Subject: Confirmation of the minutes of 257th meeting of the Finance & Contract

Committee held on 21.12.2015 at 3.00 p.m. in the Committee Room of the

Municipal Corporation, Chandigarh.


Subject: Budget Estimate for the year 2016-17.

Note: Booklet regarding budget estimate is being sent separately.


Subject: Installation of Low Power Transformers on Street Light poles regarding.

Keeping in view the technological advancements in the telecom sector and to

provide seamless coverage, M/s Reliance Jio Infocomm Limited (RJIL) have come out with

an innovative low power mobile coverage known as Micro Cell Solution to overcome the

coverage gaps due to less number of normal sites and challenges due to 2300 Hz band

allotted to them for 4G services. Under this scheme, a small electronic unit with its

accessories shall be installed on the existing and new electricity poles. RJIL have requested

for installation of micro cells on approx. 500 street poles and ready is pay rent @ Rs. 500 per

pole /month with annual increase of rent by 5%.

The Chandigarh Administration has issued a notification bearing no. 26/2/22

UTF (3)-2015/2140 dated 09.03.2015, namely, “Chandigarh Policy on Travers for mobile

Telephone and Data Services.” In this policy, restrictions on locations, foot prints, height,

sharing, safety, fee & charges, documents required have been stipulated. The license fee

and in addition ground lease fees, in case of Govt. land has also been fixed in the said

notification.

However, the proposal submitted by RJIL is a different/ innovative technical

solution which does not get covered under the existing Tower Policy. The proposal under

consideration is installation of micro cell on existing infrastructure and this does not required

any additional civil construction which may hinder and spoil the aesthetic of the city

architecture.

RJIL has also submitted that in Municipal Commissioner, Delhi and PSPCL,

Punjab only rental charges are being paid. MC Delhi is charging Rs. 1096.28 per pole per

annum and PSPCL Punjab is charging rental of Rs. 180 per pole per annum.

The proposal was examined on file and it was decided to invite Expression of

Interest (E0I) on the Swiss model for renting minimum 500 street light pole. Accordingly, E0I

was invited on 29.10.15. M/s AIRTEL has offered

rental of Rs. 1000/ month per pole with 5% annual increase. Further, vide their letter dated

03.12.2015, they have informed that they require only 50 sites in the initial phase. The said

offer is not in line with the E0I invited by MC, Chandigarh.

In view of the above, the matter is placed before the Finance & Contract

Committee for its consideration and decision of the following:

1) To allow Reliance Jio Infocomm Limited to install Microcell Solution on electrical poles

@ Rs. 500 per pole per month for 5 years with annual increase in rent by 5%

2) To reject the proposal of M/s Airtel being non-responsive.

Subject: To make a policy for sale and purchase of old two wheelers in the Scooter

Bazaar running in parking area of Sector 41-D, Chandigarh.

It is hereby intiamated that the agenda to frame the policy for sale as per

the office record and the report of area SDE (Roads), there are 22 number of sites with the

size of 15 Rft X 30 Rft are available for the business of sale and purchase of second hand

scooters (two wheelers) in the parking area of Sector 41-D, Chandigarh. Presently there are

21 sites where the business of sale and purchase of Old Scooters/two Wheelers in the

parking area of Sector 41-D, Chandigarh are running. Thus, one site is vacant for the said

purpose.

It is further submitted that earlier, the business of sale and purchase of old

Scooter/ two wheelers were running in the different Sectors of the city. Without any policy the

same have been shifted to the parking area of Sector 41-D, Chandigarh. It is also submitted

that as per the office records there are two sites in Sector 22-D, Chandigarh out of which one

dealer taking the permission from this office regularly but the second dealer has not taking

the permission from last more than two years. But, they are regularly pressing hard the office

to shift them from Sector 22 to Sector 41-D, Chandigarh along with other dealers for running

the business of sale and purchase of Old Scooter/Two Wheeler vehicles. But presently only

one site is vacant in sector 41-D, Chandigarh.

In view of above, the matter is placed before the F&CC for:-

1. Fixing the reserved price:-

Presently this office charging the fees of Rs. 450/- + S.Tax for the size of 15‟x30‟ against every Sunday from each dealer.

Weekly fees Rs. 450x1week = Rs. 450/-Monthly fees Rs. 450 x 4 week = Rs. 1800/-Yearly fees Rs. 450 x 52 weeks = Rs. 23400/-Therefore, it is proposed that the reserved price for the auction of scooter bazaar site

may be fixed for Rs.30000/- P.A. as presently fee charging for the permission of scooter

bazaar site of size 15‟x30‟ was fixed on 21-02-2009 by the F&CC in its 183rd (adjourned) meeting.

2. Approval of Terms and Conditions:-

The terms and conditions to allot and regulate the old scooter bazaar is proposed as

Annexure A&B.

The agenda is placed before the F&CC for consideration and decision please.

Subject: Inclusion of conditions in the exiting terms and conditions of Old Car Bazaar, Sector 7-C, Madhya Marg, Chandigarh.

The Municipal Corporation, Chandigarh has published an advertisement for

conducting an auction of 21 number sites for running the business of sale and purchase of

old cars in the Old Car Bazaar, Sector 7-C, Chandigarh only on Sunday(s). Against the said

advertisement only 10 number applications have been received in the office.

As certain points have been raised before the office. Thus, to resolve the same

the following points are required to be included in the existing terms and conditions of the Old

Car Bazaar:

1. The allottee can appeal before the Commissioner, Municipal Corporation, Chandigarh,

if any dispute arise at any stage or in case of dissatisfaction of the decision of the

Additional Commissioner/Joint Commissioner/ Assistant Commissioner, Municipal

Corporation, Chandigarh. The decision of the Commissioner, Municipal Corporation,

Chandigarh will be final.

2. The allottee can surrender his/her site, address to the Additional Commissioner/Joint

Commissioner/ Assistant Commissioner, Municipal Corporation, Chandigarh. The

allottee has to inform the Corporation well in advance atleast 60 days before

surrendering the site and also clear all the dues pending against him/her.

3. The Commissioner, Municipal Corporation, Chandigarh reserves all the rights to

increase or decrease the sites to be included in the auction, any time, without giving

any reason.

The case is submitted before the F&CC for its approval to include these conditions in

the existing terms and conditions of the Old Car Bazaar.



Subject: Auction of Ideal Truck Parking, Sector 26 (transport area), Chandigarh.

Sh. Lalit Joshi, was allotted the License to operate Ideal Truck Parking, Sector

26, Chandigarh initially for a period on one year extendable upto a maximum of 3 years, on

year to year basis, subject to satisfactory performance of terms and conditions of the

licensee on payment of license fee at the rate of Rs. 61.10 Lac per annum. The licensee took

the Physical Possession on 17.12.2013.

The period of one year of license expired on 16.12.2014 and Sh. Lalit Joshi

Licensee did not apply for further extension of the license, However, on his request he was

allowed to run the Paid parking of Ideal Truck Parking, Sector 26, Chandigarh till the

finalization of the auction process and further allotment of the said PPA to new licensee on

the running terms and conditions and license fee i.e. Rs.61.10 Lac per annum.

The auction of the allotment of parking contract was held on 21.01.2015 and

Sh. Narinder Kumar Awasthi gave highest bid for an amount of Rs. 63 Lac, but he did not

deposit 25% of the bid amount at the time of fall of hammer and thereafter, the M.C., in view

of Clause 2 of amended Terms and Conditions forfeited his earnest money amounting to Rs.

4.13 Lac. The said parking was again put on auction and technical bids were scheduled to

be opened on 2.6.15, but Sh. Lalit Joshi filed a CWP in Hon‟ble High Court and the Court

granted stay for auction of Ideal Truck Parking(Annexure-I). The Municipal Corporation filed

an appeal in the Supreme Court and the Hon‟ble Supreme Court has stayed the

implementation of the impugned order and allowed the Municipal Corporation to hold fresh

auction (Annexure-II). As per order of Hon‟ble Supreme Court the Corporation can hold fresh

auction for this parking.

As agenda in this regard alongwith other various parking sites was placed

before the F&CC in its meeting held on 9.11.2015, but no decision was taken by the F&CC,

(Annexure- III)

The committee constituted by the Mayor, in its meeting held on 30.9.2015, has

recommended that the paid parking areas be allotted through e-tendering (Annexure-IV).

This parking is situated in the transport area Sector 26, Chandigarh and is

meant for parking of trucks only and the rate of parking is Rs.50/- for Truck per day (24 hour)

and Rs. 75/- for Multi Axle Vehicle per day (24 hour). Presently, Sh. Lalit Joshi is running the

said paid parking at a license fee of Rs. 61.10 Lacs.

The matter is placed before the F&CC to decide as to whether this parking may

be allotted through open auction or e-tendering.



Subject: Resumption of site no. 52, 55 & 56 of Old Car Bazaar , Sector 7-

C, Chandigarh.

The brief history of the 60 sites of Old Car Bazaar, Sector 7-C, Madhya Marg,

Chandigarh, which were auctioned on 20.05.2015 is as under:

1. All the 60 sites for running the business of old car bazaar in parking area

of Sector 7-C, Chandigarh on Sunday only were auctioned on 20.5.2015.

2. Out of 60 successful bidders, only 43 number successful bidders have

been issued allotment letters after receiving their 50% dues (i.e Ist and IVth

instalment) and completion of other formalities as per the terms and conditions

of the old car bazaar.

3. The Municipal Corporation, Chandigarh cancelled the allotment and

forfeited the earnest money i.e. Rs. 25,000/- of all the 17 successful bidders,

who did not deposit the due amount and fulfil the other formalities as per the

clause 15 of the general instructions/terms and conditions of old car bazaar.

Thus, as per the instructions, the same un-allotted sites were offered to the

second highest bidders. Who further did not come forward to take the

possession of these sites, therefore, the earnest amount deposited by them

were also forfeited.

4. Out of 43 allottees, the following four (4) number sites were cancelled due

to non-deposition of 2nd instalment and Bank Guarantee.

3rd instalment, Bank Guarantee alongwith interest payment @ 12% on the delay

payment or to consider their sites remained cancelled as per the decision of the

authorities under the light of the terms and conditions of the allotment letter of

the Old Car Bazaar.

Subject:- Rough Cost Estimate for Providing and fixing of Dustbins in various parks of Sector 37, 38 & 38 (West), Chandigarh (Under Landscaping).

(Approx. Amount: Rs.2.76 lacs)

The rough cost estimate for providing and fixing of Dustbins in various parks of

Sector 37, 38 & 38 (West), Chandigarh (Under Landscaping) was occurred as there is a dire

need for providing the same in the said locations. Moreover, these parks are also

maintained by different Resident Welfare Association so that said areas may be maintained

regularly clean.

In this regards, the site has been visited by the Executive Engineer alongwith concerned

S.D.E. and J.E.. Accordingly, a rough cost estimate amounting to Rs.2.76 lacs has been

prepared and submitted for arranging administrative approval and allotment of funds under

the appropriate Head of Accounts.

It is certified that scope of work taken in this estimate has not been earlier

included in any of the estimate.

Subject: Providing HT/LT Work at Community Centre, Sector 47, Chandigarh.

This Estimate has been framed for providing HT/LT power supply to meet up

power requirements of Janj Ghar, Sector 47, Chandigarh. The Electrical power requirement

for lighting, water pumps, lifts and Air Conditioning System etc in totality is around 383

Kilowatts. Hence one no. 3 phase package type transformer 500 KVA Dry Type 11 KV/433V

along with allied components, control cable, DWC pipe for main cable, G.I Pipe, EDO ACB,

RMU, VCB, tri vector meter 3 CORE 120 Sq. mm HT cable and Main LT Panel consisting

bus bars of required size including MCCBs of various capacity and other accessory is

required. It is certified that the site has been visited and inspected by the EE/Elect. along with

the concerned SDE/Elect. & JE incharge of the area. Therefore this Rough Cost Estimate

has been prepared for the convenience for the general public.

Accordingly this Rough cost estimate amounting to Rs.41.85 lacs has been

framed for seeking Administrative Approval under head “4217 Plan Electrification”.

The Scope of work involve (i) Package type transformer 500 KVA Dry Type 11

Subject: Agenda for granting permission for shooting documentary files, promotional shooting and commercial shooting in various gardens under jurisdiction of Municipal Corporation, Chandigarh.

The Municipal Corporation, Chandigarh has number of well maintained and

beautiful gardens such as Rose Garden, Japanese Garden, Shanti Kunj, Leisure Valley,

Valley of Animal, Bougainville garden, Fragrance garden, Terrace Garden etc. etc. which

attracts the people to shoot movies, documentary films, pictures. As such many people

approach the Municipal Corporation for getting permission for the shooting in these gardens.

Therefore, it is proposed that Municipal Corporation may allow to shoot in beautiful gardens

under its jurisdiction for which we may charge some fee from the applicants subject to

following conditions:

1. That fee of Rs. 40,000/- per day will be charged for shooting.

2. In addition to the above, a security advance e of Rs.20,000/- will also have to be

deposited by the applicant which will be refunded to the applicant later on.

3. The applicant will ensure that no damage is caused to the plantation/other

Municipal Corporation property. To keep these intact, the greatest care must be

taken while shooting and during any related work. Any instructions given by local

offices must be followed at all times.

4. However, in case any damage, the cost of damage will be recovered from the

security deposited by the applicant.

5. That applicant will not be allowed to use any infrastructure of the garden/park such

as water supply, electricity etc. during the shoot.

6. Detailed terms and conditions shall be finalized and amended from time to time by

the Commissioner, Municipal Corporation, Chandigarh.

It is also proposed that the Executive Engineer, Horticulture Division, Municipal

Corporation, Chandigarh be authorized to grant permission for using the garden/parks for

shooting purpose with above said terms and conditions.

Matter is placed before the Finance & Contract Committee for its consideration and

decision please.
