(i) The bidder and/ or the contract manufacturer must have filed Industrial entrepreneurmemorandum (iem), with department of Industrial policy and promotions beforesubmission of bid.

(ii) The bidder and/ or the contract manufacturer has to complete The following steps for

manufacture of core equipments in India Within a period of six (6) months from the dateof issue of purchase

Order for phase-v.1:(a) Ensure construction/ leasing of factory premises(b) Place firm orders for procurement of capital goods

All third party equipment should be of proven technology and supported by documentsfor its successful operation of similar or higher configuration for minimum one year inany other network.

POTENTIAL PROBLEMS

Unable to meet deadlines:In the event that the contractual partner is not able to meet the deadline there is noclause provided as to what action would be taken against them, what kind of capital orlegal penalty would be levied upon them.

Testing:

After the equipment is installed, there is no clause as to how it would be tested, whowould bear the testing charges and what would happen in case the equipment fails tofunction. There should be a clarity regarding all this in the tender document.

Bankruptcy

There is no clause mentioned in case the vendor goes bankrupt as to what actions

would be taken against them, how will BSNL get its capital back etc.
