This presentation will take a deep dive into internal audit procedures, from concept through execution to feedback to your firm and board of directors. By focusing on one aspect of a fictional firm’s operations, the panel will analyze all aspects of the audit process related to that function. The panel will touch on risk assessment as a necessary precursor to the audit process, leading to the decision to conduct an audit of a particular function. The panel will then explore the process of formulating the initial requests for information, following up with more in-depth inquiries, deciding whether defects rise to the level of findings, preparing and issuing the initial report, reaching agreement on remediation of findings, and following up to confirm remediation. The panel will conclude with the importance of issuing a final report and reporting findings to the board of directors.Eileen Bitterman, Weltman, Weinberg & ReisCatherine Calko, Bank of AmericaAndrew Hall, Estate Information Services, LLCDavid Weimer, Kramer & Frank, P.C.

Lawyer Impairment and Well-Being - Our Challenges and Opportunities: An Ethical PerspectiveFor lawyers, trust account issues, missing deadlines and failing to communicate or complete projects may be the tip of the iceberg for far greater problems ranging from too much stress to addiction and mental health issues. Lawyers face stress daily and are subject to particular circumstances which can lead to higher levels of stress than for most other members of the population. There is a clearly recognized continuum where unresolved chronic stress becomes a predictor for addiction and mental illness, particularly depression, which are also more prevalent among lawyers. By understanding this continuum and the facts about addiction and mental illness, lawyers can reduce their risk and, hopefully, get help earlier when there is a mental health or addiction/dependency problem. The program discusses how to recognize and obtain help when you, a work colleague, or other professional colleague may have an issue that affects behavior, conduct and performance, how to support a colleague who has accessed help and the ethical issues that may arise and can be prevented. Personal examples and information on Lawyer Assistance Programs will also be provided.Joan Bibelhausen, Lawyers Concerned for Lawyers

Religious Perspectives on Debt CollectionIn our collections practices and as members of a diverse society, we encounter individuals of different religions or faith traditions. You will learn firsthand how Judaism, Christianity, Islam, Hinduism, and Buddhism each look at lending, debt, interest, and collections. When relevant we will discuss the religious history, traditions and texts that would impact beliefs or attitudes. What can we learn from each religion’s customs, celebrations, holidays and beliefs to impact our practices? Lastly, we will ask members of the audience how faith and religious traditions have influenced their practices. Expect a lively discussion on how religious perspectives shape how we conduct ourselves as professionals.Daniel C. Consuegra, Law Offices of Daniel C. Strategic Decisions in Replevin Actions Despite recent improvements in the nationwide economy, credit markets are still tight and personal property loan defaults remain high. As a result, both lenders and servicers are at risk for lender liability claims. For years, these claims were used mainly as stall tactics during repossession and personal property foreclosure but now they are increasingly used as leverage during workout negotiations. This course will provide an overview of the extraordinary remedies available in the replevin process and strategic approaches for avoiding such liability. A discussion of consumer protection statutes including Fair Debt Collections Practice Act and Telephone Consumer Protection Act. This topic will educate the creditor’s attorney on their client’s litigation perspective and allow the creditor to effectively work with their attorney to protect personal property interests.Larry Fallon, Ally Vanessa A. An Update on TCPA CasesThe TCPA has been in existence for 25 years. In its early years the TCPA was a little-known statute which had been relegated to obscurity. That all changed about ten years ago. Ever since, TCPA litigation has exploded. The TCPA is now arguably the most draconian of the consumer protection laws, and undoubtedly a class action incubator. Worse, due to evolving case law and regulations, liability under the TCPA seems to expand and contract on a monthly basis. Those who use automatic telephone dialing systems (ATDS) to collect debts (and especially those who aren’t sure) absolutely must understand the requirements of the TCPA, lest they fall victim to it. Seasoned TCPA litigators Joe Messer and Jeff Topor will bring attendees up to speed on the latest legal developments under the TCPA so they will have knowledge to avoid liability. Millennials & Money: Maximizing Collections from Generation YMillennials, emerging as the most powerful consumer group in the United States, are changing the landscape of the collections industry. 71 million strong in the United States, Experian’s most recent State of Credit report indicates that 44% of Millennials (born 1980-1995) have a consumer credit account in collections. As of January 2018, student loan debt ($1.4 trillion) surpassed credit card debt ($1.02 trillion) for the first time. These trending topics beg the questions: What characterizes the millennial generation and how can the collections industry capitalize on their financial habits to maximize revenues? How do Millennials’ expectations change your strategy? Do you have a digital strategy? Presented by attorneys who are also Millennials, this presentation will provide an overview of the millennial generation’s financial habits, expectations, characteristics and tendencies, analyze how specific areas of case law are evolving in response to Millennial trends, and provide suggestions for how the collections industry can create winning strategies in response to “Generation Y.” Kate Figgins, Messerli & Kramer P.A.Stephanie Lamphere, Messerli & Kramer P.A.
