Meeting Minutes:

Call to Order: Meeting called to order at 9:00 a.m. by Ms. Carrier. A sign-in sheet was passed to each person. Agenda Item 1: The minutes from the August 15, 2012 meeting were reviewed. Mayor Humphrey made a motion for the board to approve the document. Mr. Hartman seconded the motion. All approved. Motion carried. Agenda Item 2: Consider approval of Self-Certification Resolution Mr. Berry stated that an Executive Board vote was required to approve and endorse the Self Certification Resolution before proceeding to amend the 2011-2014 TIP (Resolution 2012-05). The Johnson City MTPO is required by federal law to provide Self Certification that the Johnson City MTPO meets requirements of U.S. Code 23 of the Federal Regulations 450.334. Ms. Fleming made a motion for the board to approve. Mr. Hartman seconded the motion. All approved. Motion carried. Agenda Item 3: Consider approval of Amendment (Resolution 2012-08) to the FY 2011-2014 TIP to include 5309 funding for capital expenses for FY 2012 for Johnson City Transit. Mr. Rawles stated the 5309 funds for the Johnson City Transit bus storage lot was not ready to move forward at this time as it still needed further review. The Board agreed to defer the portion of 5309 capital funds for the bus storage lot and approve the amendment for capital vehicle replacement. Mr. Hartman made a motion for the board to approve capital vehicle replacement amendment and defer bus storage lot amendment. Ms. Fleming seconded the motion. All approved. Motion carried. Agenda Item 4: Other business/Citizens concerns. Mr. Berry informed Executive Board and Staff that the TDOT Commissioner will be doing a bus tour throughout the state and will be making a stop in Johnson City on October 18, 2012. Mr. Berry indicated that a light breakfast will be provided and that the location and time will be provided at a later time. Agenda Item 5: Ms. Carrier made closing statements, and the meeting was adjourned at approximately 9:10 a.m.

ITEM 2 Resolution 2013-01 “Smoothed / Adjusted” Urbanized Area and Metropolitan Planning Area By federal law the U.S. Census Bureau has the responsibility to define and delineate “urban and rural” areas for the United States. In this process the U.S. Census Bureau develops the official criteria for urban and rural areas, as well as actually defining the geographic boundaries, based on the U.S. Census Topologically Integrated Geographic Encoding and Referencing (TIGER) base maps. It should be noted the criteria for determining “Urban and Rural” areas, as well as the geographic boundaries, change with every decennial census. Many federal and state agencies use the rural and urban information for various programs and funding formulas. This includes the U.S. Department of Transportation, Federal Highway Administration, Federal Transit Administration, and Tennessee Department of Transportation. One of the issues that arise when using the TIGER base maps is they often do not exactly match what is on the ground or reflect the purpose of the programs being administered. For instance when using the Urbanized Area Boundary maps to determine “rural or urban” road classification, the urbanized area boundaries defined by the U.S. Census Bureau may hop from one side of the road to the other leaving “gaps” of inconsistency. Federal law recognizes this and allows for “Smoothing and Adjusting” of the urbanized area to develop more logical boundaries and assist in developing a better Metropolitan Planning Area Boundaries, within federal guidelines, to meet the needs of transportation planning. At a minimum the “smoothed/adjusted” urbanized boundary must include all of the area defined by the U.S. Census Bureau. With that in mind, the Johnson City Metropolitan Transportation Planning Organization has completed the “smoothing and adjusting process for the urbanized area and updated the MTPO Planning Area (MPA) Boundary. It should be noted the official population for the Urbanized Area, as defined by the U.S. Census Bureau does not change due to this adjustment. In the process the Johnson City MTPO completed the following steps. 1. The Johnson City MTPO downloaded the Urbanized Area GIS files from the U.S. Census Bureau and overlaid it with the accurate base maps, include the existing Johnson City MTPO Planning Area Boundary. 2. As mentioned before, the TIGER base maps do not reflect actual ground conditions. The MTPO used current aerial photography and property base maps to “smooth and adjust” the inconsistent nature of the maps provided by the U.S. Census Bureau to meet the needs of the MTPO and FHWA. The following criteria were used to smooth and adjust the UZA for Johnson City.

The adjusted UZA must at a minimum include all areas of the UZA provided by the U.S. Census Bureau

The UZA must be one single, contiguous area and eliminate gaps created by the U.S. Census Bureau’s automated mapping process

Include areas with urban characteristics

Include all large traffic generators

The Johnson City MTPO also took into consideration the continuity of roadways when defining the UZA eliminating the irregular jumping from one side of the road to the other along certain boarders of the UZA provided by the U.S. Census Bureau. 3. In the case of the Johnson City Urbanized Area, through the U.S. Census Bureau’s automated mapping process, part of the existing Bristol Urbanized Area was actually “renamed” to part of the Johnson City Urbanized Area. The Johnson City MTPO staff contacted the U.S. Census Bureau in Washington and requested an explanation for this anomaly. The U.S. Census Bureau stated it had followed their criteria and the automated mapping procedures when developing the Urbanized Area and there was no recourse for the urbanized area to be changed. 4. As a result of this process, the Urbanized Area of Johnson City and Bristol was reviewed by the Johnson City MTPO staff, along with its consulting firm for the Long Range Transportation Plan Development as well as the existing MPA Boundaries for both the Johnson City MTPO and Bristol MPO. Technical staff from both MPOs met to review federal law as it relates to smoothing process for UZA’s and MPO boundaries. When developing the MPA Boundaries federal law, U.S.C. 23 450.312 (g) will not allow MPA boundaries to overlap. It only states it must be contained in a MPA boundary and it does allow for two MPOs to exist in the same Urbanized Area as long as the MPA boundary does not overlap. Thus the when developing the Johnson City MTPO developed its new MPA boundary it was extended to include urbanized area along U.S. 11 E to Allison Road in Johnson City. From that point north the remaining urbanized area is in the existing Bristol, TN MPA boundary. This is especially important since the Bristol MPO Long Range Transportation Plan valid for two more years. During the development of the Bristol Long Range Transportation Plan this issue will be revisited. However, all transportation planning needs are being met, all urbanized areas, whether the name be Johnson City UZA or Bristol UZA are within an Metropolitan Planning Area, thus both MPOs are in compliance with federal law. Figures 1 through 3 show the process of developing the MPA Boundary for the Johnson City MTPO while taking into consideration existing MPA of the Bristol, TN MPO.

RESOLUTION 2013-01

RESOLUTION ESTABLISHING THE “SMOOTHED AND ADJUSTED” URBANIZED AREA AND

METROPOLITAIN PLANNING AREA BOUDNARY BASED ON THE 2010 CENSUS URBANIZED AREA

WHEREAS, the Johnson City Metropolitan Transportation Planning Organization (MTPO) is responsible for the transportation planning and coordination for the Johnson City Urbanized Area; and

WHEREAS, the U.S. Census Bureau designates a new list of Urbanized Areas (UZAs) every 10

years, after the completion of the decennial census; and WHEREAS, federal law requires that every UZA with a population of 50,000 or more persons,

and the surrounding area expected to be urbanized in the next 20 years be included in an Metropolitan Planning Organization planning area boundary to allow for continuing, cooperative, and comprehensive (“3-C”) transportation planning process; and

WHEREAS, the Johnson City MTPO Long Rang Transportation Plan is due on March 18, 2013; and

WHEREAS, the Johnson City MTPO technical staff has used criteria from the Federal Metropolitan Transportation Planning Regulations found in 23 CFR 450.312 to smooth and adjust Urbanized Area Boundary and Metropolitan Planning Area Boundary that are logical from a regional transportation planning context NOW THEREFORE, BE IT RESOLVED BY THE JOHNSON CITY METROPOLITIAN TRANSPORTATION EXECUTIVE BOARD:

THAT the Executive Board hereby adopts the Johnson City MTPO “Smoothed /Adjusted Urbanized Area” and the Metropolitan Planning Area based on the 2010 Urbanized Area from the U.S. Census Bureau.

ITEM 3 RESOLUTION 2013-02: 2040 Long Range Transportation Plan for the Johnson City Metropolitan Transportation Planning Organization The Johnson City MTPO has completed updating the Johnson City MTPO 2040 Long Range Transportation Plan and is ready for consideration by the Executive Board for adoption. The 2040 LRTP has been reviewed by the Tennessee Department of Transportation, Federal Highway Administration and Federal Transit Administration. The afore-mentioned agencies are in concurrence that the document has been developed in compliance with federal law, has demonstrated fiscal constraint, and significant public outreach has been included in developing the updated plan. The plan has been made available in both hardcopy and electronic format. It is recommended this item be approved by MTPO Executive Board by vote and accompanying resolution.

RESOLUTION 2013-02

RESOLUTION ADOPTING THE 2040 LONG RANGE TRANSPORTATION PLAN FOR THE JOHNSON CITY

METROPOLITIAN TRANSPORTATION PLANNING ORGANIZATION

WHEREAS, the Johnson City Metropolitan Transportation Planning Organization is responsible for the transportation planning and coordination for the Johnson City Urbanized Area; and

WHEREAS, the Johnson City Metropolitan Transportation Planning Organization Executive Board

has the authority to adopt plans and programs; and WHEREAS, the development of a Long Range Transportation Plan was completed in accordance

with Title 23 United States Code, Section 134, Metropolitan Transportation Planning; and WHEREAS, various local, state, regional, and federal agencies, involved with transportation

planning for the Johnson City Urbanized Area have cooperatively developed the Johnson City MTPO 2040 Long Range Transportation Plan; and

WHEREAS, the Long Rang Transportation Plan has been presented to various public groups and completed the required 30-day public review and comment period; NOW THEREFORE, BE IT RESOLVED BY THE JOHNSON CITY METROPOLITIAN TRANSPORTATION EXECUTIVE BOARD:

ITEM 4 Resolution 2013-03 Consider a resolution reaffirming the “Self Certifications and Federal Certifications” for the Johnson City MTPO that must accompany amendments to the Transportation Improvement Program (TIP).

The Johnson City MTPO is required to comply with federal law to “Self Certify” they are following all regulations as identified in U.S. CFR 23 Section 450.334 and an approved certification must be sent with the entire proposed TIP or when it is amended. It is recommended this item be approved by MTPO Executive Board by vote and accompanying resolution.

RESOLUTION OF THE EXECUTIVE BOARD OF THE JOHNSON CITY METROPLITAN TRANSPORTATION PLANNING ORGANIZATION (MTPO) to Re-Affirm the

“Self Certifications and Federal Certifications”

WHEREAS, in accordance with the requirements of the U.S. Department of Transportation, the Johnson City MTPO is required to prepare a Transportation Improvement Program (TIP); and WHEREAS, the Transportation Improvement Program (TIP) documents a cooperatively developed program of projects scheduled for implementation during the projected four-year period; and WHEREAS, the Johnson City MTPO has adopted a Long Range Transportation Plan which serves as a guide for the development of the Transportation Improvement Program (TIP); and WHEREAS, in accordance with the requirements set forth in MAP-21, the Johnson City MTPO Executive Board hereby determines the use of various Federal Highway Administration funds, including Surface Transportation Program, Bridge Rehabilitation and Reconstruction, STP Enhancement, National Highway System, Highway Safety Improvement Program, Interstate Maintenance, Federal Transit Administration Capital Operating and Planning, and American Recovery and Reinvestment Act of 2009, commonly referred to as Economic Stimulus funds for the Johnson City MTPO Area projects, as listed in the TIP; and WHEREAS, the Johnson City MTPO does hereby certify that the requirements of U.S. Code 23 of the Federal Regulations 450.334 are met. NOW THEREFORE, BE IT RESOLVED, that the Executive Board and Executive Staff of the Johnson City Metropolitan Transportation Planning Organization do hereby approve and endorse the following certifications, as set forth in U.S. 23CFR Section 450.334, as to be submitted with the Johnson City MTPO Area FY 2011-2014 Transportation Improvement Program as amended.

ITEM 5 It is recommended that the TIP be amended with one resolution for items 5a and 5b by MTPO Executive Board. 5a Transportation Improvement Program (TIP) Amendment. Consider approval of an amendment to the FY 2011-2014 TIP to include additional funding Johnson City Safe Routes to School (Cherokee School) Project for construction (CN) phase and include funding to enhance the traffic signal system along SR 381 (State of Franklin Road) which has been identified major congested traffic corridor in the region, located in Johnson City, TN. The city of Johnson City received a “Safe Routes to School” grant several years ago in the amount of $250,000 funded at 100 percent federal funding. However, this amount was not enough to complete the project. It was not the intention of the federal government, the Tennessee Department of Transportation, nor the MTPO to place a finical burden on local jurisdictions with this grant. Since the maximum amount of the grant is only $250,000 the Johnson City MTPO has funding to cover the additional cost to complete this existing project. The funding for the additional costs unfortunately are not at 100 percent federal funds, but rather at an 80 percent federal funding level with the local jurisdiction paying the remaining 20 percent.

ITEM 5b 5b Transportation Improvement Program (TIP) Amendment. In an ongoing effort to efficiently operate and maintain the transportation network in Johnson City, SR 381 (State of Franklin Road) has been identified major arterial serving East Tennessee State University, the Veterans Affairs Administration Complex, Mountain States Health Alliance Complex and other business as well as access a primary access to downtown Johnson City. Traffic has continued to grow along this corridor and congestion has grown. This corridor does not fit the typical, evenly spaced grid pattern of development that is suited for traditional traffic signal timing methodology. Instead, this corridor sees fluctuation in traffic patterns throughout the day and calls for adaptive traffic signal control. The Traffic Division of Johnson City has an existing project along the corridor that allows traffic signals (traffic controllers) to communicate along the corridor, however the ability to “adapt” to traffic conditions in real-time is not present. This requires the next generation of hardware and software to accomplish the goal of improving safety along this corridor, improve safe traffic flow and reduce crashes. For the existing system to be enhanced the existing TIP must be amended in the amount of $290,000. As these projects are both existing project and using federal funds the existing Transportation Improvement Program (TIP) is required to be amended to include the additional funding. The funding for items 5a and 5b will come from an existing project that has been delayed for construction by at least two to three years by the Johnson City Commission, the roundabout at Greenline Road. RESOLUTION OF THE EXECUTIVE BOARD OF THE JOHNSON CITY METROPOLITAN TRANSPORTATION PLANNING ORGANIZATION (MTPO) TO AMEND

THE 2011-2014 TRANSPORTATION IMPROVEMENT PROGRAM BY INCLUDING FUNDING FOR JOHNSON CITY SAFE ROUTES TO SCHOOL (CHEROKEE SCHOOL) PROJECT AND TO INCLUDE FUNDING FOR

ADAPTIVE SIGNAL CONTROL FOR THE SR 381 CORRIDOR

Whereas, Johnson City Metropolitan Transportation Planning Organization (MTPO) is responsible for

programming of funds for Transportation Purposes; and

Whereas, it is the responsibility of the Johnson City MTPO to program these funds for transportation

projects in the Transportation Improvement Program (TIP); and

Whereas, the City of Johnson City completed the first phase of this project with Safe Routes to School

grant; and

Whereas, the Johnson City MTPO FY 2011-2014 Transportation Improvement Program must be

amended to show the addition of construction funds for the Johnson City Safe Routes to School project

for Cherokee School; and

Whereas, the Johnson City MTPO FY 2011-2014 Transportation Improvement Program must be

amended to show the addition funds for the adaptive signal control improvement project along SR 381

Corridor in Johnson City; and

NOW THEREFORE, be it resolved the Executive Board of the Johnson City Metropolitan

Transportation Planning Organization does amend the 2011 – 2014 Transportation Improvement

Program to show the addition of construction funds for Johnson City Safe Routes to School Project and
