a. Action Regarding Site Plan Review for REVISED The Bohemian Park Phase 2, 2100

Holmgren Way, Parcel VA-67-A-2

Aaron Schuette stated Engberg-Anderson Architects, as applicant for owner Wewerka

Group, LLC has requested a site plan review for a revision to the proposed second

building within The Bohemian Park apartment complex. The proposed second building

will front primarily along Holmgren Way and extend north to the corner of Holmgren Way

and Morris Avenue. The primary revision to the plan is to reduce the building from a 5-

story, 69-unit building to a 4-story, 52 unit building due to building material costs. The

overall architectural features and rooftop elements remain the same.

Motion to recommend to Village Board to approve the revised The Bohemian Park

Building - Phase 2 with staff conditions:

• All metal panels are to utilize concealed fasteners

• All ground-mounted and roof-mounted mechanical units and associated

materials need to be screened from view from the subject property line and

right-of-way boundaries

• Meet all applicable parts of 17-2-200 and all other applicable parts of the

Ashwaubenon Municipal Code

• Contact Utility Operations Supervisor for quote on connecting to Village

watermain and stubbing 8” line to development. Cost to be charged to

development and includes restoration of road and sidewalk.

• Verify functionality of existing bio-retention area and complete any

maintenance required

• Protect existing bio-retention area with appropriate erosion control measures

• Confirm the fire lane provided on west side of building to be 24’in width and

turning radius is adequate for fire apparatus

• Knox box required near main entrance to building

• Provide additional private hydrant on west side of building. Work with Public

Safety on exact location.

• Forestry recommends to approve as presented

b. Action on a request for an accessory garage and parking lot expansion for Capital

Credit Union, located at 825 Morris Avenue, Parcel VA-67

Aaron Schuette stated Joel Ehrfurth of Mach IV, as applicant for Capital Credit Union, at

825 Morris Avenue, has requested site plan review for a 46' wide by 50' long and 23' 6"

high accessory garage. The proposed garage is to be used for indoor storage of

vehicles and office supplies and will replace the existing 30' wide by 60' long garage on

the site. At the Site Plan Review Committee meeting, it was requested by the owner to

have an option for either a pitched roof as depicted or a flat roof, similar to the existing

Capital CU building. The proposed garage will be located south of the Capital CU

building in the middle of the existing and proposed parking lot. Village staff worked with

the applicant to relocate the dumpster enclosure to a location adjacent to the south

side of the garage. Exterior materials will consist of a similar splitface concrete block and

color as on the existing Capital CU building, but will also have an LP lap siding accent on

the east and west elevations. Exterior materials as proposed meet design requirements.

A garage door and service door will be located on the west elevation and a second

service door will be located on the south elevation.

Along with the addition of the garage, the parking lot will be expanded into the current

unutilized green space on the south/southeastern corner of the property. The new

parking lot area will have conventional curb and gutter. Site Plan Review Committee

recommended approval of the requested site plan review with the owner's requested

option for either a pitched or flat roof for the garage.

Motion to recommend to Village Board to approve the requested garage accessory

structure up to 46'X50' with either a flat or pitched roof and parking lot expansion for

Capital Credit Union at 825 Morris Avenue with staff comments:

• Meet all applicable requirements of 17-2-200 Ashwaubenon Municipal Code

c. Action Regarding Amending Section 17-6-500 Village of Ashwaubenon Municipal Code

Relating to Off-Street Parking

Under Section 17-6-500 of Ashwaubenon Municipal Code, the Village currently requires 1

off-street parking space for every 2 persons based on maximum capacity, plus 1 space

per employee for restaurants, taverns, supper clubs, cocktail lounges, and nightclubs.

This requirement has led to very large off-street parking lots for restaurants within the

Village that are seldom filled. The current off-street parking requirement has also had the

unintended consequence of precluding businesses from expanding in order to maintain

the high number of required off-street parking spaces. This has become particularly

problematic as interest in outdoor patio dining has increased due to the COVID-19

pandemic, and restaurants have not been able to add patios due to the parking

requirements.

In reviewing peer communities as identified on the attached table and example, the

Village of Ashwaubenon currently requires significantly more off-street parking than any

of the polled peer communities. The proposed ordinance amendment would reduce

the required minimum parking for restaurants, taverns, supper clubs, cocktail lounges,

and nightclubs to a number that is more in line with the other communities. This will

decrease the land necessary for off-street parking for these uses, which may then be

used for higher value improvements, such as building expansions or outdoor dining

patios.

Additional recommended revisions to the off-street parking requirements would permit

the use of formal parking agreements among adjacent properties to meet off-street

parking requirements and allow for the counting of legal, on-street parking within 50' of

the property boundaries toward the off-street parking minimums as indicated in the

attached ordinance revision. Site Plan Review asked the village to investigate some off-

street parking dedicated for ride share programs.

In the interest of time, the actual ordinance providing for the proposed change will be

prepared and presented at the Village Board meeting.

Motion to recommend to Village Board to approve amending the minimum off-street

parking standard for restaurants, taverns, supper clubs, cocktail lounges, and nightclubs

and providing for shared parking agreements and counting of on-street parking toward

parking minimums.

Public Hearing Regarding Proposed Territory Amendment #2

for TID #5

FULL EXPLANATION:

TID #5 was formed in 2015 as a Blight Elimination TID - generally including the area east of S.

Oneida Street, south of Lombardi Avenue, Borvan Avenue, Morris Avenue, Mike McCarthy Way,

Element Way, and Holmgren Way. In 2018, the boundary and project plan for TID #5 was

amended to include the land for the Expo Center and Capital Credit Union Park Stadium. The

current boundaries of TID #5 are included within the draft project plan. Typical of blight

elimination TIDs, expenditures are very high on the front end due to property acquisition, utility

improvement, and environmental testing/remediation.

The Village is proposing to amend the boundaries of TID #5 as depicted within the draft project

plan to facilitate redevelopment that but for TIF, may not happen. The only significant change

from the Project Plan as amended (amendment #1) to the proposed project plan is the addition

of parcels to connect TID #5 to the former Menards property at the Waube Lane / I-41

interchange.

The Planning Commission adopting a resolution recommending approval of the territory

amendment is one of the required statutory steps in the process to amend a Tax Increment

District. The Village Board will take formal action regarding the requested TID #5 amendment #2

at its September 28, 2021 meeting. The Joint Review Board will subsequently take formal final

action regarding the requested amendment #2 at its second meeting (October 5, 2021)

following Plan Commission and Village Board action. A copy of the public hearing is attached

for reference.

NOTICE IS HEREBY GIVEN, that the Village of Ashwaubenon will hold a Joint Review Board (JRB) meeting on September 1, 2021 at 12:30p.m. in the Village Hall Conference Room A, 2155 Holmgren Way, Ashwaubenon, WI 54304 regarding the Proposed Territory Amendment #2 Tax Incremental District No. 5 of the Village of Ashwaubenon, Wisconsin. The purpose of this meeting is to organize a JRB for purposes of considering the proposed Territory Amendment. The meeting is open to the public. NOTICE IS HEREBY GIVEN, that the Plan Commission, of the Village of Ashwaubenon, will hold a public hearing on September 7, 2021 at 5:30 p.m. in the Village Hall Boardroom, 2155 Holmgren Way, Ashwaubenon, WI 54304 regarding the proposed Territory Amendment #2 for Tax Incremental District No. 5 in the Village.

The TID No. 5 Territory Amendment #2 will accomplish the following: Amend the boundaries of the District to add territory. The addition of territory to the District will facilitate economic development and blight elimination. In accordance with Wisconsin Statute Section 66.1105(4)(h), in order to include this territory into the TID #5 boundary, a contiguous connection via parcels of land must be made to the existing TID #5 boundary by utilizing the CN railroad parcels to provide the necessary connections.

A RESOLUTION DESIGNATING

PROPOSED TERRITORY AMENDMENT NO. 2

FOR TAX INCREMENTAL DISTRICT NO. 5

VILLAGE OF ASHWAUBENON, WISCONSIN

WHEREAS, the Village of Ashwaubenon has determined that use of Tax Incremental Financing is

required to promote development and redevelopment within the Village; and

WHEREAS, Tax Incremental District No. 5 (the “District”) was created by the Village of Ashwaubenon

(“the Village”) on February 25, 2014, as a blight elimination district; and

WHEREAS, the District was amended in 2018 by adoption of a Territory and Project Plan Amendment

No. 1 dated March 27, 2018, which added territory to the District and providing incentive and

opportunities for additional development and redevelopment; and

WHEREAS, the proposed Amendment No. 2 to modify the territory for the District was filed with the

Village Community Development Director on August 23, 2021, and made available for inspection on

weekdays between the hours of 8:00 a.m. and 4:30 p.m., and to any person requesting a copy thereof;

and

WHEREAS, a public hearing was held on September 7, 2021, in accordance with Wis. Stat.

§66.1105(4)(a) and (e), in which interested parties were afforded a reasonable opportunity to express

their views on the proposed Territory Amendment No 2; and

WHEREAS, prior to its publication, a copy of the notice of public hearing was sent by first class

certified mail to the chief executive officers of Brown County, the Ashwaubenon School District, the

Northeast WI Technical College District, and any other entities having the power to levy taxes on

property located within the District; and

WHEREAS, notice of such hearing was published by Class 1 publication in the Village’s official

newspaper on August 27, 2021; and

WHEREAS, a meeting pursuant to Wis. Stat. §66.1105(4m) of the Tax Incremental District No. 5 Joint

Review Board was held on September 1, 2021, within fourteen days after the publication of the notice

of the above-referenced public hearing; and

WHEREAS, at the above-referenced public hearing conducted in the Boardroom of the Ashwaubenon

Village Hall on September 7, 2021, at 5:30 p.m., the Plan Commission heard all interested parties, their

agents and attorneys, regarding proposed Territory Amendment No. 2 for the District and determined

that the territory amendment as proposed is in conformity with the Village’s Comprehensive Plan and,

further, is in the best interests of the Village in order to foster economic development and blight

elimination and would not otherwise occur without tax incremental financing in that part of the Village.

NOW THEREFORE, BE IT RESOLVED by the Plan Commission of the Village of Ashwaubenon,

Wisconsin, that:

The Plan Commission recommends the boundaries for the District be amended as to those

boundaries are set forth in the Territory Amendment No. 2 and the proposed Project Plan, and to

modify the boundary for the District, a copy of which is attached hereto and incorporated as if

fully set forth herein.

BE IT FURTHER RESOLVED THAT:

The Plan Commission hereby adopts the Territory Amendment No. 2 for the District and the

proposed Project Plan, Village of Ashwaubenon, as prepared and presented by Robert W. Baird

& Co. and Village staff; further, that such Territory Amendment and Project Plan is hereby

submitted to the Village Board of the Village of Ashwaubenon in accordance with Wis. Stat.

§66.1105(4)(f).

Adopted by the Plan Commission of the Village of Ashwaubenon, Wisconsin, this 7th day of

Introduction and Description of Territory Amendment

Tax Incremental District No. 5 (the “TID #5” or the “District”) was created by the Village under the authority provided by Wisconsin Statute Section 66.1105 on February 25, 2014. The TID prior to and including this amendment is considered a “Blight Elimination District” based on the findings that at least 50 percent of the TID is a blighted area and in need of rehabilitation or conservation work. The original TID boundary included the area east of S. Oneida Street, south of Lombardi Avenue, Borvan Avenue, Morris Avenue, Mike McCarthy Way, Element Way, and Holmgren Way.

TID#5 was amended in 2018 by adoption of a territory and project plan amendment dated March 27, 2018, which expanded the boundaries to include adding 37 parcels and remove 1 right-of-way. The main purpose of the territory amendment was to include land for the Resch Expo Center and Capital Credit Union Park Stadium. The total for “priority” projects remained at the original Project Plan amount of $60.2 million while the total for “contingent” projects was increased to $68.3 million.

Wisconsin Statutes Section 66.1105(4)(h)2 allows a municipality to modify the TID boundaries no more than four times during the life of the TID. This amendment is the second territory amendment in TID #5.

This second amendment adds territory to facilitate redevelopment and blight elimination that but for TIF, may not happen in the District. In accordance with Wisconsin Statute Section 66.1105(4)(h), in order to include this territory into the TID #5 boundary, a contiguous connection via parcels of land must be made to the existing TID #5 boundary by utilizing the CN railroad parcels to provide the necessary connections. As proposed, the TID #5 territory amendment would keep the Village under the 12% TID value threshold using 2021 valuation numbers. Utilizing the CN railroad parcels keeps the additional valuations down as those parcels have no value for property tax purposes. Additional "no value" parcels including WPS and the Reserve Center were included to connect the CN railroad parcels to the vacant former Menards site. This second amendment only adds territory to the original TID project plan and subsequent amendments, and all other subject areas of the original plan and subsequent amendments remain unchanged.

The maps on page 6 shows the District before this second amendment and the map on page 7 shows the territory added parcels as contiguous to TID #5. The new territory boundary demonstrates that the entire District area remains contiguous.

Page 8 of this project plan contains the list of specific parcels to be added with this second amendment. Exhibit A demonstrates revenues for TID #5 are generally trending toward meeting our expenditure commitments (bonds) for projects within the TID boundaries, but due to impacts of the COVID pandemic, a number of projects that were approved and were anticipated to develop have stalled. Although the final year of revenues for TID #5 remains a number of years off (2041), any additional property tax increment that can be captured by the TID would help to meet the expenditure commitments ahead of time and potentially help with additional redevelopment efforts within the TID. TID #5 has a maximum statutory life of 27 years, closing no later than September 25, 2041, with final tax collection in 2042. The final year to incur TIF related expenditures is 2036. Based on current cash flow projection, TID #5 is expected to close in 2041, the end of its maximum statutory life. The legal description in Exhibit C describes the full TID #5 territory updated for the amended area.

Equalized Valuation Test

The following calculations demonstrate that the Village is in compliance with Wisconsin State Statute Section 66.1105(4)(gm)4.c. Wis. FULL EXPLANATION: The requested Certified Survey Map (CSM) as submitted by TNT Professional
