RAILROADS ARE NOT DENYING ACCESSS TO SURVEYORS. INSTEAD THEY ARE ALLOWING THEM ON THEIR RIGHTS-OF-WAY UNDER THEIR PROTECTION AND UNDER THE SAME RULES THAT THEIR EMPLOYEES ARE TO ABIDE BY. THE ISSUE IS MANAGEMENT OF RISK & LIABILITY.
Since 9/11/2001 ACCESS TO AND AROUND THE NATION’S TRANSPORTATION INFRASTRUCTURE HAS ONLY GOTTEN MORE DIFFICULT. WITH RAILROADS BEING THE SAFEST WAY TO SHIP HAZARDOUS BULK MATERIALS & LADING, RAILROAD RIGHTS OF WAY HAVE BECOME SECURITY ZONES. RAILROADS HAVE HAD TO ADJUST TO THE TIMES.

FRA/ USDOT STATES:NEW YORK• It is unlawful in New York for anyone other than a
railroad employee in the performance of their duties to walk upon the tracks of any railroad.
• AS OF 1-16-12 the NY Statute got even tougher on all• ARTICLE 140 includes:• Section 1 – Personal Trespass on RR Property• Section 140.10 of the Penal Law is amended to prohibit trespassing by individuals on foot on all RR property
statewide• Previously, this section only applied to RR property located in NYC, Long Island and Monroe County• The penalty for violating this section is a Class B Misdemeanor, punishable by a maximum three months jail and
a $500 fine

Response to NEW YORK Statutes:
• IF the surveyor is there without the knowledge and permission of the railroad, he/she is a trespasser at the federal level under 49 CFR 214….You can only be a roadway worker, an operating employee or a trespasser under the federal regulations (no exceptions shown in the rule)
• What qualifies him as a “roadway worker” under 49CFR214 ? (NOT Railroad Rules qualified, no evidence of annual training by a railroad common carrier)
• Homeland Security issue / you became a threat to Interstate Transportation? (like RailFans?)
• OSHA has limited jurisdiction on RR R/W, FRA assumes lead role (If no OSHA rule, FRA rule then holds where appropriate.) Injury on RR R/W becomes a railroad statistic.)

• A railroad corporation in New York shall no be liable for any injury to an passenger wile on the• platform of a car, on in any baggage, wood or freight car, in violation of the printed regulations of

• No person other than those connected with or employed by the railroad shall walk upon on along the track or tracks, except where the tracks are laid across or along streets or highways, in which case he shall not walk upon the track unless crossing the same.
• It is also unlawful for any person to ride, lead, or drive any horse or other animal upon any railroad,• or within the fences and guards, other than at a farm or street or forest crossing, without consent. If• convicted, a person shall forfeit to the people of the state the sum of ten dollars, and pay all

Information on New or Modified Crossings•The ONLY arbiter of what crossing is public or private in NEW YORK is NYDOT-Railroad Engineering & Safety Section under its application/ decision process.
(You cannot turn a private crossing into a public crossing w/o STATE AGENCY OVERVIEW!!!)
•The ONLY agency that can permit placement of, change width of or dictate change type of crossing protection of a public crossing is the NYDOT Railroad Section. •The State DOTs now administers the DOT Crossing Number database for New York (Issues new numbers and does record corrections, not the railroads)

NEW YORK APPLICATION OF STATUTE:
• The commissioner and the New York Department of Transportation (NYDOT) have statutory authority to order the construction of new crossings and alterations to existing ones. The statute does not specifically mention authority for closure of existing crossings.
• New York Railroad Law Sections 88, 89, 93-96 • Under NY Railroad Law, the Department has regulatory authority for grade
crossing safety over all public highway-railroad grade crossings in New York as well as private crossings along intercity (Amtrak) and commuter railroad (Metro-North Railroad and Long Island Rail Road) corridors. The Grade Crossing Safety and Regulation Section assists in managing the regulatory process.

MARYLAND STATUTEThe Maryland State Highway Administration (SHA) has general authority to abandon, relocate, construct, or reconstruct any railroad grade crossing or railroad grade separation that is dangerous or inconvenient for public travel. If the railroad-grade crossing is dangerous or inconvenient for public travel, SHA may construct a railroad grade separation. Md. Ann. Code art. 8 § 640(b)(2) (Michie 1998).
The Maryland secretary of transportation has general authority to approve the construction or modification of a railroad grade crossing or a change of crossing protection equipment and to impose conditions necessary to insure public safety at the crossing. No other approval, safety condition, or protective measure may be required by any public authority.
Except for an industrial track spur or siding, a railroad may not construct, reconstruct, improve, widen, relocate, or otherwise alter a railroad grade crossing over a state, county, or municipal highway, except in Baltimore City or over a private road, or change the crossing protection at such a crossing unless approved by the secretary.This same section provides that a person may not construct, reconstruct, improve, widen, relocate, or otherwise alter either a railroad grade crossing over a public highway or a private road over a railroad or change the crossing protection at such a crossing unless approved by the secretary. Md. Ann. Code art. 8 § 639 (Michie 1998).

PENNSYLVANIA STATUTE • The Pennsylvania Public Utility Commission has exclusive authority to eliminate highway-rail
grade crossings. After due notice and proper hearing to all parties in interest, the commission may order any crossing relocated, altered, suspended, protected, or abolished.
• Upon a finding of immediate danger to the safety and welfare of the public, the commission may order an immediate alteration, improvement, or suspension. Any order for suspension must include the following for protection of the motoring public:
•• 1. Removal or covering of crossing warning devices.• a) Paving over the tracks.• b) Removing the tracks and paving over the area formerly occupied by the tracks.• c) Barricading the crossing.• Within a township, borough, or city, the Court of Quarter Sessions of the county may close a
crossing upon petition of the railroad company and declare as a public highway any over grade or under grade substitution that is to then be maintained by the proper authorities. Pa. CONS. STAT. §2702 (1999). Also see 32 Pa. Code § 33.31.

DELAWARE:The Delaware Department of Transportation has the authority to order the closing

NEW YORK:
• The power to order creation or elimination of a highway-rail crossing lies with the commissioner of transportation.
•• Any railroad company or governing body of a municipality that contains a highway-rail crossing
can petition the commissioner to institute grade crossing elimination procedures.•• The commissioner may hold public hearings on any elimination requested by petition after giving
due notice to the parties in interest. At the conclusion of the hearing, the commissioner shall, by order, determine whether it is in the public interest to require the elimination of the highway-rail grade crossing. In any elimination order, the procedures for elimination are to be specified. N.Y. [Transp.] Law § 222 (McKinney 1999).

• NEW YORK RAILROAD LAWS – SECTION 52• Section 52-a: Fences along road operated by electric third rail• Notwithstanding the provisions of section fifty-two or of any other law, general or special, within a
city containing a population of over one million inhabitants according to the last preceding federal census or state enumeration, every railroad corporation operating a railroad deriving its motive power in whole or in part from an electrified third rail shall erect and thereafter maintain a fence or fences along the boundary line of its right of way contiguous and adjacent to a public highway running generally parallel to or terminating at such boundary line whenever the commissioner of transportation after a hearing on notice to such railroad corporation shall determine it to be necessary for the public welfare and shall by order so direct. The order of the commissioner of transportation may prescribe the height, length, materials and design of such fence or fences.

Be aware of older clearances being “grandfathered – in”…if you add to a structure, you design to the current regulation and often must adjust the older grandfathered sections, including fences & gates .
Be aware that in curves, the clearances are greater because of car overhang. You are protecting men on the side of a railcar.

• The private surveyor’s challenge is to find copies of these documents, usually from the land-owner.
• Most railroads will only release copies of their contract documents unless there is a request from the licensee. (Privacy and confidentiality issues) ….Those railroad contract numbers found in research are often “gold”.
• Title lawyers and real estate people/ landmen are famous for overlooking having contracts assigned.
