I. Purpose The purpose of this Administrative Directive (ADM) is to implement the second statutory trend factor (STF) for direct care staff, direct support professionals and clinical staff included in the enacted budget for State Fiscal Year 2014-15, as authorized by Part I of Chapter 60 of the Laws of 2014. Among other programs, this enacted legislation provides for an STF of two percent for increases in annual salary and salary-related fringe benefits for direct care staff, direct support professionals and clinical staff, and in payments to foster parents and adoptive parents and kinship guardianship assistance program (KINGAP) guardians1, applicable to all programs for which the Office of Children and Family Services (OCFS) establishes maximum state aid rates (MSARs) and Committee on Special Education (CSE) maintenance rates pursuant to Social Services Law (SSL) §398-a and sections 4403 and 4405 of the Education Law, beginning April 1, 2015. Please note that this ADM will only address the increases that are required beginning April 1, 2015 and that 14-OCFS-ADM-07 addressed the implementation of the STF that was required beginning January 1, 2015. The titles that fall within the definition of “direct care staff,” “direct support professionals,” and “clinical staff” for the purposes of this ADM are included as Attachment I. Please be advised that local departments of social services (LDSSs) and voluntary agencies are required to increase their own payment schedules to reflect the two percent increase in annual salary and salary-related fringe benefits for direct care staff, direct support professionals and clinical staff, effective April 1, 2015, for all administrative/ services rates applicable to regular

foster boarding home programs and for all pass-through rates applicable to foster parent, adoption subsidy and KINGAP assistance payments. Please be further advised that LDSSs are required to pay the increase of two percent for direct care and clinical staff personal service costs and fringe benefits even to those rates currently exempt from the MSAR minimum payment requirement specified in SSL §398-a(2-a). That means, in addition to LDSS being required by existing statute to pay no less than the OCFS-established congregate care rates and administrative/services rates applicable to specialized foster boarding home programs, LDSSs and voluntary agencies are also required to increase their own payment schedules to reflect a two percent increase in annual salary and salary-related fringe benefits for direct care staff, direct support professionals and clinical staff effective April 1, 2015, for all administrative/services rates applicable to regular foster boarding home programs and for all pass-through rates applicable to foster parent, adoption subsidy and KINGAP assistance payments. All published MSARs and CSE Maintenance Rates remain in effect for payment and reimbursement until modified or deleted by the OCFS. Please note that LDSSs will not be required to do any special claiming in order to finance the required payments of this STF initiative and that guidance on claiming will be addressed in a subsequent Local Commissioners Memorandum (LCM) OCFS will issue regarding the Foster Care Block Grant. II. Background
Each year, OCFS issues MSARs and CSE Maintenance Rates to LDSSs advising them of the annual rate methodology approved by the New York State Division of the Budget. MSARs define the reimbursement limits for LDSSs in negotiating contracts with authorized foster care providers, pursuant to SSL §398-a and 18 New York State Codes, Rules and Regulations (NYCRR) Part 427. Pursuant to SSL §398-a(2-a), LDSSs are required to pay no less than 100 percent of each OCFS-established congregate care rate as well as each administrative/services rate for a therapeutic, special needs, or emergency foster home program. The details of such minimum payment requirements are specified in 05-OCFS-ADM-04. CSE maintenance rates, as published by OCFS, must be paid for children placed by local school districts into State Education Department (SED) approved residential schools, pursuant to sections 4402 and 4405 of the Education Law.
III. General Provisions Applicable to this STF
A. Required documentation
1. Within 60 days of the issuance of this ADM, each LDSS and each voluntary
agency shall submit to the address specified, a plan of implementation that details how such funding increases shall be used solely to support salary and salary-related fringe benefit increases for eligible direct care staff, direct support professionals, clinical staff, foster parents and adoptive parents and KINGAP guardians, in accordance with this ADM and Part I of Chapter 60 of the Laws of 2014.

2. Within 60 days of the issuance of this ADM, each LDSS and each voluntary agency shall submit a written certification to the address specified, detailing the manner in which such funding will be or was used for eligible purposes.
3. Within 60 days of the issuance of this ADM, voluntary agencies shall submit to
the address specified, a resolution from their Board attesting that the funding received will be or was used solely to support salary and salary-related fringe benefit increases for eligible direct care staff, direct support professionals, clinical staff, foster parents and adoptive parents and KINGAP guardians, in accordance with this ADM and Part I of Chapter 60 of the Laws of 2014.
4. Reimbursement may be forfeited by those LDSS, or voluntary agencies, that do
not submit the required document within 60 days of the issuance of this ADM.
B. Recoupment
1. Pursuant to Part I of Chapter 60 of the Laws of 2014, OCFS is authorized to employ any legal mechanism to recoup any funds distributed by OCFS for the purposes of achieving the STF that have been used in a manner inconsistent with the provisions of such law or this ADM, including offsetting other funds that are owed to each LDSS, and each voluntary agency.
IV. Program Implications (Rates effective April 1, 2015, through June 30, 2015)
A. Rate increases for the period April 1, 2015, through June 30, 2015, must be paid in the following manner:
1. LDSSs are required to increase their contracted payment rates to reflect no less
than a two percent increase for direct care staff for each administrative/services rate for each voluntary agency-operated regular foster boarding home program, for the period April 1, 2015, through June 30, 2015. That means the LDSS paying less than 100 percent of the OCFS-established administrative/services rate for a voluntary agency-operated regular foster boarding home program is required to increase its contracted payment rate by two percent, effective April 1, 2015. For an LDSS that pays at least 100 percent of the OCFS-established administrative/services MSARs for a regular foster home program operated by a voluntary agency, such a payment, effective April 1, 2015, must be at least 100 percent of the OCFS-established MSAR, effective April 1, 2015, to satisfy the requirement of paying the two percent increase.
2. LDSSs and voluntary agencies are required to pay a two percent increase to
payment rates for foster and adoptive parents and KINGAP payments, including clothing and diaper payments, for the period April 1, 2015, through June 30, 2015. That means an LDSS paying less than 100 percent of the OCFS-established MSARs for such payments is required to increase such payment rates by two percent, effective April 1, 2015. For an LDSS that pays at least 100 percent of the OCFS-established MSARs for foster parents and adoption subsidies, such payments, effective April 1, 2015, must be at least 100 percent of the OCFS-established MSARs, effective April 1, 2015, to satisfy the requirement of paying the two percent increase.

3. LDSSs are required to pay no less than 100 percent for each OCFS-established
congregate care rate and administrative/services rate for a therapeutic, special needs, or emergency foster home program, for the period of April 1, 2015, through June 30, 2015, pursuant to SSL §398-a(2-a).
B. MSARs and In-State CSE maintenance rates for group care programs: The following
policies are applicable to all such MSARs and In-State CSE maintenance rates, effective April 1, 2015:
1. MSARs for group care programs: The following aggregate growth factors were
used in the calculation of group care MSARs:
i. Personal Service (PS): The calculation of trended costs includes one-year growth factors of two percent for direct care staff, direct support professionals and clinical staff and fringe benefit costs for 2014-15 effective 4/1/2015 – 6/30/2015.
ii. Other-Than-Personal Service (OTPS): The calculation of trended costs
includes one-year growth factors of 0.0 percent for 2014-15. C. In-State CSE maintenance rates: The In-State CSE maintenance rates for Special
Act School Districts and on-campus schools affiliated with Article 81 institutions are composed of the MSAR effective April 1, 2015 (revised to include the two percent STF for direct care professionals), for the institution program, plus the 2014-15 medical assistance per diem established by the Department of Health (DOH).
The LDSS where the child is a legal resident is responsible for the 10-month CSE maintenance payment, in the first instance. The school district of residence must reimburse the LDSS for part of the maintenance costs for such children. The local school district placing the child is responsible for the 10-month CSE tuition payment and a portion of the 10-month CSE maintenance payment. The LDSS is not responsible for either the maintenance or tuition payments for CSE summer school placements. 03-OCFS-LCM-22 and 04-OCFS-LCM-13 specified information regarding the procedures for implementing these requirements
CSE maintenance rates for children placed by local school districts are not negotiable and must be paid as published.
Pursuant to Chapter 53 of the Laws of 2014, the 10-month CSE maintenance reimbursement formula continues as follows:
1. For a child placed by a school district into a privately operated residential school
or special act school district: State share is 18.424 percent; Local share is 43.152 percent; and The portion chargeable to the child’s school district of residence for the 10-
month CSE maintenance payment remains 38.424 percent.
2. For a child admitted to a state-operated school for the deaf or blind: State share is 46.06 percent; and

Local share is 53.94 percent.
D. Administrative/Services Rates for Voluntary Agencies: 1. Growth Factors for Administrative/Services Rates for Voluntary Agencies:
The following aggregate growth factors were used in the calculation of MSARs for the Administrative/Services rates for FBH programs:
Personal Service (PS): The calculation of trended costs includes one-
year growth factors of two percent for direct care staff, direct support professionals and clinical staff and fringe benefit costs for 2014-15 effective 4/1/2015 – 6/30/2015.
Other Than Personal Service (OTPS): The calculation of trended costs
includes one-year growth factors of 0.0 percent for 2014-15.
2. Property Cost Transfer Policy: OCFS is continuing its policy of supporting an offset of a Foster Boarding Home (FBH) program’s property overage with available growth that is not being used in the program’s administrative cost center. The offset is automatically calculated, which means the MSAR reflects the application of available administrative growth to an overage of property expenditures.
E. Payments to Foster Parents: OCFS policies effective April 1, 2015, regarding
MSARs for “pass-through” payments for the foster parent components of the FBH program (including adoption subsidy and KINGAP assistance payments) are as follows: 1. Basic Room and Board Payment to Foster Parents, Adoptive Parents and
KINGAP Guardians: All MSARs for basic room and board are increased by two percent effective April 1, 2015, through June 30, 2015. Current LDSS and voluntary agency rate schedules for such payments must be increased by two percent, effective April 1, 2015, through June 30, 2015.
2. Clothing Allowance: MSARs for replacement clothing paid to foster parents,
adoptive parents and KINGAP guardians are increased two percent, effective April 1, 2015, through June 30, 2015. Current and voluntary agency rate schedules for such payments must be increased by two percent, effective April 1, 2015, through June 30, 2015.
3. Diaper Allowance: MSARs for diaper payments to foster parents, adoptive
parents and KINGAP guardians for birth through three years of age, are increased two percent, for birth through three years of age, effective April 1, 2015, through June 30, 2015. Current LDSS and voluntary agency rate schedules for such payments must be increased by two percent, effective April 1, 2015, through June 30, 2015.
4. Payments to Foster Parents for Emergency Placements: The MSAR for this
type of payment continues to be calculated as 200 percent of the currently effective MSAR for a non-special or non-exceptional child (i.e., 200 percent of the basic room and board payment rate that would apply to the child according to his/her age).

5. AIDS Per Diem Add-On: The $15 AIDS per diem add-on continues to be
effective April 1, 2015, for children with HIV/AIDS placed in regular FBH programs. Please note: the AIDS per diem add-on is specifically for regular FBH programs only and should not be charged for emergency, special medical or therapeutic FBH program care days. The treatment of the $15 per diem revenue for rate setting purposes is as follows: revenue from the $15 AIDS per diem add-on was subtracted from the allowable direct care costs for each FBH program, and the adjusted costs were compared with the direct care parameter to determine the rate base.
6. Finder’s Fee for Recruiting New Foster Homes: OCFS is continuing the policy
of allowing LDSSs to pay a voluntary finder’s fee of up to $200 to existing foster parents who recruit new foster parents. For detailed information regarding how to apply this policy, please refer to Chapter 8, Section G, of the Standards of Payment for Foster Care of Children Program Manual at: http://ocfs.ny.gov/main/rates/FosterCare/Manual/
F. Rate Stabilization for New Programs: OCFS is continuing its rate stabilization
policy for all new programs for which it is first using historical program expenses. There is a ten percent margin of rate variance. This means that the first cost-based rate for a new program may not increase (or decrease) by more than ten percent when compared to the prior year’s budget-based rate.
G. Supervised Independent Living Programs (SILPs): There are growth factors of
two percent for direct care staff (effective April 1, 2015) to the MSARs for double occupancy SILPs, triple occupancy SILPs, and four- and five-bed mother/child SILPs effective April 1, 2015, through June 30, 2015.
V. Systems Implications Existing procedures for processing MSAR payments and reimbursing claims will continue to be applicable. VI. Rate Consultations / Rate Adjustments The purpose of issuing MSARs is to specify the OCFS-approved maximum reimbursement program rates for state and federal claiming purposes, as well as to provide guidance to LDSSs in their contract negotiations with providers of foster care. MSAR payment requirements, pursuant to §398-a(2-a) of the SSL, prohibit LDSSs from paying less than the MSAR per diem established by OCFS for each congregate care rate and for each administrative/services rate for a therapeutic, special needs, or emergency foster home program operated by a voluntary agency, as specified in 05-OCFS-ADM-04. An LDSS may contract for a rate higher than the MSAR, but the MSAR sets forth the maximum rate for purposes of state and federal reimbursement. When an LDSS agrees to contract for a rate that is greater than the published MSAR, OCFS may be able to assist the LDSS and/or the voluntary agency in developing a program intensification request to increase the MSAR.

OCFS regulation 18 NYCRR 427.9 allows the LDSS and/or the voluntary foster care agency to request a rate consultation in regard to a promulgated MSAR, as follows:
A. An LDSS requesting a rate consultation must submit the request in writing. All
such requests must be received by OCFS within 30 days of the date a rate is issued (as specified in 18 NYCRR 427.9 and in Chapter 9 of the Standards of Payments for Foster Care of Children Program Manual). The LDSS should send requests for a rate consultation to:

B. A voluntary agency requesting a rate consultation must use the web-based statewide standards of payment (SSOP) system to submit the rate consultation request electronically. Pursuant to OCFS regulations, such requests must be received (in this case, electronically) within 30 days of the date a rate is issued.
