Chapter IIObject and scope of the Policy

Article 1. COVERAGE PROVIDEDBY THE COMPANY

The Company guarantees payment ofthe benefits established to compensateinjury to the insured interest, with alimit of the limits established for eachinsured risk or item, araising from:

A) INSURED RISKThe repair of material damages toinsured items or, where applicable,replacement thereof when theydisappear or are destroyed as a directconsequence of:1. Fire.2. Internal or external explosion.3. Lightning.4. Smoke.5. Electrical phenomena:

a) short-circuitsb) power surgesc) lightning induction

6. The action of water:a) Leakage caused by burst pipes or

accidental breakage of fixedapparatuses or tanks (aquariumsincluded).

b) Overflows caused by accidentalblockage of these same pipes,apparatuses or tanks.

c) Overspills caused by saturation,reflux or accidental leakage fromthe public sewer or watertransportation system, providedthat these are not caused by the

accumulation of rainwater.d) Flooding caused by overflowing of

canals and other artificial watercourses.

e) Leaking through roofs.f) Filtration from neighbouring

houses or premises.g) Failure to turn off taps or stopcocks.

7. The action of:a) Galesb) Hailstormsc) SnowstormsProvided that such weatherphenomena also cause damage toother constructions, trees or otherforms of property within a 500 meterradius and not only to the insureddweeling.

8. Frosts.9. Impact:

a) Fall of aircrafts.b) Crash of land vehicles.c) Collision with items or animals not

forming part of the insured risk.d) The fall of trees and lampposts

located inside the insuredproperty, solely when producedby storms as described in thepreceding paragraph 7.

e) Sonic waves.10. Total destruction of the building, as a

direct consequence of work carriedout by third parties on adjacentproperties or public works carriedout on adjacent streets or thesubsoil.

11. Breakage, exclusively insofar as itaffects the Insured's:a) smooth glazing and mirrors, both

if they are part of the domestic

furniture or part of the insuredbuilding, but never other types ofobjects of the same material,either for ornamental or everydayuse.

b) marble or other natural orartificial stones, also smooth, thatare part of the insured domesticfurniture, but not including otherobjects created from these samematerials, whether for ornamentalor everyday use.

c) bathtubs, wash-basins, showertubs and bathroom furnituremade from earthenware, glass,acrylic or marble or other naturalor artificial stones that are part ofthe insured building.

d) ceramic glass hobs that are part ofthe insured domestic furniture.

e) cooking tops of marble or othernatural or artificial stones notintegrated into kitchen furniture.

12. Vandalism.13. Rotting affecting food stored in

fridges in the following circumstances:a) Breakdown of the apparatus.b) Leakage of cooling gas.c) Interruption in the electricity

supply.14. Measures taken by the Authorities

during the occurrence of a claim tolimit its extension or propagation.

15. Rescue measures, taken during theoccurrence of a claim to limit thedamage.

16. Coverage of expenses incurred as aresult of the claim due to:a) The intervention of the Fire

brigade.b) Demolition, waste and removal of

debris, after the claim has takenplace.

c) Rescue, transfer and safeguardingof domestic furniture, valuableobjects and jewellery affected by

the claim.d) Temporary housing for the Insured

and his/her family.e) The simple material reproduction

of duplicates of personaldocuments and computer files,without taking into account theirpossible commercial, affective,intellectual, artistic,representative or indirect valuenor the creative work carried out,where applicable, by the Insured,members of his/her family or thirdparties dependent on the latter.This insurance does not coverdocuments or computer filesrelating to the professionalactivities of the Insured, membersof his/her family or third partiesdependent on the latter.

f) Cleaning.g) Finding water leaks.h) Repair of the part of water

conduits or tanks causing the leak.i) Installation of new windows and

smooth glazing, marble or othernatural or artificial stones - alsosmooth - and bathroom furniture,following breakage thereof.

j) Loss adjustment for extraordinaryclaims covered by the InsuranceCompensation Consortium.

k) The intervention of the Architectand Architectural Technician forthe planning and supervision ofthe repair or reconstruction of theBuilding.

l) Obtaining of the municipallicenses and permits required forthe repair or reconstruction of theBuilding.

17. The loss of rental income by theInsured for the duration of theenforced vacation of the building byits tenants due to a claim and for amaximum of twelve months.

B) NOT INSURED RISKThe repair or replacement of items dueto material damage, destruction ordisappearance due to:1. Causes other than those specifically

indicated above as covered.2. Serious and manifest deficiencies in

the conservation of the damageditems or those causing the claim.

3. The steady and gradual action ofdamp and smoke.

4. Direct effects of weather phenomenaon garden plants and trees.

5. Simple scratching, chipping,cracking, warping, fading, stains andsimilar aesthetic defects, includingpaintwork on façades, and wear andtear.

C) BENEFITS PROVIDED BY THE INSURERIN THE EVENT OF CLAIM1. Loss adjuster's evaluation of the

material damages or destroyed items.2. The payment of invoices for the

repair of damage, as evaluated by aloss adjuster, to the insured items.

3. Compensation for the insured valueof the destroyed items, in accordancewith the evaluation of the lossadjuster.

4. Payment of invoices for expensescovered.

5. Compensation for loss of rentalincome caused.

D) INSURABLE PROPERTIES1. Domestic Furniture

The total of:a) All furniture, including glazing

and marble or other stones,whether natural or artificial,forming part of the same.

b) All mirrors, either wall-mountedor forming part of furniture.

c) All fixed furniture, such as those in

the kitchen, bathroom or the doors,linings and shelves of built-inwardrobes, including glazing andmarble or other natural orartificial stones forming part ofthe same.

d) All domestic appliances, whetherfixed or mobile.

e) All sound and vision equipment;personal computers.

f) All fixed utility apparatuses andinstallations: water, gas, electricity,heating, solar energy, cooling,waste system, telephone, radio,television and othercommunications, alarms, thoughnot fixed conduits built into theconstruction, which areconsidered as the Building.

g) All clothes and personal items.h) All domestic furnitures.i) All decorative or ornamental

objects.j) Tools, utensils and other equipment

for DIY or gardening.k) All supplies, provisions and fuel for

domestic use.l) All personal documents.

2. Restoration of the aesthetic unitCoverage of the greater cost causedby the claim for restoration of theaesthetic unit, due to thenon-existence of items like thosedamaged, when it is necessary tomaintain as far as possible theuniform appearance of a set offurnitures or other components ofthe domestic furniture, all of whichare located in a single room.However, restoration of the aestheticunit does not refer to and hence,does not provide coverage for, thecost of replacement of pieces fromcollections or sets of items requiredto complete a set, such as, for

instance, volumes of a literary ormusical work or collection, pieces of acutlery set or dinner service, elementsof a series of paintings or figurines andsimilar situations of incomplete seriesof objects from any type of collectionor set.

3. Professional furnitureAll furniture, furnishings, utensils,apparatuses, documentation orsample collections used in theperformance of a liberal profession.

4. MoneyThe total of:a) All cash and bank notes.b) All cheques, if they are

transformed into money after theclaim.

c) All credit cards, if usedfraudulently after the claim andbefore the Insured cancels them, inaccordance with the terms andregulations of the Issuer of thecards.

5. Valuable objectsThe total of the following items,provided that their unit value isgreater than 3.000 €.a) Silver objects.b) All fur.c) All collections.d) All paintings or other works of art.The unit value is considered to be, inaddition to that of the individualobjects, the value of series thatnaturally constitute a set, such as asilver cutlery set or collection ofcoins.

6. JewelleryThe total of:a) All jewellery, gems, precious

stones.

b) All gold and platinum objects.

7. BuildingThe total of:a) All foundations, structure, walls,

roof, floor, doors, windows, lifts,goods elevators and otherconstruction elements, includingglazing, marble or other stones,whether natural or artificial, andbathroom furniture made fromearthenware or acrylic, of:1. The home.2. Any outbuildings, such as

garages, parking spaces, storagepremises and similar, located inthe property.

b) The walls, including retainingwalls and other enclosures of theproperty separate from thebuilding.

c) All fixed utility conduits built intothe construction: water, gas,electricity, heating, cooling system,drainage, telephone, television oramateur radio antennas and othercommunications, though notinstallations and apparatuses,even if fixed, such as the boiler forcentral heating and radiators,which are considered PersonalFurniture.

d) All swimming pools and otherfixed recreational installations.

e) All fixed decorative elements ofthe buildings, such as paintwork,parquet, carpets, wallpaper or thestructure of built-in wardrobes.

f) All trees, fountains, lamp posts andother fixed elements of thegarden.

g) The corresponding part ofcommon elements, in the event ofa joint-ownership system.

The legal management in the event ofclaims made by the injured party,with payment of the correspondinglawyers' bills and expense invoicesaccredited by the Lawyers andSolicitors designated by the Company.As such legal management isestablished in Article 74 of Law 50/80on Insurance Contracts, only in theevent of conflict of interest, whichthe Company shall report immediatelyto the Insured, may the latterdesignate an individual to deal withhis/her legal management; this is theonly case in which the Company willbe held liable - up to the establishedeconomic limits - for payment oflawyers' bills and expense invoices

2. Electrical emergenciesDue to lack of electricity as a result ofbreakdown in the fixed installationsof the Building.

3. Security emergencies

Due to the home having been left witheasy access to its interior as a result offire, explosion or theft.

4. Locksmith emergenciesa) Due to inability to access the home

as a result of loss or theft of thekeys, and due to inability to usethe lock. Due to loss or theft of aset of keys that are identified andwould enable anybody who foundthem the access to the home.

5. Emergency replacement of TV andvideoDue to the impossibility of using theTV or video appliances of the Insured,as a result of a claim covered by thepolicy.

6. Sending of emergency messages.

B) BENEFITS PROVIDED BY THE INSURER1. The existence and operation of a

24-hour helpdesk, open every day ofthe year, by which the Insured mustrequest the services covered.

2. The organisation and maintenanceof a call-out service able to providethe services covered.

3. The performance, either through itsown means or those of third parties,of the services covered.

4. Plumbing and electricity servicesinclude travelling expenses andlabour, but not spare parts and othernecessary materials.

5. Locksmith services include travellingexpenses, labour, spare parts andother necessary materials.

6. Security services include travellingexpenses and presence of qualifiedstaff for a maximum of 48 hours.

7. In the case of replacement of TV andvideo, the service includes delivery,free use of the appliance for amaximum of 15 days and collectionof the same.

blinds, carpets, parquet, upholsteryand varnishing.

6. Antennas and intercoms.7. Domestic appliances, televisions and

videos.8. Building work, plastering, and work

B) BENEFITS PROVIDED BY THE INSURER1. The existence and operation of a

helpdesk, open 24 hours a day 365days a year, by which the Insuredmust request the services covered.

2. The organisation and maintenanceof a call-out service able to providethe services required.

3. The dispatch, to the address of theInsured, of the professional requested.

4. The payment of expenses incurredfor the first call-out of theprofessional to the insured home.

5. The payment of invoices for therepair or replacement covered, whenthe intervention of the professionalis due to a claim covered by thepolicy, in accordance with thatindicated in the preceding sectionsof this Chapter.

6. In all other cases, intervention of theprofessional will be chargeable tothe Insured.

7. In all events the Company providesthe Insured with a three-monthguarantee for work carried out byprofessionals supplied by it.

8. All emergency services will be carriedout as soon as possible.

9. All non-emergency services will becarried out, where possible, on thesame day, provided that it is aworking day and that the telephonecall was made before 6:00 pm.

4. Claim for conflicts concerningeasement, limits and party walls of theBuilding.

5. Claim for third-party breach ofcontracts for trading, deposits andsimilar that affect the domesticfurniture.

6. Conflicts with the Community ofProperty Owners, except for thoseconcerning fee debits.

7. Conflicts deriving from rentalcontracts, when the Insured is atenant of the home, except when thelatter is taken to court for failure topay the rent.

8. Defence of penal liability as amember of the Board of Co-owners ofthe Community of which the Owner ofthe Building forms part.

9. Defence against claims made bydomestic staff registered under theSocial Security system.

10. Defence of alleged administrativeinfractions related to the homeinsured till wear out theadministrative action, but no enteringthe legal action.

B) BENEFITS PROVIDED BY THE INSURER1. The existence and operation, from

9:00 am to 2:00 pm and from 4:00pm to 6:00 pm, Monday to Friday, ofa helpdesk through which the Insuredcan make queries and receive theinsured legal advisory service.

2. The organisation and maintenanceof a call-out service able to providelegal advice and protection covered.

3. The technical and legal managementof legal protection, though the Insuredis free to choose his/her lawyer andsolicitor who, in which case, shall notbe subject to the instructions of theCompany.

4. The exercise of judicial andextrajudicial actions for claims.

5. The payment of fees and expenses forclaims action taken, in accordancewith the regulations and scales ofthe corresponding professionalassociations.

C) THE INSUREDThe following are considered Insured:1. the head of household and his/her

spouse or common-law marriagepartner.

2. the ancestors of both partners who liveat the home of the policyholder.

3. the single children who live with thehusband and wife and are not 23 yearsold or above.Children who due to studies or healthreasons are temporarily living outsideof the policyholder's home in Spainshall also be considered insuredparties.

A) INSURED INTERESTThe availability for the Insured of aMedical Guidance Helpline which he/shecan call to consult a doctor on thefollowing matters:1. Basic information on clinical aspects,

diagnoses and treatment options forailments or illnesses that have beendiagnosed in relation to the Insured.

2. General guidance on the public andprivate health care systems that aremost appropriate for solving thehealth problems of the Insured.

3. Simple health education advice tohelp increase the effectiveness of thetreatment prescribed by the doctor.

4. Solving any possible queries thatmay arise in following the treatmentrecommended by the doctor, onadministrative regulations or possibleside effects of the medicinesprescribed by him/her.

This is a telephone service that does notreplace the medical checkup itself, withconsultation meaning the directpatientdoctor relationship that is essentialfor making proper diagnoses andtreatments, thus fulfilling establishedregulations that expressly prohibitmedical consultations by telephone.Neither is this an emergency service andit cannot be compared to the currentlyavailable emergency hotlines(061,112,092, etc.).

B) BENEFITS PROVIDED BY THE INSURERThe availability and operation, 24 hoursa day, 365 days a year, of a call-outservice for the Insured to make queriesand receive a reliable medical guidanceservice.

with eating them.e) Companionship and walks.f) Transport.g) Shopping and administrative

A) INSURED RISKThe availability for the Insured of asupport network which is equipped toprovide him/her, either on the telephoneor via the Internet using a chat-controltool, the following services relating tothe use of the Insured's personalcomputer/s in the insured dwelling:1. Technical support for solving

computer problems in the event of themalfunction of any of the applicationsor systems for which this service isprovided.

2. Interactive assistance in usingapplications, essentially those relatingto the Office suite, email, Internetbrowsing, antivirus, firewalls, graphictreatments and other commonly usedapplications, thus offering the Insuredon a basic online training service.

3. Configuration of equipment andapplications:a) Installation, start-up and use of the

equipment and applications forwhich this service is provided (see

section C).b) Change in the parameters of any of

the applications or systems forwhich this service is provided withthe aim of optimizing theiroperation.

c) Addition or removal offunctionalities.

d) Addition or removal of applications.4. Assistance with accessing and using

the Internet:a) Assistance with configuring the

Windows Internet connection.b) Assistance with the different means

of connecting to the Internet: RTC,ADSL, cable, WIFI, 3G or electricalnetwork.

B) NOT INSURED RISK1. Assistance for equipment or

programmes not covered by thepolicy and servers of any kind.

2. Incidents caused intentionally orthrough negligence of the Insured,and any incidents that cannot besolved exclusively by remote access tothe Insured's equipment, or bytelephone if the Insured does not wantor is unable to facilitate this access.Under no circumstances does theInsurer guarantee that the incident

can be definitively resolved.3. Incidents relating to software for

which the Insured does not have theofficial licence, and likewise itsupdates.

4. Any software updates that are not freeand are necessary for the assistance tobe provided.

5. Support for specific developments onMicrosoft Office Suite products(Outlook, Outlook Express, Word,Excel, Access, PowerPoint, FrontPage).

6. Assistance with applications, devicesand equipment that is not mentionedin this policy.

7. Activities for which the Insured doesnot have the CD-ROM with the originalsoftware of the application or system,and it is not possible to download itfree from the Internet at the time theassistance is requested.

8. Damages resulting from theinappropriate use by the Insured ofthe systems, applications or softwareinstalled for the remote access of thetechnical assistance referred to in thispolicy.

9. Requests for assistance that cannot befulfilled or are delayed as a result offorce majeure or unexpectedcircumstances, particularly failures inthe transmission of IP packets, powercuts or any other exceptional measuretaken by the administration orgovernment authorities, including civilor foreign war, whether declared ornot, riots, public uprisings, terrorism orany kind of official prohibition.

10. Under no circumstances will theInsured be offered any kind ofreplacement software.

C) APPLICATIONS AND SYSTEMS COVERED1. Operating Systems: all those of

Windows.2. Hardware: PC, monitors, external

storage devices, webcams, printers,PSD, scanners. The assistancedescribed above shall apply to Intel orAMD workstations with MS Windowsoperating systems

4. Internet programmes: InternetExplorer, Netscape Navigator (whichno longer exists), Mozilla Firefox,Opera, Chrome, Safari, Outlook andOutlook Express, Eudora, MSNMessenger and Yahoo Messenger.

5. Multimedia programmes: Acrobat,Windows Media Player, Real Audioand the main codecs on the market.

6. Data compressors: WinZip, WinRar.7. Copiers: Nero.8. Peer-to-peer: Emule, Kazaa, eDonkey.9. Antivirus and Firewalls: Panda, Norton,

Symantec, McAfee.10. Management of drivers in any of the

abovementioned devices11. Other: the main PC/PDA synchronizers

on the market.The Insured should be in possession of therelevant licences for using the computerprogrammes for which assistance is beingsought.

D) BENEFITS PROVIDED BY THE INSURERThe availability and operation, from8.00 am to midnight, Monday to Friday,and from 10.00 am to 8.00 pm onSaturdays, Sundays and national publicholidays, of a central switchboard, awebsite www.allianz.es/ecliente/ and atelematic platform (chat control tool)through which the Insured can makequeries and/or ask for the insured servicesto be provided.In the case of telematic assistance(Internet), a technician may take controlof the equipment to provide the service,always subject to the prior authorizationof the Insured.

F) RESPONSIBILITY AND CONFIDENTIALITYThe Insurer shall not be responsible forany loss of information, including butnot limited to personal, professional orany other type of information held ondatabases, shared files or any otherapplication on the computer equipmentfor which assistance is being sought.All the information to which thetechnicians providing the service havemay access to will be treated incomplete confidence by the Insurer.The Insured guarantees that he/she isthe owner of the applications and thelegitimate owner of the rights to anyfiles and content on his/her computer.

1. 9. Data recovery

A) INSURED RISKThe recovery of information from thedata storage devices belonging to theInsured and located in the insureddwelling that sustain physical damage(fire, water or accident, amongst others)or logical damage (virus, inappropriateuse or human error, amongst others) thatprevent access to the information on thedamaged support.Data storage supports for which theservice may be requested:1. Hard disks (of desktop and laptop

computers) such as: IDE, E-IDE, ATA,S-ATA, ACSI, 2.5" laptop disks (laptopand notebook), Ultra-SCSI, Wide SCSI,SCA80, tapes and tape cartridges(DLT, SDLT, DLTIII, DLTIV, DDS4,DDS5).

2. Portable memories: Floppy (diskettes,LS 120 diskette), Jaz, Zip, CD-ROM,

DVD, DVD-R, DVD+R, DVD-RW.3. Memory cards: Flash, Smart Card,

Memory Card, Smart Media, MemoryStick, Microdrive, PCMCIA.

4. Other storage systems: DVD/videorecorders or media center (hard disk);video cameras, cameras, PDA orsimilar systems (memory cards).

B) NOT INSURED RISK1. Recovery from supports that do not

belong to the insured property'spolicy.

2. Recoveries from storage supports thathave been manipulated before beingdelivered to the Insurer for recovery.

3. Recovery of original films, CDs, games,etc.

4. Recovery of multiple-disk systemssuch as RAID.

Recovery is impossible in the cases ofdisappearance of the support, damagewith acid or similar products, overwritingor "Head-Crash" (loss of the magneticstrip).

C) BENEFITS PROVIDED BY THE INSURER1. The availability and operation, from

8.00 am to midnight, Monday toFriday, and from 10.00 am to 8.00pm on Saturdays, Sundays andnational public holidays, of a centralswitchboard which the Insured cancall to request the insured services.

2. Transport of the damaged supportfrom the home of the Insured to thedata recovery lab.

3. Evaluation and diagnosis of thedamaged support.

4. Recovery of the data, if at all possible.The repair of Office files, compressedfiles and email will require the writtenauthorisation of the Insured, whoshould also confirm that he/she is theowner of their contents.

5. New support of equal or better

characteristics than the damagedsupport, if this is not reusable, or DVD.

6. Transport of the support with therecovered information from the lab tothe home of the Insured named on thepolicy.

D) PROCEDURE FOR THIS SERVICE1. The Insured should ask for the Data

Recovery service by calling902.436.426 or visiting the Allianzwebsite www.allianz.es/ecliente/ .

2. The Insured should dismantle thedamaged support/s, for which he/shewill be given the relevant instructionsif necessary. If this is not possible, theInsured should ask for a technician tovisit (the cost of which is payable bythe Insured).

3. Wherever possible the support shouldbe sent in an anti-static bag, packed ina box double the size of the support,protected with bubble-wrap, foam orpadded paper and including, ifavailable, the special start-up disks,the passwords for accessing thesystem, the directories and theprograms necessary to execute thefiles that need to be recovered.

4. Once the damaged support has beenreceived, it will be immediatelyanalysed and diagnosed in order tostart rescuing the data on it.

5. Once the process of rescuing the datafrom the damaged support has beencompleted, the Insured will be sent therecovered information on a newsupport, at no extra cost to theInsured.

6. In order to protect against any lossduring the shipment of the support, aback-up copy of the recoveredinformation will be made and kept in asafe place. Once 15 days have elapsedsince the support was shipped to theInsured, the back-up copy will be

destroyed.

E) THE INSUREDThe owner of the insured items.

F) RESPONSIBILITY AND CONFIDENTIALITYThe Insurer cannot guarantee therecovery of the data and cannot be heldliable or required to pay compensationof any kind if the information on thesupport cannot be fully or partiallyrecovered.All the information to which thetechnicians providing the service havemay access to will be treated incomplete confidence by the Insurer.

Article 3. RISKS COVERED BYTHE INSURANCECOMPENSATIONCONSORTIUM

Clause for compensation by theInsurance Compensation Consortium forlosses arising from extraordinary eventsoccurring in Spain in property damageinsurance

In accordance with the provisions of thecodifying text of the legal Statute of theInsurance Compensation Consortium,approved by Royal Legislative Decree7/2004, of 29 October 2004, andamended under Law 12/2006, of 16 May2006, the party taking out an insurancepolicy on which they are under theobligation to pay a surcharge to theenterprise stipulated has the power toagree on cover for extraordinary risks withany insurance company that fulfils theterms and conditions of the governinglegislation.

Compensation deriving from claimscaused by extraordinary events occurringin Spain and which affect risks locatedtherein shall be paid by the InsuranceCompensation Consortium when theInsured has, in turn, paid the relevantsurcharges in its favour, and any of the

following situations should arise:a) That the extraordinary risk covered

by the Insurance CompensationConsortium is not covered by theinsurance policy taken out with theinsurance entity.

b) That, even though covered by thesaid insurance policy, theobligations of the insurance entitycould not be met due to its havingbeen declared in a state ofbankruptcy or it is subject to aprocess of intervened liquidation orthis has been assumed by theInsurance CompensationConsortium.

The Insurance Compensation Consortiumshall act in accordance with that set out inthe abovementioned Legal Statute, in theInsurance Contract Act 50/1980, dated 8October, in the Extraordinary RisksInsurance Regulations, approved by RoyalDecree 300/2004, dated 20 February, andin supplementary provisions.

I. Summary of legal rules

1. Extraordinary occurrences covereda) The following natural phenomena:

earthquakes and seaquakes,extraordinary flooding (includingbattering by waves), volcaniceruptions, uncharacteristic cyclones(including extraordinary winds withgusts over 120 kph and tornadoes)and the falling of meteorites.

b) Those caused violently as a result ofterrorism, rebellion, sedition, riotsand civil disturbance.

c) Acts by the armed forces and lawenforcement agencies in peacetime.

2. Excluded risksa) Those that do not qualify for

compensation under the Insurance

Contract Act.b) Those suffered by property insured

by an insurance contract different tothose in which the surcharge for theInsurance CompensationConsortium is compulsory.

c) Those caused by faults or defects inthe insured object, or by its manifestlack of maintenance.

d) Those produced by armed conflictseven though there has been no priorofficial declaration of war.

e) Those caused by nuclear energy,without prejudice to the provisionsof the Nuclear Energy Act 25/1964,dated 29 April. Notwithstanding theforegoing, all direct damage causedin an insured nuclear facility shall bedeemed to be included when it isthe consequence of anextraordinary event which affectsthe facility itself.

f) Those caused by the mere action oftime, and in the case of propertyeither partially or totallypermanently submerged, thatattributable to the mere action ofswell or ordinary currents.

g) Those caused by naturalphenomena other than thosereferred to in article 1 of theextraordinary risks insuranceregulations and, in particular, thoseproduced by rises in the level of thewater table, landslides or landsettling, rock falls or similarphenomena, except where these areclearly caused by the action ofrainwater which, in turn, has led toextraordinary flooding in the areaand they have occurred at the sametime as said flooding.

h) Those caused by tumultuous actsoccurring during meetings ordemonstrations carried out incompliance with the provisions of

the Freedom of Assembly OrganicAct 9/1983 dated 15 July, andduring the course of legal strikes,except where these acts may beclassified as extraordinary eventspursuant to article 1 of theextraordinary risks insuranceregulations.

i) Those caused by the bad faith of theinsured.

j) Those derived from claim eventsoccurring within the waiting periodlaid down in article 8 of theextraordinary risks insuranceregulations.

k) Those relating to claim events thathave taken place prior to thepayment of the first premium orwhen, in accordance with theprovisions of the InsuranceContracts Act, the cover of theInsurance CompensationConsortium is suspended or theinsurance is cancelled due tonon-payment of premiums.

l) Indirect ones or losses deriving fromdirect or indirect damage, otherthan business interruption asdelimited in the extraordinary risksinsurance regulations. In particular,this cover does not include damageor loss suffered as a result of cut offor alteration of the external supplyof electrical power, flammablegases, fuel oil, gas oil, or otherliquids, nor any other indirectdamage or losses other than thosecited in the previous paragraph,even when these alterations arederived from a cause included in theextraordinary risks cover.

m) Those claim events which, due totheir magnitude and gravity, areclassified by the nationalgovernment as a "nationalcatastrophe or disaster".

3. ExcessIn the case of direct damage (exceptmotor vehicles and homes and theircommunities), the excess to be paidby the insured shall be 7 per cent ofthe amount of the compensabledamage produced by the claim event.

In the case of cover for businessinterruption, the excess to be paid bythe insured shall be that set out in thepolicy for business interruption inordinary claim events.

4. Extension of coverCover of extraordinary risks shallextend to the same property andsums insured as have beenestablished in the policy for thepurposes of ordinary risks.Nevertheless, in policies which coverown damage to motor vehicles, theConsortium shall cover the entirety ofthe insurable interest even if the policyonly does so in part.

II. Procedure in case of a claim eventthat can be compensated by theInsurance Compensation Consortium

Should a claim event occur, the insured,policyholder, beneficiary or theirrespective legal representatives must,either directly or through their insuranceentity or insurance broker, report theoccurrence of the claim event, within a

maximum of seven days of it coming totheir knowledge, to the relevant regionaloffice of the Consortium, depending onwhere the claim event took place. Thisnotification should be made using theform provided for this purpose, which isavailable from the Consortium's website(www.consorseguros.es), its offices orfrom those of the insurance entity, and towhich the documentation required by thenature of the damage should be attached.

Likewise they must preserve remains andtraces of the claim event for appraisalpurposes, and should this proveabsolutely impossible, present documentsin proof of the damage, such asphotographs, notarial certificates, videosor official certificates. Likewise, bills forthe damaged property whose destructioncannot be delayed should be kept.

They must take such measures as may benecessary to reduce the damage.

Appraisal of losses derived fromextraordinary events shall be made by theInsurance Compensation Consortium, andit shall not be bound by the appraisals thatmay have been made by the insuringentity which covers the ordinary risks.

Chapter IIIClaims

Article 4. VALUATION OF ASSETS,EVALUATION OF DAMAGES ANDCALCULATION OFCOMPENSATION.

A) VALUATION OF ASSETSThe valuation of insured assets iscarried out in sections and indicated inthe insured sums of Chapter I. It takesinto account the following:1. Furniture.

Total replacement value coverage.The purchasing cost of items, wherepossible the same items and, in allevents, similar.

2. Building.Total replacement value coverage.The sum of the cost required forcomplete reconstruction thereof,excluding the value of the land andmarket circumstances, such as themarket price of the area, views andother elements defining purchasingand sale prices, but which have nodirect relationship with the cost ofthe materials and labour, which arethe only elements insured.Affecting of alignment, changes ingradient, assignments,expropriation and other legal/urbanplanning conditioning factors aretaken into consideration to reducethe corresponding replacementvalue while at least respecting thereal value, i.e. the cost of purchasingproperties, where possible, the sameand in all events, similar, afterdeducting depreciation, taking intoaccount their state and otherconditioning circumstances, though

without taking into considerationany affective, emotional or indirectvalue, which are not insured.

3. Restoration of the aesthetic unit ofthe Building. First-loss coverage.Supplementary value to compensatethe greater cost of restoration of theaesthetic unit, due to thenon-existence of materials like thosedamaged, when it is necessary tomaintain, as far as possible, theuniform appearance of elements ofconstruction located in a singleroom.

B) EVALUATION OF DAMAGES1. Material damages will be evaluated

using the same criteria used to valuethe insured assets and whichdetermine the insured sums - theeconomic expression of the insuredrisk.

2. Loss of rental income will beevaluated on the basis of the lastmonth's rent received by theInsured.

3. Obligations to compensate thirdparties will be evaluated byconsidering as a single claim alldamages deriving from a single,essential common cause, includingdamages occurring at different sitesor moments regardless of thenumber of affected parties, andconsidering, where applicable, thatall damages due to the same causetook place at the same time of whichthe first occurred.

4. Expenses will be evaluated on thebasis of invoices, fees or valuations

of costs.In the case of reconstruction ofdocuments, the cost of the simplematerial reproduction of duplicatesof the same shall be taken intoaccount, without considering theirrepresentative or indirect value.

C) CALCULATION OF COMPENSATION1. Insured sums and groups of items

The basic values of each insuredgroup of items will be taken intoaccount along with the sums insuredfor each risk, without compensatingeach other .

2. Sum of payments for damages andexpenses.The amount covered shall not, underany circumstances, be greater thanthe value, as determined by a lossadjuster, of the damages andexpenses.

3. Third-party compensation.The amount covered shall be thatestablished in:a) a friendly transaction between the

Company and the affected party.b) final judgement.

4. Replacement valueWhen the policy establishes coveragefor an item at replacement value, thefull settlement is subject to thereconstruction or purchase of newitems, which the Insured mustaccredit within a term of threemonths, in the case of Furniture, andtwo years, in the case of Buildings, bythe presentation of invoices orcompletion certificates.The Company will pay the differenceover the replacement value of thereal value of the items affected whenthese documents are submitted.The real value of the above groups ofitems will be settled prior tocompletion of the loss adjustments

and other procedures relating to theclaim.

5. AbandonmentAny remains of effects shall be paidfor by the Insured, who may notabandon the latter to the Company,and their value will be deductedfrom the applicable compensation.As an exception, in the event of theft,robbery or burglary, one month afterthe event the Insured may opt forabandonment, without repaying thecompensation sum to the company,or for the repurchase of the same, byreturning the sum of compensation,if this has already been collected,less the sum of possible damage tothe items.

D) PROCESSING OF CLAIMSIn the event of robbery, burglary, streetmugging, theft or vandalism, in orderfor the incident to be processed it willbe essential to submit the relevantpolice report to the Company.

E) WAIVER OF APPLICATION OF THEPROPORTIONAL RULE

a) Building: The Company waivesapplication of the proportionalrule provided that the differencebetween the constructed areadeclared by the Policyholder andthe actual constructed area of thehome located in the propertyitself, is no greater than 10% ofthe built area, which was used asthe basis for calculating theinsured sum. Otherwise, theCompany also waives applicationof the proportional rule when thecost of repair or replacement isless than 1.500,00 euros , andcarried out directly by theprofessionals sent by theCompany through the Insured's

use of Home Assistance coverageby calling the telephone numberindicated.

b) Domestic Furniture: The Companywaives application of theproportional rule provided thatthe difference between the

constructed area declared by thePolicyholder and the actual areaof the home is not more than 10%of the said built area, which is thebasis for calculating the insuredcapital.

Chapter IVAutomatic Appreciation

Article 5. REVALUATION OFCAPITAL AND PREMIUMS.To try and compensate as far as possiblethe negative effects of inflation, at eachannual expiry, the capital and premiumswill be revalued on the basis of theConsumer Price Index published by theSpanish Statistics Institute.In order to establish the percentage to beapplied in each calendar year, thecalculation will take into consideration the

twelve-month period prior to the lastindex, published in November of eachyear.When the policy expires, the premium willbe calculated on the basis of theCompany's rate in force on that date,drawn up in accordance with applicablelegislation, and made available to theDirectorate-General of Insurance andPension Funds of the Ministry of Economyand Housing.

Chapter VFundamental general issues

Article 6. REFERENCES TO THEINSURANCE CONTRACTS LAW.

The following General Conditions have atthe end of each section, the reference tothe precepts of the Law applicable totheir contents, so that your query can behandled, if required, with the maximumease and accuracy.

These General Conditions aim to beused as a guide to inform their users ofthe basic issues affecting the drawingup, duration and termination ofinsurance contracts.LEGISLATIVE CONSULTATION: Articles 1,2 and 3.

6. 1. Persons taking part in theinsurance contract1. The Policyholder, who fills in the

insurance questionnaire so that thepolicy may be prepared, signs thecontract and pays the premiums.

2. The Insured, who has an economicinterest in the insurance and holdsthe rights derived from the contract.

3. The Insurer, Allianz, Compañía deSeguros y Reaseguros, S.A. whoguarantees payment of the benefitsestablished in the event of a claim. Itis also called "the Company".

4. The Control Body, that is theDirectorate General of Insurance andPension Funds of the Ministry ofEconomy and Housing, thatsupervises the activity of the Insurerpursuant to the competence of theKingdom of Spain, Member of theEuropean Economic Area.

6. 2. Documentation and formalisationof insurance contracts.A) The Insurer draws up the policy in linewith the responses given in theQuestionnaire by the Policyholder, andapplies conditions and rates based onthe declarations made by the latter.Therefore, the Policyholder's answersare of vital importance to the contract.

The policy draws together, in a singledocument, the Particular Conditions ofthe Insurance Contract, which stipulatethe personal and individual details ofthe contract, determine its scope andpurpose, and include the clauses which,by will of the contracting parties, governthe operation of the cover as permittedby the Law; and the General Conditionsof the Insurance Contract, which establishduties and entitlements regarding thecreation, observation and expiry of thecontract.In addition, there may beSupplements,which are amendments orclarifications carried out with theconsent of the insurance policy holder,altering the original Conditions as manytimes as may be required.

B) The Policyholder must carefully readand check the Terms and Conditions ofhis/her policy and, if necessary, requestthat any errors are corrected within amaximum term of one month.Otherwise, he/she shall be subject tothat set forth in the policy.

C) If the policy is correct, the

Policyholder must sign the contract andalso ask the Insured to sign it, if thelatter is not the Policyholder.

D) The Policyholder must pay the firstpremium.

E) Only when the policy has been signedand the premium has been paid will thecontract be duly formalised and comeinto force. After this time, any claimsthat may occur will be covered.LEGISLATIVE CONSULTATION: Articles 1,2, 3, 4, 5, 6, 8, 14 and 15.

6. 3. Term of the Insurance ContractA) The term of the contract is from 00:00hours on the day of the start of thecoverage period, to 24:00 hours on theday of its end.

B) Each year, except in special cases, thepolicy will expire and be renewedautomatically.

C) To ensure that the insurance policyremains in force, the Policyholder mustpay the premium for the followingannuity. For this purpose, a grace periodof one month is established; after thistime, if the payment has not been made,the Insurer's coverage will be suspendedand the latter will not be held liable forclaims that occur after this time.

D) When the Policyholder or Insurer donot wish to renew the policy on itsannual expiry, they must notify theother party at least two monthsbeforehand.

E) Certain events may cause one of theparties to decide to terminate thecontract before expiry, such as thoseproducing increased risk, or whenreservations or inaccuracies are foundin the declarations of the Policyholder.

If the party terminating the contract isthe Insurer, coverage is extended forfifteen days to allow the Policyholdertime to take out another policy and theproportional unused part of thepremium is returned to him/her.The Insured may terminate the contractwith immediate effect, withoutrecovering the proportional part of thepremium.

F) Likewise, this occurs when insuredproperties are sold or transferred toother parties.It is particularly important to note thatthe new purchaser or owner does notacquire the rights of the previousInsured Party by subrogation innominative policies coveringnon-compulsory risks, which is the caseof this policy. Only following the requestof the purchaser and expressacceptance by the Insurer will theinsurance policy continue in force forthe purchaser, who will then becomethe new Insured Party.LEGISLATIVE CONSULTATION: Articles 8,10, 12, 14, 15, 22, 34, 35, 36 and 37.

6. 4. Amendments to the InsuranceContractA) Any change in the content of theanswers supplied in the Applicationbefore the policy was taken out by thePolicyholder must be reported to theInsurer as soon as possible in order todetermine whether the policy needs tobe adapted to the new situation.

B) Increased or decreased risk, changesin the ownership of the insuredproperties or any significant change inits legal consequences (such as, forinstance, the constitution of amortgage) must be reported by thePolicyholder, usually within 15 days,

except in the event of increased risk,which should be communicatedimmediately.

C) The response of the Insurer shouldgenerally be given within a 15-dayperiod, except wheN there is increasedrisk, in which case the latter has twomonths to propose an amendment tothe contract, provided of course that theInsurer does not make use of its powersof termination mentioned in the abovesection.

D) When the risk is decreased, thePolicyholder of the Insurance is, as of thenext annuity, entitled to thecorresponding reduction in thepremium.LEGISLATIVE CONSULTATION: Articles11, 12, 13, 32, 34, 37 and 40.

6. 5. Action taken in the event of a claimA) Firstly, in the event of a claim, thePolicyholder and the Insured must takeall possible measures to mitigate theconsequences of the same, cooperatingin the saving of persons and items.

B) The Policyholder, the Insured or theBeneficiary must inform the Insurer, evenby telephone or e-mail, of the claim, itscircumstances and consequencesimmediately and within a maximum ofseven days.

C) Communicate, for claims withdamages to items and within the termof five days, the list of existing objects,the list of those saved from the claim,and an estimation of the damage.

D) Without delay, the Insurer will reachan agreement with the Insured orBeneficiary to establish the amount ofcompensation or to pay out the benefit.

E) If the characteristics of the claim sorequire, the Insurer will appoint a lossadjuster. The Insured may, if he/she sowishes, appoint his/her own lossadjuster. When either of the parties failsto appoint a loss adjuster, the decisionof the loss adjuster appointed by theother party must be accepted.

F) Any disagreement between lossadjusters will be solved by appointing athird loss adjuster, who will resolve theissue.

G) The decision of the loss adjusters willbe binding for the parties, except in theevent of a legal challenge lodged by oneof the parties.

H) When the decision of the lossadjusters is not challenged legally, theInsurer shall pay the compensationwithin five days.

I) So as not to prejudice the interests ofthe Insured or Beneficiary, in the event ofa lengthy loss adjustment orprocedures, forty days after the claim isreported, the Insurer will make aprovisional payment, which will besubtracted from the final compensationamount.

J) The provisional payment will be atleast equivalent to the compensationamount that it could reasonably owe inthe light of the circumstances known atthe time.

K) Once the compensation has beenpaid, the Insurer can often claim fromthe third parties responsible for thedamages. The Insured must safeguardthis right of the Insurer.LEGISLATIVE CONSULTATION: Articles

The Law provides for diverse situationswhose occurrence goes against theinterests of the Insured, as they aresanctioned with nullity orineffectiveness of the contract, or withconsequences such as contestation,exemption from the obligation tocompensate and even the claiming ofdamages by the Insurer.In general, these situations take placewhen the Policyholder, the Insured orthe Beneficiary act with wilfulmisrepresentation, bad faith or seriousnegligence, when the Policyholdermakes incorrect declarations,information is concealed, when he/shefails to co-operate in the tasks of rescueand, in short, when he/she fails torespect the principle of good faith thatforms the basis of the insurancecontract.

B) Communication between parties.

All communication must be made eitherin writing, by e-mail or by telephone.

When the Policyholder, the Insured, theBeneficiary or the Creditor contacts theInsurer, they may do so at its businessaddress or at one of its branches. Suchcommunication may be made directlywith the Insurer or through an InsuranceBroker mediating the contract.The Insurer will contact the InsurancePolicyholder at his/her last knownaddress of the Insured.

C) Prescription of actions.

The actions taken to demand rightsderiving from the contract are prescribedafter two years.

D) Questions regarding claims:

resolved within a period of two monthsfrom the date on which it is presented tothe Customer Satisfaction Department.The final decision will be duly notified tothe complainants within ten calendar dayscounted from the date that it is issued.If the complaint or claim is totally orpartially rejected, or if two months havelapsed after it was presented to theCustomer Satisfaction Departmentwithout it being resolved, the complaintor claim may be presented to the

F) Litigation in relation to the contract:

The signer agrees to communicatethese issues to the persons whosepersonal data is being provided and tofacilitate, if necessary, a copy of thesigned document.

This Insurance Proposal was draftedin accordance with the informationprovided to us by the Policyholder;therefore, if the Policyholder agrees tosuch proposal, the the Insurer shalldecide the ownership interest in theinsurance contract before it is issued.

The policy to be issued would be withthe texts outlined in the precedingpages and it would be possible torequire that the risk be verifiedbeforehand by the Insurer in order todetermine the premiums and termsand conditions of the final contract.Henceforth, this proposal is solely forinformational purposes for theinterested party; thus, it is not aninsurance proposal as stipulated byArticle 6, Section 1 of Spanish Law50/80 on Insurance Contracts.
