painted all round the Mediterranean

for a stunning show on the limestone

walls of the caves at Les Baux. The

show, in seven sequences, plunges

into the Impresssionists,with Monet

and Renoir, the Pointillists, Signac

and Cross, the Fauves, Camoin,

Derain, Vlaminck, Friesz, Marquet

and Valtat, and of course Matisse,

continuing with Bonnard and Dufy

ultimately finishing with vivid

Chagalls. A show worth seeing.

I visited the Aix en Provence exhibition at the Granet Museum, and it is truly superb – not to be missed, beautifully curated with works from a number of private collections. UK/FRENCH TAX AGREEMENTS – THE LATEST! France moves to clarify its stance on

double taxation, saying British

expats should not be taxed twice on

UK-generated income such as

pensions and rental earnings

Tax officials in France have recently

clarified that British expats should not be

paying income tax in France or make

social contributions on their UK rental

incomes or state pensions.

The two countries have a double-tax

agreement which prevents the same

income being taxed twice – firstly in the

country it is paid and then when it is

received in France.

However, French officials have been

analysing the double-tax treaty signed

between France and the UK.

The rules changed slightly last year, and

as a result, French authorities believed

they could charge tax and social security

contributions on the UK-generated

income. The situation was complicated by

the fact that French tax offices were

taking different stances on the issue.

While it appears no such tax will be

charged on UK pension and rental

income there is still a question mark over

income which falls below the personal

allowance threshold.

Every UK taxpayer has a personal

allowance (£9,440 for the 2013/14 tax year)

which they can earn without paying tax.

The allowance is slightly higher once they

reach 65 years of age.

Because they are not subject to UK tax on

this amount, it may still be subject to

French tax laws, and not break a double

tax treaty. Until the situation is resolved

fully, the French tax authorities have said

they will not be taxing or charging social

security contributions on this income.

Dean Power, assistant tax manager and

tax technical coordinator at The Fry

Group said: “There was confusion last

year following some rule changes and

some French officials believed that this

enabled them to impose French tax and

social security on UK rental income

received by British expatriates living in

France.

“Following a delay in clarifying the exact

position, the DGfip (Direction Generale des

Finances Publiques) have now confirmed

that as stated in the UK/France double

taxation agreement, such income attracts

credit for French tax meaning that no

French tax is payable.

“However there remains confusion, and

further clarification is required for those

who do not pay UK tax on the income

within their personal allowance, as this

could still attract a French charge.

“British expatriates need to report income

to the French authorities but would be

well advised to check whether tax is

payable in France with a local adviser or

with the local French tax office who have

been made aware of these recent

developments."

French U-turn on tax grab spells good news for second home owning expats The French government has relaxed

a draconian policy relating to capital

gains tax on second homes.

Expats in France can breathe a sigh of

relief after the French government backed

down on its tax grab on second homes.

From September 1, those owning a second

home in the country for more than 22

years will have complete exemption from

capital gains tax (CGT).

The previous French government

doubled the amount of time before

second home owners could claim

exemption, raising the bar from 15 to 30

years in February 2012.

However, amid concerns that the policy

slowed down the property market,

current French President François

Hollande said extending the time frame

had been a mistake. It has now been

reduced to 22 years from September

onwards.

Graham Keysell of Paris-based Spectrum

IFA Group (www.spectrum-ifa.com) said

the “draconian” 30 year policy dissuaded

a number of his clients from selling their

second homes.

“Not only is this tax imposed on French

property, but it also applies to properties

in the UK owned by expats. One of my

clients was facing a bill of over €83,000

(£70,000) on a flat she has owned in

Devon for the past 25 years. You can

imagine her relief on hearing of the

proposed changes,” he said.

Lindsay Kinnealy, head of international

property at UK-based Pannone Solicitors

(www.pannone.com), said many Britons

with homes in France will welcome

Hollande’s initiative.

“The move represents a tremendous

potential benefit to individuals who

might have owned second homes in

France for some years but been looking to

sell, either because they had become too

old to visit regularly or because their

children were not interested in taking

them on,” she said.

“It could also have a considerable effect

on when people inclined to dispose of

such property actually sell up. Previously,

they may have lost out because they did

not feel prepared or able to wait until 30

years had passed in order to qualify for a

full CGT exemption. Some might have

reluctantly accepted having to pay the

tax, and the impact which it would have

on any profit.

“Even though they will still only be

eligible after 22 years, that represents a

significantly shorter period of time than

before, and makes the value of hanging

onto their French property far greater.”

Kinnealy added that a revived French

government proposal for a one-off 20 per

cent CGT discount for sales of second

homes completed in 2014 - regardless of

how long they have been owned - would

provide a further fillip if approved.

However, tax expert Howard Bilton,

chairman of the Sovereign Group

(www.sovereigngroup.com), cautioned

that expats are unlikely to escape the UK

taxman.

“Unfortunately the relaxation of the rules

on capital gains tax on houses in France

probably will not help most UK residents

as they will still have to pay UK CGT on

any gain in value realised upon resale of

their French property," he said.
