WHEREAS, civic prayers and national days of prayer have a long and venerable historyin our constitutional republic, dating back to the First Continental Congressin 1775; and
WHEREAS, the Declaration of Independence, our first statement as Americans of
national purpose and identity, made " the Laws of Nature and Nature' s God"the foundation of our United States of America and asserted that peoplehave inalienable rights that are God- given; and
WHEREAS, the Supreme Court has affirmed the right of state legislatures to open theirsessions with prayer and the Supreme Court and the U. S. Congress
themselves begin each day with prayer; and
WHEREAS, on April 17, 1952, President Harry Truman signed a bill proclaiming theNational Day of Prayer into law, and in 1988, legislation setting aside thefirst Thursday of May as an annual National Day of Prayer was passedunanimously by both Houses of Congress and signed by President RonaldReagan; and
WHEREAS, the National Day of Prayer is an opportunity for Americans of all faiths tojoin in united prayer to acknowledge our dependence on God, to give thanks
for blessings received, to request healing for wounds endured, and to askGod to guide our leaders and bring wholeness to the United States and hercitizens.
NOW, THEREFORE, I, Dana E. Outlaw, Mayor of the City of New Bern, on behalf of theNew Bern Board of Aldermen, do hereby proclaim that each year the firstThursday of May shall be designated as

THAT WHEREAS, the Historic District Resident Association (" HDRA") has
requested the 500 block of Craven Street be closed to vehicular traffic on May 16, 2020from 12: 00 p. m. until 5:00 p. m. with a rain date of May 17, 2020 for a summer social; and
WHEREAS, the Director of Parks and Recreation of the City of New Bernrecommends the streets be closed as requested.

THAT WHEREAS, New Bern Young Professionals Group has requested the 400block of South Front Street between Hancock and Middle Streets be closed to vehicular

AN ORDINANCE ANNEXING TO THE CITY OF NEW BERN PROPERTY OF
ROSERT A. YULICK, CONSISTING OF 0.40 ACRES, MORE OR LESS, LOCATED AT
203 RIVERSIDE DRIVE IN NUMBER TWO (2) TOWNSHIP
THAT WHEREAS, Robert A. Yulick filed a petition requesting the annexation to the
City of New Bern of real property he owns located at 203 Riverside Drive in Number Two ( 2)
Township, Craven County, North Carolina, said property being more particularly described on
E ibit A attached hereto and incorporated herein by reference, consisting of 0.40 acres, more or
less, the boundaries of which are illustrated on a map prepared by City of New Bern
Development Services Department, a copy of which is attached hereto as Exhibit B and
incorporated herein by reference; and
WHEREAS, said petition was referred to the City Clerk for an investigation as to the
sufficiency thereof; and
WHEREAS, the City Clerk certified the sufficiency of the petition in writing to the Board
of Aldermen; and
WHEREAS, the Board of Aldermen called for a public hearing on the question of
annexation of said territory; and
WHEREAS, pursuant thereto, notice of a public hearing to be held at 6: 00 p.m. on April
14, 2020, in the City Hall Courtroom was duly caused to be published as required by law in the
Sun Journal, a newspaper having general circulation in the City; and
WHEREAS, on April 14, 2020, at 6: 00 p.m., a public hearing on the question of
annexation of the subject area was held by the Board of Aldermen of the City of New Bern, at
which time all interested parties were given an opportunity to be heard; and
WHEREAS, it was then determined by the Board of Aldermen that the petition filed met
the requirements of the General Statutes of North Carolina, and that the area described in the
petition should be annexed.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE
CITY OF NEW BERN:
Section 1. That the subject petition meets the requirements of §160A-31 of the
General Statutes ofNorth Carolina.
Section 2. That the real property owned by Robert A. Yulick located at 203 Riverside
Drive in Number Two (2) Township, Craven County, North Carolina, said property being more
particularly described on E ibit A attached hereto and incorporated herein by reference,
consisting of 0.40 acres, more or less, the boundaries of which are illustrated on a map prepared
by City of New Bern Development Services Deparhnent, a copy of which is attached hereto and
incorporated herein by reference as Exhibit B, be and the same is hereby annexed to the City of
New Bern.
Section 3. That the effective date of annexation shall be midnight on April 14, 2020.
Section 4. That the area to be annexed be and the same is hereby made a part of
Ward One of the City ofNew Bern.
Section 5. That this ordinance, together with a plat reflecting the area being annexed,
shall be recorded forthwith in the Office of the Register of Deeds of Craven County.

THAT WHEREAS, Nasr Abdo Ali Algaradi owns real property at located 2409 Oaks Road
in the City ofNew Bern, consisting of approximately 0.25 acre, more or less, and an application
has been made to change the zoning classification of the subject property from R-6S Residential
District to C-4 Neighborhood Business District consistent with the attached plat entitled
REZONING CASE: 2409 OAKS ROAD—Approx. 0.25+- Acres: PID: 8- 019- 008" prepared by
the Development Services Department of the City of New Bern; and
WHEREAS, the Planning and Zoning Board unanimously recommended that said request
be approved; and
WHEREAS, the Board of Aldermen of the City ofNew Bern conducted a duly advertised
public hearing with respect to the proposed amendment on April 14, 2020, at which time all
interested parties were given an opporiunity to be heard; and
WHEREAS, the Board ofAldermen of the City ofNew Bern deems it advisable and in the
public interest to effect said change, as the requested C-4 Neighborhood Business District
classification is consistent with the City Land Use Plans and nearby land uses.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF
THE CITY OF NEW BERN:
Section 1. That the zoning map of the City of New Bern be and the same is hereby
amended by changing the zoning classification of the subject property owned by Nasr Abdo Ali
Algaradi located at 2409 Oaks Road in the City of New Bern, consisting of 0.25 acres, more or
less, from R-6S Residential District to C-4 Neighborhood Business District as more specifically
shown on the plat entitled" REZONING CASE: 2409 OAKS ROAD—Approx. 0.25+- Acres: PID:
8- 019- 008" prepared by the Development Services Department of the City of New Bern, a copy
of which is attached hereto and incorporated herein by reference.
Section 2. That the Board deems it in the public interest to rezone the subject property
consistent with the attached plat as the requested C-4 Neighborhood Business District
classification is consistent with the City Land Use Plans and nearby land uses.

RESOLUTION
THAT WHEREAS, the City of New Bern has received an offer to purchase a parcel of
property owned by the City identified as 1509 Washington Street, and being more particularly
described herein; and
WHEREAS, the Board of Aldermen is authorized to sell the property pursuant to North
Carolina General Statute § 160A-269; and
WHEREAS, the offer to purchase was advertised as required by said statute; and
WHEREAS, the offer to purchase was in the sum of$3, 000.00 by Robert E. Carter; that
no increased bids were received; and
WHEREAS, the Board ofAldermen deems it advisable and in the best interest of the City
to sell the subject property to the successful bidder and to convey the said property by quitclaim
deed.
NOW, THEREFORE, BE IT RESOLVED BY' THE BOARD OF ALDERMEN OF THE
CITY OF NEW BERN:
Section 1. That the last and highest bid of Robert E. Carter in the sum of$ 3, 000.00
for said parcel identified as 1509 Washington Street, and being more particularly described
herein, be and the same is hereby accepted, and the Mayor and the City Clerk be and they are
hereby authorized and directed to execute a quitclaim deed to the purchaser for the said property.
Section 2. That a copy of said quitclaim deed is attached hereto and incorporated
herein by reference, and the original deed shall be delivered to said purchaser once the same has
been executed on behalf of the City, upon payrnent of the purchase price.
Section 3. That the subject property is more particularly described as follows:

Township, Craven County, North Carolina, and being more particularly described asfollows:

Donation of Equipment to No. 9 Township Fire & Rescue
WHEREAS, No. 9 Township Fire & Rescue is in need of electronic radios, laptops,
and miscellaneous equipment to be used in provision of services within the community;and,
WHEREAS, the City of New Bern has determined it has miscellaneous equipmentfrom time to time, which are no longer of useful service to the City.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OFTHE CITY OF NEW BERN: ,
That it does hereby transfer ownership to No. 9 Township Fire & Rescue the
equipment listed on Exhibit A, to be used in providing firefighting and rescue services.

BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF NEW BERN:
Section 1. That the Parks and Recreation Department requests the sole sourceexemption be authorized for the purchase of Ideal# 300 Hunter Green fence
for the Union Point Park Pedestrian Bridge project from Coastal FenceCompany.
Section 2. The purchase and installation of the fence from Coastal Fence Company inthe amount of$ 12, 537.00 is recommended and is hereby. authorized by theBoard of Aldermen based on G. S. 143- 129(6)( e):.
NC General Statute 143- 129(6)( e) allows an exception from bidding forPurchases of apparatus, supplies, materials, or equipment when: ( i)
performance or price competition for a product are not available; ( ii) a
needed product is available from only one source of supply; or (iii)
standardization or compatibility is the overriding consideration.
Notwithstanding any ofher provision of this section, the governing board ofa political subdivision of the Stafe shall approve fhe purchases listed in thepreceding sentence prior fo the award of the contract.
Section 3. That the City of New Bern intends to fund the cost of the purchase withHurricane Florence grant proceeds.

TheLocal Community Contribution funds is for the National Night Out $ 2,500 and Smoke Detector Safety Program$ 2, 500.
