The summary of this case is a case regarding Underage drinking with teens which led to an incident which could have caused both teens and other lives. This case is regarding Dena and Alex, Kirk and Eric hall. Dena was a young lady who had problems drinking but had given up drinking because of the death of her friend Cathy she blamed her ex boyfriend Kirk for her friends death and she changed her ways. Dena started out with different friends and started dating Alex. Alex asked Dena to go to the movies and his parents allowed him to take the car but did not know that he was going to the party . At this party Alex knew Kirk would be there but he wanted to show him that he was not scared of him so he joined the party with Dena which he knew would make Kirk mad at the party Kirk began to drink and so did Alex because Alex had not drunk in a long time his tolerance for alcohol was not high this caused him to have no judgment he stated that he pulled his knife out on Kirk and before he knew it he had stabbed the young man. Case summeryIn my Opinion Alex should have been held liable because even if he tried to protect himself he went to the party to prove a point to Kirk he knew that once Kirk saw him with Dena there would be a problem . There were several witness there the first was Dena the second was Eric Hall who had purchased the keg of beers . There were other witness after that happen the ambulance driver who tried to stop the bleeding the ambulance tech smelled alcohol on Kirks breath and requested a breathalyzer test when he reached the hospital there was also the sheriff officer who tried to get witness together when he arrived on the scene but of course all the kids scattered due to under aged drinking.

Summery continuedAfdavit- a statement in writing that is made under oathDeposition- a testimony taken down in writing under oath before a trialAfdavits and Depositions Facts that lead to the outcome:

Eric Howe bought two kegs of alcohol from Lou Dempsey Lou Dempsey did not mean any harm, great friends with Eric Lou also did end up paying a ne for the illegal sale or alcohol to an under aged person Alex Jacobs did not go to the party intentionally to hurt Kirk Alex and Deanna did break up as a result as to what happened Kirk and Alex did have a rough relationship before the party ever happened and would have eventually end up ghting with or without the use of alcohol Alex had never stabbed anyone Kirk was always getting into and asking for trouble Alex ended up going to jail for a period of time and also had to participate in community service.

An example would be driving.Due to the facts and laws given alcohol did not play a role in the fight. In did not play a role in it because the dispute had started before alcohol was even involved. The only charges on Alex would be assault due to his actions with the knife.Based on the FactsMess Of MeSwitchfootHello Hurricane, track 22009Alternative210141.67
