This final rule adds AGAR Part 426 and amends AGAR Part 452 to establish acquisitionpreferences for selected biobased products; i.e., nonfood, nonfeed products made fromagricultural and forestry materials and animal by-products.

This final rule amends AGAR Parts 401, 402, 403, 407, 409, 411, 416, 419, 422, 424,425, 432, 434, 436, and 452 to reflect changes in the Federal Acquisition Regulationthrough Federal Acquisition Circular 97-01 and to correct minor errors and omissions inthe AGAR. The following changes have been made to the AGAR:

1. AGAR 401.170 is added to inform users about the USDA DepartmentalAdministration Procurement Homepage.

402.000 Scope of part.

SUBPART 409.4--DEBARMENT,SUSPENSION AND INELIGIBILITY

409.403 Definitions.

"Debarring official." Pursuant to theSecretary's delegations of authority in 7CFR 2.24, the Senior ProcurementExecutive (SPE) is designated as thedebarring official (Department DebarringOfficer) with the following exceptions:

(a) for commodity contractsawarded on behalf of the CommodityCredit Corporation (CCC), the ExecutiveVice President, CCC, or his designee isdesignated as the debarring officialpursuant to 7 CFR part 1407.

(b) for contracts awarded under theSchool Lunch and Surplus RemovalPrograms (42 U.S.C. 1755 and 7 U.S.C.612c), the Department Debarring Officerhas delegated debarring authority to theAgricultural Marketing Service (AMS).

409.404 List of Parties Excluded fromFederal Procurement andNonprocurement Programs.

The Department Debarring Officer isUSDA's single point of contact withGSA for debarment and suspensionactions taken under this subpart. The

debarring official for AMS shall notifythe Department Debarring Officer ofeach debarment and suspension action bypromptly submitting a copy of thedebarment or suspension notice and anylater changes to the debarment orsuspension status. The DepartmentDebarring Officer will forward a copy ofeach notice to GSA for inclusion in theGovernment-wide list.

409.405 Effect of listing.

Compelling reasons are consideredto be present where failure to contractwith the debarred or suspendedcontractor would seriously harm theagency's programs and preventaccomplishment of mission requirements. The SPE is authorized to make thedeterminations under FAR 9.405. Requests for such determinations shall besubmitted through the head of thecontracting activity (HCA) to the SPE.

SUBPART 434.0--GENERAL

434.001 Definitions.

Pursuant to OMB Circular No. USDA and that the managementA-109 (A-109) and the definition at FAR objectives of the Circular are realized. 2.101, within USDA, a system shall be considered a major system if:

Assistant Secretaries) individually or as agroup will participate in this decisionmaking process.

(b) The Assistant Secretary forAdministration (ASA) is the USDAAcquisition Executive. The ASA willensure that A-109 is implemented in
