New and Renewal Registration Fee ~ CChampions maintains a straight forward business model with respect to registration fees, oharges and costs. Our registration revenue share agreements simply state that CChampions retains $100.00 of each registration processed/collected with the remainder going to the community. CChampions reserves the right to approach the city to renegotiate fees for each renewal year.

Late Registration Fee - Jacksonville's ordinance requires a $50 late fee. When collected this $50 late fee will be entirely remitted by CChampions to the community.

Section 4-Minimum Requirements

A. Consultant must have completed similar services for a local municipality or regional government entity within the past three years:

CChampions has been operating for the past six years in the state of Florida, as well as six other states, with the seventh state coming online within the next four months.

We partner with 78 communities currently. Our communities range from populations of 300 residents, to metropolitans with over two million residents.

References. Below is a list of references for which similar services have been provided:

• Palm Beach County-S01 N. Olive Ave., West Palm Beach, FL 33401 Project and service dates -Sept. 2011 to present, and currently maintaining a registration database of 17,342 registrations. Ordinance number 2011-015.

• Pasco County- 8731 Citizens Dr. New Port Richey, FL 34654 Project and service dates January 2011 to present and currently maintaining 12,438 registrations. Ordinance number 10-49.

• Hillsborough County, FL" 601 E. Kennedy Blvd., Tampa, FL 33602 Project and service dates October, 2014 to present and currently managing 18,041 registrations.

B. Consultant can demonstrate it has sufficient personnel and financial resources to handle the proposed project workload in a timely and cost effective manner.

CChampions employees 45 full time employees and 12 additional contract employees.

CChampions has 7 years in the development, implementation, and management of a foreclosed property registry database and on~line collection of fees. The company has established relationships within the industry and provides a central, convenient, and efficient process for this important government tool. The company's primary source of revenue comes from registrations, requiring our process and service to evolve and continually become more effiCient while providing added value. We have the experience, the relationships, the know~how, and the technology to provide the

1. Competence - Since being founded in 2009 CChampions has administered proactive property registration programs for Counties and MUnicipalities across Florida and five other States. Through our commitment to best practice methodology and our work with local Government staff we've been able to develop a registry program specific to the needs of local Government. Our internally developed proCHAMP registry platform has successfully processed hund reds of thousands of registrations and de-registrations and is the preferred registry of all the major lending institutions. Furthermore, we have built a client base of nearly eighty (80) Government partners since 2009 without ever having a community terminate our relationship (contract). Our registry program has received nationwide recognition for our best practice registry model to include invitations to showcase our programs this year at the Florida Association of Code Enforcement (F.A.C.E.) Conference where we led a panel discussion that included Wells Fargo, the Jacksonville Community Development Coalition Corporation (non-profit) and a Code Official from the Village of Wellington. Additionally we were invited to showcase our program at the Florida City and County Manager's (F.C.C.M.A.) Conference in Orlando and more importantly CChampions was recognized by the International City Manager's Association (l.e.MA) for our work in the property registration realm and we'll be presenting our program at a session in September at their Conference in Seattle.

2. Current Workload - CChampions cu rrently has 227,711 active registrations in our proCHAMP registry program administered by a large team of review professionals to ensure the quality of these registrations and alt related data. Additionally, our review team processes hundreds of support requests weekly in response to requests from responsible parties, Government staff and other related entities while maintaining a 3-5 day turnaround standard for response.

3. Financial Responsibility - The CChampions' registry program is completely transparent in the sense that any government employee can securely log in at any time from any location and view their registration data. This includes registration processing specific to properties registered and payments collected. All communities are provided a monthly remittance report detailing the number of properties registered accom panied by a check for those properties that were registered that particular month. It's also important to note CChampions dedicates a portion of our registration revenues to supporting local non-profits in the rehabilitation of properties in a number of communities across the State of Florida that are partners with us.

Proximity to the project - While the property registration program is driven by technology, our corporate office is located in Melbourne, Florida and therefore reasonably close to the City of Jacksonville. CChampions also has an satellite office located at 1501 N. Main St., Jacksonville. FL, 32206.

Ability to design an approach and work plan to meet the project requirements - In addition to the CChampions' review team and management teams, CChampions has Code Enforcement professionals that not only meet with staff twice annually, but are available at all times to address any concerns or project initiatives that may arise outside the scope of the bi-annual visits.

CChampions will provide all the required services necessary to develop and implement the property registry and fee collection program in accordance with the requirements of the City's adopted Ordinance, applicable State of Florida laws, Federal laws, and shall include, but is not limited to, the following:

A. prOCHAMP (web-based property registration application)

At the center of the CChampions property registration program is our prOCHAMP web·based application.

prOCHAMP facilitates all registration processes, activities, collaboration and communications. Its primary strengths include ease of use, security and accessibility from any device with an internet connection. proCHAMP is proposed to be a collaborative tool for code enforcement and all other public safety agencies to view the registration, occupancy and foreclosure status of properties in Jacksonville.

Additional proprietary features of the proCHAMP web~based application include:

• Diminishes inaccurate registration data, by requiring the registrant to choose the property merged from public record instead of manually registering data that may be more likely to diminish data integrity.

• Neighbors and Homeowners of both potential and/or registered properties can take advantage of the citizen's request feature, that will send automated emails to code enforcement or other designated government officials and agencies while also notifying the mortgagee/responsible party and property manager via email.

prOCHAMP has evolved over several years of development and it leads the industry in capabilities, accessibility, reliability and quality assurance. In fact, more properties are registered with proCHAMP than with any other application in the country.

In order to continue to lead all other property registration systems we regularly gather feedback from our partner communities and continue to build a roadmap of innovative features that will continue to improve our processes, simplify the user experience and continue to provide the most effective registration solution available.

B. Property Data Collection and Analysis

CChampions collects and compiles up"to-date property, foreclosure, violation, lien and vacancy data from public and 3rd party data resources creating a 360·degree view of the property. CChampions analyzes this data through automated business rules and qualifies the need to register.

The compiled data records provide visibility into potential properties that are or have been subject to registration. This data is made accessible to a1\ GOVT staff via secure access to prOCHAMP. The compiled property data is not only useful for determining registration compliance but can also useful for many other government programs. For example, the data can be useful for first responders in identify occupancy status of a foreclosed property and in the identification oftarget properties for Neighborhood Stabilization Funds and other Grants.

C. Proactive Registration Services

Implementing proactive identification, assignment, notification and enforcement, CChampions provides the means for communities to get in front of problems caused by neglected properties and achieves and maintains high registration compliance rates.

CChampions, in accordance with City of Jacksonville's Property Registration Ordinance and utilizing the compiled data, will immediately identify properties qualified for registration.

Properties will be identified that are subject to a mortgage and involved in a foreclosure action or whereby a mortgagee has taken title to a propert;ythrough a foreclosure action or deed-in-Iieu of foreclosure sale.

All properties that are identified as needing registration are manually reviewed by the CChampions support team to confirm the obligation to register prior to assignment. Once the obligation is confirmed the support team does the necessary research to determine the current responsible party and then they assign the property for registration.

The CChampions support team also follows this manual review and assignment process for voluntary new registrations, on deregistration and on annual renewal.

Pf:§,~¢.tJY~,~~h CChampions maintains a proprietary database of key contacts within Real Estate, Property Preservation, Banking, and Lending organizations. This proprietary responSible party contact database includes contact information for the managers of various business units and departments of the largest lending institutions.

CChampions will use this proprietary database and its ongoing relationships to proactively notify and ensure responsible parties have up to date ordinance information and understand their obligations to comply with registration and resolve any active violations.

Responsible parties are notified via email of all non-compliant property registrations. These notifications are tracked and viewable securely by GOVT staff in proCHAMP.

CChampions will also make contact with the state, regional, and [ocal mortgagees and provide ordinance requirements, process and procedural training, and support for registration.

If after repeated notifications the property registration remains non-compliant then enforcement may be necessary. GOVT staff will have access to detailed reports of all non-compliant Registrations.

Our code enforcement experts will work collaboratively with the City of Jacksonville to establish a collaborative enforcement plan. For repeat and high volume offenders our code enforcement experts will assist where possible in the enforcement process.

D. Registration (Data and Fee Collection)

We've streamlined this process to benefit both responsible parties and to improve compliance. We provide multiple means of collecting registration fees both online and through traditional channels. These include:

• Pay Online - using any major credit card • Pay by Invoice/Check • Pay by ACH • Pay by DPP (Deferred Payment program) - DPP is similar to online payment

minus the credit card fees. This is a unique payment method that makes it easier and less costly for Responsible Parties to pay their registration fees and in so doing improves compliance.

Our payment process is seamless for our Community Partners. At anytime our partners can get a real time report of all registration payments through proCHAMP. Monthly we provide a detailed remittance report and a deposit to equal Jacksonville's portion of the registration fees received.

At all times GOVT staff have complete visibility and audit capability of registration and payment processing.

Note: In preparation for supporting Jacksonville's amended ordinance CChampions is in the process of adding support for the collection of Late Fees and Update Fees to be included in prOCHAMP.

E. Registration Support Services

CChampions assigns a dedicated registration support team to respond to all registration support questions or concerns. Support questions range from disputes surrounding the obligation to register, simple property address validation and request for assistance wIth registration. The CChampions support team currently responds to hundreds of support requests from responsible parties weekly.

Timing & Timeline

The standard onboarding timeline is N/A because CChampions is already partnered with the City of Jacksonville as its registration partner and is already collecting registrations on its behalf. Upon selection and contracting CChampions will simply continue managing the program it is already responsible for.

Training

CChampions provides GOVT staff both custom and standard onsite and online training. As need CChampions will conduct custom on-site and/or online trainings to familiarizing staff with prOCHAMP and the registry processes.

Also CChampions will make available to staff unlimited, online training which is provided by CChampions staff every other Wednesday and can be scheduled via proCHAMP or by sending an email [email protected].

Reporting

prOCHAMP provides extensive real time reporting capabilities. These reports are exportable to Excel spreadsheets for additional customization and analysis. Also, custom reports will be provided by CChampions upon request.

Also, to ensure all Jacksonville and CChamplons staff are in sync we will conduct a bi­annual health check. During these health checks we will review reports on registrations, non-compliance, foreclosure trends, etc. Additional calls or meetings can be scheduled and will be provided at the discretion and convenience of the government partner's staff.

New and Renewal Registration Fee - CChampions maintains a straight forward business model with respect to registration fees, charges and costs. Our registration revenue share agreements simply state that CChampions retains $100.00 of each registration processed/collected with the remainder going to the community. CChampions reserves the right to approach the city to renegotiate fees for each renewal year.

Late Registration Fee - Jacksonville's ordinance requires a $50 late fee. When collected this $50 late fee will be entirely remitted by CChampions to the community.

Registration Update Fee - Jacksonville's ordinance requires a $50 update fee. This $50 update fee will be retained by CChampions with no portion being remitted to the community

12 WHEREAS, in 2010 the Jacksonville City Council adopted

13 Ordinance 2010-327-E to create a foreclosed property registry for

14 mortgaged real property which is in default, distress or in the

15 process of foreclosure; and

16 WHEREAS, the foreclosed property registry established a

17 process to mitigate the level of deteriorating property within the

18 City of Jacksonville by providing that funds from the registration

19 of properties, in addition to covering administrative costs of the

20 registry, go into programs for foreclosure intervention programs

21 and code enforcement; and

22 WBEREAS, there are certain areas within the City that suffer

23 from blighted conditions and devaluation in property values at a

24 greater intensity and frequency than other areas of the City,

25 particularly in the following zip codes; 32202, 32205, 32206,

26 32208, 32209, 32254 due to the lack of adequate maintenance of

27 properties subject to mortgages that are in default or have been

28 foreclosed; and

29 WHEREAS, the City desires to establish a policy so that those

30 neighborhoods and communities most negatively affected by the

31 ongoing lack of adequate maintenance of properties subj ect to

2 for funding for community development and maintenance, in addition

3 to foreclosure intervention programs and code enforcement; and

4 WHEREAS, the city of Jacksonville further finds that

5 improvements and efficiencies can be made to the current

6 registration process to enhance the program; and

7 WHEREAS, the City Council of the City of JacKsonville has

8 determined that the following additions and modifications to the

9 City's Ordinance Code will meet a public purpose by serving and

10 contributing to the px:omotion and protection of the general health,

11 safety and welfare of the residents of the City of Jacksonville;

12 and,

13 WHEREAS, upon passage, duly noticed public hearings as

14 required by 'law will have been held by the City Council of the City

15 of Jacksonville, at which public hearings all residents and

16 interested persons were given an opportunity to be heard; now

2 provided in the Florida Building Code shall apply.

3 Abandoned real property means any real property that is

4vacaatJ and is under a public notice of default, notice of

5 mortgagee's sale , pending tax assessor's lien sale l or is pending a

6 mortgage foreclosure, er notice of mertgagee's sale, or lien sale

7 and/or properties that have been the subject of a mortgage

8 foreclosure sale where title is retained by the mortgagee, and/or

9 any properties transferred under a deed-in-lieu of foreclosure

10 sale, a short sale or any other legal means.

11 Annual registration shall mean 12 months from the date of the

12 first action that required regis~rationJ as determined by the City

13 of Jacksonville's Housing and community Development Division, or

14 its designee, and every subsequent 12 months. The date of the

15 initial registration may be different than the date of the first

16 action that reguired registration.

16 certificate of title, certificate of title and all other processes,

17 activities and actions, by whatever name, associated with the

18 described process. The process is not concluded until title to the

19 property is transferred to a third party either before or after

20 certificate of title or until the legal process is dismissed.

21 "Local" means within the boundaries of the City of

22 Jacksonville, Plorida.

23 "Local Agent" means the property manager or agent designated

24 py the mortgagee upon registration as required under this Chapter.

25 The Local Agent t s office must be located within twenty (20) miles

26 of the City of Jacksonville.

27 "Mortgagee" means the creditor I including but not limited to,

28 trustees; servicing companies; lendersi any agent, servant or

29 employee of the creditor; an~ successor in interest; or any

30 assignee of the creditorl s rights, interests or obligations under

31 the mortgage agreement.

1 "Owner" means every person, entity, or service company, who

2 alone or severally with others:

3 1) has legal or eguitable title to any dwelling, dwelling

4 unit, mobile dwelling unit, residential building, residential

5 structure, residential Earcel of land l vacant or otherwise,

6 including but not limited to, a mobile home park; or

i 2) has care, charge or control of any dwelling, dwelling unit,

8 mobile dwelling unit, residential building, residential structure

9 or residential parcel of land, vacant or otherwise, including a

10 mobile hc:in:e park, in any capacitYI including but not limited to,

11 agent l executor, executrix, administrator, administratix 1 trustee

12 or guardian of the estate of the holder of legal titlej or

13 3) is a mortgagee in Eossession of any such property, or is a

14 mortgagee with act.ual control of access to the property by any

15 means including, but not limited to, changing locks or putting on a

16 lock box; or

17 4) is an agent I trustee or other person appointed by the

18 courts and vested with possession or control of any such property.

19 Vacant means any building or structure that is not lawfully

20 occupied or inhabited by human beings as evidenced by the

21 conditions set forth in the definition of "Evidence of Vacancy"

22 above.

24 Sec. 179.104. Inspection and registration of ~ foreolos~

25 real property by mortgagee holding mortgages in default.

26 (a) Any mortgagee who holds a mortgage on real property

27 located within the City of Jacksonville shall perform an inspection

28 of the property upon defaul t by the mortgagor or prior to the

29 issuance of a notice of default. If the property is fOl:iRd to se

4 (c) wi thin ten (10) days of the date any mortgagee declares

5 its mort.gage to be in defaul t, the mortgagee shall register the

6 real property wi th the City of Jacksonvi 11e' s Housing &

7 ~Jeighborhoed Department Community Development Division, or its

8 designee, on forms promulgated by the Heusing & Neighborhood

9 Department, 'Housing & Community Development. Division, or other

10 manner as directed, and, at the time of registration, indicate

11 whether the property is vacant, shows evidence of vacancy or is

12 occupied, and shall designate in writing a -±-eeal pJ:'6f?erty manager

13 Local Agent to inspect, maintain and secure the real property

14 subj ect to the mortgage in default. A separate registration is

15 required for each property, whether it is found to be vacant or

16 occupied.

17 (d) Registration pursuant to this section shall contain at a

18 minimum the name of the mortgagee, the mailing address of the

19 mortgagee, e-mail address, ~ telephone number, and name of the

20 local property manager Local Agent and said person I s address, e-

21 mail address, and telephone number. The ~oeal ~r6perty managcJ:'

22 Local Agent shall be responsible to inspect, secure and maintain

23 the property. The property ffian~ Local Agent named in the

24 registration shall be located within twenty (20) miles of the City

25 of Jacksonville and available to be contacted by the City I Monday

26 through Friday between 9:00 a.m. and 5:00 p.m., legal holidays afl6

27 lunch hours excepted.

28 (e) At the time of registration each Eaeft registrant shall

29 pay a gon-refundable annual registration fee of $3;50.0-9 $250.00 for

30 each registration. Subsequent annual reaistrations and fees in the

31 amount of $250:00 are due within 30 days of the expiration of the

2 of (1.) registration and registration enforcement, (2) code

3 enforcement and mitigat.ion related to blighted and deteriorati:ng

4 foreclosed properties that were owner-occupied, (3) post-closing

5 counseling and foreclosure intervention limited to owner-occupied

6 persons in default I which may include cash and mortgage

7 modification assistance",:" ,and (4) may be used for any related

8 pur-eoses as may be adopted in the pOlicy set forth in Section

9 179.110 below, Said fees shall be deposited to a special account

10 in the Planning and Dev'elopment: Department:: Housing lit. Community

11 Development Division dedicated to the cost of implementation and

12 enforcement of this ordinance, combatting blight in affected

13 ~i9hborhoods consistent with the policy ado:Q.ted by :he Housing lit.

14 Community Development Division in Section 179.1H!.1 and any

15 registries so required. None of the funds provided for in this

16 section shall be utilized for the legal defense oE foreclosure

17 actions.

18 (f) 'This section shall also apply to properties lShat have

19 eeen the subject sf a foreclesure sale Tdhere title is tJ:'a:asfen:=eel:

20 to the ff1ort§'agee as ~I'ell as an), properties transfclJlJcd to the

21 mert::gagee under a deed in 1ieu of' foreelosure. Begi~ing on July

22 1 t 2015, each individual property on the registry that has been

23 registered for twelve months or more prior to that date shall have

24 thirty (3 0) days to renew the registration and Eay the $250.00

25 annual renewal fee. The anniversary date for annual renewal of

26 registration for these properties shall be deemed to be July 1 each

27 subsequent year. Properties registered less than twelve months

28 prior to July 1, 2015 shall use the date of initial registration as

29 their annual renewal date and shall pay the $250.00 annual renewal

30 date on the anniversary of the initial registration each subsequent

31 year.

2 is sold or transferred, t.he new mortgagee is subj ect to all the

3 terms of this ChaRter, Within ten (10) days of the transfer, the

6 all previous unpaid fees, regardless of who the mortgagee ~<las at

11 (h) If the mortgagee of a foreclosed real proEerty sells or

12 transfers the property in a non-arm's length transaction' to a

13 related enti tX' or person, the transferee is subj ect to all the

14 terms of this Chapter, and within ten (10) days of the transfer the

15 transferee shall register the proEerty or update the existing

16 registration and pay a registration update fee of $50.00. Any and

17 all previous unpaid fees I resardless of \o[ho the mortgagee was at

18 the time regist.ration was required, including but not limited to

19 unregistered periods during the foreclosure process, are the

20 responsibilicy of the new owner of the foreclosed property and are

21 due and payable withche updated registration.

22 (i) If the property is not registered and the registration

23 fee is not paid within thirty (30) days of when the registration is

24 required pursuant to this section, a late fee of $50.00 per

2S property shall be charged and shall be due and payable with the

26 registration. This section shall apply to the initial registration

27 and registrations required by subsequent owners of the defaulted

28 mortgage and/or foreclosed property. Each period where the

29 registration fee is late shall be assessed a late charge of $50.00.

30 R.egist.rations delinguent greater than 30 days are SUbject to

31 additional fines as described by_Section 179,106(g) herein.

21 that any property is in violation of this chapter the City may take

22 the necessary action to ensure compliance with and place a lien on

23 the property for the cost of the work performed to benefit the

24 property and to bring it into compliance.

Sec. 17~.L06. Security requirements.

(a) Properties subject to this Chapter shall be maintained in

28 a secure manner so as not to be accessible to unauthorized persons.

29 (b) A "secure manner" shall include, but not be limited to,

30 the closure and locking of windows·, doors: gates and other openings

31 of such size that may allow a child or adult to access the interior

2 by reglazing or boarding.

3 (e) If a mortgage ona property is in default, and the

4 property has become vacant or abandoned, a 10eal property manager

5 Local Agent shall be designated by the mortgagee to perform the

6 work necessary to bring the property into compliance with the code

11 (d) When a property subject to this Chapter becomes vacant or

12 abandoned, it shall be posted with the name and twenty four (24)

14 Agent. The sign shall be placed in a window facing the street and

15 shall be visible from the street. The posting shall be no less than

16 18 inches x 24 inches and shall be of a font that is legible from a

17 distance of 45 feet. The posting shall contain the following

18 language with supporting information:

24 (e) The posting required in subsection (d) above shall be

25 placed on the interior of a window facing the street to the front

26 of the property so that it is visible from the street, or secured

27 to the exterior of the building/structure facing the street to the

28 front of the property so that it is visible from the street or if

29 no such area exists, on a stake of sufficient size to support the

30 posting in a location that is at all times visible from the street

31 to the front of the property but not readily accessible to vandals.

2 resistant materials.

3 (fl Failure of the mortgagee and/or property owner of record

4 to properly inspect and secure a property subject to this Chapter,

5 and post and maintain ~he signage noted in this section, is

6 unlawful and a Class C violation and shall be subject to

7 enforcement by any of the enforcement means available to the Ci ty

8 of Jacksonville. Pursuant to a finding and determination, the City

9 of Jacksonville may take the necessary action to ensure compliance

10 with this section, and recover costs and expenses in support

11 thereof.

(9) Failure of the mortgagee to register a property pursuant

to this Chapter shall authorize the City to impose a civil penalty

in the amount of $500.00 against the mortgagee for each offense.

Upon written notice of noncompliance from the City or its designee,

the rnortgag·ee shall have 20 days from the date of the notice of

noncompliance to pay the registration fee and any additional fees

(such as any late fee or update fee noted within the letter of

noncompliance). If the mortgagee fails to timely make these

payments within the time allotted above, the $500.00 civil penalty

shall be imposed upon mortgagee and shall be payable to the City of

Jacksonville within 15 days of receipt of notice of delinguent

payment, along with any other registration fees which have not been

paid by that date. The provisions of this section are cumulative

with and in addition to other available remedies. Moreover 1 the

Housing and Community Development Division Staff of the Planning

and DeveloEment Department is authorized and empowered to refer the

Notice of Noncompliance to the City Code Enforcement Special

Magistrate for disposition.

5 The Housing & Community Development Division of the Planning and

6 Development Department has established a policy for the expenditure

7 of funds deposited in the Foreclosed Property Registry consistent

8 with the purpose of comb~tting blight I particularly in

9 neighborhoods and communities inordinately impacted by the mortgage

10 foreclosure crisis j and to counteract the deterioration of

11 properties in the registry and to reduce the devaluation of

12 surrounding properties caused by deteriorating properties subject

13 to mortgage foreclosure. The city of Jacksonville hereby adopts

14 the policy created by the Housing and Community Development

lS Division at.tached hereto as Exhibit 1 and incorporated herein by

16 reference. This policy is subject to annual review by the Housing

17 and Community Development Division. Should the Housing and

18 Community Development Division determine that modifications to the

19 policy are necessary or recommended, the Housing and Community

20 Development Division shall file legislation through the Mayor's

21 Office to have such modifications to the policy adopted by the

22 Council.

Chapter 179 - MORTGAGE FORECLOSURE REGISTRATION

Sec. 179.101. - Purpose and intent.

It is the purpose and intent of this Chapter to establish a process to limit and reduce the deterioration of property located within the City of Jacksonville, which property is In mortgage foreclosure, or where ownership has been transferred to a lender or mortgagee by any legal method. It is further intended to establish a registration program as a mechanism to protect neighborhoods from becoming blighted through the lack of adequate maintenance of abandoned and vacated properties which are subject to mortgages that mayor may not be in default.

Sec. 179.102. - Definitions.

The following words, terms and phrases, when used in this Chapter, shall have the meanings ascribed to them, except where the context clearly indicates a different meaning. Where the context will permit and no definitions are provided herein, the definitions provided in the Florida Building Code shall apply.

Abandoned real property means any real property that is vacant, and is under a public notice of default, or is pending a mortgage foreclosure, or notice of mortgagee's sale, or lien sale and/or properties that have been the subject of a mortgage foreclosure sale where title is retained by the mortgagee, and/or any properties transferred under a deed-In-lieu of foreclosure sale, a short sale or any other legal means.

Default means that the mortgagee has filed a foreclosure action or public notice of default on the mortgage. A mortgage shall be considered in default at such time as the mortgagee declares said mortgage to be in default either in writing, by recording a lis pendens, by commencing foreclosure proceedings; or by any other actions demonstrating a breach of a security covenant on a property.

Enforcement officer means any fulltime law enforcement officer, building offiCial, fire inspector or code enforcement officer employed by the City of Jacksonville.

Evidence of vacancy means any condition that on its own, or combined with other conditions present, would lead a reasonable person to believe that the property is vacant. Such conditions may include, but are not limited to: overgrown and/or dead vegetation; electricity, water or other utilities turned off; stagnant swimming pool; or statements by neighbors, passers-by, delivery agents or government agents.

Foreclosure means the judicial process by which a property, placed as security for a mortgage loan, after a judicial process, is to be sold at an auction to satiSfy a debt upon which the borrower has defaulted.

Vacant means any building or structure that is not lawfully occupied or inhabited by human beings as evidenced by the conditions set forth in the definition of liE vidence of Vacancy" above.

Sec. 179.103. - Applicability.

This Chapter applies to abandoned and vacant property located within the City of Jacksonville, which property is in or has been in mortgage foreclosure, or where ownership has been transferred to a lender or mortgagee by any legal method.

Sec. 179.104. - Inspection and registration of vacant real property by mortgagee holding mortgages in default.

(a) Any mortgagee who holds a mortgage on real property located within the City of JacksonviHe shall perform an inspection of the property upon default by the mortgagor or prior to the issuance of a notice of default. If the property is found to be vacant or shows evidence of vacancy, it shall be deemed vacant or abandoned and the mortgagee shall, within ten days of the inspection, register the property with the City of Jacksonville's Planning and Development Department on forms promulgated by the Housing and Community Development Division.

(b) Property inspected pursuant to sUbsection (a) above that is occupied but remains In default, shall be inspected on a regular basIs by the mortgagee or mortgagee's designee.

(c) Within ten days of the date any mortgagee declares Its mortgage to be in default, the mortgagee shall register the real property with the City of Jacksonville's Planning and Development Department on forms promulgated by the Housing and Community Development Division and, at the time of registration, shall designate in writing a local property manager to inspect. maintain and secure the real property subject to the mortgage in default.

(d) Registration pursuant to this section shall contain at a minimum the name of the mortgagee, the mailing address of the mortgagee, e-mail address, and telephone number and name of the local property manager and said person's address, e-mail address, and telephone number. The local property manager shall be responsible to Inspeot, secure and maintain the property. The property manager named In the registration shall be located within 20 miles of the City of Jacksonville and available to be contacted by the City, Monday through Friday between 9:00 a.m. and 5:00 p.m., holidays and lunch hours excepted.

(e) Each registrant shall pay a fee of $150.00 for each registration. Said fees shall be used to offset the costs of (1) registration and registration enforcement, (2) code enforoement and mitigation related to blighted and deteriorating foreclosed properties that were owner-occupied, (3) post-closing counsellng and foreclosure intervention limited to owner"occupied persons in default. which may include cash and mortgage modification assistance. Said fees shall be depOSited to a special account in the Planning and Development Department dedicated to the cost of implementation and enforcement of this ordinance and any registries so required. None of the funds provided for in this section shall be utilized for the legal defense of foreclosure actions.

(f) This section shall also apply to properties that have been the subject of a foreclosure sale where title is transferred to the mortgagee as well as any properties transferred to the mortgagee under a deed in lieu of foreclosure.

(g) Properties subject to this section shall remain under the registration reqUirement, and the inspection, security, and maintenance standards of this section as long as they remain vacant or subject to having been declared by a mortgagee to be in default.

(h) Any person or other legal entity that has registered a property under this ordinance must report any change of information contained in the registration within ten days of the change.

(i) Failure of the mortgagee and/or property owner of record to properly register or to modify the registration from time to time to reflect a change of circumstances as required by thIs ordinance is a violation of this Chapter and shall be subject to enforcement by any of the enforcement means available to the City of Jacksonville.

0) Pursuant to any judicial finding and determinatIon that any property is in violation of this Chapter the City may take the necessary action to ensure compliance with and place a lien on the property for the cost of the work performed to benefit the property and to bring it into compliance.

Sec. 179.105. - Maintenance requirements.

Properties subject to this Chapter shall be maintained in accordance with the City's property safety standards found in Chapter 518, Ordinance Code.

Sec. 179.106. - Security requirements.

(a) Properties subject to this Chapter shall be maintained in a secure manner so as not to be accessible to unauthorized persons.,

(b) A "secure manner" shall include, but not be limited to, the closure and locking of windows, doors, gates and other openings of such size that may allow a child or adult to access the interior of the property and/or structure. Broken windows shall be secured by reglazing or boarding.

(c) If a mortgage on a property is in default, and the property has become vacant or abandoned, a local property manager shall be designated by the mortgagee to perform the work necessary to bring the property into compliance with the code of ordinances and the local property manager must perform regular inspections to verify compliance with the requirements of this section, and any other applicable laws or ordinances of the City of jacksonville.

(d) When a property subject to this Chapter becomes vacant or abandoned, it shall be posted with the name and 24-hour contact telephone number of the local property manager. The sign shall be placed in a window faCing the street and shall be visible from the street. The posting shall be no less than 18 inches x 24 inches" and shall be of a font that is legible from a distance of 45 feet. The posting shall contain the following language With supporting information:

THIS PROPERTY IS MANAGED BY AND IS INSPECTED ON A REGULAR BASIS.

THE PROPERTY MANAGER CAN BE CONTACTED BY TELEPHONE AT

OR BY EMAIL AT

(e) The posting required in subsection (d) above shall be placed on the interior of a window facing the street to the front of the property so that It is visible from the street, or secured to the exterior of the building/structure facing the street to the front of the property so that it is visible from the street or if no such area exists, on a stake of sufficient size to support the posting in a location that is at all times visible from the street to the front of the property but not readily accessible to vandals. Exterior posting shall be constructed of and printed with weather-resistant materials.

(f) Failure of the mortgagee and/or property owner of record to properly inspect and secure a property subject to this Chapter, and post and maintain the signage noted in this section, is unlawful and a Class C violation and shall be subject to enforcement by any of the enforcement means available to the City of Jacksonville. Pursuant 10 a finding and determination, the City of Jacksonville may take the necessary action to ensure compliance with this section, and recover costs and expenses in support thereof. '

Sec. 179.107. - Additional authority.

(a) If an appropriate City Code Enforcement Administrator has reason to believe that a property subject to the provisions of this Chapter is posing a serious threat to the public health safety and welfare, the Code Enforcement Administrator may bring the violations before the City's Code Enforcement Board or Code Enforcement Special Magistrate, or a court of competent jurisdiction as soon as possible to address the conditions of the property.

(b) If there is a finding that the condition of the property is posing a serious threat to the public health safety and welfare, then the Code Enforcement Board or Code Enforcement Special Magistrate or a court of competent jurisdiction may direct the City to abate the violations and charge the mortgagee with the cost of abatement.

(0) If the mortgagee does not reimburse the City for the cost of abatement within 30 days of the City sending the mortgagee the invoice, then the City may lien the property with the cost of abatement, atong with an administrative fee of $500 to recover the administrative personnel services.

Sec. 179.108. ~ Provisions Supplemental.

Nothing contained in this Chapter shall prohibit the City of Jacksonville from enforcing its codes by any other means, including, but not limited to, injunction, abatement or as otherwise provided by law or ordinance.

Unless otherwise provided for in this Chapter, a viotation of this Chapter is declared unlawful and shall be a Class B offense.
