The report recommended that: visual inspection of the proposed earthworks location has confirmed

high levels of past disturbance; in accordance with the DDCoP, no further investigation is required for

the proposed earthworks; the existing bund material may be used for fill in the construction of

the Hunter Expressway; if unexpected Aboriginal objects are identified during works, the

Protocol for Discovery of Aboriginal Objects outside the s.90 Footprint, as detailed in Appendix B2 of Aboriginal Heritage Management Plan (Abigroup, 2011), should be followed; and

this report meets the requirements of the Due Diligence Code of Practice for the Protection of Aboriginal Objects in New South Wales.

Three sites that have been identified within the s.90 boundary and recorded with the Aboriginal Heritage Information Management System (AHIMS) after the issuing of s.90 #2562.

Site Branxton Rail 13, isolated find recorded west of Wine Country Drive;

Site Branxton RW 41/A, isolated find recorded east of Wine Country Drive; and

Site KR07, two artefacts recorded in a powerline easement east of Old Maitland Road.

Site Branxton Rail 13 was recorded by South East Archaeology Pty Ltd in September 2009 during a survey along the Main Northern Railway between Maitland and Minimbah. The site is recorded as an isolated grey silcrete, proximal flake measuring 18 x 19 x 7mm. The site was originally recorded in a grass covered residential lawn. The site was assessed as having low archaeological significance.

The location of the site was inspected on 26 May 2011 and the artefact was not relocated by ERM.

Branxton RW 41/A was recorded by South East Archaeology Pty Ltd in December 2009 during a survey for the Branxton Recycled Water Transfer System. The site is recorded as an isolated silcrete blade.

The site was assessed as having low archaeological significance and low potential for containing subsurface deposit.

Abigroup will not impact on this area and has barricaded the area off

Site KR07 was recorded by Australian Museum Business Services in May 2009 during a survey for the proposed upgrade to the 132kV Kurri-Redbank Feeder.

The site was assessed as having low archaeological significance.

The location of the site was inspected on 17th June 2011, and a single artefact was relocated at the site, an orange tuff flake

Abigroup have fenced the recorded co-ordinates of site KR07

The entire area has been significantly disturbed since the initial recording of site KR07, by heavy clearing, vehicle movement and the removal and relocation of powerlines.

Allandale Road compound was conducted by ERM’s archaeologist Amy Stevens and included site survey with participating representatives of the Aboriginal Focus Group US!

Two areas within the proposed impact area were identified by the participating AFG representatives as being of cultural concern because they might contain artefacts.

SIGNIFICANCE ASSESSMENT No archaeological material was recovered during the test

excavations at Allandale Road. The test excavation findings support the original assessment that the area has low archaeological significance.

areas of potential archaeological deposit will be impacted by the proposed Compound works at Allandale Road.

Allandale Allandale CONCLUSION The archaeological assessment and test excavations undertaken for

the proposed construction compound at Allandale Road fulfil the requirements of the Due Diligence Code of Practice for the Protection of Aboriginal Objects in NSW (DECCW, 2010a) and the Code of Practice for Archaeological Investigation of Aboriginal Objects in NSW (DECCW, 2010c).

Consultation has been undertaken as required under the Aboriginal Cultural Heritage Consultation Requirements for Proponents (DECCW, 2010b)

The assessment found that no identified sites or areas of potential archaeological deposit will be impacted by the proposed works. Works may proceed with caution without an application for an s.90 Aboriginal Heritage Impact Permit.

ERM was commissioned by Abigroup to undertake an archaeological assessment for proposed alternative locations for the Hunter Expressway Main Compound. Three alternative Main Compound sites have been proposed and are located at:

Bakers Lane – 90 Bakers Lane, SAWYERS GULLY 2326. Private property south east of Bakers Lane acquired by RTA (Lot 14/1082909);

Old Maitland Road (west) – 1056 Old Maitland Rd, SAWYERS GULLY 2326. Private property west of Old Maitland Road acquired by RTA (Lot 1/1003814); and

Old Maitland Road (east) – 1059 Old Maitland Rd, SAWYERS GULLY 2326. Private property east of Old Maitland Road acquired by RTA (Lot 12/1082909).

It was observed during the visual inspection of the Old Maitland Road (west) compound that much of the western portion of the compound lacks any topsoil. Orange-brown, cracking clay was evident at the ground surface at all surface exposures west of the driveway loop

Moderate to high levels of disturbance were encountered across all of the survey areas

Disturbance to the ground surface is expected during the course of compound construction and use, and may involve excavation and levelling for the construction of buildings and dams

Bulk Earthworks 8 x 637 scrapers working on Cut to Fill in C28 (North of

the Main Rail Bridge). due to be completed by mid June. 8 x 651 scrapers have commenced in C27 (North of Wine

Country Dr). 2 x 637 scrapers commence stripping operations in C26.Bridges Piling commenced at Camp Rd on 9th June. It is expected

to complete all 12 piles by late June where columns will follow. Once completed at Camp Road the piling rig will move to Wine Country Drive (Br 22) and the Northern Rail Bridges (Br 23/24).
