This Agreement is entered into by ami between the Govennii¡;iit or Antigua and Barbuda (hereiiinfkr called "the
Government") and the Antigua Trades and Labour Union (licrelJwlkr called "the Union") represcntirg the nol1-
established workers ofÚie GoyelTlment covered by this Agreement made at SL John's, Anllgua, West Indies. In
entering into this Agreement, the parties recognize Úie necessi!y of campi iance with its terms and the deyelopment
of a continuing spirit of cooperation for the mutual benefit or the Governrnent, the employees and the public
service.
RECOGNITION AND SCOPE
(a) The Union represents to the Govennment that it is the duly constituted and authorrsed representative of a
majority of the employees in the c!assifíeatioii listed, and that it exists and operates in full compliiance with all
apphcablc Jaws of Antigua. Based upon t1iese representattons, the Gm'ennment recognizes the Union as the sale
and exclusive bargaining agent Ii)! the employees In the classification i ¡sted with respect to wages, hours of \vork
and conditions of employment.
(b) No employee covered by this Agreement shall be interfered with, restrained, coerced or discriiniiated against
by the Government because of membership in, or lawful activity on behalf of the Union, or for his abstinence
from such membership or activity.
(c) The Union designate and certify to the Governinenl in writing, (i\'e or more representatives, to be known as
Shop Stewards, from the employees covered by this Agreement who have completed their probationary periods.
These representatives shan form a Works Committee. These representatives sha!l be funy authorized to act for
the Union in accordance with the terms of this Agreement, and the Chairman of the 'Narks Committee may
request 11 meeting with represeníaltves of the GoverrJlient and the Works Committee not more th,m once per
month to discuss mailers arising under this Agreement. Tliis shall not he conslnicd (0 preclude the operation of
Clause I () (Gne\'iiice Procedure and Settlement for Disputes).
(d) It shall be the dual responsibility of the Union and the Government to m,ike facilities available for the
eIJieient carrying out of the duties of the Shop Stewards and the Works COIlJliiiUee.

PURPOSE
(a) The purpose orthis Agreeinenlis in the !1utualiitercsl ofillc Government and the cmployees, to provide for
the operation olthe services of the Government under melhods which will further, to the fullest extent possible,
the efficiency and economy or operation, and continuation ,md \\orkmg conditions (including the safety of
employees). It is the mutua! duty of the Government and the employees both individually and collectively to
cooperate rully for the ach,inccment or the purpose.
(b) It is agreed and understood that the Government and employees shall during the tcrii of this Agreement, be
bOtUid by the provisions contained herein. In consideration hereof, the provisions of setting disputes contained
in this Agrcement are recognized to be exclusive and binding. In the event that an employee rcpresented by the
Unnon violates the provisions of this Agreement, the Union shall within twenty-four (24) hours after receipt of
nottce ÍÌom the Governnnent:-
(i) advise the Government in writing that the
violation has not been sanctioned by the
Union;
(i i) post such notices, as the Government may
request, instructing the employee or employees
to cease parttcipation in the violation; and
(iii) take such other and flirther steps as may be
necessaay to abate the violation.
I\1ANAGEMENT CLAUSE
(a) The Government or its Agency' has and retams the sole right and function to manage its business including,
but mtJJout limitation, the right:
(i) to decide, control and regulate tlle s!l.e of

expressly provided by law, or this Agreement.
(b) The Union recognnzes the right of the Government to make and promulgate such reasonabiie rules and
regulations, not in conniet with this Agreement, as it may from time to time deem necessary for the purpose of
maintainmg order, safety and the effcient or effective operation of Government's activities and, upon reasonable
notice to the employees to requure compliance therewith.
Clause I
HOURS OF WORK
(a) The nOl1ia! hours or work shall be forty (40) hours per week, t alJ. to 4 p.m. each day, Monday to Fiiday
(excluding one (¡) hour for lunch each day.
(b) Special times for Special Duties can be arranged departmcntalh'
(c) The normal hours of work for watclil1en and other shin workers shalJ be eight (8) hours per shirl, fÖrty-eight
hours per week.

RATES Of' PA Y. PERIOD OF EMPLOYMENT, AND BROIG~N PERIODS OF EMPLOYMENT
(a) The approved rates of pay arc set out (It Appendix i to this Agreement.
(b) Norma! conditions of employment shal! be by the week or by the month.
(c) The approved ratc canhowe\er be converted into hourly rates when necessary or for the purpose of deductmg
a part of a \\'orker's daily wages should he arrive late at work or !ci!\eS work before the normal daily hours of
work are comp!cted. Whether an employee js engaged by the day or by the hour is at the discretion or the i Icad
of Department concerned to decide, provided hat he approved scales of wages are paid.

OVERTIME
Subject to the hours prescribed at Clause J, the exceptions staled in this Clause and Clause 20 and the limitations
provided in Clause 5 of this Agreement
(a) On a normal day, In respect of work performed
iii excess of the normal hours of work, the rate

(b) In respect of work performed on a Saturday the

Clause 4
PUBLIC HOLIDAYS
Subject to the provisions of Clause 5 the following days are recognised as holidays 111 respect of

PAYMENT FOR PlJBUC HOUOA YS
Payment fè)r Public Holidays shall be niade only if the worker has worked em the scheduled work
day immediately preceding, as well as on the scheduled work day immediately following the
Public Holiday. Declared Public Holidays shall be regarded as recognized Public Holidays.
Clause 6
MEAL ALLOWANCE
Where work is carried out beyond the normal working hours, and at the completion of two hours,
a meal or a meal allowance of not less than $ ¡ 5.00 per worker should be provided.
Clallse 7
ACTING ALLOWANCE
An acting allowance shall be paid to any worker who IS authorized i.l~riting to per/èJrnn duties of
another worker iii a higher category. The acting allowance shall be calculated 011 the basis of
halfof the basic wage of the worker plus hal r of the basic wage in the higher category minus ihe basic
wage of the worker. efTective fì'oii the COl1lnenceinent date stated in the letter of aui!!orization
provided that no acting allowance shall be paid f()!' a period of less than five (5) \vorking day.
'rhe period of act i rrg should not exceed forty-five (45) working days if the job is vacant.

All employees covered by this Agreement who are required to Lise his/her vehicle (car, pick-up,
bicycle, motorcycle) for the per/Ònnance ofhis/ller duties shall be paid a travelling allowance al
the rates consistent with the rates paid to Established Workers.

HEALTH AND SAFETY
It shall be the responsibility of all Goverrment Departments COl1lcctcd (0 !Iiis Agreement, to prO\ ide employees
\\ith safe \\orki1Jg conditions and the Union shall cooperate \\ith each GO\ennment Department to carry out till
responsibility effectively. Each Govcrnmcnt Dcpartment shall ensure (hnt all employccs arc f,iinilizir \\th the use
of all safety equipment and the location of al power s\\'itches etc.
The Government Department and the Union shall mutually agree on the saCcty out!ìts and protecii''ie clothllg to
be used \\hile on duty as well as iheir adequacy for the presen'ntion of' the health and safet) of the employees.
Such outfits and clothirg shall be isslIed in accordance with the prmisions or Schedules i & II to Clause 23 of'
tlii Agreement
Quarry Workers, Cooks, Liquid Waste Workers, Operators of Earth Movmg Equipment, Welders and Workers
exposed to contamination shall be entitled to free quarterly medica! exainiraiIoIJ as well as treatment if necessary.
All workers covered by this Agreement shaH be eligible for protection undcr ihe Health and Safety Clause.
However, those workers who arc directly invo!ved in dangerous occupation shall be provided with the necessary
safety gears and protective clothing such protective clothing shall be wom at all times when performing duties
that require the use of protective clothing or safety gears.
Clause 10
ANNUAL HOLIDAY WITH PA Y
Aiiy employee who has completed two hundred and fourteen (214) working days JJ any calendar year shall be
eligible for vacation !cave on full pay at the following ratcs; but for a penuel of less that t\\o hundred and fourteen
days payment shal! be in accordance with the provisions of the Labour Code:

Clause 11
SICK LEA VE
( ¡) J\ny employee who has passed his probationary period shall in any calendar year fÒI!O\vIng thecommencement of his employment be eligible for t~9,!lly-eight (n) workllg days sick )cave \\lith full pay and
an additional three (3) months from i 7th February, J i)lJ3.
(2) If a worker is absent from work due to illness for a penod of not more than (\VO (2) consecutive working
days he need not be required to produce a Medical Certificate in order to qualify for sick leave pay. On the third
day of such absence, however he is required to produce a Medical Certificate at the rcquest of the Hcad of
Department or Supervisor and payment wiil be madc as ÍÌom the first day of ilness. In any cvc.il( the \vorkcr
should make evcry effort to inform his immediate supervisor or his iJIness at the earliest opportunity and
preferably on the first day of absence.
(3 ) Payment in respect of sick leave shall be made to an employee as far as possible at such tuiic as thc
cmployee would normally receive wages if he wcre at work.
( 4) Pcriods of sick !cave shall be mcludcd when calculating the number or day's quali(ying the: worker for
annual leave.

bencfìts paid undcr thc Social Security Scheme and the employee's basic wagcs up to a maximum or three
pregnancies.

vacation leavc as wcll as public holiday pay l:illing within such period ofvacation leave plus leave without pa)

An employee may absent himself from work with the permission of the Head of the Department iiii which he/she

iperiod not excecding six (6) months, provided that the employee has exhausted all the earned vacation Icave for

SPECIAL CONDITIONS OF \YORK
(a) WATCHMEN
A watchman shall be supplied with a whistle, a cloak and a flashlight. Flashlight batterres \\ll be
supplied as often as necessary. All watchmen should be identified by a badge or other lorm of
IdentiJìcation. Articles supplied to watchnien under this agreement must be returned lo nwn,igement on
cessation of employment

(b) FIELD COOKS
Cooks attached to gangs should not be requured to cook for more than eight (8) workers In the case of

A suitable receptacle for drinking water must be pro\'ided at each \york site.
(d) FIREST ANDS
Firestands shall be provided ¡it \vOlk sites for the use of cooks.
TRANSPORTATION OF WORKERS
Trucks used for transportmg workers shall be provided with steps, tarpaulins and other safety equipment
when in such usc.
((' Temporary sheds shall be provided for the shelter of workers at work sites II such cases as Managcment,
in consultation with the Union, may iìceii necessary, practical and reasonable.
Clause 18
PA YMENT FOR LOSS OF TIME CAUSED BY RAIN
(i) Where a tradesman or labourer reports to work and is unable to work on that day due to r¡iin he should
be paid three (3) hours pay.
(2) Where work commences and has to be stopped because of continuous rain before lunch time the ,varkel'
shall be paid up to lunch tunc on that day.
(3) Should rain fall after lunch and work cannot be continued the worker should be paid his full day's pay.

TIME OFF IN EXCEPTIONAL CIRCUMSTAN(:ES

CONDITIONS UNDER WHICH ABOVE SPECJAL ALLOWANCES SHOULD BE MADE
(a) The percentage allowance shall be calculated, when applicable, on the normal hourly rate of the person

(c) In case where the Government takes special precautions (0 salcguard the health and well-being of their
employee and such precautions arc deemed to constitute the maxiniimi that 1S possible to be provided, then the
allowance aforementioned may be waived or reduced by agreement between the Govennment and the Union.
(I) The aforementioned allowances shall not be taken iito consideration in the assessment of c!aim for
compensation in rcspect of accJdents or other dis¡¡bilities arising fì.om the conditions of such employment.
(g) No consideration shajJ be given in respect of any of these alJO\vances for the assessment of pensions or
otJJer payments which may be made to persons eligible for such pensions or payments due to length of service.

PROTECTIVE CLOTHING
Protective cJothing shall be issucd in accordance WJth thc subjoined schcdule. Such protective clothing must be
worn by the worker solely in the performance of his duties. Should an article be dcstroyed or lost through
negligence of the employee, the employee is required to purchase a replacement
Protective cJothiiig shall be issued within the lirst quarter of c¡ich year. The replacement and repairs of iienis or
clothing listed under Protcctive Clothing will be at the díscretion of the Head of Department and the Works
Committee.
