Amending Synthetic Drug Control Act 1 2 3 Summary 4 Amends ineffective law that simply address the problem of synthetic drugs by passing legislation to make 5 specific chemical formulations of synthetic drugs illegal. These specific chemical formulations become 6 dated quickly. This bill goes after broad base formulations that create or mimic the effect of cannabis or 7 certain controlled substances and thereby helps law enforcement to stay ahead of criminal drug activity. 8 Additionally it addresses weakness in the Analog statute that allows clever distributors to cloak products 9 with an innocuous name in order to insulate themselves by marking packages: “Not For Human 10 Consumption.” 11 12 Model Legislation 13 14 Section 1. Short Title. Amending Synthetic Drug Control 15 16 Section 2. Purpose. Adds various synthetic drug compounds including various structural classes of those 17 compounds to the list of Schedule I controlled substances. Deletes from the definition of controlled 18 substance analog the requirement that a substance must be intended for human consumption to be 19 considered an analog of a controlled substance with a chemical structure substantially similar to that of a 20 controlled substance in Schedule I or II, or that was specifically designed to produce an effect substantially 21 similar to that of a controlled substance in Schedule I or II. 22 23 Section 3. Definition. 24 (f) "Controlled Substance" means (i) a drug, substance, or 25 immediate precursor, or synthetic drug in the Schedules of 26 Article II of this Act or (ii) a drug or other substance, or 27 immediate precursor, designated as a controlled substance by 28 29 the Department through administrative rule. substances having a stimulant effect on the central nervous 529 system, including its salts, isomers, and salts of isomers: 530 (1) Fenethylline; 531 (2) N-ethylamphetamine; 532 (3) Aminorex (some other names: 533 2-amino-5-phenyl-2-oxazoline; aminoxaphen; 534 4-5-dihydro-5-phenyl-2-oxazolamine) and its 535 salts, optical isomers, and salts of optical isomers; 536 (4) Methcathinone (some other names: 537 2-methylamino-1-phenylpropan-1-one; 538 Ephedrone; 2-(methylamino)-propiophenone; 539 alpha-(methylamino)propiophenone; N-methylcathinone; 540 methycathinone; Monomethylpropion; UR 1431) and its 541 salts, optical isomers, and salts of optical isomers; 542 (5) Cathinone (some trade or other names: 543 2-aminopropiophenone; alpha-aminopropiophenone; 544 2-amino-1-phenyl-propanone; norephedrone); 545 546 (6) N,N-dimethylamphetamine (also known as: 547 N,N-alpha-trimethyl-benzeneethanamine; 548 N,N-alpha-trimethylphenethylamine); 549 (7) (+ or -) cis-4-methylaminorex ((+ or -) cis- 550 4,5-dihydro-4-methyl-4-5-phenyl-2-oxazolamine); 551 (8) 3,4-Methylenedioxypyrovalerone (MDPV). 552 (g) Temporary listing of substances subject to emergency 553 scheduling. Any material, compound, mixture, or preparation 554 that contains any quantity of the following substances: 555 (1) N-[1-benzyl-4-piperidyl]-N-phenylpropanamide 556 (benzylfentanyl), its optical isomers, isomers, salts, 557 and salts of isomers; 558 (2) N-[1(2-thienyl) 559 methyl-4-piperidyl]-N-phenylpropanamide (thenylfentanyl), 560 its optical isomers, salts, and salts of isomers. 561 (h) Synthetic cathinones. Unless specifically excepted, 562 any chemical compound not including bupropion, structurally 563 derived from 2-aminopropan-1-one by substitution at the 564 1-position with either phenyl, naphthyl, or thiophene ring 565 systems, whether or not the compound is further modified in one 566 or more of the following ways: 567 (1) by substitution in the ring system to 568 any extent with alkyl, alkylenedioxy, alkoxy, 569 haloalkyl, hydroxyl, or halide substituents, whether 570 or not further substituted in the ring system 571 by one or more other univalent substituents. 572 573 Examples of this class include, but are not 574 limited to, 3,4-Methylenedioxycathinone 575 (bk-MDA); 576

(2) by substitution at the 3-position 577 with an acyclic alkyl substituent. Examples of 578 this class include, but are not limited to, 579 2-methylamino-1-phenylbutan-1-one 580 (buphedrone); or 581 (3) by substitution at the 2-amino nitrogen 582 atom with alkyl, dialkyl, benzyl, or methoxybenzyl 583 groups, or by inclusion of the 2-amino nitrogen atom 584 in a cyclic structure. Examples of this class include, 585 but are not limited to, Dimethylcathinone, Ethcathinone, 586 and a-Pyrrolidinopropiophenone (a-PPP). 587 (Source: P.A. 97-192, eff. 7-22-11; 97-193, eff. 1-1-12; 588 97-194, eff. 7-22-11; 97-334, eff. 1-1-12; 97-813, eff. 589 7-13-12; 97-872, eff. 7-31-12; 98-987, eff. 1-1-15.) 590 591 Sec (Regarding Manufacture or Delivery of Controlled Synthetic drugs). 401. 592 Except as authorized by this Act, it is unlawful 593 for any person knowingly to manufacture or deliver, or possess 594 with intent to manufacture or deliver, a controlled substance 595 other than methamphetamine, a counterfeit substance, or a 596 controlled substance analog. A violation of this Act with 597 respect to each of the controlled substances listed herein 598 constitutes a single and separate violation of this Act. For 599 purposes of this Section, "controlled substance analog" or 600 "analog" means a substance which is intended for human 601 consumption, other than a controlled substance, that has a 602 chemical structure substantially similar to that of a 603 controlled substance in Schedule I or II, or that was 604 specifically designed to produce an effect substantially 605 similar to that of a controlled substance in Schedule I or II. 606 Examples of chemical classes in which controlled substance 607 analogs are found include, but are not limited to, the 608 following: phenethylamines, N-substituted piperidines, 609 morphinans, ecgonines, quinazolinones, substituted indoles, 610 and arylcycloalkylamines. For purposes of this Act, a 611 controlled substance analog shall be treated in the same manner 612 as the controlled substance to which it is substantially 613 similar. 614 615 Sec. 402 (Regarding Possession of Controlled Synthetic Drugs). 616 Except as otherwise authorized by this Act, it is 617 unlawful for any person knowingly to possess a controlled or 618 counterfeit substance or controlled substance analog. A 619 violation of this Act with respect to each of the controlled 620 substances listed herein constitutes a single and separate 621 violation of this Act. For purposes of this Section, 622 "controlled substance analog" or "analog" means a substance 623 which is intended for human consumption, other than a 624

controlled substance, that has a chemical structure 625 substantially similar to that of a controlled substance in 626 Schedule I or II, or that was specifically designed to produce 627 628 an effect substantially similar to that of a controlled 629 substance in Schedule I or II. Examples of chemical classes in 630 which controlled substance analogs are found include, but are 631 not limited to, the following: phenethylamines, N-substituted 632 piperidines, morphinans, ecgonines, quinazolinones, 633 substituted indoles, and arylcycloalkylamines. For purposes of 634 this Act, a controlled substance analog shall be treated in the 635 same manner as the controlled substance to which it is 636 substantially similar. 637 638 Section 5.
