“Acceptable bid” means any bid which, in all respects, complies with the conditions of bid and specifications as set out in the bid documents, including conditions as specified in the Preferential Procurement Policy Framework Act (Act 5 of 2000) and related legislation as published in Government Gazette number 22549, dated 10 August 2001, in terms of which provision is made for this policy.

APPOINTMENT OF A CONTRACTOR FOR THE MAINTENANCE OF STEEL POLE OVERHEADLINES NETWORK IN GERMISTON AREA.

APPOINTMENT OF A CONTRACTOR FOR THE MAINTENANCE OF WOODEN OVERHEADLINES NETWORK MV AND LV.

1. BACKGROUNDSeveral suburbs in the Ekurhuleni Metropolitan Municipality (EMM) were reticulatedby means of steel poles, concrete poles and wooden poles with stranded barecopper conductors or either aerial bundle conductor. Service connections are eitheran overhead connection or underground cables that have been strapped to thepoles. Most of the steel poles have now rusted to the extent that entire linesregularly fall over due to poles breaking off at ground level. The bare copperconductors have also been damaged so often through being forced together by treebranches and line thefts that most of the conductors are full of weak points andjoints that regularly break or burn off when the wind blows or when a fault occurs.Aerial bundle conductor is also damaged in areas where theft and overloading tookplace.In the light of the above the Ekurhuleni Metropolitan Municipality (EMM) now wishesto employ a contractor to remove existing dilapidated and worn out low voltageoverhead lines in the Ekurhuleni Metropolitan Municipality (EMM) and replaces itwith a system of low voltage aerial bundled conductors on tubular steel poles,concrete poles or wooden poles. The need is also there to replace non-standardlow voltage overhead service connections.Due to the extent of the task and also the fact that not all the lines are in an equallybad condition, the work will be undertaken over a period of several years. TheMunicipality will also use the opportunity to rationalise the layout of the low voltageoverhead line system to allow for load growth and load shift that has taken placeover the years since the lines were built.There is also a need in replacing and repairing overhead low voltage service andoverhead distribution cables especially where cables are past their useful life,damaged by cable theft and 3rd party interference.It is a requirement that the contractor/s must be available after hours to performemergency breakdowns on the underground and overhead low voltage network toensure that we deliver a firm and reliable service to the customers of the EMM.

2. SCOPEBidders are required to quote for the following: To inform the customers where a line is to be rebuilt or a cable is repaired orreplaced of the fact that the power will be off for a considerable period of timewhile the work is being undertaken. To receive as a free issue from EMM or supply when requested the necessarygalvanised tubular steel poles, concrete poles and wooden poles, aerial bundledconductor and low voltage cable. Contractor to ensure that all material suppliedor received are correct and suited for the specific application. To carefully disconnect the supply cable to the existing line as well as all thehouse service connections and then remove the overhead line conductors,damaged wooden poles, concrete poles and rusted steel poles and convey thescrap material to a specified workshop of the EMM in the EkurhuleniMetropolitan Municipality (EMM). Relatively new poles that are not damaged,

cracked or rusted or wooden poles not rotten shall be returned to the verticaland left in position for use in the new line or shall be repositioned for such use. To supply the necessary pole top service connection boxes / pole kits, pole topcable, dead end and support clamps, electrical connectors and all wiring andsundry materials and erect an aerial bundled conductor low voltage overheadline in more or less the same position as the bare conductor low voltageoverhead line that was removed. To reconnect the supply cable and service connections, commission the newABC line, test all the service connections for polarity, phasing and earthcontinuity and hand the whole system over to the Ekurhuleni MetropolitanMunicipality in a proper working condition. An earth resistance / continuity test certificate of each replaced steeldistribution pole and ABC line to be provided with each invoice. 10ohmsand less will be acceptable readings The overall resistance to earth of the neutral of an LV distributor ordistribution system must not exceed 10 ohms. To supply all material (cable, joints & sundry material) when needed toreconnect a low voltage bulk supply connection. To update existing drawings and provide as-built drawings to the EMM inelectronic format (AutoCad). This bid also allows for other work requests to be carried out as part of therebuilding and repairing of lines as specified in this document. It shall be noted that the contractor is only allowed to work on an undergroundcable if it forms part of a refurbishment or rebuilding project currently inprogress. Cable fault location and repairs of underground cables notforming part of a project are covered by another bid and does not form part ofthis bid.Note: Preference will be given to Ekurhuleni based companies and biddersand note that this bid may be awarded to more than one company.It is envisaged that the work will be undertaken over the entire EkurhuleniMetropolitan Municipality (EMM) on an as and when basis. Bidders are thusrequired to quote for the work on a rate basis to allow some flexibility in theexecution of the work and to facilitate payment for work completed. Bidders canbid for all areas or for a particular area . The areas of the Ekurhuleni areAlberton, Benoni, Boksburg, Brakpan, Edenvale, Germiston, Kempton Park,Tembisa, Springs.

3. REQUIREMENTSNote that specific works cannot be surveyed before bidding as this will be acontinuous project as and when required. The bidder must quote on the requiredrate prices, which will be used to adjust the total price per individual works projectrequired.Bidders are required to survey, inspect and examine the existing bareconductor overhead lines in all areas, or in the area he or she is bidding for,in the Ekurhuleni Metropolitan Municipality (EMM).

4. PROGRAMME OF WORKSThe contractor will give notice in writing to the Chief Area Engineer or his / herrepresentative when he commences work on site and renders progress reports tothe Chief Area Engineer or his / her representative at regular intervals, as requiredby the Chief Area Engineer or his / her representative.

The Contractor shall be fully and solely responsible for ensuring compliance withthe Occupational Health and Safety Act (Act no 85 of 1993) and any otherlegislation that may apply. In this regard it is specifically pointed out that theContractor will, inter alia, have to do the following: Provide and maintain systems of work, plant and machinery that are safe andwithout risk to health. Eliminate or mitigate hazards or potential hazards before resorting to personalprotective equipment. Ensure the safety and absence of risk in connection with the handling of articlesor substances. Establish the hazards pertaining to work establish what precautions should betaken and provide the means to apply the precautions. Provide information, instructions, training and supervision to ensure health andsafety. Not permit anyone to do anything unless the necessary precautions have beentaken. Do everything possible to ensure compliance with the applicable legislation. Enforce discipline in the interest of health and safety. Ensure that work is performed and plant or machinery is used under thesupervision of a person with the necessary training and authority. Cause all employees to be informed of their authority in terms of section 37(1)(b)of the OHS Act. Conduct his undertaking in such a manner that he or any other persons are notexposed to hazards to their health and safety. It is also recorded that, in order to comply with legislation, the Contractor wouldhave to appoint certain persons in writing, e.g. to supervise machinery,excavation work, stacking, etc. and to operate lifting gear and to investigatecertain incidents. These people should have received special training and insome cases they should be in possession of specified qualifications or holdprescribed certificates. It will be the responsibility of the Contractor to ascertainwhat the law requires and to ensure compliance. It is specifically recorded that the Contractor shall, in terms of section 37(2) ofthe Occupational Health and Safety Act, be fully and solely responsible forensuring compliance with the provisions of this Act. Should the Contractor findanything in this specification or receive an instruction that may jeopardise hiscompliance with any legislation he shall bring such finding or instruction to theattention of the Ekurhuleni Metropolitan Municipality and resolve the matterbefore proceeding. It is further specifically pointed out that the Contractor shall be registered interms of the Compensation for Occupational Injuries and Diseases Act (Act No.130 of 1993) and that he shall be in good standing with respect to the paymentof assessments to the Compensation Commissioner. The contractor shall sign a section 37(2) contractual agreement with the EMMOccupational Health & Safety Practitioner for Contractors in Alberton CCC priorto commencement of any work. In terms of regulation 4(3) of the Construction Regulations, 2003 (hereinafterreferred to as the Regulations), promulgated on 18 July 2003 in terms of Section43 of the Occupational Health and Safety Act, 1993 (Act No 85 of 1993) theEmployer shall not appoint a contractor to perform construction work unless theContractor can satisfy the Employer that his/her firm has the necessarycompetencies and resources to carry out the work safely and has allowedadequately in his/her bid for the due fulfilment of all the applicable requirementsof the Act and the Regulations.

REGULATIONSThe work will be carried out strictly in accordance with the latest issue of thefollowing documents: The SANS 0142/1 Code of Practice for the Wiring of Premises The Occupational Health and Safety Act, 1993 (Act 85 of 1993) The EMM By-Laws Electricity Act, 1987 (Act 41 of 1987) (as amended). (Note, particularly,Government Gazette R103, 26 January 1996). Any reasonable special requirements of the Regional director / Chief AreaEngineer or his representative.

7. QUALITY AND STANDARDSAll material, equipment and workmanship that is supplied, installed and deliveredunder this contract or part thereof shall be new and of the best quality. All material,equipment and workmanship supplied shall comply with the requirements specifiedin the latest editions and amendments of the relevant National RationalizedSpecifications (NRS), SANS, BS and IEC specifications. Material with the SANSmark will receive preference.All inferior material, equipment and workmanship located on inspection shallimmediately be replaced / corrected at the expense of the contractor.The following standards must be used as guidelines: IEC 60947-2:1995, Low-voltage switchgear – Part 2: Circuit breakers. SANS 182-1:1973, Conductors for overhead electrical transmission lines – Part1: Copper wires and stranded copper conductors. 8. SAFETY No work will commence before the required works permit is completedindicating that it is safe to work. Working without a works permit is prohibitedand the contractor can be relieved from this contract. It is the contractor’sresponsibility to insist a works permit prior any commence of work. It will be arequirement to submit a copy of the works permit with the invoice toensure safety was adhered to at all times. Portable earths will be visible and applied either side of a worker on a bareoverhead line. All electrical equipment including electrical enclosures where possible shall belocked both by a lock from the contractor as well as from an authorised person

from EMM when power is switched off to perform any work. The necessarydanger notices informing not to make the circuit alive shall be displayed at allisolating points. The contractor’s staff will at all time wear protective clothing as prescribe by theoccupational health and safety act. Every reasonable precaution for the safety of all concerned in the operation ofthis contract will be catered for by the contractor. Safety is the responsibility of the contractor and the EMM will not be heldresponsible for any injuries, accidents or incidents that might occur. The EMM reserves the right to stop any work at any time if the contractor is notfollowing the right safety procedures explained in the OHS, SANS and EMM bylaws. The contractor must meet all requirements stipulated in the OHS, SANS andEMM by-laws. Live switching will be done by the Operations & Maintenance Section of theElectricity Division in the region where work is done of the EMM. If the contractor is not complying with legislation his/her work will be ceased untilhe/she can satisfactorily proof compliance. A documented health and safety plan must be submitted after awarding this bidbut prior to commencement of any work , which addresses hazards andidentifies and includes safe work procedures in order to reduce or control thesehazards. No persons is allowed to climb up any pole before he or she hasdetermined in what condition the pole is.

9. COMPETENT STAFFThe bidder shall submit with his bid document full details of: Any person having the knowledge, training, experience and qualificationsspecific to the work or task being performed: Provided that where appropriatequalifications and training are registered in terms of the provisions of the SouthAfrican Qualifications Authority Act, 1995 (Act No. 58 of 1995), thesequalifications and training shall be deemed to be the required qualifications andtraining. Contractors who cannot offer competent and experienced personnel in thistechnical field will not be considered. All work to be conducted either by a competent person or under the directsupervision of a competent person. Names to be submitted of all competentpersons who will be on site and take responsibility of all work under his / hersupervision.

10. COMPETENCY OF CONTRACTOR’S STAFF Contractors will be required to use personnel that have been trained in theerection, repairs and maintenance of Aerial Bundled Conductor and bareoverhead lines. Properly trained in the jointing and terminating of low voltage cables. Replacement of overhead transformers and distribution enclosures foroverhead transformers.- Attach qualifications –minimum must be at least 3 qualified electricians11. RESPONSIBILITY FOR WORKSThe contractor will take full responsibility and care of the works, temporary works,structures, plant, material and equipment from the commencement to completion ofthe contract. The contractor at his own cost will repair, replace and make good anyloss or damage to the works, structures, plant, material and equipment.

12. SECURITYThe sites where the works are to be done are situated in the EkurhuleniMetropolitan Municipality (EMM) in the province of Gauteng, South Africa. This isan area notorious for violent crime, theft and corruption. The Contractor shalltherefore ascertain beforehand what facilities will be obtainable for the safe keepingof valuable material and equipment. The Contractor shall also note that theEkurhuleni Metropolitan Municipality will only accept responsibility for the installedequipment when it is handed over in a good acceptable standard. The security ofall material issued to the Contractor (if applicable) as well as the security of theinstallation will remain the responsibility of the Contractor and he / she shall allowfor the necessary armed guards, patrol dogs, security lighting, alarm systems,insurance cover, etc. to safeguard all material issued to the contractor as well asthe works until it has been handed over to the EMM.

13. CIDB (CONSTRUCTION INDUSTRY DEVELOPMENT BOARDConstruction work is any work in connection with: The construction, maintenance, demolition or dismantling of any bridge, dam,canal, road, railway, runway, sewer or water reticulation system or any similarcivil engineering structure; or The moving of earth, clearing of land, the making of an excavation, piling, orany similar type of work; The erection, maintenance, alteration, renovation, repair, demolition ordismantling of or addition to a building or any similar structure. The installation, erection, dismantling or maintenance of a fixed plant wheresuch work includes the risk of a person falling.Only those bidders who are registered with the CIDB, or are capable of being soregistered prior to the evaluation of bids, in a contractor grading designation equalto or higher than a contractor grading designation determined in accordance withthe sum bidded for a 1EP or higher class of construction work, are eligible to submitbids.

14. SUFFICIENCY OF THE BIDThe contractor shall satisfy himself / herself prior to submitting his / her bid as to thecorrectness, sufficiency for the works, rates, prices and will cover all his / herobligations under the contract in relationship to the supply, delivery, off-loading,installation, testing, commissioning and handing over in proper working order to theEMM.

15. SITE INSPECTION BY THE CONTRACTOR PRIOR TO BIDDINGThe Bidder or Bidders shall inspect and examine the specific area / ccc where he /she is bidding for and its surroundings in liaison with the relevant area MaintenanceEngineer. Satisfy him / her prior to submitting a bid as to the nature of the ground,sub-soil, roads and any obstacles. He / she are required to obtain all the necessaryinformation as to risks, contingencies and other circumstances, which may influenceor affect his / her bid.

16. ALTERNATIVE OFFERSIf the bidder wishes to submit additional or other offers, he / she shall set out detailsof the proposal(s) and qualify alternatives in a covering letter. The fact that thebidder is qualified by a covering letter shall be indicated in the appropriate section ofthe bid document. It should be noted that the contractor will only be adjudicated onthe contents of this contract only.

17. DAMAGE TO OTHER SERVICESIt is specifically noted that the Contractor shall properly investigate the presence (orpossible presence) of other services before any excavations are undertaken. Thisincludes making contact with all possible service owners to ascertain whether theyhave any services in the area and to obtain their requirements for opening and/orcrossing such services. It also includes exposing services by means of manualexcavation (pick and shovel) and guarding such services while exposed, all inaccordance with the requirements of the owners of the services. The Contractorwill be liable for damage to any service or other property on site and shall take outsufficient insurance cover to indemnify the Ekurhuleni Metropolitan Municipality inthe event of a claim.Successful service provider shall ensure that liability insurance is in placeafter appointment of this bid.If an existing service or other property is damaged the Contractor shall immediatelynotify the owners of the service or property as well as the Ekurhuleni MetropolitanMunicipality. The Contractor shall also allow the owners to affect repairs and, as faras practicable, assist the owners of the service with the repair work.It is the contractor’s responsibility to obtain a way leave where and when required.

18. NON-COMPLIANCENo claim for additional costs incurred as a result of non-compliance with theregulations / specifications by the contractor will be considered. In the event of anycontradiction in the regulations and the technical specifications it will be requiredthat such contradiction is referred to the Regional director / Chief Area Engineer inwriting for a decision.

19. USE OF LOCAL LABOUR AND SUB-CONTRACTORSIt shall be noted that it is a requirement of this contract that local labour and localsub-contractors residing in the specific region / ccc will be used when the workloadis excessive.The contractor will only be allowed to bring in labour from outside the area wherespecialised skills are required and must be severely motivated.The use of local sub-contractors is very important to ensure that small andupcoming contractors have opportunities to succeed / grow and improve their skillsand levels of competency.A name list of local sub-contractors can be made available if required from thespecific area where works have to be executed. It shall be noted that the maincontractor is still responsible for the sub-contractor as employer.Payment of the sub-contractor/s by the main contractor/s shall preferably bemade within thirty (30) days on receipt of the sub-contractor’s invoice butnot later than five (5) days on receipt, by the main contractor/s, of theMunicipality’s payment.

20. GUARANTEEThe contractor shall guarantee the material, equipment and workmanship deliveredfor a period of twelve (12) months. respective area, accepts the works as completed and in working condition. Theguarantee will provide for the replacement of all parts, spares, appurtenancessupplied by the contractor and workmanship that become defective during theguarantee period, at no cost to the EMM.

21. SITE MEETINGS AND SITE INSPECTIONSThe Contractor will be required to facilitate and attend a site inspection and meetingfor the duration of this contract as and when required. It will be compulsory for theperson who is normally in charge of the work on site as well as the person in chargeof this contract to be present at each site meeting and site inspection. Nonattendanceof a site meeting and site inspection will be a sufficient reason for theEkurhuleni Metropolitan Municipality to hold back a progress payment certificate forwork that has been completed by the Contractor. All site meetings & instructionsshall be recorded in a site instruction book and signed both by the contractor andresponsible person for the project from the EMM.It is essential that all work be inspected and accepted by an inspector from theEkurhuleni Metropolitan Municipality whilst the work is in progress. The Contractorshall thus make the necessary arrangements in this regard and shall obtain asignature from the inspector in respect of each inspection carried out. A logbookshall be kept on site for the inspector to record his comments and/or instructionsand a copy shall be submitted with each claim for a progress payment submitted bythe Contractor.The Chief Area Engineer or his / her representative reserves the right to test /inspect the material, equipment and workmanship at any stage of the contract andto be present at any test performed during the contract. Such tests / inspections willnot relieve the contractor of his responsibility for meeting all requirements of thespecifications and will not prevent subsequent rejection if material, equipment andworkmanship are later found to be defective.

22. REPRESENTATIVE OF THE CHIEF AREA ENGINEERThe duties of the representative of the Chief Area Engineer will be to control theperformance of the works, to witness tests, to examine materials to be used and tocheck on the quality of the workmanship carried out in the works. He / she will nothave the authority to: Relieve the contractor from any of his duties or obligations under the contract. Grant an extension of time for completion of the works Approve extra payment Make any variation of or in the worksFailure of the Chief Area Engineer representative to disapprove any work,workmanship, materials or equipment will not prejudice the power of the regionaldirector / Chief Area Engineer thereafter to disapprove such work, workmanship,materials or equipment and to order the replacement thereof at no cost to the EMM.

23. CALL OUT / STANDBY SERVICES It shall be required from the contractor to provide a 24hour call out /standby service in regards of an emergency breakdown on the LV networkregarding work covered in this bid.It shall be expected from the contractor to be on the affected site within 2 hours(maximum) after being informed. A penalty of 15 % of the repair andmaintenance cost for the specific project the contractor was called for,will be levied, should the contractor arrive/commence later than therequired two hours on site. A call out rate will only be applicable for calls after hours. for repairs regardless if it is after hours or during working hours. The call out rateis only for the call out and the repair rates are as per this document’s priceschedule. After hours will be the same as the Ekurhuleni Metro’s after hours.

24. COMMENCEMENT OF WORK AFTER AN OFFICIAL ORDER HAS BEENRECEIVEDIt is required that the contractor shall be on site to commence work within 2 workingdays after an official order has been received for planned work.25. RECORD OF WORK COMPLETED A record of the work undertaken, results and checks made and a copy of theworks permit, test certificates are required in the form of a dated and signedsheet together with a digital photo (Before & after photos) for each linerebuild / repairs / replacements. The data is to be captured in Microsoft Excel format. Photos to be burned on aCD-R / DvD-R in a JPG format and handed to the EMM’s responsible person.No payment of any invoices will be made unless the record sheets, copy ofthe works permit, test certificates and photos for the work being invoicedhas been duly completed and handed to the Metro’s responsible person priorto this. The form and layout of the data to be captured on Microsoft Excel will be agreedupon, after contract award, with the successful contractor

26. HANDING OVER PROCEDURE The re-building of overhead lines may be handed over in phases consisting ofcomplete line zones. The Contractor shall conduct an inspection to satisfy himself that installation hasbeen completed to the requirements of the Specification and that theWorkmanship complies with the expected standard. When the contractor issatisfied he / she shall then apply for a final inspection. The installation shallthen be inspected in the presence of the EMM & the Contractor. Should the completed phase not pass the inspection the Contractor shall rectifythe fault(s) and apply for another inspection. When a completed phase of the installation passes a handing over inspection,the Contractor shall submit a completion and handing over certificate for signingby the EMM and contractor.

27. VARIATION ORDERSIn all cases the Employer must first approve Variation Orders if any before suchwork commences. Variation Orders relate to non-specified activities, material andequipment that may be required to complete the works, however the costimplications thereof are not covered by the Bill rates.

28. PAYMENT Payments will be made on a monthly basis for work completed during a specificmonth. Payment will be made within thirty (30) days from the date that the invoices havebeen received by the Department of Finance. Only one payment per month per area will be made, covering the workperformed during the month, subject to receipt by the Engineer: Operations &Maintenance of a specific area of the necessary written reports, before and afterphotos, copy of the works permit, required test certificates and invoices. The Contractor will be paid on the nett measurement of the work completed.

29. TRANSPORTThe contractor shall make his / her own arrangements for the transport to and fromsite of all plant, material, equipment and labour. This will include material orequipment supplied by the EMM if applicable. Such material will be made availableat the Municipal Electricity stores or Electrical Workshops in the respective areas,against the Contractor’s signature. The addresses will be supplied when workcommences.Specialised vehicles normally used are a hydraulic elevated platform (CherryPicker) and a hydraulic crane truck.30. TRAFFIC CONTROLThe Contractor shall be responsible for all arrangements with the traffic authoritieswhere necessary and shall provide all cones, barriers and other items specified bythem for the control of traffic on the roads during construction.

31. COMPLETION DATEThe completion date will be determined for each project as and when required.

32. RESTORATION & CLEANING UP Upon completion of work or any portion thereof the ground, paved, concreted ortarred areas, fences and any other structures, which have been interfered with,shall be carefully restored to their original condition. All rubble, rubbish, tools,tackle, plant and materials shall be removed and the whole of the works or eachcompleted portion thereof shall be left in a neat, orderly and working condition. All unused cross-arms, old bare overhead lines and other unusedequipment on distribution poles shall be removed by the contractor wherebare overhead lines were replaced with aerial bundle conductor. Thescrap / redundant material shall be delivered to a particular electricalworkshop / store within the specific working area. The restoration of paving, cement and tar surfaces need to be reinstatedprofessionally, tunnelling should be used as far as possible to avoid thebreaking up of the said surfaces.

33. COMPULSORY BRIEFING SESSIONAll prospective contractors will be required to attend a compulsory briefingsession. See details on the front Page of the bid document.The contractor or a representative of the contractor shall sign the register at themeeting as proof of attendance. No bids will be considered unless the prospectivecontractor or his representative has attended the briefing session on the time anddate specified and has signed the register.

34. POWER OUTAGESIt shall be noted that the work specified in this document is to be done in built upand inhabited areas. The existing overhead lines and underground low voltagecables are all supplying customers that are dependent on their service connectionsfor their daily activities. The contractor will thus have to take special precautions toensure that all preparations are properly done before a line or cable is switched off.Once the supply has been terminated the contractor will have to work continuouslyuntil the power has been reinstated to all the affected customers.

35. NOTIFICATION OF PLANNED POWER INTERRUPTIONSThe contractor will be required to inform all customers that will be affected byplanned work in writing at least 14 days in advance. Such notification shall be bypersonal visit of the contractor to the customer and a signature shall be obtainedfrom the customer to acknowledge the visit and notice served. most of such visits will have to be undertaken after hours and over weekends.Proof of signatures obtained should accompany the invoice to ensure what isclaimed for is delivered.

36. EXCAVATION AND BACKFILLING OF CABLE TRENCHES All excavations in soft and intermediate material shall be done manually.The opening-up of existing services shall only be done manually. No machine excavation shall be undertaken within three meters of any serviceor other obstruction that may be damaged by the excavation machine, unlessspecific permission has been obtained from the service owner. Manual excavation by means of local labour (i.e. job creation) is a requirementof this bid. All cost implications will be for the Contractor’s account. Excavations shall be barricaded as prescribed by the Act and shall not be leftopen for longer than 3 days. Contractor might be penalised if this is notadhered to. The contractor must make his / her own arrangement with the crossing ofresident’s drive-ways and ensure not to cause any inconvenience when driveways are crossed. Cables shall be laid in accordance with manufactures recommendations andSANS 0198.The minimum required dimensions for trenches for low voltagecable are: Width – 300mm and Depth – 650mm All cables shall be installed in straight lines as far as possible and excessivedistortion and weaving in the cable length is not accepted. Excavation in hard material shall be brought under the attention of the EMM. Trenches across roads, access ways or footpaths will not be left open. If cablecannot be laid immediately the contractor will install temporary bridges or coverplates of sufficient strength to accommodate traffic concernedBACKFILLING OF EXCAVATED CABLE TRENCHES:Compacting of the trench will be done in 200mm bedding layers. The trench must as far as possible be re-instated to its normal condition orbetter. The Contractor will be held responsible for any soil sagging or subsiding for aperiod of 6 months after completion of the work. Backfilling material will be without any foreign objects, rocks or stones that cancause damage to the cable. If suitable backfilling material is not available on site suitable material will haveto be imported. Due allowances will be made in the bid for this should importedbackfilling material be required.

37. TUNNELLING Tunnelling shall be used where it is not practical or possible to trench. Breaking up of tar roads and paving should be as far as possible be avoided andtunnelling should be used instead. No person shall enter a tunnel, which has a height dimension of less than800mm. Tunnelling activities shall comply with the Tunnelling Regulations as publishedunder the Mine Health and Safety Act, 1996 (Act no. 29 of 1996), as amended. Contractor to provide all equipment / machinery to execute tunnelling.

38. PRUNING OF TREESThere are existing street and private trees in the areas where the EMM isresponsible to maintain the vegetation underneath the distribution overhead lines.Where such trees are obstructing the overhead lines the contractor will be required

to suitably prune such trees as follow (See annexure 10): All trees in a street underneath power overhead lines must be equally pruned togive it a pleasant appearance. Tree branches must be cut underneath the power overhead lines in such fashionthat the clearance between the power overhead lines and tree top must be±3.0m (minimum). Pruning of low branches must be done for pedestrian traffic. Unnecessary mutilation of trees must be avoided, no tearing will be allowed. Branches that are in contact with Overhead conductors must not be cut whilstsuch conductors are alive. Necessary arrangements must be arranged with theOverhead Section for the respective areas, to switch-off power where and whenrequired. No work to be carried out without a works permit. Trees must not be left lop sided. Care must be taken to prevent the branches from falling on to pedestrians,vehicles or any obstruction and damages to infrastructure. All branches should be tested for soundness and strength before standing onthem. Branch cutters to be used under direct supervision. The safety clearance between live Low Voltage over headlines and any part of atool or any part of a person’s body shall be ±2.0m (minimum). The safetyclearance between live Medium / High Voltage over headlines and any part of atool or any part of a person’s body shall be ±4.0m (minimum), it is advised not tocut trees whilst Medium / High Voltage lines are alive. No trees to be pruned in stormy weather conditions or where thunder is present. Please obtain prior approval if it is necessary to enter private property. All pruned tree branches to be removed from site within (2) two days and bedisposed off in a legal manner by the contractor. Tree pruning to be done in conjunction with the Parks Section of a specific CCC/ area.

39. SWITCHING AND COMMISSIONINGThe Contractor shall make the necessary arrangements with the EMM for the powerto be switched off before any work is carried out on or near live equipment. Apermit that states that the power is off and that all relevant switchgear has beenlocked out and sign posted and equipment earthed as contemplated in the OHS Actshall be obtained from the EMM before any work is put in hand. If possible the keysto the locked-out switches shall be obtained and handed to the person working onthe equipment that can be made live through the locked-out switches. Adequateprecautions shall be taken to ensure that a permit is not signed off prematurelyand/or that somebody does not return to a job after the permit has been signed off.The Contractor shall, before requesting the EMM to make any equipment live,conduct a thorough inspection of all equipment that is to be energised to confirmthat all work has indeed been completed, that all signs and notices are in place andthat all equipment and cubicle doors are closed and locked. All relevant circuitsshall then be tested for continuity and insulation integrity and, where applicable, forpolarity and phase coincidence before the permit is signed off. The Contractor shallalso bring it to the attention of all his staff that the equipment will be made live andthat they must stay clear of it from then on.

40. EARTHING40.1. The common neutral / earth support conductor of each low voltage aerialbundle conductor feeder shall be earthed at every pole by means of a35mm² stranded copper conductor linking the common neutral / earth

support conductor to the steel by using a 6mm thick x 38mm long fullythreaded “self drilling” screws.(Annexure 6) . Suitable crimped lugs shall beused to tie the one side of the earth conductor with the “self drilling” screw tothe steel pole. The other side of the earth conductor shall be clamped to theneutral of the Aerial bundle by the correct size and type of piercingconnector.It is of vital importance to connect and reconnect all separate earthconductors found at a specific pole to the common neutral / earth supportconductor of the Aerial Bundle Conductor.40.2. It shall be a requirement that the neutral conductor of a bare overheadline system be connected to a steel distribution pole directly. Where it isfound that the neutral conductor is tied to an insulator, it shall be earthed atevery pole by means of a 35mm² stranded copper conductor linking theneutral / earth support conductor to the steel pole by using a 6mm thick x38mm long fully threaded “self-drilling” screw.(Annexure 6) . Suitablecrimped lugs shall be used to tie the one side of the earth conductor with the“self-drilling” screw to the steel pole. The other side of the earth conductorshall be clamped to the neutral of the Bare line by the correct size and typeof clamp.It is of vital importance to connect and reconnect all separate earthconductors found at a specific pole to the common neutral / earth conductor.40.3. All stays should be bonded with the common/neutral conductor of the ABCand with the neutral / earth system of the bare conductor system.40.4. Test for the earth resistance should be carried out in accordance with themethod described in SANS 0199.40.5. Earthing of the system should be carried out in accordance with SANS 0142and SANS 0198.40.6. Allowance shall be made for the supply and installation of the variousearthing requirements as listed hereunder:40.6.1. Regulation 13 of the Electrical Machinery Regulation of the OHSAct, 1993. This regulation details the items of equipment at anypremises that shall be earthed and also the responsibilities of thesupply authority and the occupier/owner of the premises to correctsuch items that are found, during tests, not to be earthed.40.6.2. SANS 0142. A section of SANS 0142 details the materials andmethods that can be used for earthing during the wiring of premises,whether it be one room or a block of flats or offices. It also detailsthe responsibilities and certification requirements of wiringcontractors.40.6.3. SANS 0198-3 covers general provisions for the earthing of electricpower cables and apparatus in which the cables are terminated.40.6.4. SANS 0198-5 details the method of determining the thermal andelectrical resistivity of soil, in order to select the most suitable type(s)of earthing electrodes.40.6.5. SANS 0198-12 covers the installation of earthing systems.Reference is made to methods of providing an earth electrode. Theearthing of metal cable components is covered in detail.40.6.6. SANS 0199 details methods used to design and install a suitableearth electrode and to reduce the earth resistance if found to be high.

41. SERVICE CONNECTIONS All existing overhead service connections shall be carefully disconnected beforea pole is removed and shall be equally carefully replaced and connected to theequipment in the pole mounted low voltage box / pole kit. ensure that all service connection conductors are correctly connected, i.e.neutral on the ABC / Bare line neutral; earth and armouring on the ABC neutraland live onto the load side of the circuit breaker. Correctly sized insulatingpiercing connectors (Annexure 4) shall be used for all connections to the ABC.Where a cable is too long it shall be made off at the correct length and where itis too short a proper joint with crimped ferrules shall be made by contractor andto supply all material needed. All existing underground service connections in any ground or overheadenclosure (mini-sub, kiosks,substations....) shall be carefully disconnected whenrequested to do so. When service connections in an electrical enclosure need tobe reconnected care should be taken that all service connections conductors arecorrectly connected. Where a cable is too long it shall be made off at the correctlength and where it is too short a proper joint with crimped ferrules shall bemade by contractor and to supply all material needed. All existing distribution cables in any ground or overhead enclosure (mini-sub,kiosks, substations....) shall be carefully disconnected when requested to do soand forms part of the overhead distribution network. When the distribution cableconnection in an electrical enclosure need to be reconnected care should betaken that the distribution cable connection conductors are correctly connected.Where a cable is too long it shall be made off at the correct length and where itis too short a proper joint with crimped ferrules shall be made by contractor andto supply all material needed. Care shall be taken to ensure that a new 5 Ka Curve 1 circuit breaker of thesame current rating as the one removed from that specific service connectionshall be installed. This is of cardinal importance as the tariff paid by thecustomer is based on the circuit breaker rating. The contractor will also be requested to supply and replace all “jumper”conductors between all protective devices (Circuit breakers & fuses) and themain LV supply line (bare or aerial bundle conductor) with new UV resistantconductors with the exact mm² size as the removed “jumper” conductor.Common jumper size conductors are 10mm², 16mm², 25mm² & 35mm². It shallbe noted that a suitable insulating piercing connector must be used with aerialbundle conductor and a suitable line clamp with bare overhead lines. Each“jumper” conductor shall be separately clamped on either the aerial bundleconductor or bare overhead line. All service connection cables not running through a galvanised pipe shall beneatly strapped to the “back side” of pole (Annexure 1) using stainless steelstraps at intervals of not more than one metre. Where service connection cables are required to run through a 25mm, 32mm,40mm or 50mm galvanised pipe - The galvanised pipe will be neatly strapped tothe “back side” of the distribution pole using stainless steel straps at intervals ofnot more than one metre. The galvanised pipe will be buried into the ground at adepth not less than 200mm. The galvanised pipe will be same length as theservice connection cable from the bottom to the connection point on the top ofthe pole plus the 200mm planting depth. The galvanised pipe to be supplied bythe contractor. The contractor shall ensure that all three (3) phase service connections will bedisconnected and re-connected in such fashion that the phase rotation to theconsumer is exactly as it was before. The contractor shall also ensure that the load balancing is far as practicallycorrect over one supply circuit to an overhead line or aerial bundle conductor. one. Overhead connections that need replacement should be replaced as far aspossible underground. It shall be noted that the contractor must supply all sundry material such as ahouse service wall bracket, house service dead end clamps, pigtails, pigtailscrew, suspension clamps, joints, lugs, ferrules, insulation tape and all othermaterial or spares to effectively comply with the SANS, Eskom & all otherrequired specifications when a cable is replaced either overhead orunderground. Low voltage steel compression glands will be supply and fitted by thecontractor for all cables without steel wired armouring in accordance with thecable and gland manufacturer’s instructions. The correct size and type of glandwill be used for the particular cable and application where applicable. (Seeannexure “9”) Low voltage steel mechanical glands or K-clamps (depends on applicationor electrical enclosure) will be supply and fitted by the contractor for all cableswith steel wired armouring in accordance with the cable and glandmanufacturer’s instructions. The correct size and type of gland will be used forthe particular cable and application where applicable. (See annexure “9”)

42. JOINTING AND TERMINATING OF CABLES Approved SANS Moulded resin jointing kits shall be used for the house serviceconnection and bulk supply cables. All joints to be made in accordance with theinstructions issued by the manufacturer of the specific joint kit used. Crimpedferrules approved by the Ekurhuleni Metropolitan Municipality shall be used forsplicing the wires in all joints. Earth conductors / armouring are to be joined by means of approved crimpingferrules and must be carried through in the joint box. Bimetal ferrules shall be used where it is necessary to join a copper andaluminium cable with each other. It could be a requirement that the jointer/s that will be used to make the joints doat least one (1) demonstration joint so that the Ekurhuleni MetropolitanMunicipality can assess their capability. All jointing kits shall be approved by the Regional Director / Chief Area Engineeror his / her representative. Overhead line supply cable terminations should be done in a “gooseneck” configuration. Cable terminations inside an electrical enclosure shall be done with eithera k-clamp or mechanical steel gland configuration depending on the layoutof the enclosure. A copper-aluminium lug should used whenever an aluminium cable needs to beconnected to a copper pad (circuit breakers / fuses...) or to transformer studs. Copper-aluminium lugs / pin connectors shall be used whenever an aluminiumcable needs to be connected onto a circuit breaker or fuse holder.

43. AERIAL BUNDLE CONDUCTOR CONNECTIONS (REPLACEMENT ANDREPAIRS) All aluminium aerial bundled conductors shall be connected to the feeder cablesby means of suitable insulation piercing clamps or thick walled ferrules crimpedby means of the deep indent process in a container die. Contractor to supply all necessary equipment and material such as mountingbrackets, clamps (Suspension, strain, dead end etc.), piercing connectors toinstall / replace one span of aerial bundle conductors. clamps (Annexure 4) or pre insulated bimetal, water sealing ferrules(Annexure 7) shall be used. If clamps are used heat shrink type end caps(Annexure 4) shall be fitted to the aerial bundled conductor cable ends to keepmoisture from entering the conductor. If ferrules are used they should becovered with self-vulcanising tape and heat shrink tubing for the same purpose. All aerial bundle conductor connections between 25mm² - 95mm² shall be donewith Double shear head bolt Insulation Piercing Connectors. Pre insulated colour coded, water tight compression joints (Annexure 7) shall beused for joining two L.V. Aerial Bundle Conductor lines in midspan.

44. LOW VOLTAGE BARE LINES (REPLACEMENT AND REPAIRS) All bare lines shall be connected to the feeder cables by means of suitable PGclamps or thick walled ferrules crimped by means of the deep indent processin a container die. Where aluminium conductors have to be connected to copper conductor’ssuitable bi-metal PG clamps (Annexure 7) or bi-metal ferrules (Annexure 7)shall be used. Contractor to supply all necessary equipment and material such as mountingbrackets, porcelain insulators, clamps etc., to install / replace one span of bareline conductors. Cross-arms should be replaced where it is no longer in a good condition,contractor to supply and install a suitable galvanised cross-arm. All bare line connections shall be done with Double bolted PG Clamps. Un-insulated compression joints (Annexure 7) shall be used for joining two L.V.bare lines.

45. MARKING AND LABELLING OF LOW VOLTAGE DISTRIBUTION AND SERVICECONNECTION CABLES AND ELECTRICAL EQUIPMENT The electrical equipment supplied and installed in terms of this contract will formpart of the electrical reticulation of Ekurhuleni. The Contractor shall thereforepermanently mark each circuit with an approved engraved label or an otherwiseapproved means as required by the OHS Act and to the satisfaction of theEkurhuleni Metropolitan Municipality with the designation provided by theRegional Director / Chief Area Engineer or his / her representative Existing cable connections must be identified with the premises it is connectedto and then the pole box, circuit breaker and cable must be clearly labelled byapproved methods, a tie-on cable marker is preferred.

46. REPLACEMENT OF STEEL, CONCRETE AND WOODEN DISTRIBUTIONPOLES, WOODEN SERVICE CONNECTION SUPPORT POLES ANDELECTRICAL CONNECTION EQUIPMENT TRANSFERS.Where it is necessary to replace distribution poles, the following shall apply:46.1. Replacement of distribution poles & electrical connection transfers:46.1.1 The contractor has two choices of replacing distribution poles: Removing the existing pole after it has been properly supported bysuitable means, disconnect all electrical conductors, plant a newpole in its position and do the electrical connection transfers. (fromthe old to the new pole.) To excavate a new hole as close as possible to the one that must bereplaced, plant a new pole in the new excavated hole, do theelectrical connection equipment transfers and then remove theexisting pole. the same side of the existing poles either all on the left or right handside to ensure that distances between poles remain more or lessintact.46.1.2. The Contractor can be requested to excavate around the pole todetermine the condition of the pole.46.1.3. General Requirements: Contractor to provide all necessary equipment, material & spares tosuccessfully do all electrical connection transfers in a neat andorderly fashion between old and new distribution poles.46.1.4. Excavation holes should be 1/5 of the pole length deep and wideenough for the base plate where applicable. All other requirementswhere applicable as per section 37 shall supply.46.1.5. Backfilling and compacting of pole and stay holes should follow thesame procedure as for cable trenches. (See section 37).46.2. The Supply of new distribution poles as and when required by thecontractor for replacement:46.2.1. Steel Poles Steel poles shall comply with the latest SANS (0225)requirements. The poles shall be suitable for use at a mean altitude of 1800 mabove sea level in an environment subject to heavy pollution atambient temperatures of -15C to 65C. Poles must be fitted with a crimp sleeve or a galvanised sleeve.The sleeve must be approximately 7 mm thick and 600 mmlong and must be fitted or crimped ±1070 mm from the base ofthe pole. Special attention must be paid to joints. All changes indiameter shall be by means of swaging or continuous tapering.Under no circumstances will welded pieces (pipe reducers)inserted into the poles be accepted. All joints shall be bevelledprior to welding and shall present a symmetrical appearanceafter welding. In addition, all joints shall be designed andmanufactured to ensure that there is no ingress of water intothe interior of the pole. All welding shall be continuous and incompliance with SABS 044, Parts 1 to 4. All welding shall bedressed where necessary. All poles shall be hot-dip galvanised in accordance with SABSISO 1461. The minimum thickness of the zinc layer shall be 90m. The process used shall comply completely with therequirements of SABS ISO 1461. Each pole must have a 500 mm square x 6 mm thick mild steelbase plate with two (2) M20 (20 mm) diameter “BSW” hookbolts, with which to secure the plate to the base of the pole.Holes for the base plate must be drilled into each pole,minimum size 23 mm.46.2.2. Wooden Poles Only poles suitable for use in the construction of low voltagereticulation networks and power transmission lines shall beused. The poles used shall be treated with a mixture of copperchromium-arsenic (CCA) compound in accordance with SABS753/754 – 1982. 47. MAINTENANCE OF STEEL DISTRIBUTION POLES When rust appears on the outer surfaces, cleaning and painting are required.The pole should be replaced when corrosion at the ground line is severe. When required a 300mm deep inspection hole should be dug to establish whatthe condition of the pole is underneath ground level. A zinc based primer should be applied before two layers of top coating. Thecolour of the top coating will be specified by the relevant CCC. The top coatingshall be UV and weather resistant and suitable for galvanised steel poles. No spray painting is allowed. Only qualified painters are allowed and all safety precautions should be adheredto, paint selection and application method should be done in conjunction with therelevant SANS standards. Pole Numbering – Stencilling should be done with UV resistant light reflectingpaint to be visible at night time and should be compatible with the galvanizing ofthe steel pole.o Stencilling should be at a minimum of 2.5m from the ground, thestencilling for one letter or number shall have a minimum height of 75mmand a width of 50mm.

48. MAINTENANCE OF WOOD DISTRIBUTION POLES Determination of wood pole adequacy should be done to determine if polereplacement or treatment is necessary. When required a 300mm deep inspection hole should be dug to establish whatthe condition of the pole is underneath ground level. When inspections reveal heart rot, splits, lightning, insect, bird, vehicle damageor other apparent weaknesses, these conditions should be reported so that theadequacy of the pole to sustain its loads be evaluated. Pole treatment - Poles in place are exposed to weathering and decay, which isusually most severe at the ground line. In some cases, the upper part of the polewill have decayed to only a small degree, and preservative treatment to extendits useful life will be necessary.o For the best results, Creosote and water-borne or oil-borne preservativesshould be used. All of these can be used only by a certified pesticideapplicator only copper naphthenate does not require certification.Qualified applicators should meet the applicable requirements to ensurethe best treatment practices.o Personnel used for this application must be qualified for this specializedwork. The contractor will be required to supply, replace / install reinforced concrete polesto the standards of the latest SANS 470.Concrete poles supplied should be manufactured from high quality durablereinforced concrete that forms a uniformly dense strength with a smooth,impervious, finish.All concrete poles shall have an integral earthing system, stainless ferrules, flushwith the outside of the pole to provide an electrical connection to all of the pole’sreinforcement wire.All concrete poles shall confirm with the specification in SABS 470 and carry theSABS Mark of Approval. Pole Numbering – Stencilling should be done with UV resistant light reflectingpaint to be visible at night time and should be compatible with the concretesurface of the pole.o Stencilling should be at a minimum of 2.5m from the ground, thestencilling for one letter or number shall have a minimum height of 75mmand a width of 50mm.

50. REPAIRS / REPLACEMENT OF ELECTRICAL EQUIPMENT / MATERIAL OFDISTRIBUTION ENCLOSURES MOUNTED UNDERNEATH OVERHEADPLATFORM, POLE MOUNTED DISTRIBUTION TRANSFORMERS ANDGROUND LOW VOLTAGE DISTRIBUTION / METERING ENCLOSURES To replace LV cable / conductor supply between transformer and enclosure. To rewire a distribution enclosure with the appropriate size conductors / wires. To replace large frame distribution circuit breakers (Eg. 10kA to ±35kA). To replace small frame distribution circuit breakers (Eg. 6kA and lower) Neutral connection copper bus bar (1 x (120mm x 30mm x 6mm thick) to befitted / replaced inside enclosure by means of insulators. Earth connection 1 x (120mm x 30mm x 6mm thick) copper bus bar to be fittedinside by means of brass bolts. The Neutral and Earth bus bars must be bridged out with each other with apiece of 95mm² Copper wire. Enclosures should be properly earthed as per section 42. If a trench earth is notavailable then the contractor should install a separate earth by means of asuitable earth spike and copper earth wire minimum 95mm². Copper conductorsshall be installed inside a 20mm galvanized pipe for overhead enclosures. Thegalvanized pipe shall be neatly secured against the pole by approved methodssuch as the use of a 20mm galvanized bandit strap. An earth resistance testmust be conducted and the reading must be recorded on the inspection /handover certificates. An acceptable reading is less than 20ohm.

51. REPAIRS / REPLACEMENT OF ELECTRICAL EQUIPMENT / MATERIAL OFPOLE MOUNTED METERING ENCLOSURES To rewire a pole mounted enclosure with the appropriate size conductors /wires. The pole mounted meter enclosures used are 4 and 6 ways. To replace service connection small frame circuit breakers (6kA). Neutral connection copper bus bar to be fitted / replaced inside enclosure bymeans of insulators, copper busbar should be minimum 200mm (Length) x20mm (Wide) x 5mm (Thick). Earth connection copper bus bar to be fitted inside by means of brass bolts,copper busbar should be minimum 200mm (Length) x 20mm (Wide) x 5mm(Thick). The Neutral and Earth bus bars must be bridged out with each other with apiece of Copper wire of an appropriate size.

Enclosures should be properly earthed as per section 42. 52. REPLACEMENT, SUPPLYING AND INSTALLATION OF LOW VOLTAGE ONLOADKNIFE BLADE TYPE ISOLATING SWITCHES It will be a requirement to newly fit or replace and connect outdoor low voltagepole mounted on load knife type isolating switches similar to Annexure “3”. It will be the required from the contractor to supply and fit the necessary crossarm or mounting bracket for the switches where required that new switchesmust be installed or where it must be replaced and the existing mountingbracket / arm is not suitable or unusable. It shall be noted that bi-metal lugs shall be used for aluminium conductors thatneed to be connected to the switches. Knife switches will be supplied and installed in sets of three (3). Switches supplied shall comply as follow:o AC low voltage knife switch must apply in an outdoor distributing line of400V, 50 Hz.o Double switch blades for a bigger area of contact.o Copper busbar connectors with stainless steel bolts, nuts and washersfor conductor connections via suitable lugs.o Reliable contact of the fixed contact and the switch blade.o The switch blade of pick-off frame should be taken off by a link stick.o Silicon rubber post insulators.o Installed on the existing or new suitable mounting bracket / cross arm.o Should be fixed on an angle of 15°to the vertical plane of the angle steelin any position.

53. OVERHEAD LINE EARTH STRUCTURE Earth structures on bare over headlines need to be inspected to ensure that itcomplies with the relevant legal standards. The contractor to report immediatelywhere such an earth structure is not complying and need major repairs orreplacement.

54. AERIAL BUNDLE CONDUCTOR TENSIONINGIt is important that the right stringing tension is obtained. Use Annexure “12” as aguideline to achieve the required results.

Where poles are to be planted in a straight line the contractor shallensure that this is meticulously done. All poles shall be planted perfectlyvertical and to the correct depth. The planting depth shall be ±1/5 of thelength of the pole, for example the planting depth for a 9 m pole shall be±1, 8 m or as specified by the manufacturer of the poles. After plantingone half of the corrosion sleeve on the steel pole shall be above and onehalf below the natural ground level.56.4. Low voltage cables will as far as possible be supplied by the EMM. All material supplied shall be new of the highest quality and comply with all therelevant SANS standards. All material and equipment required to remove the existing worn out low voltageoverhead lines and to replace them with new lines as specified in this documentshall be supplied by the Contractor to the standards as specified.The following items are highlighted (Annexure 1, 2, 3, 4, 5, 6, 7, 8, 9):58.1. Stays and Anchors for an aerial bundled conductor low voltage overheadline supported on galvanised tubular steel poles or wooden poles.All pole clamps, stay wires and anchors shall be galvanised and shall besuitable for the type of pole, size of aerial bundled conductor and span lengthof the particular situation. Stays and anchors shall be installed at an angle of45 degrees to the horizontal. Care shall be taken to disturb as little of theground around a hole for an anchor and the soil over an anchor shall be verythoroughly compacted with water added if necessary. Strut poles shall onlybe used where approved by the Chief Area Engineer or his / herrepresentative and only an approved method of joining the poles at the topshall then be used.Fixed and adjustable stays are used within EMM. “bid” means a written offer in a prescribed or stipulated form in response to an invitation by an organ of state for the provision of services, works or goods, through price quotations, advertised competitive bidding processes or proposals;

2.5 “Broad-Based Black Economic Empowerment Act” means the Broad-Based Black Economic Empowerment Act, 2003 (Act No. 53 of 2003);

2.6 “comparative price” means the price after the factors of a non-firm price and all unconditional discounts that can be utilized have been taken into consideration;

2.7 “consortium or joint venture” means an association of persons for the purpose of combining their expertise, property, capital, efforts, skill and knowledge in an activity for the execution of a contract;

2.8 “contract” means the agreement that results from the acceptance of a bid by an organ of state;

2.9 “EME” means any enterprise with an annual total revenue of R10 million or less.

2.10 “Firm price” means the price that is only subject to adjustments in accordance with the actual increase or decrease resulting from the change, imposition, or abolition of customs or excise duty and any other duty or levy, or tax, which, in terms of the law or regulation, is binding on the contractor and demonstrably has an influence on the price of any supplies, or the rendering costs of any service, for the execution of the contract;

2.11 “functionality” means the measurement according to predetermined norms, as set out in the bid documents, of a service or commodity that is designed to be practical and useful, working o operating, taking into account, among other factors, the quality, reliability, viability and durability of a service and the technical capacity and ability of a bidder;

2.12 “non-firm prices” means all prices other than “firm” prices;

2.13 “person” includes a juristic person;

2.14 “rand value” means the total estimated value of a contract in South African currency, calculated at the time of bid invitations, and includes all applicable taxes and excise duties;

2.15 “sub-contract” means the primary contractor’s assigning, leasing, making out work to, or employing, another person to support such primary contractor in the execution of part of a project in terms of the contract;

2.16 “total revenue” bears the same meaning assigned to this expression in the Codes of GoodPractice on Black Economic Empowerment, issued in terms of section 9(1) of the Broad-Based Black Economic Empowerment Act and promulgated in the Government Gazette on 9 February 2007;

2.17 “trust” means the arrangement through which the property of one person is made over orbequeathed to a trustee to administer such property for the benefit of another person; and

2.18 “trustee” means any person, including the founder of a trust, to whom property is bequeathed in order for such property to be administered for the benefit of another person.

3. ADJUDICATION USING A POINT SYSTEM3.1 The bidder obtaining the highest number of total points will be awarded the contract.

3.2 Preference points shall be calculated after prices have been brought to a comparative basis taking into account all factors of non-firm prices and all unconditional discounts.

3.3 Points scored must be rounded off to the nearest 2 decimal places.

3.4 In the event that two or more bids have scored equal total points, the successful bidmust be the one scoring the highest number of preference points for B-BBEE.

3.5 However, when functionality is part of the evaluation process and two or more bids havescored equal points including equal preference points for B-BBEE, the successful bid mustbe the one scoring the highest score for functionality.

3.6 Should two or more bids be equal in all respects, the award shall be decided by thedrawing of lots.

5.3 Bidders other than EMEs must submit their original and valid B-BBEE status level verification certificate or a certified copy thereof, substantiating their B-BBEE rating issued by a Registered Auditor approved by IRBA or a Verification Agency accredited by SANAS.

5.4 A trust, consortium or joint venture, will qualify for points for their B-BBEE status level as a legal entity, provided that the entity submit their B-BBEE status level certificate.

5.5 A trust, consortium or joint venture will qualify for points for their B-BBEE status level as an unincorporated entity, provided that the entity submit their consolidated B-BBEE scorecard as if they were a group structure and that such a consolidated B-BBEE scorecard is prepared for every separate bid.

5.6 Tertiary institutions and public entities will be required to submit their B-BBEE status level certificates in terms of the specialized scorecard contained in the B-BBEE Codes of Good Practice.

5.7 A person will not be awarded points for B-BBEE status level if it is indicated in the bid documents that such a bidder intends sub-contracting more than 25% of the value of the contract to any other enterprise that does not qualify for at least the points that such a bidder qualifies for, unless the intended subcontractor is an EME that has the capability and ability to execute the sub-contract.

5.8 A person awarded a contract may not sub-contract more than 25% of the value of the contract to any other enterprise that does not have an equal or higher B-BBEE status level than the person concerned, unless the contract is sub-contracted to an EME that has the capability and ability to execute the sub-contract.

1 This Form “I“ must form part of all bids¹ invited.2 Section 4 (1) (b) (iii) of the Competition Act No. 89 of 1998, as amended, prohibits an

QUOTATION PROCUREMENT FORM

If no such Certificate or copy thereof has been submitted, the bid must be rejected. If a valid original tax clearance certificate has not been submitted, the bidder must be requested in writing and in the standard format approved by the Executive Director: Legal & Administration, to submit a valid original tax clearance certificate by a specific date and at a specific venue.

If the bid does not meet the requirements contained in the EMM Supply Chain Management Policy,

and the mentioned framework, it shall be rejected by the Municipality, and may not subsequently

be made acceptable by correction or withdrawal of the non-conforming deviation or reservation.

8. Total Bid Adjudication Points

The total number of bid adjudication points awarded, is the sum of:

Bid price points + meeting specific goals points (not to exceed 100)

9. PenaltiesThe City Manager must act in terms of paragraph 15 of the Preferential Procurement Policy Regulations 2001, as published on 10 August 2001, against the person awarded the contract upon detecting that a preference in terms of the Preferential Procurement Policy has been obtained on a fraudulent basis, or any specified goals are not attained in the performance of the contract.

Regulation 15 of the Preferential Procurement Policy provides as follows:

“15 (1) An organ of state must, upon detecting that a preference in terms of the Act and these regulations has been obtained on a fraudulent basis, or any specified goals are not attained

in the performance of the contract, act against the person awarded the contract.

(3) An organ of state may, in addition to any other remedy it may have against the person contemplated in sub-regulations (1) –

(a) recover all costs, losses or damages it has incurred or suffered as a result of that person’s conduct;(b) cancel the contract and claim any damages which it has suffered as a result of having to make less

favourable arrangements due to such cancellation;(c) impose a financial penalty more severe than the theoretical financial preference associated with the claim

which was made in the tender; and(d) restrict the contractor, its shareholders and directors from obtaining business from any organ of state for a

period not exceeding 10 years.
