Food operators responsibility

Substances causing allergies or intolerances with mandatory declaration*

Producers, manufacturers, packaging industries, and distributors of food products or ingredients have the obligation to declare “any ingredient or processing aid listed in Annex II or derived from a substance or product listed in Annex II causing allergies or intolerances used in the manufacture or preparation of food and still present in the finished product, even if in an altered form” (Regulation EC 1169/2011).

Undeclared allergen in a food product is equivalent to the presence of a serious food safety hazard with high risk for final consumers. In such a case, a procedure to withdraw the food from the market must be immediately initiated in line with Regulation EC 178/2002 principles, with huge costs and damages on brand image. Nevertheless, undeclared allergen remains a major cause of food product recalls worldwide, with increasing trend for the last few years.
