    RULES AND REGULATIONSEach state has its own set of rules andregulations to carry out the provisions of thelaw regulating nursing. These rules and

    regulations are established by theadministrative body, usually state board ofnursing. The rules and regulation must bewithin the scope outlined by the legislation that

    was passed .those that are accepted by theappropriate board have the force of law unlessthey are challenged in court and are found to benot in accord with the legislatures intent.

    NURSING LICENSURE LAW

    CONTENTEarly in the 1900s the ANA formulated a

    model nurse practice act that could be used

    by state associations when planninglegislation. The model was revised in 1981 bythe ANA congress for nursing practice and amore up to date approach to nursing licensurelegislation was published .The national council

    of state board of nursing has developed amodel nursing act in1982.The NCSBNcontinues to update its model act with themost recent revision being published in 1988

    ROLE OF THE BOARD OF NURSINGThe board of nursing is the group that is legallyempowered to carry out the provisions of law.Board of nursing range in size from 7-17 members.The members of the state board of nursing usually

    appointed by the governor. Each state board has apaid staff that usually is headed by a registerednurse who is employed as the executive director ofthe state board of nursing.

    Each board must operate within theframework of its own state law regarding thepractice of nursing, but all co-operate with oneanother through the NCSBN.

    OBTAINING A NURSING LICENSE

    There are two different procedures for obtaining anursing license, one for applying for an initiallicense and the other for applying when one is

    already licensed in another jurisdiction. The initiallicensure process is called licensure byexamination. Obtaining a license in a second

    jurisdiction is called licensure by endorsement.

    In both instances the applicant for licensuremust meet all provisions of the law of the state inwhich he/she is seeking licensure such aseducational preparation, language proficiency, andlegal residency status
