SCHEDULE OF TARIFF COMMITMENTS

IHEADNOTE TO MALAYSIA'S SCHEDULE OF TARIFF COMMITMENTS

The tariff lines indicated with the note "TRQ" in the phasing colu nns of the Scheduleare subject to a Tariff Rate Quota ("TRQ") as specified in Appen jix 1 to thisHeadnote.

APPENDIX 1: TARIFF RATE QUOTAS

1. Tqriff Rate Quota (TRQ) Commitments for Liquid Milk

a) "Liquid milk" means goods classified to the following Maleysian HS 2007Codes: 0401.10.110, 0401.20.110 and 0401.30.110.

b) Malaysia's commitments on liquid milk are specified in thl Appendix.

c) The tariff quota volumes for liquid milk shall increase frorr entry into force ofthe Agreement, from the initial TRQ volumes in the first YI~arin Table 1, at thefollowing rates:

i) For HS 2007 0401.10.110 and 0401.30.110 at a rate of 3%annually, in perpetuity; and

ii) For HS 20070401.20.110: at a rate of 9% (annually, inperpetuity.

d) Import licences for these TRQs to be provided on a first-c Jme, first-servedbasis. Details of quota administration will be promptly pul Ilished, includinginformation on procedures for the submission of applicatic ns for licences.Quota administration will be in accordance with the WTO ~greement onImport Licensing Procedures and Article 11 of the Trade i 1Goods Chapter.

e) In each year for which tariff quotas apply to HS 2007 040' .10.110 and0401.20.110, Malaysia shall administer 35% of each of th ~seannual TRQvolumes by an open licensing system, on the basis of the following additionalconditions:

i) There shall be no restriction on who can apl,ly for a licence; and

ii) There shall be no restriction on whether pro. luct is imported inbulk or retail packs.

2. TI~~QCommitments for Other Products

a) The TRQ commitments for other products are set out n Table 2. The TRQvolumes shall increase annually, in perpetuity, at the Iates specified in theNote to Table 2.

b) Import licences for these TRQs are to be provided 011the basis of thefollowing conditions:

i) Import licences for the TRQs to be issued 0' a first-come, first-served basis;

ii) There shall be no restriction on who can ap )Iy for a licence 1;and

iii) Details of quota administration will be promlltly published,including infonnation on procedures for the ;ubmission ofapplications for licences. Quota administratIon will be inaccordance with the WTO Agreement on Irr port LicensingProcedures and Article 11 of the Trade in G )ods Chapter.
