I n view of the provisions of section 9 sub section (3) of the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admissions and Fees) Act, 2015 (IYah. Act No. XXVIII of 2015) which came into force on the IYay, 2015, the Pravesh Niyantran Samiti existing as on the date of commencement of the Act shall continue to exercise the powers of the Admissions Regulating Authoriw till such Authoriw is duly constituted under the Act.

llth April 2017 Item No. 3(a): To review disposal of work - Academic Year 2016-17

JPresent Scenario).

The Authority perused the details (Annexure - A), w.r.t. no, of Institutes (Higher & Technical and Medical Education) who have submitted online proposals of admissions for Academic Year 2016-17, to the Authority office and after scrutiny, the report being submitted by the office to the Authority, the details of which are as under:-

i) As shown in column no. 5, out of total 3388 Higher and Technical Educational Institutes, 886 institutes of Higher and Technical Co~~lrses and out of total 348 Institute, 61 institutes of Health Science courses have not so far submitted their admissions details online.

ii) As shown in column no. 8, total 1315 (32 Health Science + 1283 Higher and Technical Courses) proposals are under scrutiny.

I n view of it, the Authority directs the office to verify and put up proposals in the c~ming meetings for its consideration in due course.

. . . III) It is observed as shown in column no. 9 that total 2006 (246 for Health

Science courses + 1760 for Higher and 'Technical Courses) Colleges/lnstitutes, have not submitted the proposals for approval of admissions for the Academic Year 2016-17.

Attention of the Authority is also drawn to the Chapter 111, Section 9, subsection (5), clause (iii) of the Government of Maharashtra Act No. XXVIII of 2015, the extract is as under:-

"(iii) every such proposal received from the Institution by Admissions Regulating Authority shall be scrutinized and approved before the 31st January of every year,."

I n view of the above, the Secretary, Admissions Regulating Authority pointed out total 2006 Colleges/Institutes have not subrr~itted their proposals for approval of admissions for the Academic Year 2016-17.

After deliberations, the Authority decides to extend and allow such Colleges/Institutes to submit their admission details online from 8th May, 2017 to 2oth May 2017 for the Academic Year 2016-17. I n case if ally College/Institute fails to submit online details, then such Colleges/Institutes may be penalized or a fine may be imposed on them, which may be noted by all concerned. I n continuation to this the Authority decides to suggest to the Higher and Technical Education Department, Government of Maharashtra to take the necessary steps in respect to Section 9, subsection (5), clause (iii) of the Government of Maharashtra Act No. XXVIII of 2015 at the earliest and inform the Authority accordingly.

for the Academic Year 2015-16 and 2016-17.

The Secretary, Admissions Regulating Authority pointed out that 2181 and 3028 Colleges/Institutes have paid the 'Processing Fees" as prescribed by the Admissions Regulating Authority in its meeting held on 21/11/2016 for the Academic Year 2015-16 and 2016-17 respectively, whereas around 645 and 768 Colleges/Institutes have not paid so far, the 'Processing Fees' for the Academic Year 2015-16 and 2016-17, respectively.

I n view of the above, after deliberations, the Authority decides that admissions of the Colleges/Institutes will not be scrutinized, approved and confirmed by the Authority (for the Academic Year 2016-17), who have not paid the 'Processing Fees' for the Academic Year 2015-16 and 2016-17. Authority directs to inform the same to the concerned Colleges/Institutes as well as to the concerned Universities to not to give affiliation, not to enroll students of such Colleges/Institutes for the Academic Year 2016-17 with a copy to the concerned Colleges, the details of which are marked as Annexure - B. The concerned Authorities may be asked to do the needful to cancel the approval of such defaulter Institutes/Colleges. The Colleges will inform the same to their students. The responsibility of all consequences will be of the respective Colleges/lnstitutes. Ofice to take necessary steps.

I tem No. 3(c]: To decide on letters received from Colleqes/Pnstitutes reauestina to waive the 'Processinq Fees' in respect of zero admissions for the Academic Year 2015-16 and 2016-17.

The Authority perused the letters received from some Colleges/Institutes requesting to waive the 'Processing Fees' in respect of zero admissions for the Acaderr~ic Year 2015-16 arid 2016-17.

I n view of this, after deliberations, the Authority decides to waive the 'Processing Fees' in respect of zero admissions for the Academic Year 2015-16 and 2016-17. However, the Colleges/.lristit~~tes has to pay the 'Processing Fees' even if single admission is done by the College/Institutes. The earlier decisions taken w.r.t 'Processing Fees' should be followed by all the Colleges/Institutes. All Colleges/Institutes to note and do the needful immediately. Office to take necessary steps and inform the concerned Colleges/Institutes accordingly.

I tem No. 4: To discuss and decide in respect of report submitted by Maharashtra University of Health Sciences, Nashik vide letter dated 10/03/2017 reqardinq Foreiqn National students admitted in M.A. Ranqoonwala Dental Colleqe, Pune for the First Year BDS course for the Academic Year 2012-13 and 2013-14. (Ref. Minutes of the Meetinq of PNS held on 20/06/2014)

The Authority perused the letter under reference and noted.

Secretaw, Admissions Reaulatinq Authority, Mumbai with respect to the admissions of PG students in N.K.P. Salve Medical Colleae, Naqpur on the basis of PGM-CET and AIPGMEE for the Academic Year 2014-15 (Ref. - Minutes of the Meetina dated lst March 2017 at Item No. 7).

The Authority perused the report submitted by the Secretary, Admissions Regulating Authority, Mumbai in respect of the admissions of PG students in N.K.P. Salve Medical College, Nagpur on the basis of PGM-CET and AIPGMEE for the Academic Year 2014-15.

The Authority went through the decision taken by the Authority in its meeting held on lSt March 2017 at Item No. 7.

It is noticed that the Secretary, Admissions Regulating Authority in its aforesaid report stated that 1N.K.P. Salve Medical College, Nagpur admitted 05 students other than the APGM-CET-2014 i.e. 04 students from PGM-CET-2014 and 01 student From AIPGMEE-2014 for the Post Graduate Medical Courses for the Academic Year 2014-15. It is submitted that after the completion of all rounds of admission by Association, 37 seats remained vacant with the College/Institute. I n order to fill up 37 seats of CAP round, the Colleye/%17stitute had given advert:isemcnt in the tlcwspapcr.

The Secretary further stated that the College/Institute had admitted the 05 students through the procedure laid down in rule INo. 15.10 of the brochure of APGM- CET-2014, which was approved by the former Pravesh Niyantran Sarr~iti in its' meeting held on 1 7 ~ ~ January 2014 at Item No. 3(a). It is also pointed out that after following the admission process, still 15 seats remained vacant for Academic Year 2014-15 at N.K.P. Salve IYeclical College, Nagpur for Post Graduate IVID/MS course.

I n view of the above, after deliberations, the Authority decides to approve the admissions of 05 students viz. - 1) Dr. Kshitij Nikose, 2) Dr. Ravi Gawande, 3) Dr. Prerna Dhabarde, 4) Dr. Anurag Singh and 5) Dr. Geeta Chandawani admitted from other than APGM-CET-2014 for Post Graduate Medical Course at 1N.K.P. Salve Medical College, Nagpur for the Academic Year 2014-15 on the basis of report submitted by the Secretary, Admissions Regulating Authority, Mumbai, subject to fulfillment of eligibility criteria laid down by the respective Authorities. The Authority made it clear that the said permission is granted keeping in rr~ind the academic welfare of students. The aforesaid Colleges/Students should not take it as a precedent for the years to come. Office to take necessary steps.

Item No. 6: To consider and decide on the letter dated 2gth March 2017 received from Yoqita Dental Colleae, Khed, Ratnaqiri in respect of the decision taken the Authoritv in its meeting held on lSt March 2017 l a t Item No. 5) reaardina allocation of seats under CAP and ManaaementINRI Ouota for Post Graduate Dental course for the Academic Year 2015-16.

The Authority went through the decision taken by the Authority in its meetings held on 1 8 ~ ~ March, 2016, 1 8 ~ ~ March 2017 and lst March 2017 at Item No. 5, w.r.t. the subject.

llth April 2017 The Authority perused the aforesaid letter received from Yogita Dental College,

Khed, Ratnagiri regarding allocation of seats under CAP and ManagementINRI Quota for the Post Graduate Dental Courses for the Academic Year 2015-16. The Authority noted the approved subject wise intake by Government of India for Post Graduate Dental Courses and the seats matrix and allocation of seats (Open and reserve) for the subject, by the AMUPMDC, which was not as per the approval of Government of India. Out of total 11 seats, 05 seats were expected to be filled in through CAP and 06 through Management; in the courses approved by Government of India. -The College has not submitted the details satisbing that 05 seats have been filled in through CAP and 06 through Management, as per merit and to the respective approved courses alongwith merit list prepared and due procedure followed by the college. The secretary, Admissions Regulating Authority also further pointed out that the advertisement to f~ l l the seat remain vacant after CAP round is required as per the rule 15.10 of the APGM- CET-2015.

The Secretary, Admissions Regulating Authority stated that in respect of decision taken on lSt March 2017 aforesaid, the College has submitted its explanation and requested to waive the penalty amount of Rs. 5,00,000/-. The College has submitted that 04 candidates are selected in 50% quota, 05 candidates are selected in management quota, 01 candidate against CAP, 01 candidate against NRI. As per AMIJPMDC letter dated 17/03/7017, the seats remaincd vacant after third ro~lnd may hc! filled up as per rule no. 15.10 of the brochure of APGM-CET-2015.

I n view of the above, after the deliberations, the Authority decides to call the relevant details as mentioned above and also the advertisements published for vacant seats for the admission process, given by the Yogita Dental College, Khed, Ratnagiri for Post Graduate PIDS course for the Academic Year 2015-16, all other relevant papers and directs to submit the same without fail, within a week to the Authority. After receipt of the same it will be placed before the Authority for its consideration. Office to take necessary steps.

Item No. 7: To consider and decide on the letter dated 5th April 2017 received from Ms. Shruti Manik Davare complainins of admission process of Health Science Courses for the Academic Year 2015-16 alonq with order of the Lokaavukta, dated 9-03-2017.

The Authority perused the aforesaid letter received from Ms. Shruti Manik Davare complaining of admission process of Health Science Courses for the Academic Year 2015-16.

The Authority also perused the order/direction, of the Lok-Ayukta, dated gth March 2017.

The Secretary, Admissions Regulating Authority pointed out that the admission process of First Year Health Science course for the Academic Year 2015-16 was conducted by the Competent Authority and the Director, Medical Education and Research, Mumbai and also pointed out that the Officers of Directorate of Medical Education and Drugs Dept. as well as of Directorate of Medical Education and Research, IYumbai were present before the Lok-Ayukta at the time of hearing dated 09-03-2017.

llth April 2017 Hence concerned Officers of the Directorate of Medical Education and Research, Mumbai have knowledge of the said matter; and may furnish the details regarding the complaint.

I n view of the above, after deliberations, the Authority decides to forward the complaint of Ms. Shruti Manik Davare to the Director, Directorate of Medical Education and the Director should submit his report within two weeks to the Authority. After receipt of the same it will be placed before the Authority for its consideration. Office to inform DMER accordingly.

Item No. 8: To consider and decide on the letters dated loth March 2017 and l z t h January 2017 received from Sai

vacant seats after last CAP round at Institute level for First Year BHMS course for the Academic Year 2016-17.

Item No. 9:: To consider and decide on the letter dated lot" March 2017

The Authority perused the aforesaid letters received from Sai Homoeopathic Medical College and Nityanand Hospital, Thane and also of Directorate of AYUSH, Mumbai regarding 07 candidates admitted at the Institute level on the vacant seats, after computerized admission process of First Year BHMS course for the Academic Year 2016-17.

Vd. K.R. Kohli, Director, Department of AYUSH pointed out that the aforesaid College/Institute has filled up 07 vacant seats at the Institute level without the prior perrnission of the Competent Authority or the State CET-CELL for the Academic Year 2016-17, which is not just, appropriate, valid and lielice these 07 ddrnissioris may be cancelled.

I n view of the above, after deliberations, the Authority decides not to approve the admissions of 07 students admitted at Institute level by the aforesaid College/Institute for First Year BHlvlS course for the Academic Year 2016-17, on the basis of the remarks/comments submitted by the Directorate of AYUSH, IYumbai vide its letter dated loth March 2017. Office to inform accordingly.

Item No. 10: To consider and decide on the email dated sth A ~ r i l 2017 received from Su~rivadidi Sule Nursinq Colleqe, Ahmednasar submittinq list of students admitted in B.Sc. Nursinq course and askinq for a~proval of admissions for the Academic Year 2016-17.

The Authority perused the aforesaid email dated 5th April 2017 received from the Supriyadidi Sule Nursing College, Ahmednagar submitted the list of the admitted students in First Year B.Sc. Nursing course and requesting for approval of admissions for the Academic Year 2016-17.

llth April 2017 The Authority also perused the interim order of the Hon'ble High Court, Bench at

Aurangabad in Writ Petition No. 11106 of 2016 with Writ Petition No. 11108 of 2016, dated 18-11-2016.

The Secretary, Admissions Regulating Authority pointed out that the State Government and Maharashtra Nursing Council have not permitted to the aforesaid College/Institute to admit students for First Year B.Sc. IVursing course for the Academic Year 2016-17. However, the Hon'ble High Court, Aurangabad Bench vide its order dated 11-11-2016 granted interim relief to the aforesaid College/Institute and permitted to admit students for the Academic Year 2016-17, subject to result of the said petitions and at the risk of students.

I n view of the above, after deliberations, the Authority is of a view that, no action is necessary at this stage as the matter is subjudice. The Authority directs to the aforesaid College/Institute to submit the final judgment in the said matter before the Authority. After receipt of the same it may be placed before the Authority for its consideration. Office may check through the Advocate whether, Adlr~issio~i Regulating Authority is made party to these petition and whether final Order of High Court is issued and may take necessary steps accordingly.

Item No. 131: To consider, discuss and decide about approval of the admissions to Hiqher & Technical Education courses for the Academic Year 2016-17.

Item No. 9(a): To consider, discuss and decide on proposals received for approval of admissions where there are no discre~ancies.

TECHNICAL EDUCATION

The Admissions Regulating Authority perused the observations of the Director, Technical Education, Mumbai for Academic year 2016-17. After going through it and office of the Director, Technical Education, Mumbai, having found no discrepancies in admission process of following 84 Colleges/Institutes, the Admissions Regulating Authority decides to approve the eligibility and selection process of the institute for Academic Year 2016-17.

The Admissions Regulating Authority perused the observations of the Director, Higher Education, Pune for Academic year 2016-17. After going through it and office of the Director, Higher Education, Pune, having found no discrepancies in admission process of following 2 Colleges/Institutes, the Admissions Regulating Authority decides to approve the eligibility and selection process of the institute for Acaderr~ic Year 2016- 17.

The Admissions Regulating Authority perused observations of the Director, Technical Education, Mumbai, having found certain discrepancies in admission process of 188 colleges/Institutes. The Admissions Regulating Authority after deliberations decides to approve eligibility and selection process of following 188 colleges/Institutes in Technical Education for AY 2016-17, subject to the Director, Technical Education or his Officers or the Competent Authorities sorting out and disposing off with the said discrepancies after appropriate compliances from respective Institutions for Academic Year 2016-17, within four weeks. The same will be verified /checked by the Secretary, Admissions Regulating Authority, who may approve or disapprove the admissions as per the merit of the case.

The Commissioner, State CET-CELL stated that the State Common Entrance Test Cell, Maharashtra has floated e-Tender inviting request for proposals from reputed software firms/systems Integrators to design, develop, hosting, implement and maintain a system for conducting 'Centralized Adrl~ission Process' (CAP) for IYaharashtra State CET-CELL, Mumbai.

The Commissioner further pointed out that the RFP documents were published on mahatender.gov.in on 20/03/2017. The last date for submission of proposals was 30/03/2017. Since no bids were received within the said period, State CET Cell has extended the date of submission till 10/04/2017, on which the State CFT Cell received only one bid. The bid opening for this tender is 12/04/2017. A separate Committee is formed for the pre qualification/evaluation of the bids in respect to the CAP - REF.

After deliberations, the Authority directs the State CET-CELL to complete the aforesaid procedure before 3oth June, 2017 and inform the Authority accordingly.

I tem No. 16: To discuss and finalize the acieneies for conduetinq Common Admission Process (CAP) of various CET's.

The Authority perused the report submitted by the office of the Commissioner, State CET-CELL, Mumbai, the details of which are marked as Annexure - F.

The Commissioner, State CET-CELL stated that the tender for selecting the agency for CAP (Common Admission Process) has already been floated by the State CET CELL as mentioned in item no. 15 above. However it may take some more time. I n the meanwhile, the process of conducting CAPS for different courses/stream will be continued by the State CET-CELL for Academic Year 2017-18 with the existing agencies. Accordingly the State CET CELL took review in this regard and hereby proposed the names of agencies for conducting CAP process of various CFTs.

I n view of the above, after deliberations, the Authority decides to approve the proposals submitted by the Office of the Commissioner, State CET-CELL cegarding appointment of agencies for conducting various CAPS for the Academic Year 2017-18. OFl'ice of the Commissioner, State CFT-CELL to take necessary steps.

I n view of the above, after deliberations, the Authority expressed its displeasure with the concerned Colleges/Institutes, for not submitting requisite documents, corr~plete in all respect to the office of the Authority and cautioned to reject claim for approval of admissions of above candidates in 15% NRI Quota, for the respective Academic Year, if the documents are not submitted within two weeks from the date of communication by the Authority office to concerned College/Institute. The concerned College/Institute shall inform respective students immediately and submit the requisite documents, complete in all respect immediately to the office of the Authority. Office to inform accordingly to the College and Maharashtra University of Health Sciences, Nashik.
