REGULAR MEETING OF THE VILLAGE OF CLEMMONS COUNCIL

March 26, 2018 The Village of Clemmons Council met on Monday, March 26, 2018, at 7 p.m. The meeting was held at the Village Hall, Clemmons, North Carolina. The following members were present: Mayor Wait, Council Members Barson, Binkley, Combest, Lofland, and Wrights. Attorneys Warren and David Kasper were also present. Call to Order & Pledge of Allegiance Mayor Wait called the meeting to order at 7 p.m. and led the Pledge of Allegiance. Public Comments There were approximately 50 citizens in attendance. There were no individuals signed in to speak. Approval of the Minutes Council Member Barson moved to approve the minutes of the March 12, 2018 regular meeting as presented. The motion was seconded by Council Member Lofland and unanimously approved. Council Member Barson moved to approve the minutes of the March 20 & 21, 2018 special meeting (Retreat) as presented. The motion was seconded by Council Member Lofland and unanimously approved Approval of the Agenda Council Member Combest moved to approve the agenda as presented. The motion was seconded by Council Member Barson and unanimously approved. Announcements A. Mayor Wait announced that the Village of Clemmons will be closed for Good

Friday on Friday, March 30, 2018. B. Mayor Wait announced a Special Meeting - Joint Session with Planning Board on

Tuesday, April 17, 2018 at 5:30pm for Comprehensive Plan Review at Village Hall.

C. Mayor Wait announced a Community Input Session on Tuesday, May 1, 2018 at 6:30pm for Comprehensive Plan Review at River Oaks Community Church (Coffee Bar).

Business – Information/Review Items for Future Action A. Marketing and Communications Director’s Report.

1. Events Update – Manager Buffkin provided an update on the following events: - The month of March is featuring Random Acts of Kindness daily on the

Village of Clemmons Council March 26, 2018 Minutes Page 2

Facebook page. - March 17, 2018 was Family Fishing Fun at River Oaks Community Church – there were approximately 100 participants. Thank you to all the volunteers from the scout troops. - March 19, 2018 was Operation Medicine Drop at the Clemmons Fire Department (James Street location) – total amount collected was 73 pounds from 113 residents.

B. Manager’s Report.

1. Financial Report for February 2018 – report was presented. 2. Sheriff’s Department Report for February 2018 – report was presented. 3. Idols Road Industrial Park Update – Manager Buffkin provided Council

with an Idols Road Industrial Park Update which he advised is now named Tanglewood Business Park (attached hereto as Exhibit A and incorporated as a part of the minutes).

4. Budget Workshop Date(s) and Time – Manager Buffkin advised that in the

past the Budget Workshop has been conducted beginning at 5:30 p.m. prior to the last Council meeting in April. Council Member Barson requested and Council consensus was to direct Staff to send a calendar to all Council Members to determine availability for the Budget Workshop(s).

5. Advertising for Citizen Boards – Manager Buffkin advised that the

advertising for Citizen Board opportunities will take place as there are several openings with terms expiring June 30, 2018. Council consensus was to direct Staff to advertise via The Clemmons Courier, Village of Clemmons website and social media outlets.

6. CGI Video Viewer Statistics – Manager Buffkin advised that Director of

Operations Gearren is currently working to secure these statistics. 7. Ordinance 2018-02 Declaring Speed Limit Modification for Blue Bonnet

Lane (West of Kinnamon Road) – Manager Buffkin introduced the request to Council. Council consensus was to direct Staff to place as an action item on the agenda at the next Regular Council meeting.

8. Discussion of Brunch Bill Consideration – Manager Buffkin requested

Council’s direction as this was a discussion topic at Retreat. Council consensus was to ask Triad Municipal ABC Board Member, Eric Blanks, to provide a brief overview of the determining factors of the Brunch Bill adoption by Forsyth County. Council consensus was to add a public comments section under this action item’s consideration to the next Regular Council meeting and publicize via social media outlets.

9. Village Streets Paving Bid Proposals – Manager Buffkin presented the following quotes received for the Village streets resurfacing project for consideration at the April 9, 2018 Regular meeting. The quote from Yadkin Valley Paving, Inc. was the lowest.

C. Attorney’s Report – Attorney Warren Kasper expressed his appreciation to

Council for allowing him to attend the Municipal Attorney’s Conference and provided an update on applicable discussion items.

D. Planner’s Report.

1. Update on Timeline for Traffic Analysis Review – Planner Ledbetter provided Council the following update on the timeline for the Traffic Analysis Review:

Staff review and draft complete - May 2018

Planning Board review and public hearing - June 2018 Council review and public hearing - July 2018

Business – Action Items E. Market Center Drive.

1. Bid Proposals - The following quotes were received and the one from Yadkin Valley Paving, Inc. was recommended (attached hereto as Exhibit B and incorporated as a part of the minutes).

Council Member Wrights moved to accept the bid from Yadkin Valley Paving, Inc. for Market Center Drive Phase I in the amount of $695,391.00. The motion was seconded by Council Member Lofland and unanimously approved. 2. Budget Amendments –

a. Budget Amendment 18-G-4 to transfer $65,000 to Capital Projects for Phase I.

Council Member Combest made a motion to approve Budget Amendment 18-G-4 to transfer $65,000 to Capital Projects for Phase I (attached hereto as Exhibit C and incorporated as a part of the minutes). The motion was seconded by Council Member Wrights and unanimously approved.

b. Budget Amendment 18-S-1 to transfer $51,000 from Stormwater Fund to the Market Center Drive Project Phase I for storm drainage.

Council Member Combest made a motion to approve Budget Amendment 18-S-1 to transfer $51,000 from Stormwater Fund to the Market Center Drive Project Phase I for storm drainage (attached hereto as Exhibit D and incorporated as a part of the minutes). The motion was seconded by Council Member Wrights and unanimously approved.

c. Capital Project Ordinance CPO-LCR-2018-1 to amend Lewisville-

Clemmons Road Connectivity Project for confirmation of Department of Commerce Grant and related appropriations from bid document for Phase I in the amount of $25,000.

Council Member Combest made a motion to approve Capital Project Ordinance CPO-LCR-2018-1 to amend Lewisville-Clemmons Road Connectivity Project for confirmation of Department of Commerce Grant and related appropriations from bid document for Phase I in the amount of $25,000 (attached hereto as Exhibit E and incorporated as a part of the minutes). The motion was seconded by Council Member Wrights and unanimously approved.

F. Discussion of After Hours Access to Trash Compactors and Mulch – Council

consensus was to direct Staff to offer access to the trash compactor and mulch twice a month for a half day on Saturdays and publicize via social media outlets. There will be two Public Works employees staffed on those days (morning hours to be determined). The mulch will be offered weather-permitting. This service is being offered on a trial basis from April through September 2018 and usage will be tracked.

G. Council Comments – Council Member Barson provided an update on a meeting

she had with Lt. Shutt to discuss the Tanglewood Lights traffic situation. He advised that this is a volunteer system with the staffing of Forsyth County deputies for traffic control. Council Member Barson stated there are some logistical improvements that can be made and requested Council consider requesting Manager Buffkin to get a seat at the table at meetings that are held twice a year prior to and following the Tanglewood Lights with the County. Council consensus was to direct Manager Buffkin to get a seat at the table for one or two Council members at the meetings related to the Tanglewood Lights. Council Member Barson touched briefly on the elevation and necessary dirt for the library site and the County mentioning a cost-sharing opportunity for the Village. Council consensus was to direct Planner Ledbetter and Public Works Director Gunnell to look for opportunities for low-cost dirt.

H. Closed Session for Discussion Under Attorney-Client Privilege in accordance

with NCGS 143-318.11(a)(3).

Council Member Wrights made a motion to reconvene the regular meeting with no action taken during Closed Session. Council Member Combest seconded the motion which was unanimously approved.

Idols Road Project Update – March 26, 2018

• The County Commissioners has decided to name the business park "TanglewoodBusiness Park", as Idols Road Business Park was just a working name. All the documentsgoing forward will reflect this.

• The County is scheduled to vote on the Declaration of Protective Covenants for the Parkthis Thursday (March 29, 2018) and County personnel have promised a copy will bedelivered to us once they are approved.

• The County has heard back from Norfolk Southern with the information that is neededfor the TIA. County staff reports they expect to receive a draft of the study on April3rd. After that, the NCDOT will need to sign-off. We have been promised a copy of thatas well.

• The Beaufurn closing was moved to May 10th

Organization: Village of Clemmons, North Carolina Licensing and Services: Events Calendar Software and Management – I’m Going Contract Period: April 15th, 2018 – April 15th, 2019 Fee: $16,000 No Early Termination; No Refunds. The contract period will end on the expiration date and the agreement cannot be cancelled early. Either party may terminate this agreement for cause, as to any or all services: (i) upon thirty (30) days’ notice to the other party of a material breach if such breach remains uncured at the expiration of such period, or (ii) immediately, if the other party becomes the subject of a petition in bankruptcy or any other proceeding relating to insolvency, liquidation or assignment for the benefit of creditors. This agreement may not otherwise be terminated prior to the end of the contract period.

RESOLUTION DECLARING HISTORIC PRESERVATION MONTH IN CLEMMONS, NORTH CAROLINA

MAY 2018 WHEREAS, the Village of Clemmons joins cities and counties across the United States in a nationwide celebration of Historic Preservation Month, and;

WHEREAS, historic preservation is an effective tool for economic development, tourism promotion, revitalizing neighborhoods, fostering local pride, and maintaining community character while enhancing livability; and

WHEREAS, historic preservation is relevant for all communities across the nation, both urban and rural, and for all neighborhoods and citizens all over the Village of Clemmons; and

WHEREAS, it is important to celebrate the role of history in our lives and the contributions made by dedicated individuals in helping to preserve the tangible aspects of the heritage that has shaped us as a people; and

WHEREAS, Historic Preservation Month is co-sponsored by the Forsyth County Historic Resources Commission and other local preservation and neighborhood organizations throughout Forsyth County, and

WHEREAS, these organizations encourage members of the community to participate in creative and fun events related to historic preservation as a way to celebrate Preservation Month 2018, and

WHEREAS, there are over thirty events scheduled in Forsyth County for citizens to attend.

NOW, THEREFORE, BE IT RESOLVED, that the Mayor and Village Council of Clemmons do hereby declare the month of May 2018 as Historic Preservation Month and call upon the people of Clemmons to join their fellow citizens across the United States in recognizing and participating in this special observance.

BE IT FURTHER RESOLVED that this resolution be spread upon the minutes of the Village Council and that a copy be furnished to the Forsyth County Historic Resources Commission. Adopted this 23rd day of April, 2018

AN ORDINANCE DECLARING A SPEED LIMIT MODIFICATION BY THE VILLAGE OF CLEMMONS

WHEREAS, N.C.G.S. 160A-296 provides that cities shall have general authority and control over all public streets, and N.C.G.S. 160A-174 provides that municipalities may by ordinance regulate conditions detrimental to the safety of its citizens; and WHEREAS, on occasion the Village of Clemmons may determine that speed limit controls require amending on streets where special circumstances warrant such a declaration for a safe and reasonable speed limit; and WHEREAS, the Village of Clemmons has received, pursuant to the Residential Speed Limit Policy, a valid petition of at least 75% of the dwelling units on Blue Bonnet Lane (West of Kinnamon Road); and WHEREAS, the streets in the above mentioned subdivision are not part of the State’s street system; and WHEREAS, to ensure the enforceability of the speed limit on Blue Bonnet Lane (West of Kinnamon Road), it is necessary for the Village of Clemmons to adopt an ordinance to comply with statutory requirements. NOW, THEREFORE, be it ordained and resolved that the speed limit on Blue Bonnet Lane (West of Kinnamon Road) located within the municipal limits of the Village of Clemmons, shall be twenty-five (25) miles per hour, effective the date of adoption. An Ordinance to Allow the Sale of Alcoholic Beverages Before Noon on Sundays at Licensed Premises

WHEREAS, on June 29, 2017, the North Carolina General Assembly enacted Senate Bill 155, entitled “An Act to Make Various Changes to the Alcoholic Beverage Control Commission Laws”; and

WHEREAS, Section 4 of Ratified Senate Bill 155 authorizes city and county governments to adopt an ordinance to allow alcohol sales beginning at 10 am on Sundays; and

WHEREAS, Ratified Senate Bill 155 was signed into law by Governor Roy Cooper on the 30th day of June, 2017 and became effective on that date (Session Law 2017, Chapter 87); and WHEREAS, by enacting Senate Bill 155, North Carolina joins 47 other States in allowing alcohol service before noon on Sunday; and

WHEREAS, Sunday morning alcohol service will allow the hospitality community and retail merchants in our community to meet the needs of their customers; and

WHEREAS, Sunday morning alcohol service will benefit our small business community, bring people into business districts earlier in the day, and generate increased tax revenues; and WHEREAS, our community has a diverse and growing population with different religious beliefs, each of which has various times and multiple days for worship;

NOW, THEREFORE, BE IT ORDAINED by the Village Council of the Village of Clemmons, North Carolina that: Section 1. Pursuant to the authority granted by S.L. 2017-87 any establishment located in the corporate limits of the Village of Clemmons and holding an ABC permit issued pursuant to G.S. 18B-1001 is permitted to sell beverages allowed by its permit beginning at 10:00 A.M. on Sundays.
