9. OLD BUSINESS (TAB 2) Rezoning for Buchanan Estates Area Extension

We have been notified that Buchanan Estates will be extended to include previously undeveloped area. Since our current zone includes Buchanan Estates in the Buchanan Elementary School zone and the undeveloped section in the Christiana Elementary School zone, it is recommended that the to-be-developed section of Buchanan Estates area also be included in the Buchanan Elementary School zone. As a better utilization of transportation services, it is also recommended that Brickyard Court and Daytona Court be included in the Buchanan Elementary zone.

Recommend Approval --- motion to extend the Buchanan Elementary School zone to include the developing section of the Buchanan Estates and adjacent identified areas as presented.

10. NAMING OF THE NEW HIGH SCHOOL IN ROCKVALE

A committee was appointed to recommend a name for the new high school in Rockvale. This committee met on April 19, 2017, at the office of Robert Farris. All community members on the committee previously attended Rockvale School. Committee members are as follows:

The history of Rockvale School was discussed. Rockvale High School was consolidated into Riverdale High. The Rockvale Community Consolidated School existed from 1927-1993. Rockvale’s mascot, The Rockets, was developed during WWII. Recommend Approval --- motion to name the new high school Rockvale High School, with the mascot being the Rockets, and the school colors blue (MTSU) and white.

11. DISMISSAL OF TENURED TEACHER (TAB 3)

The Board has been provided with a memorandum containing charges against Jacqueline Sweeney who is a tenured teacher at Christiana Elementary School. If the Board sustains these charges Ms. Sweeney will be presented with a copy of the charges and a statement of her rights under Tennessee law.

Recommend Approval --- motion to sustain the charges against Jacqueline Sweeney as presented.

12. STUDENT DISCIPLINE APPEAL The Board has been requested to review the April 21, 2017 decision of the Disciplinary Hearing Authority (DHA) to uphold the remandment of a student from Blackman High School to Smyrna West Alternative School. This review is pursuant to Policy 6.317 and the Board may:

(A) Affirm the decision of the DHA; or (B) Modify the decision to a lesser penalty; or (C) Grant a hearing before the Board.

Minutes Special Called Budget Meeting April 13, 2017

The Board Chairman called the meeting to order at 5:00 P.M.    2. PROPOSED 2017‐2018 BUDGET 

 The Director reviewed the recent BEP estimates and revenue numbers, uses of ending fund balance and other potential revenue enhancements.  It was recommended to hold expenditure  requests  that  the Board discussed previously.    The  Legislature  is  still  in session, and a budget has not been approved. 

 Motion  made  by  Mr.  Blair,  seconded  by  Mr.  Hodge,  to  accept  the  Director’s recommendation for three (3) Safety Coaches to be added to the budget. 

 Vote:  All Yes 

  3. CLASSIFIED SALARY LEVELS & STEPS 

 Lisa Moore, Board Member, provided an overview of the Salary Committee discussion and  support  for  the  proposal  that  was  presented.    Jeff  Sandvig  voiced  that  full implementation  is  an  option  based  on  current  revenues.    If  the  revenue  numbers change, then the salary proposal would be tweaked.  Mr. Holladay requested more time

 to review and to defer for more study, more discussion about index formula process, and consistency across all positions.  Chairman Jordan requested more time to review as well.  Mr. Sandvig will bring Classified Salary levels and steps back to the Board at the next budget  meeting.    This  item  was  deferred  to  the  next  budget  meeting  with  no recommendation. 

  4. PROPOSED BUDGET 

 Mr. Odom  reviewed  the General  Purpose  School Budget.    There was discussion and questions  by  Board Members  about  revenues.   Mr.  Sandvig  stated  that May  1  will provide closure to the April numbers, and he will have more information. 

 General Purpose School Budget – Fund 141 The  first  estimate  for  2017‐2018  revenues  is  $356,825,778  which  could  be supplemented by  using  $7,996,206  from ending  fund  balance.   We used  $6,200,843 from ending fund balance to fund the 2016‐2017 GPS Budget.  The draft budget has a 3% raise.  A half per cent drop would reduce the budget by $1,233,600. 

 Cafeteria Budget  – Fund 143 The Cafeteria Fund Budget has $17,937,000 in estimated revenues and $18,914,554 in expenditures.  $977,554 from their ending fund balance would be used to balance Fund 143.   

 Capital Project Budget – Fund 177 The Capital Projects Budget, Fund 177, is in balance with $4,265,340 in revenues and $4,265,340 in expenditures. 

  Mr. Jordan asked Mr. Clardy to give a report on Christiana Elementary School repairs that happened due to the storm.

SRO Bill West introduced the sheriff and several other SRO’s. Since this is Distracted Driving Awareness Month, the SRO’s are sponsoring a campaign called THUMBS DOWN to TEXTING and DRIVING.

7. FACILITIES

A. Smyrna Elementary School Marquee Sign

Principal Amy Patton has submitted a request to purchase and install a new LED school sign at Smyrna Elementary School. The total cost of the project is valued at about $18,000.00. This includes the sign from Signs Plus and labor and material for the masonry part from AMP, Inc. The Rutherford County Schools Maintenance Department will install the concrete footings and run and connect electrical wiring to the sign. This project will be funded through the PTO and Student Council.

Motion made by Mr. Holladay, seconded by Mr. Estes, to approve purchase and construction of an LED sign at Smyrna Elementary School as presented. Vote: All Yes

B. Deductive Change Order for John Colemon Elementary School

The John Colemon Elementary School Construction Contract is now fulfilled. The approved bid price from R.G. Anderson Construction was $17,246,700.00. The final cost is $17,185,481.18. R.G. Anderson has submitted a Deductive Change Order in the amount of ($61,218.82) for approval that will close this project out.

Motion made by Mr. Hodge, seconded by Mr. Blair, to approve the one and final Deductive Change Order in the amount of (–$61,218.82) for R.G. Anderson on John Colemon Elementary school as presented. Vote: All Yes

8. IMMIGRANT GRANT FUNDED CONTRACT

The ESL (English as a Second Language) Department was awarded an Immigrant Grant based on a proposal submitted by Nona Hall. The grant total was $21,746.88. It requested funding for four (4) extended contracts for a six-week summer school program to be held at Smyrna Middle School. Ms. Abdelmasseh, Ms. Vigil, Ms. Guadron, and Ms. Awadalla have agreed to supervise the summer school program. Transportation is being provided by Chip Industries. Each teacher will receive $2,325.00 for their services. Each educational assistant will receive $1,800.00. Chip Industries will receive $2,378.00 to provide transportation from June 5 - July 14, 2017.

Motion made by Mr. Blair, seconded by Mr. Young, to approve a Rutherford County Schools Immigrant Grant funded contract with Mervat Abdelmasseh, Meghan Vigil, Beatriz Guadron, Amira Awadalla, and Chip Industries for the six-week summer school program to be held at Smyrna Middle School.

Vote: All Yes 9. PARTNERSHIP GRANT WITH METRO-NASHVILLE PUBLIC SCHOOLS

Rutherford County teachers will participate in an eight-day Integrated Math summer workshop through a MSP grant obtained by Metro-Nashville Public Schools. The program will involve Rutherford County high school mathematics teachers. With grant monies, the teachers will be paid a stipend and mileage.  Motion made by Mr. Estes, seconded by Mr. Holladay, to approve the agreement to pay the stipend and mileage to participating teachers.  Vote: All Yes  

10. REZONING FOR BUCHANAN ESTATES AREA EXTENSION

We have been notified that Buchanan Estates will be extended to include previously undeveloped areas. Since our current zone includes Buchanan Estates in the Buchanan Elementary School zone and the undeveloped section in the Christiana

The Bus Committee and Bus Contractors have reached an agreement on the terms of the renewal of the bus contracts with the Bus Contractors. Technology Amendment – General Purpose School Budget

The State introduced a new major function and new object codes for technology expenditures for 2016-2017. They have given us new guidance on the use of these accounts after reviewing district budgets across the state. Instructional software, materials, and equipment are to be recorded under Instruction. Networks and system-wide expenditures are to be recorded in Technology, function 72250.

The amendment reclassifies already budgeted technology funds. The $100,000 in 72810 is for safety and telephone system related expenditures.

Motion made by Mr. Hodge, seconded by Mr. Blair, to amend $2,580,461 in already budgeted funds to the applicable line items as presented.

Mr. Holladay reported that the Secretary of Education, Betsy DeVos, joined the President this past week at a press conference on the President’s Executive Order – Buy US/Hire US. Ms. DeVos was to show the Department of Education’s robust support of career and technical education. Mr. Holladay stated that as far as Rutherford County is concerned it would sure be good if they would show their robust support by reauthorizing the Carl Perkins Act and to insure our uninterrupted funding of CTE. He expressed that Rutherford County is doing an extra ordinary job training students with life skills and marketable education to go directly into the workforce or pursue further CTE education beyond high school. Mr. Odom shared that principals across Tennessee are going to Washington, DC for an advocacy meeting. The principals from Rutherford County who are attending are Dirk Ash and Larry Creasy. Two things they hope to discuss are the Carl Perkins Act and lost Title I funding. Several groups are bringing these things forward to the Federal government.

MEMORANDUM

To: Rutherford County Board of Education From: Marvin D. Odom RE: Jacqueline Sweeney Subject: Charges Warranting Dismissal Date: May 4, 2017 FACTS:

Ms. Sweeney was placed on a formal Plan of Assistance at the beginning of the 2016-2017 school year due to deficiencies in performance and professionalism. The components of the Plan of Assistance included the following areas of concern: chronic failure to arrive to work on time, repeated incorrect reporting of absences, failure to have lesson plans and other materials in place for substitutes when absent, assignments/grades not entered into iNOW database timely, failing to communicate with parents through the student agenda as required, formative assessments not administered timely and formative assessment data not entered timely.

The Plan of Assistance provided clear directions for areas of improvement. The Plan of Assistance provided multiple types of assistance in the improvement areas. The Plan of Assistance was monitored on multiple dates throughout the school year. As of the current date Ms. Sweeney has arrived late to her classroom 17 times. As of the current date Ms. Sweeney has reported absences late and incorrectly. As of the current date Ms. Sweeney has failed to enter formative assessment data for four

assessments. As of the current date Ms. Sweeney has failed to administer formative assessments on at

least six dates as required by administration. AS of the current date Ms. Sweeney has repeatedly failed to provide data submission for

PLCs and Leadership Teams as required. The administration has performed multiple record reviews of parent communication since

implementing the Plan of Assistance. As of the current date Ms. Sweeney consistently fails to meet the minimum requirements for parent communication as required by the administration.

As of the current date Ms. Sweeney has failed to report student grades and has failed to show assignments that support any grades that were reported.

As of the current date Ms. Sweeney has failed to provide student progress reports as required by the administration.

The following areas of assistance have been provided to Ms. Sweeney by the administration and by team members: provided with copies of all formative assessments and calendars indicating dates assessments are to be given, provided with folders to send

student work home in communication with parents, provided with copies of PLC agendas prior to meetings so she is made aware of items to be brought to the meeting, PLC calendar is posted in the grade level hallway, all analyzed assessment data is provided on a shared drive so it is accessible at any time, online assessment data was also provided to Ms. Sweeney in hard copies, instructional resources and strategies have been shared with Ms. Sweeney consistently by team members throughout the 2016-2017 school year, establishing seating arrangements for students, modeling for classroom management techniques, providing additional supervision for students during breaks, observations of math instruction and feedback for improvement provided by Instructional Coaches and Specialists, sent to observe model classroom, training provided on effective lesson planning.

The administration made multiple observations in Ms. Sweeney’s classroom throughout the 2016-2017 school year to monitor progress with the Plan of Assistance and has noted little to no improvement in all areas.

CHARGES:

INCOMPETENCE Tennessee law defines “incompetence” as “being incapable, lacking adequate power, capacity or ability to carry out the duties and responsibilities of the position. This may apply to physical, mental, educational, emotional or other personal conditions. It may include lack of training, experience, evident unfitness for service, a physical, mental or emotional condition making the teacher unfit to instruct or associate with children or the inability to command respect from subordinates or to secure cooperation of those with who teacher must work.” Ms. Sweeney has repeatedly shown inability to carry out the duties and responsibilities of her position as evidenced by the “Facts” section in the Memorandum. Ms. Sweeney’s incompetence results in a lack of instruction for students in her classroom. INEFFICIENCY Tennessee law defines “inefficiency” as “being below the standards of efficiency maintained by others currently employed by the board for similar work, or habitually tardy, inaccurate or wanting in effective performance of duties.” Ms. Sweeney’s expectations and responsibilities are equal to those of every elementary education teacher in the system. As evidenced the “Facts” section of the Memorandum, Ms. Sweeney’s performance has been deficient and inaccurate on a weekly, sometimes, daily basis. Ms. Sweeney has also been habitually tardy over an extended period of time. Ms. Sweeney’s inefficiency results in the lack of instruction to students in her classroom. NEGLECT OF DUTY Tennessee law defines “neglect of duty” as “gross or repeated failure to perform duties and responsibilities which reasonably can be expected of one in such capacity or continued unexcused or unnecessary absence from duty.” As evidenced by the information provided in the “Facts” section of the Memorandum, Ms. Sweeney exhibited deficiencies in her ability to perform duties and responsibilities of her positon on a weekly, sometimes daily, basis. After being placed on an assistance plan and provided with resources to improve her performance, Ms. Sweeney’s

performance did not improve. Ms. Sweeney’s neglect of duty results in a lack of instruction to students in her classroom. INSUBORDIANTION Tennessee law defines “insubordination” as “refusal or continued failure to obey the school laws of Tennessee or to comply with the rules and regulations of the Board, or the principal, each acting within its own jurisdiction, when such rules, regulations and assignments are reasonable and not discriminatory.” Ms. Sweeney has repeatedly failed to comply with directives issued by the principal at Christiana Elementary School. Ms. Sweeney failed to successfully complete any of the components of her assistance plan as directed. RECOMMENDATIONS Based upon the foregoing information, I charge Ms. Jacqueline Sweeney with incompetence, inefficiency, neglect of duty and insubordination. I believe these charges warrant her dismissal as a tenured teacher. At the regular Board meeting on May 4, 2017 I will ask the Board of Education to sustain the charges against Ms. Sweeney. Thereafter, I will provide Ms. Sweeney with a copy of these charges and a statement of her rights under Tennessee law.

3. Create, in conjunction with the Secondary Coordinator, annual job goals that will become part

of the criteria for evaluation. 4. Work collaboratively with the Secondary Coordinator as well as building level administrators

to provide science leadership and support by:

a. Facilitating and developing staff development b. Providing teacher support c. Developing district science curriculum guides d. Oversee science program implementation e. Oversee science textbook adoption process f. Evaluate science program implementation

5. In carrying out these responsibilities, the Secondary Science Specialist will:

Observe, coach, and provide feedback to teachers regarding all aspects of science / STEM instruction, student engagement, and classroom environment;

Provide professional development training for RCS personnel within his/her area(s) of expertise as part of RCS annual professional development program;

Keep current of new developments in science curriculum and evaluation through readings, conferences, and other means of gathering training and knowledge and disseminate information on a regular basis, including conducting staff development for the benefit of RCS employees;

Coordinate with administrators and science departments to equip new science / STEM labs due to new construction or expansion.

QUALIFICATIONS: Skills to develop and interpret formative and summative assessment data. Strong working and application knowledge of high school science instruction. Hold a valid Tennessee Teacher’s license with a minimum of five years successful teaching

experience and an endorsement in one of the sciences with preferences given to candidates holding a Tennessee Certification in Administration and Supervision.

Have substantial experience in high school science instruction with a strong background in professional development.

Good communication skills. Ability to demonstrate exemplary classroom teaching. Skill in PLC collaboration, science instruction, STEM, and the analysis of data to improve

student learning. Demonstrate skills in coaching strategies that improve teaching. Demonstrate deep understanding of the use and interpretation of summative, formative,
