1 Chicago Title – North Carolina October 2017 Overview of the ALTA Commitment for Title Insurance (Adopted 08012016) ALTA Commitment Form 80116 (herein 2016 ALTA Commitment) was adopted by ALTA (American Land Title Association) with an effective date of August 1, 2016. It has been filed with the NCDOI (North Carolina Department of Insurance) and is approved for use in North Carolina. Chicago Title – NC anticipates beginning to issue this form as its sole commitment form in October of 2017. ALTA is scheduled to decertify the 2006 ALTA Commitment in December of 2017. ALTA Commitment Form 61706 (herein 2006 ALTA Commitment) has been in use by Chicago Title – NC for approximately 10 years.

ALTA Commitment Form 8‐01‐16 (herein 2016 ALTA Commitment) was adopted by ALTA (American Land Title Association) with an effective date of August 1, 2016.  It has been filed with the NCDOI (North Carolina Department of Insurance) and is approved for use in North Carolina.  Chicago Title – NC anticipates beginning to issue this form as its sole commitment form in October of 2017.

The Notice prominently placed at the top of the jacket of the 2016 ALTA Commitment is considered the most significant revision to the commitment form.

ALTA is addressing two major goals:  • First, it wanted to make it clear that a commitment was only for insuring the title as it is 

described in the commitment.  It is not an abstract or opinion of title.  • Second, the Committee wanted to clarify a Company’s liability if a Proposed Insured 

suffered a loss as a result of reliance on an erroneous matter in the Commitment when it is issued.  

Commitment to Issue Policy

Commitment is not effective until the identity of the Proposed Insured and the Proposed Policy Amount are added to Schedule A.

Schedule A ‐ Proposed Policy Amount Not Known at Commitment Issuance

If the Proposed Policy Amount is not known at the time of commitment issuance, Chicago Title will include an estimated amount.  The minimum preliminary amount that will be used is $10,000.00.

The Commitment will include the following Requirement:

The Proposed Policy Amount(s) must be increased to the full value of the estate or interest being insured, and any additional premium must be paid at that time.  An Owner’s policy should reflect the purchase price of the Land.  A Loan Policy should reflect the loan amount.  Proposed Policy Amount(s) will be revised and premiums charged consistent therewith when the final amounts are approved.

Chicago Title will not provide an invoice that includes premium charges based on a preliminary coverage amount inserted by Chicago Title.

The invoice will be provided when the customer has provided Chicago Title with the actual proposed coverage amount(s).

Schedule A ‐ Proposed Insured Not Known at Commitment Issuance

If the Proposed Insured is not known at the time of commitment issuance, Chicago Title will include TBD, LLC, as the name of the Proposed Insured.

TBD, LLC, is a valid North Carolina limited liability company.

Company must be provided with the name(s) of the actual Proposed Insured(s) for the transaction to be insured (i.e., not "TBD, LLC,”) in writing prior to closing and this Commitment revised to reflect that information.  TBD, LLC, will NOT take title, represent or become agent for any party on any matter, handle any funding, or become the Insured.  The Company may include additional Requirements or Exceptions in the revised Commitment including the following if the actual Proposed Insured(s) is/are an entity/entities:  Verification as of closing of (1) the due organization and good standing of the actual Proposed Insured(s) (herein "Entity") in its state or country of organization and (2) authority of individual(s) executing documents on behalf of Entity to enter into the transaction to be insured on its behalf.
