Let’s do some math!
Look at the weight and gender of the person. Calculate how much alcohol they have had in how many hours and try to figure out what his or her BAC is!
120 pound Amanda goes to a
Christmas party where
she has 2 mixed
drinks in the first hour
and 3 beers the second
hour. She is 22 years old.
Legally, should she
drive home?
After the first 2 drinks,
Amanda is already at the legal limit of
.08!
During the second
hour, she metabolizes .015, but she has 3 beers
(.11).
TOTAL BAC
after 2 hours=
.175
Matt Male
180 pounds
4 Beers and 1 shot in 1 hour
An hour later, what is his BAC?
After 4 beers,
his BAC is .
08.
After the
shot it is .11.
He waits
an hour to drive home.
BAC when
driving home
is .095.
And hour
after he gets
home it is still .
08.

Driving Under the Influence Driving While Intoxicated
¡ DWI, 1st Offense: Class B Misdemeanor in Texas
¡ Fine - A fine not to exceed $2,000. ¡ Jail - Confinement in the County Jail for a
term of not less the 72 hours nor more that six (6) months. Open Container - If there was an open container of alcohol in your car when arrested, the minimum term of confinement is six (6) days in the county jail.
¡ Community Service - Texas law mandates that a judge order not less than 24 hours nor more than 100 hours.
Fake IDs
§ 521.451(a) Possession / Use of Altered Driver License A person commits an offense if they: • show or posses a driver license or certificate that they know to be fake or altered • show or represent as their own a driver license not issued to them Penalty: Class B Misdemeanor (≤ 180 days in jail and/or $2,000 fine) § 521.453(a) Possession of Fake Driver License (a) a minor commits an offense if they posses, with the intent to represent that they are 21 years of age or older, a deceptively similar driver license or ID certificate UNLESS the license displays the statement “NOT A GOVERNMENT DOCUMENT” printed in 1/4" solid red capital letters diagonally on both sides. (b) “deceptively similar” means a reasonable person would assume that the fake license presented was genuine. Penalty: CLASS C Misdemeanor (≤ $500 fine)
Evading arrest/Resisting arrest
Resisting arrest: attempting to flee from police officers, fighting against the arrest with physical force or by threatening an officer, or attacking law enforcement officials. Normally, this is a misdemeanor crime, but if you use a deadly weapon such as a gun, you can be charged with a felony.
Evading arrest: a more serious version of resisting arrest. You may attempt to flee from an officer on foot or in a vehicle. The level of your crime escalates with the amount of effort that you put into your escape. For instance, using a motor vehicle can lead to a felony. If anyone is hurt in the process, you may be charged with a third degree felony.
In Texas, these two crimes can span from class A misdemeanors to second degree felonies. The consequences of these charges can be significant.
Intoxication Manslaughter
§ 49.08. Intoxication Manslaughter. (a) A person commits an offense if the person: (1) operates a motor vehicle in a public
place, operates an aircraft, a watercraft, or an amusement ride, or assembles a mobile amusement ride; and
 (2) is intoxicated and by reason of that intoxication causes the death of another by accident or mistake.
 (b) An offense under this section is a felony of the second degree.
