AGREEMENT OF SEPARATION

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT made and entered into by and between:

MR. ADAM CYRIL R. PONTILLAS, of legal age, Filipino , married and a resident of Putok Katuparan , Teachers Village, Magugpo South, Tagum City, Davao del Norte, Philippines, now hereinafter called the FIRST PARTY;

MRS. AISA MEL CHRISLY BRIONES-PONTILLAS, Filipino, married and a resident of Cristo Rey Village, Magugpo West, Tagum City, Davao del Norte, Philippines, now and herein after called the SECOND PARTY;

WITNESSETH:

WHEREAS, both parties are legally married but now agreed to separate;

WHEREAS, both parties have had real irreconcilable differences and marked incompatibility. Thus, owing to their evident mental and emotional incapacity, have decided on their own free will to separate ways to give each the freedom to live his or her own life unsaddled with marital duties and obligations without prejudice to continued family financial support and custody of their child;

WHEREAS, both parties agreed to partition whatever real and personal properties they own in common as maybe agreed upon by the parties. However, in the event of disagreement in the partition, the same shall be determined by the court in proper proceedings;

WHEREAS, as provided for by law on separation and annulment, both parties shall have an equal shared responsibility and custody over their child, Cychris Miguel. For this, the days in week shall be divided equally by both parties when the child shall stay with either of the parties overnight for parental bonding;

WHEREAS, both parties undertake that they would not disturb nor intervene with each others separate private lives, but instead give each one the freedom which may include taking legal action to ultimately nullify their marriage and pursue his or her endeavor and career. This agreement shall be rendered ineffective in the event the parties reconcile and decide to restore their relationship by express mutual agreement.IN WITNESS WHEREOF, the parties hereto have set their hands this ____ day of ______ , 2014 at Tagum City, davao del Norte, Philippines.
