AGENDA ITEM FOR ADMINISTRATIVE MEETING ( ) Discussion only ( X ) Action FROM (DEPT/ DIVISION): County Counsel SUBJECT: Umatilla County Fire District #1 Annexation Background: The county received a petition by property owners and voters from the Hat Rock and Salmon Point areas to annex into the Umatilla County Fire District #1 from the Umatilla Rural Fire Protection District. A public hearing on the annexation is set for May 6. There were sufficient number of property owners and voters that signed the petition to not require an election on the petition. Following the public hearing, the Board can approve the annexation. The Umatilla Rural Fire Protection District Board of Directors has been approached by several

home and land owners from the Hat Rock and Salmon Point Lane areas. These individuals

stated that they represent the interests of these areas as a whole.

The purpose of their presentation was to solicit support from the Board of Directors of the Umatilla Rural Fire Protection District, for the boundary of the two districts to be adjusted so that the Hat Rock and Salmon Point areas are annexed into the Umatilla County Fire District #1 .

Their desire for this annexation is due to the Insurance Standards Organization's (ISO) ratings that they currently have with Umatilla Rural Fire Protection District of a 10, versus the rating of a 3 they anticipate getting by inclusion into the Umatilla County Fire District #1 's District. The

lower rating will decrease the insurance costs to these residents and landowners significantly.

The Umatilla Rural Fire Protection District Board of Directors has considered this proposal to determine if there are negative impacts to the District overall or its stakeholders. After careful consideration, the Umatilla Rural Fire Protection District Board of Directors has voted to support

the wishes of the residents and landowners of the Hat Rock and Salmon Point areas in requesting this issue be put before the voters in a special election.

THE BOARD OF COMMISSIONERS OF UMATILLA COUNTY

STATE OF OREGON

In the Matter of Annexation )to Umatilla County Fire District ) Order No. BCC2020-032#1 and Removal from Umatilla )Rural Fire Protection District )

WHEREAS, in accordance with ORS 198.850, the Umatilla CountyBoard of Commissioners has received a petition from land owners inan unincorporated area of Umatilla County that desire annexation tothe Umatilla County Fire District, #1 and removal from the UmatillaRural Fire Protection District;

WHEREAS approximately 52% of the electors in the proposed areato be annexed and 84% of the property owners desiring annexation have signed the petition;

WHEREAS the board of the Umatilla Rural Fire ProtectionDistrict and the Umatilla County Fire District #1 have indorsed thepetition for annexation;

WHEREAS, in accordance with ORS 198.850, the Board ofCommissioners adopted Order No. BCC2020-025 accepting the petitionand scheduled a hearing on the proposed annexation for May 6, 2020;

WHEREAS, notice of the public hearing on this annexation waspublished in the East Oregonian on April 22 and 29, 2020, and wasposted at the following locations: Umatilla County Fire District#1, 320 S. First Street, Hermiston; Stafford Hansell GovernmentCenter, 915 SE Columbia Drive, Hermiston; and the Umatilla CountyCourthouse, 216 S.E. 4th Street, Pendleton, Oregon, and on theUmatilla County website;

WHEREAS, on May 6, 2020, the Board of Commissioners held apublic hearing on the proposed annexation to determine if thepotential annexation would be appropriate and in compliance withthe requirements of ORS 198.855 for an annexation without election,to consider public input and the potential new boundary of theUmatilla County Fire District #1 if the proposed territory isannexed.

NOW THEREFORE, the Board of Commissioners orders that:

1. The requirements of ORS Chapter 198 concerning thisproposed annexation of territory into the Umatilla County FireDistrict, #1 and removal from the Umatilla Rural Fire ProtectionDistrict are met.

2. The petition for annexation was signed by an adequatenumber of electors and owners so that pursuant to ORS 198.855(3) anelection of the proposed annexation is not required.

3. The property proposed to be annexed to the district willbe benefitted by the annexation with additional services beingprovided and reduction in cost of fire insurance.

4. The following territory is annexed to the Umatilla CountyFire District #1:

Beginning at Northwest corner of Northeast Quarter ofSection 16, Township 5 North, Range 29; thence East alongthe section lines to Northeast corner of Section 13,Township 5 North, Range 29; thence South to Southeastcorner of said Section 13; thence southwesterly in astraight line to Southwest corner of Section 24, Township5 North, Range 29; thence North to Northeast corner ofSoutheast Quarter of Section 23, Township 5 North, Range29; thence West along the section centerlines to centerof Section 21, Township 5 North, Range 29; thence Northto point of beginning; Excepting any portion within theColumbia River. All being East of Willamette Meridian,Umatilla County, Oregon.

5. The property described in paragraph 4 is withdrawn fromthe Umatilla Rural Fire Protection District.
