DISCUSSION:
Apollo M~nufacturing Company is currently discharging approximately3000 gallons per day of industrial wastes, f{om the manufacturingof fireworks products, to an impervious pond. Approximately 3000gallons per day of sanitary wastes are also dischsIged to septictank-subsurface disposal systems. The discharge of industrialwastes is currently covered under Order No. 71-39. Revision ofthe present Order No. 71-39 is necessary to implement the WaterQuality.Contro! Plan. The discharge overlies the Rialto 9round-water Subbasin and the limitations proposed cumplywith this sub-basin’s objectives.
These requirements also specify that all sanitary .wastes discharged
~0 subsurface disposal systems mu. st be maintained below the groundsurface. The industrial wastes may not be discharged in E mannerwhich will allow the wastes to reach waters of the State. Afreeboard limit is specified for the evaporation ponds.
The requirements contained in the propose~ order should be adequateto protect the beneficial uses of the Rialto Groundwater Shbbasin.
RECOMMENDATION:
Adopt Order No. 78-96 as presented.

Apollo l.~nufacturing Company (hereinafter discharger) submitted areport of waste discharge on December 30, 1977, for the discharge of:
a. Approximately 3000 gallons per day (11.4 m3/day) of industria!~astes to an impervious evaporation" pond;
b. Approximately 3000 gallons per day (11.4 m3/day) of sanitarywastes to septic tank-subsurface disposal systems.
2. The discharge of industrial wastes is presently governed underOrder No. 71-39.
3. The discharge of Wastes is !ocated in the portions of Sections 20,21, 29 and 28, TIN, B_~, SBB&M, and overlies the Rialto GroundwaterSubbasin.
The beneficia! uses of the Rialto Groundwater Subbasin include:
a.. }£~nicipal and domestic supply, c. Industrial service supply,b. Agricultural supply, d. Industrial process supply.
5. West San Bernardino County Water District supplies water to thedischarger. .In 1977, the filtrable residue and chloride concentrationsin the water supply were 212 mg/l and 8 mg/l respectively.

General Provisions for Reporting

By.January 30~of each year, the discharger shall submit an ann~alreport to the Regional Board. This is to confirm the findings of~inspection of March 3, 1983. Atthe tim~ of the insp~ctioB, the evaporation pond was full ~nd rainfallwas causing a minor overflow of.the pond. You stated that you hadcontacted aliquid waste hauler about pumping out the pond, but that"the hauler was unable to respond to your request immediately.
! wish to remind’you that.overflows of waste from the evaporation pondare prohibited by your Waste Discharge Requirements (Order No. 78-96).Discharge to the pond when freeboard.is less than one foot is alsoprohibited. In the future, please make arrangements for pumping ofth~ pond in a timely m~nner, such that overfl~vs do not occur and theone foot discharge limit is ~ot violated.
In addition, you stated that recent ~onitoring reports were not sub-mitted to this office bcecause the plant was closed. P.lea~e notifyus in advance of any future plant closures.

Revised regulations’governin~ the discharge of waste to land contained inSubchapter 15 df Title 23, Chapter 3 of the California Admlnistrati~e Code,became effective on November 27, 19~. These regulations established ~ deadlinefor submittal of monitoring programs by dischargers’who own or operate existinglandfills= surface impoundments or waste piles {ioeo waste managB~ent units)..
All existing waste management units must have ground water monitoring systemswhich comply with the requireBents of Article 5 of Subchapter 15. Dischargerswho own or operate existing units are required by Section 2510(d) to submittheir proposals for achieving compliance to the Regional Board within six (6)months of’th~ effective date of the revised regulations. Therefore, a technicalreport descri.bing the measures you intend to take to bring your monitoring intocomplianc~ with Article 5 must be submitted to this office no later than May 28,1985. This report shall also include a detailed time schedule for achievingcompliance with the monitoring requimementso
A workshop on the Subchapter 15 regulations is ~n the process of being scheduledand will be held in.Orange County. We ~ill inform you of the exact time andplace when that information is available. However,"since the workshop may notbe held until early May~ it is strongly recommended that you not wait for this~orkshop, but instead, begin work on your proposed monitoring program as soon aspossible=
After your proposed monitoring program has been submitted and reviewed andapproved by the Regional Board, the self monitoring program included in yourcurrent waste discharge requir~ents will be revised to incorporate the ne~monitoring program. Monitoring information resulting from this new program willbe reviewed and used by the Regional Board in revising your waste dischargerequirements in accordanc~ with the regulations contained in Subchapt~r

This is a reminder that I am still interested in having.yourcompany dispose of the explosive ~aste that is in the imperviouspond located on our property.
As I think you know, we have pumped all of the sludge .out of thepond and only solid waste remains. This insures that none of thewaste can seep into the soi! but at the s~me time increases thestorage hazard, We have already had one incident this summerwhere the waste auto-ignited bl~rlng burning debris onto the prop-e~ty and starting a small grass fire, I am concerned that thewaste will dry out again and we’ll have another auto-ignition.
I realize that your hands are tied be.cgUSe of the A.Q,M:D, require-ments on burning= but as soon as you receive word on your petitionfor a special burn permit please contact me, I am veryqanxious todispose of al! the waste and dismantl& the pond.
