initially be permitted to be sold for a maximum period of two years from the effective date (final sales period).

General Assembly
The General Assembly took place on 21 April 2016 at the Zunfthaus zur Zimmerleuten in Zurich. The usual statutory business was dis-cussed. The Managing Board was confirmed for the period from 2016 to 2019. Tommaso Bruno, Henkel, Marc-André Heller, L’Oréal Suisse, Remo Manz, Sealedair Diversey Care and Clotaire Moineau-Quent, Beiersdorf, were elected as new members.
Thomas Früh, intracosmed, was confirmed as President for a further year. The previous members of the Board Committee, Marco Baumann, Rausch, and Ralf T. Gehlen, P & G, were also re-elected. Dr. Ina Banik from Nielsen reported on the subject «Market Environment in the Switzerland Near Food Area».
In the public part, Ms Carolin Kiefer chaired a podium discussion on the subject «Area of Conflict between Marketing and Regulatory».
The main focus of marketing is to drive the commercial success of a product with inno-vative claims and advertising statements. This often pushes the boundaries of what is legal or barely legal. The instances responsible for the regulatory sector have to define these boundaries internally. Within this area of conflict, management has to make the right decisions.
The discussion highlighted how companies deal with this issue and which consequen-ces companies could be faced with if these boundaries were breached.
The following persons participated in the dis-cussion:
• Doris Merz Nardone, PM Care Systems AG• Dr. Michael Gruhl, Cosmetic Consulting JW & Partner GmbH• Prof. Dr.iur. Mischa Senn, Schweizerische Lauterkeitskommission (Swiss Commission for Fairness)• Dr. Bernard Cloëtta, SKW office
Managing Board
The Managing Board met on 31 March and on 7 December (statutory agenda: Finances, new contribution rules for the Work Group Professional Cleaning, inclusion of the new member companies Steinfels Professional Cleaning and vanBaerle, strategy and budget 2017 to 2020).
SKW Stakeholder Council (SC)
The SKW stakeholder Council met on 27 Sep-tember. This Council consists of representatives of the key stakeholders of the SKW and an advisory committee of the Managing Board and the office. The Council discussed the fol-lowing subjects:
• Free trade – do borders have to be open to be good?• Trade 4.0: Digitalisation and changes up to the question if trade will still be required in

However, with regard to the specific areas of proposed intervention the proposals remain rather vague. • Current offers for promoting new talent and providing further training in the cosmetics and detergent/cleaning agent sector: Future opportunities and risks.
Technical Commissions (TC)
On 8 November, a meeting of the two tech- nical commissions took place in the Zurich Kongresshaus.
In the TC Cosmetics, Ms Judith Deflorin, Head of the FSVO Market Access Division, Food-stuffs and Nutrition Department, held a talk on the current full revision of the cosmetics legislation (Project LARGO, see Section 1 «Legislation»).
• The participants welcomed the planned adjustments to match EU law and the new dynamic reference system for the appendices relating to ingredients. • Individual manufacturers expressed concern about the planned Swiss special rule for furo- coumarines.
The TC cleaning Agents and Detergents dis-cussed the following subjects:
• Olivier Depallens, Head of REACH and Risk Management at FOPH, Chemicals Depart- ment, talked about the planned «Moderni- sation of Swiss Legislation of Chemicals».• Dr. Pierre Favre, Federal Office of Public Health FOPH, Consumer Protection Division, joint registration office for chemicals of FOEN, FOPH and SECO, discussed the subject of «Mass Reporting Tool». Numerous SKW members had complained about the delays in the obligatory reporting process.• Dr. Bernd Glassl, Head of Household Clea- ning products at the IKW, talked about the impending and proposed new EU laws.
For further information on these subjects, go to Section 1 «Legislation».
Work Group Branded Products
The Work Group Branded Products met on 8 June in Zurich and discussed the subjects of legislation (revisions of the cosmetics and chemicals legislations), communication (media monitoring, media topics), SKW website, the Swiss made Cosmetics industry ordinance and the status of negotiations regarding the Swissness proposal in Parliament.
Work Group Professional Cleaning
The Work Group Professional Cleaning met on 29 August. In addition to the existing members, three potential new companies were invited as well. Thomas Früh, President of SKW, also attended the meeting. The SKW endeavours to represent this industry sector as much as possible and aims to increase the number of memberships and the portfolio of the represented products.
Peter Eichenberger Obituary
On 1 October 2016, Peter Eichenberger was abruptly taken from us. Together with his wife, he was involved in a fatal accident during his
holidays. For many years, he had been coopera-
ting very closely with the SKW in technical matters. He was a pragmatical and highly target-driven expert who was equally able to represent the interests of his clients and the whole industry. He was an active member of the SKW Communications Committee and together with other mem-bers edited the SKW brochure «Waschen heute». His death has left a massive gap, both in human and professional terms, and both the SKW office and association members will always remember him with fondness.

The main subjects were the benefit of this work group for members, its future align-ment, new legislative developments and the revision and expansion of SKW’s statistics for this industry sector. The work group resolved to change the name to AG Professionelle Reini-gung – AG ProRe (Work Group Professional Cleaning). The first meetings for the revision of the statistics took place on 20 September and 24 October. The work group achieved its objective by admitting two new members, vanBaerle and Steinfels Cleaning Systems, on 1 January 2017 and by expanding the product portfolio to include professional cleaning agents and dishwashing detergents.
Work Group Professional Hair Care
The annual meeting of the Work Group Pro-fessional Hair Care took place on 11 October. Information of the office on new legislative developments and on the joint project with coiffureSUISSE was on the agenda: In the pre-sence of Damien Ojetti, Central president of coiffureSUISSE, Ms Karin Imboden, Managing Director, presented the new concept for the planned HairFashion 2017 (formerly Hairday), which will be held on 22 May 2017 at the Zurich Exhibition Centre.
Séance des membres francophones
The French-speaking members of the SWK met on 2 September in Lausanne for an in-formation conference. The managing director explained the ongoing legislative revisions (cosmetics legislation, legislation of chemicals, Swissness proposal) and other current topics. Afterwards, the participants discussed the translation of SKW’s documents, events and communications. The Annual Report, SKW website, e-mailed information and official media statements are always translated, with exception of the appendices forwarded by foreign senders.
The SKW provides simultaneous interpreters for association meetings if a certain minimum number of non-German-speaking participants has been confirmed. The participants of the meeting agreed that translations into English should also be provided.

Voice of the Industry
The usefulness of an association depends on its recognition by the political sector, the media and NGOs and its ability to voice industry concerns in the right places. To do this, it requires a large network, good representa- tive status and trustworthy and transparent communication.
Consumer Information «Waschen heute»
The SKW publication «Waschen heute» (only available in German) is the association’s most ordered and downloaded information bro-chure and an additional 1,110 copies had to be printed in 2016. The clear information brochure was published in summer 2015 and can be downloaded from the SKW website or ordered from the office.
Relaunch of Website
The appearance and technology of the SKW website are outdated. The website is not fully responsive at present, for example. The main communications project in 2016 was therefore to complete revision of this communication channel. The new website, which will continue to be hosted at www.skw-cds.ch, will go live at the beginning of 2017.
Day-to-day Media Work
Press releases, statements and background dis- cussions require rapid and coordinated actions and clear language. In 2016, various media enquired about market trends, market figures, ingredients and legislation issues, particularly with regard to the new Swissness legislation.
In addition, the following statements were published or revised during the reporting year:
• Deodorants and aluminium salts • Plastic particles in cosmetics products• Go-ahead for the Swissness draft• Apps and online portals that assess ingredients of cosmetics products

As the «mouthpiece» for the industry, we can answer questions in a neutral way or forward them to the persons or companies responsible.
Information to International Companies and Organisations
Swiss law is different to other countries. Many international corporations no longer have own legal and technical departments in Switzer-land. SKW is receiving an increasing number of enquiries from foreign companies and asso- ciations as a result.
Information is only provided to companies that are members of their respective national associations. This enables SKW members in return to ask foreign associations to provide information on laws and registration rules.
Free Sale Certificates
For our members, we issued 168 (previous year 174) Free Sale and GMP certificates for export.
Most certificates were issued for China, Iran, the United Arab Emirates and India.
Exports and Trade Shows
Our 50 Swiss manufacturers require special assistance with exports. They may join the ERFA group «Export» and the «Work Group Swiss-ness» and gain access to SKW’s «Regulatory International» network.
SKW is constantly developing this network thanks to global partnerships with international associations and companies. SKW’s members have access to information on legislation and product registration as well as events, con- sulting services and publications of the key industry associations, trade shows and export organisations.
ARGUSavenue
ARGUSavenue members can efficiently manage and edit all media reports relevant to them on particular subjects. A very useful instrument that is also used for reporting to company-internal offices.
In addition to being able to use the facilities of ARGUSavenue, members receive a weekly edited press review for the cosmetics and/or detergents and cleaning agents industries.
«The new «Swiss Made»
cosmetics ordinance came
into force on 1 January 2017,
as scheduled. This was
only made possible thanks
to the excellent cooperation
between the SKW and IPI:
final score 3-0!»

ySustainability Projects of the Companies and the Industry
Sustainability has become a key issue in our society. However, the commitment to act in a sustainable manner should not be just an empty promise but backed up with specific and trans- parent practical projects and contents, other-wise sustainability remains but a meaningless catch phrase.
For us, sustainability as a symbiosis between economic success, social justice and environ-mental protection. Both legislators and com-panies are equally responsible for accounting for these three aspects and implementing them as best as possible in day-to-day business.
Society demands strong environmental and social commitment from companies. However, sustainable business is always based on eco- nomic success. A company can only live up to these important responsibilities if it is profitable.
Our members are aware of this responsibility and volunteer to act in a sustainable manner. The companies are responsible for developing, designing and implementing their sustainability activities and all related communication.
As an association, we promote the exchange of experience amongst our members and support the sustainability efforts made by our European umbrella organisations such as the «Charter for Sustainable Cleaning» and «Clean Right» by A.I.S.E. We also inform the consumer and environmental organisations as well as traders about the industry’s projects and issues and give advice on how they may also con- tribute to the topic of sustainability.
Our Commitment
Sustainability is a key issue both in the cosmetics and detergent and cleaning agents industry. Manufacturers intensively dis- cuss this subject. Industry as- sociations initiate voluntary industry initiatives to promote sustainable manufacturing pro- cesses, consumption and the disposal of products.

n Membership Growth
The number of members has increased signi-ficantly in recent years. In 2004 we had 54 members and 82 members in 2016. More than 90 percent of the industry is organised under our roof. This significant representativeness is an important argument for the association’s work to be taken seriously by the political sector, government agencies, stakeholders and the media.
