This is a practical guide for public authorities and economic operators. Section 1 — Guidance info for networking: list of contacts supports public and private control authorities with networking. It includes a list of Member State national central authorities for GIs, competent authorities and control bodies with relevant contact details. Where possible, according to the national organisation and based on data provided by each Member State, these contact details are presented per type of control (i.e. before placing the product on the market/surveillance of the use of the name in the market place), and per product category (agricultural products and foodstuffs — indicated as ‘foodstuffs’, wines and aromatised wines, spirit drinks). Information on accessibility to contacts, that is to say, where contacts can be found, is also provided.

Section 2 — Summary of enforcement and protection measures is an overview of the administrative sanctions applicable against infringers, criminal prosecution and legal redress for private operators including civil law remedies, whose main principles and sources are indicated in the Report under each Member State chapter. This section also encompasses information on the ‘tools’ to address competent authorities when submitting claims or communicating in the event of detected or suspected infringement of GIs. In detail, tools are either contact points or online instruments available to report on misuse (e.g. whistleblowing hotline, complaints form).

Information on ‘civil redress’ pertains to civil actions that rights holders can pursue in the event of infringements of GIs and include the precautionary measures, sanctions and compensation envisaged by national legislation. As part of this chapter, the provisions to protect consumers against the misuse of indications of origin on food are also presented where relevant.

2.1 ADMINISTRATIVE SANCTIONS SYSTEM Administrative sanctions planned at federal and regional level are described below. However, at regional level information was available only for Wallonia. Federal level In accordance with the regional decisions, the refusal of control or obstruction thereof equals the finding that the product does not conform to the product specification. If the inspection shows that products are not compliant with the requirements laid down in Regulation (EU) No 1151/2012, the producer/trader should immediately remove the European logo and/or the name from the packages and advertising. A warning report is prepared in accordance with the code of economic law. In accordance with the code of economic law officials of the ADEI are competent to determine the infringement. While exercising their duties they may seek assistance from the federal police. WALLONIA With reference to control before placing the product on the market, sanctions are defined beforehand in a range of measures presented to each producer before he signs the certification agreement with the CB. At the time of the application for approval, the CB provides DQ with a list of the measures taken against any operator who does not respect the obligations arising from the product specification, according to a scale of proportionate and non-discriminatory sanctions 1. Moreover, the CB must present to the business operator an evaluation grid for evaluating non-conformities, and a grid of penalties thereto 2. The application of sanctions falls in the general competence of the CB for controls before placing the product on the market, as the certifying body. As sanctions, the CB may decide not to grant the certification until the operator has transmitted a corrective action plan and/or has implemented the corrective actions within a given period (the deadlines depending on the severity of the non-conformity). Moreover, the CB can withdraw the certification, although this sanction is quite rare.

2.2 CRIMINAL PROSECUTION In accordance with the data collected, infringement of a GI does not constitute a specific criminal type of offence. However, the Belgian Criminal Code 3 punishes those who deceive the buyer in relation to the nature or origin of the products sold by selling or delivering a product similar in appearance to that which he has bought or which thought to have purchased. This conduct may lead to an imprisonment from one month up to one year or a fine from ranging between EUR 50 and EUR 1 000. 2.3 REMEDIES FOR USERS The website and hotline of FOD Economie enable consumers, producers and any other parties concerned of GI to submit a complaint. 2.3.1 Tools Complaints Any complaint for infringements or other illicit use of GIs can be addressed to FOD Economie through:

a dedicated form for complaints available on the FOD Economie website 4;

the FOD Economie hot line, that enable consumers, producers and any other parties concerned by GIs to make a complaint.

2.3.2 Civil redress In Belgium, registered GIs are protected against:

(A) the direct or indirect commercial use of a registered name for products not covered by the registration, to the extent that those products are comparable to those registered under that name or to the extent that they use the reputation of the protected name;

(B) usurpation, imitation or evocation, even if the true origin of the product is indicated or if the protected name is translated or accompanied by an expression such as “style”, “type”, “method”, “imitation” or similar expression;

(C) any false or misleading statement about the origin, nature or substantial qualities of the product on the packaging, advertising or documents relating to the product concerned, use for packaging a container that can create a mistaken impression about the origin;

(D) any other practices capable of deceiving the consumer in relation to the true origin of the product 5.

In the event of infringement, the owner may ask the judge to order the termination of the illicit conduct and the judge may also issue a termination order against intermediaries whose services are used by a third party to infringe a GI 6. Without prejudice to possible compensation of damages, the injured party may also require the judge to order the recall of products, the removal from the market or the destruction of counterfeit goods and, where appropriate, of the materials and instruments used for the production of the said goods. In this case, the judge takes into account the proportionality between the severity of the infringement and the measures ordered, as well as the interests of third parties. Moreover, the injured party may also ask the judge to order the infringer to provide all the information concerning the origin and distribution networks of infringing goods or services and all relevant data, provided that this is a justified and proportionate measure. The judge may order that his or her decision (or its summary) is to be affixed for a given period, both outside and inside the offender’s premises and instruct the publication of his or her judgment or summary in newspapers or otherwise, at the expense of the offender 7. The injured party has the right to obtain compensation 8 for any prejudice suffered as a result of a GI infringement; if the extent of the damage cannot be determined in any other way, the judge may fix a lump sum as damages. Moreover, in the case of bad faith, the judge may, as damages, order the assignment of all or part of the profit realised as a result of the infringement.

2.1 ADMINISTRATIVE SANCTIONS SYSTEM Foodstuffs The law on the implementation of the Common Market Organisation provides for administrative sanctions in cases of misuse of registered GIs. Article 25, paragraphs 1 and 2 of the above law prohibits the use of names, symbols and/or indications of agricultural products and foodstuffs with a GI, when:

the names, symbols and/or indications are used on products which are not listed within European registries of agricultural products and foodstuffs with GIs;

the names of the products are registered as GIs, but the products or foodstuffs in question do not comply with the specification;

the names of the products are registered as GIs, but the products are not controlled as established by the law.

When BFSA inspectors investigate irregularities identified at retail level, they trace the product back to identify the food business operator (FBO) responsible for placing the product on the market and capable of correcting the non-compliances. In accordance with Article 25(a), paragraph 3 of the law on the implementation of the Common Market Organisation, when performing an official control, the BFSA may impose administrative measures, in line with the provisions of the food law in Bulgaria. In accordance with food law, the marketing of foodstuffs, which are non-compliant with Regulation (EU) No 1151/2012, may be restricted or prohibited. Fines may be imposed and are set out in Article 65 of the law on the implementation of the Common Market Organisation:

any person who violates the provisions of Article 25, paragraphs 1-5 (see above) shall be sanctioned with a fee ranging from BGN 1 000 to BGN 5 000 9;

where the infringement has been committed by a legal person or a sole trader, a pecuniary sanction ranging from BGN 5 000 to BGN 10 000 shall be imposed, and in cases of repeated infringement a property sanction shall be imposed ranging from BGN 10 000 to BGN 20 000 10.

As every inspection report by the CB must be submitted to the Ministry within one week of the inspection, a record of any non-compliance detected is maintained by the Ministry enabling any trends to be noted in a timely manner.

Wines and aromatised wines Pursuant to Article 203 of the Wine and Spirit Drinks Act, any person who or which, upon the labelling and presentation of wine and/or wine sector products, uses an assumed name and/or an assumed/fictitious domicile and/or registered office address of a producer, bottler, wine cellar or other business unit, is liable to:

a fine between BGN 3 000 and BGN 10 000, applicable to natural persons;

a pecuniary penalty between BGN 10 000 and BGN 30 000, applicable to legal persons and sole traders.

Spirits The Wine and Spirit Drinks Act provides also for administrative sanctions related to infringements in the production of, and trade in, ethyl alcohol of agricultural origin, distillates and spirits, including products bearing a GI, by imposing a range of fines depending on the type and measure of infringement 11. 2.2 CRIMINAL PROSECUTION There are criminal prosecution provisions in the Bulgarian Criminal Code which are applicable to infringements of all kind of GIs (foodstuffs, wines and spirits). In particular, Article 172(b) provides that:

anyone who, without consent from the owner of the exclusive right thereupon, makes use in commercial operations of a trade mark, industrial model, a variety of plant or race of animal, making an object of the exclusive right, or makes use of a GI or a counterfeit thereof without a legal justification, shall be punished by imprisonment of up to five years and a fine of up to BGN 5 000;

where the act under paragraph 1 is repeated or significant damage has been caused, the punishment shall be imprisonment between five and eight years and a fine between BGN 5 000 and BGN 8 000;

the object of the crime shall be taken to the benefit of the state, irrespective of the fact whose property it is, and it shall then be destroyed.

2.3.1 Civil redress Any unauthorised use of a GI or a designation of origin or the use of any other sign, or practice, prohibited pursuant to the law on trade marks and geographical indications, shall be considered an infringement of a GI. Any recorded user of a registered GI shall be entitled to bring actions for:

the establishment of the fact of infringement;

the suspension of the act of infringement;

the compensation for damages suffered;

the seizure and destruction of the infringing products, as well as of the means with which the infringement was carried out.

Where the right in a registered GI is infringed or there is good reason to believe that such an infringement will be made or some evidence will be lost, destroyed or suppressed, the holder of the right may request that the court allows some of the following provisional remedies as well, without notifying the other party thereof:

prohibition of the performance of activities that constitute or will constitute, as contended, the illegal use of a mark or GI;

seizure of the goods that are contended to illegally bear a registered GI, as well as of any other evidence of importance for proving the infringement;

seizure of the labelling or packaging, business papers or other materials for the advertising of goods or services;

sealing of the premises where the infringement is or will be made, as contended. Compensation is due for all material and non-material damages suffered and profits lost, which are a direct and immediate consequence of the infringement. When determining the compensation amount, the court shall take into account also all circumstances of the infringement, as well as all profits the infringement has brought to the infringer. The court shall rule a just compensation that is to have a deterrent and warning effect on the infringer and the rest of the community 12. The GI holder may also ask for the destruction of the infringing goods and the publication of the court decision in two daily publications at the expense of the infringer. Legal persons and one-man businesses shall bear civil responsibility for any infringement of rights under this law culpably committed by persons representing them, or their employees, or persons hired by them. In such case, guilt shall be assumed until the contrary is proven. All actions under this law shall fall within the jurisdiction of the Sofia City Court.

2.1 ADMINISTRATIVE SANCTIONS SYSTEM During the controls on the market, SPZI may impose all kinds of measures, including 14:

ask to remedy the identified non-compliance;

ban the production or the placement on the market of agricultural products or foodstuffs, if not complying the product specifications;

ask to destroy the dangerous products or foodstuffs;

seize the products that are sold or stored bearing misleading labels or offered in a misleading way;

ask to carry out sample analysis in the designated laboratories on costs of the business operator, if the products do not comply with the product specifications or if the information about these products is presented in a misleading way.

If the issued measures are not fulfilled, a fine amounting up to CZK 1 000 000 (approx. EUR 38 000) may be imposed. If a business operator breaches an obligation set by a directly applicable EU regulation governing the requirements for agricultural products 15, a fine up to CZK 3 000 000 (approx. EUR 114 000) may be imposed. A seizure of agricultural products or foodstuffs may be imposed together with the fine or independently. The inspection authority may not impose a fine in case a remedy has been found in accordance with the imposed measure immediately after the breach of the obligation, and provided that no damage for the health or no misleading of consumers has been caused. These administrative torts in the first instance are dealt by the SPZI and the income from the fines forms part of the state budget revenue. SVA may apply the following measures:

not extending a temporary approval, respectively suspend or withdraw an approval 16;

extraordinary veterinary measures 17 (e.g. limiting or banning the sale of products on the market, suspending the handling of products until the end of the necessary examinations, order the separate storage of unsafe or suspicious products);

impose instructions to eliminate determined non-compliances situations 18;

take special measures 19 such as, inter alia, ordering the destruction and disposal of products;

suspend, restrict or prohibit the production, processing or marketing of products, if not compliant with the conditions and national and EU requirements;

suspend the production, processing or marketing of products for an appropriate period upon suspicion that they may be harmful to health;

impose penalties or fines according Sections 71 — ranging between CZK 5 000 (approx. EUR 190) and CZK 50 000 (approx. EUR 1 906) — and 72 — ranging between CZK 50 000 (approx. EUR 1 906) and CZK 2 000 000 (approx. EUR 76 000) — of Act No 166/1999 Collection Veterinary Act and Section 17 of Act No 110/1997, Collection Foodstuffs and Tobacco Products.

If the infringement of rights does not reach the intensity of a crime, it is possible to start an offence proceeding 20. For the offence against industrial property rights, the municipalities may impose a fine amounting to CZK 15 000 (approx. EUR 570), the seizure of the goods and, under certain circumstances, the inhibition of the activity. Finally, Act No 355/2014 sets the administrative penalties for offences related to the infringement of industrial property rights, including but not limited to, the sale of goods unlawfully bearing a geographic indication or appellation of origin. For such administrative offence, the competent customs office may impose a fine up to CZK 10 000 000. 2.2 CRIMINAL PROSECUTION In accordance with Section 268 of the Criminal Code 21, anyone who for the purpose of achieving economical profit, spreads products illegally marked by a registered designation of origin or GI or by an indication confusable with it, or who for this purpose offers, mediates, manufactures, imports, exports or otherwise handles the products for him-/herself or for a third party, shall be sentenced to imprisonment for up to two years or to confiscation. Only individuals may be found liable for this criminal offence. In case the criminal offence is committed by a legal entity, then the liability could be attributed to a responsible person of such legal entity (e.g. statutory representative etc.) depending on circumstances of the particular case. It is also provided that if the person, by committing the above offence, gains for him-/herself or for a third party, a considerable profit or commits such an act in considerable extent, imprisonment ranging

between six months and five years, a pecuniary penalty or confiscation may be imposed. In case of an extensive profit or large extent, imprisonment ranging from three and eight years may be assigned. In addition to the criminal offence against industrial property rights, the Criminal Code also provides dispositions against unfair competition. In particular, pursuant to Section 248, anyone who breaches the rules against unfair competition and causes larger extent detriment to other competitors or consumers or gains for him-/herself or for a third party in larger extent unjustified advantages, shall be sentenced to imprisonment for up to three years, to the prohibition of the activity or to confiscation. In case the person commits the above act as a member of an organised group, commits such an act repeatedly, causes substantial damage, respectively gains for him/herself or for a third party a substantial profit, the person shall be sentenced to imprisonment for six months to five years, to a pecuniary penalty or to confiscation. If extensive damage is caused, and an extensive profit is gained, or bankruptcy of another subject is caused, the person shall be sentenced to imprisonment for two to eight years. Within such criminal proceedings, it is possible to seek monetary compensation of damages and/or immaterial harm caused by the criminal offence to the same extent that would be available in a civil action. In accordance with the Act on Criminal Procedure 22, public authorities, respectively legal and natural persons, shall assist the bodies which are active in criminal proceedings in the fulfilment of their tasks and, in particular, promptly respond to their request for legal assistance. Public authorities must inform without delay the state representative or the police bodies regarding facts indicating the commission of a criminal offence. In addition, apart from a complaint from other bodies or subjects, the police bodies may start the criminal proceedings from their own initiative (‘ex officio’). Competent courts for criminal offences for the infringement of GIs are the general district and regional courts. Unlike in the civil proceedings, no specialised courts are identified to decide on criminal offences related to infringement of the said rights. 2.3 REMEDIES FOR USERS 2.3.1 Tools Queries or questions If a rights holder suspects that his or her rights have been infringed he/she can contact SPZI at the contacts reported in Section 1 via email, telephone, letter or personally. Assessment of quality and safety of samples The assessment of quality and safety of samples can be carried out as an analysis upon request for financial reimbursement that can be carried out by any accredited laboratory. In the event of cross-border disputes the consumers may refer to the European Consumer Centre Czech Republic. 2.3.2 Civil redress Act No 452/2001 on the protection of designations of origin and geographical indications (GIs) applies: ‘Everybody may claim with the relevant court that it should be prohibited to use the registered indication for comparable goods which does not fulfil conditions for utilization of designation of origin or geographical indication and that the goods identified in a manner which jeopardises or infringes the rights arising from registered designation of origin or, as appropriate, geographical indication, should be withdrawn from the market’ 24. Moreover, a GI rights holder has the right to ask and receive information on the origin of the product and may also ask the court to order the destruction of the infringing goods in a convenient way. If the infringement caused damage to a party, the damaged party is entitled to ask for compensation. If such an infringement further caused damages other than property-related detriment, the damaged party is entitled to ask for a reasonable compensation, which may consist in monetary fulfilment. The owner may also ask for the surrender of any unjustified benefit. Act No 221/2006 on the enforcement of industrial property rights implements the EU Directive 2004/48/EC, such that the rights holders of GIs originating in other Member States whose protection is extended to the Czech Republic through EU law may invoke their rights under this Act and ask the court to order appropriate measures (i.e. recall from the market, permanent removal or destruction of products, compensation of damages, right of information or suchlike).

Moreover, in accordance with this Act, the municipal court in Prague represents the competent court for the first instance in disputes related to industrial property rights. The proceedings are conducted and decided in specialised panels composed of a presiding judge and two judges. Furthermore, the provisions of the Czech Civil Code related to unfair competition 25 may also apply in the area of GIs. These provisions are also applicable for holders of GIs which are registered only in other Member States and not in the Czech Republic. Cases of unfair competitions listed in the Civil Code and applicable to GI protection include:

misleading advertising;

misleading labelling of goods and services;

causing a likelihood of confusion;

contributing towards mistaken identity;

parasitic exploitation of a competitor's reputation. Moreover, the parties whose rights have been infringed by the unfair competition, may demand the infringer to refrain from such a conduct and to provide a remedy. Furthermore, they may ask for appropriate compensation (that may be granted also in cash), indemnities and the surrender of any unjustified benefits. If any delay in judiciary proceedings causes a hardly reclaimable financial or non-financial injury, the rights holder may ask the court to impose preliminary injunction in accordance with the Code of Civil procedure. 2.1 ADMINISTRATIVE SANCTIONS SYSTEM The main legislative basis for controls and enforcement measures is the Regulating act on foodstuffs 26. This Regulation assigns the powers for CAs to enter establishments (plants), access documentation, implement enforcement measures and put in place necessary decisions and orders. For example, the DVFA can ban the marketing of a specific product. The DVFA has the following enforcement actions/sanctions in relation to non-compliances:

warnings;

enforcement notices (injunctions or prohibitions);

administrative fines (instead of reporting to the police in certain well-defined cases);

reporting to police for prosecution (serious or complicated fraud cases and frequent offenders). If the food business operator (FBO) does not pay the fine issued by the DVFA, then the DVFA will report the FBO to the police. The level for administrative fines is based on previous court cases or decided by the Danish Parliament. The sanction given must be proportionate with the non-compliance and the CA will always make a specific assessment. In case of a minor non-compliance, the DVFA will initially give guidance on the applicable regulation. In case of a first case severe non-compliance, the DVFA will give a warning. In the case of recurring sanctions, the DVFA will perform a follow-up inspection which focuses on previous irregularities. Fees for the follow-up inspection are charged. Moreover, the sanctions system is the same as for all other food legislation but for GI agricultural products the national order No 1376 of December 2013 27 (concerning quality schemes for foods and agricultural products) includes specific rules concerning administrative fines. 2.2 CRIMINAL PROSECUTION In the Danish sanctioning system only police authorities may initiate prosecutions. Prosecutions may be pursued in response to serious offences, complicated fraud cases and repeat offenders.

All courts in Denmark are competent in handling these cases. If the infringement is committed with wilful or gross negligence, the sanction is imprisonment. The courts also have the ability to issue fines. 2.3 REMEDIES FOR USERS 2.3.1 Tools The DVFA could be contacted by letter, email, telephone or contact form on its web page: http://.foedevarestyrelsed.dk 2.3.2 Civil redress Civil remedies related to GIs infringements are regulated neither by a specific Danish law nor a national registration system for GIs. However, trade mark laws apply in case GIs are registered by relevant rights holders as trade marks or collective marks. In such a case, rights holders can request the enforcement court for a search and seizure order so as to secure evidence of an infringement and of the extent hereof. To obtain a search and seizure order, the rights holder shall demonstrate the reason of trade mark infringement. Moreover he or she shall show that the execution of the search order might produce evidence on the infringement and on its extent. The search may include all relevant documentation for the assessment. Furthermore, the rights holder might file a preliminary injunction to:

prohibit the use of the conflicting sign;

claim disclosure and seizure of unlawfully marked products.
