Narrative: A narrative on the technology planning process to include:
The Nemo Vista Technology Committee is comprised of administration, teachers, students, parents, andTechnology personnel that are interested in improving the technology and meeting the needs in regards totechnology for the Nemo Vista School District.
In the fall of 2011 an online technology survey was taken by the teachers, parents, and students. The results ofeach survey were discussed by the committee. Once the committee had the information gathered and the dataanalyzed, we developed the 2012-15 plan based in these results, the frameworks for Department of Education,the ACSIP plan, the technology policies, and the NETS.
Based on the results of these sources, needs were addressed and goals were set for the 2012-15 technologyplan.
Goals of the technology plan are to be discussed at the beginning of the year at Open House and the AnnualReport to the Public.
The Technology Committee will meet on a bi-annually basis in order to determine any needs of the schooldistrict and make any changes deemed necessary.

Vision and Mission Statements
Vision Statement
The Nemo Vista School District envisions a system of education in which technology is a tool for learning that allows ourinstruction to be enhanced by a driving force that maximizes the capacity for all learners. By dedicating ourselves to thestudents in becoming a confident technological staff and using community resources, we can aid students in becomingskilled, knowledgeable, and self-directed learners who are comfortable and proficient using technology resources and toolsthat are prepared for an ever-changing vast technology world.
Mission Statement
The mission of Nemo Vista School District is to take the steps to accomplish the vision by assuring the integration oftechnology into the curriculum by providing a student-focused education and appropriate tools in the classroom. It is themission of Nemo Vista to produce a student that will be ready for the post-secondary institutions, workforce, and above allbecome a productive member in society.

Current Technology Assessment
A. Technology Integration with Curriculum and Instruction
NVSD is veryfortunate to be able to provide a wide variety of technology resources tosupport the instructional needs of thecurriculum. The ongoing process isattributed to planning for CCSS, support from school board andadministration,Professional Development opportunities, and commitment to integration by thestaff.This has createdanenvironment where the teachers and students can access tools that aredependable and reliable.
•Byusing state mandated test scores our school district determines the curricularstrengths and weaknesses. Math is thestrongest part of our educationalsystem. Our ACSIP plan contains actions to purchase technology equipmentto aid inimproving literacy scores, which is currently our weakest area.
•Teachers at Nemo Vista incorporatetechnology into their curriculum by using the available labs and portablelaptops, as wellas iPads/iPod touches. Kindles are available in theHigh/Middle school library ton enhance literacy and reading. The Smartresponsesystems are available for assessment on skills and review on the Smartboards.Through the use of Internet accessteachers incorporate the use of DiscoveryEducation and online resources to engage the students and keep themactivelyinvolved. Learning is often facilitated and not taught. The Annual staffcreated the Yearbook annually usingyearbookavenue.com, whichallows for exposure to online creativity and responsibility.
•Students have the ability to take APcourses and courses not offered at Nemo Vista through the Distance LearningLab.Teachers have access to be involved in online professional development andwebinars through the DL lab also. Due to therising cost of fuel andsafety issues, in the future it will be encouraged for teachers to take classeson virtual field trips usingthe DL lab.
•Nemo Vista is taking several steps inthe preparation of online testing. We have purchased new computers formini-labs inthe libraries, have two labs assessable to teachers, and haveiPads to use. Teachers and Administration attend trainings thatbecomeavailable to stay abreast of the upcoming changes.
•Pinnacle grading system is in placethat parents have access to view grades online. EdLine parentalnotification system is inthe process of being implemented for teachers tocontact parents for announcements of tests and projects. We have awebsitethat has newsletters, announcements, and events for the district thatallows feedback. The parents and community can stayaware of meetings, sportingevents, and school assemblies through the webpage, which lists all email forstaff to becontacted. Protopage is a website that is used to providestudent practice on skills needed to be successful on using acomputer. This isavailable for home use also.
•Internet safety programs are presentedyearly in each school. The state has a filter on the system thatregulates the sites thatcan be visited on the web. The computer labs areset up for easy view of all monitors.

B. Professional Development
Technology is and will continue to be a rapidly changing and an influential force on the content curriculum andthe teaching process. Teachers are and must remain the primary learners and facilitators. Both training andsupport provide the Nemo Vista Staff with ability to make effective use of the sea of information available.
The Nemo Vista Staff receive Technology Professional Development in a variety of ways. Arch Ford ServiceCoop is used to instill current, up to date, reliable PD. Teachers are also encouraged to attend outsideprofessional development sources when available and feasible. We attend grouptrainingbefore the schoolyear starts in distance learning lab and have trainers available onsite. Lead teachers attend conferences suchas Schools Without Walls, andtrainingby professionals such as Tony Vincent to provide leadership and sharehow to utilize the tools available at our school and to maximize student performance.
Professional development is also based on the uniqueness of each teacher to build specific teaching strategiesto meet the needs of their curriculum to develop projects that apply to specific student learning. Administratorsare encouraged to attend technology workshops as needed.
Our district has not formally adopted a technology skill standard, but follows the current technology standardsof ISTE. The District highly encourages following the NETS at each age appropriate level.
The teachers are exposed the the NETS before each school year.The effectiveness of the professionaldevelopment activities are evaluated by formal and informal evaluations, and principal walk-throughs. The Staffis also required to fill out a Summary of Professional before school starts for administration evaluation of theattended professional development over the past summer to evaluate the PD attainment.

C. Equitable Use of Technology
The Nemo Vista School Districtstrives to ensure that all students have equitable and effective utilization oftechnology.Wetargetstudent's achievement and strive to purchase the latest software programs andother technological tools that maximizestudent performance.
Students are exposed to technology in almostevery classroom. Through the use of our Distance Learning Lab,laptopavailability, Smartboard use, and computers in the Library the facility hasaccess to integrate lessons daily. There arelabs available to the Elementaryand High/Middle school teachers for research and enhancementofcurriculum.Videostreaming, Internet, and Virtual Field Trips provide multiple opportunities forexposure to vastinformation.iPadsand iPods are available for an extension of technological advancement inlessons.Kindles are availableforstudent check-out.Smartresponse systems have been purchased for use in assessment and review. We havea portableSmartboard available for use also.
We provide a Distance Learning Lab that allowsstudents to advance their education through that cannot otherwise be offeredbythe district.Thisstate-of-the-art technology is utilized almost every class period of theday.Online educationalresources andteaching tools, such as Moodle, are used to help students meettheir educational goals in these classes.
An Alternative Education Program is alsoprovided at Nemo Vista for students who qualify.Apex, a software program,waspurchased for this ALE program to helpre mediateand achieve creditrecovery for these students.Itis used on a daily basisalong with other online resources to enhance theirlearning and preparation for continuing education or a trade ineverydaylife.
When deemed necessary, we will be willing tomake accommodations in regards to technology for any students thatneedit.Laptops have beenchecked out for summer use by students and software provided forextracurricular help. Wecurrently have a hearing impaired student that uses anauditory trainer; teachers have been trained on Front Row SystemsinElementary.A SmartTable as well as iPads have been purchased and utilized in the Self-Containedclassroom forelementary to address needs for these students to stimulate andtrain. SPED classes all received an iPad to enhance theircurriculum and buildstudent's skill.
The Technology staff is trained to supportassistive and accessible technology.ProfessionalDevelopment is attended andcurrenttrainingprovided by the school.Teachers are encouraged to attend anytechnology related workshops in order to aidfacilitation of technology intotheir curriculum.Up todatetrainingare provided on teacher in-service days that meetindividualneeds of the staff. The Arch Ford Educational Cooperative providesan off-site Technology resource department that helpswith ongoing processes inthe upcoming testing and CCSS.

D. Current Technology Inventory (2012-2015)
The current record ofinventory was acombinationof a school inventory of record combinedwith a physical count of devices.Technology staff took a previousinventory and added newequipmentand devices. This will serveas a running record for theschool district. The District currently has336 devices with internet capability, 25 phones/fax machines that work on 6phonelines.
Retaining this type of information will be very helpful if USAC requests this information in the future.

Needs Assessment
Needs Assessment
The Technology Committee evaluated the districts strengths andweakness by conducting a series of surveys with parents,students, andfaculty. Arch Ford EducationalCooperative conducted an online survey with the teachers in the co-opregion.The survey was open fromSeptember until October of 2011. TheTechnology Committee of Nemo Vista conducted a parentand student survey inJanuary 2012.
Thirty-six of 44 teachers completed the survey, of the teachersthat responded, 44% were elementary, 22% were MiddleSchool, and 33% were HighSchool. Fifty parents and 108 studentsresponded to the online survey provided by thecommittee.
Some of the key results that were found from the teacher surveywere:
1. Teachers are comfortable taking measures toprotect the privacy of student data and information 100%.
2. Teachersare aware of the district's policies and procedures regarding Cyber BullyingLaw 88%.
3. Teachersare comfortable saving and accessing files on the computer or school network84%.
4. Teacherstake measures to provide equal access to technology for all students in theclassroom 78%
5. Teachersfeel that the district is taking measures to meet NCLB's goal that everystudent will be technologically literate bythe completion of the 8th grade 75%
Some of the critical components of the teacher survey were:
1. Teachersare not comfortable using online collaboration tools in their classroom(Example: Google Docs, Microsoft Live,Blogs, Wikis, Arkansas Digital Sandbox,ect.) 69%.
2. Mostteachers are not comfortable using presentation tools other than Power Point72%.
3. Teachersare comfortable with using the National Technology Standards for Students(NETS) for planning integratedlessons 78%.
4. Teachersare not comfortable allowing their students to collaborate with students inother districts, states, or nations 72%.
5. Teachersare not comfortable using student-centered technology tools to enhance yourinstruction (Example: iPads, iPods,Smart Response, laptops/netbooks, ect...)59%.
Based on the teacher survey results we need to focus on trainingfor out teachers in the use of presentation tools, usingNETS to integratelessons, and enhance lessons by using the technology tools that are available.
Conclusions made in the student survey were based upon 100 variousstudents in grades ranging from 1st toSeniors.According the the survey 89% of the students had a home computer, and51% has had the computer for over 3years.
Some of the key results were:
1. Students reported that they use a computer towork on assignments or in class 71%.
2. Studentsare not required to use a form of Word Precessing to do work 79%.
3. Ninety-twopercent of students have not been taught to use spreadsheets.
4. Studentshave not been required to complete Multi-Media projects 89%
5. Seventy-twopercent of students do not use email.
The students were asked to think and rate the frequency oftechnology use in the classroom:
1. Seventy-nine percent reported that the teacherinstructs or demonstrates to the whole class.

2. Sixty-fivepercent say that work is primarily from a text book.
3. Studentswork on activities that the teacher has prepared with little input fromstudents 78%.
What do the students think about computers:
1. Eighty-eight percent feel thatcomputers/devices would make school-work easier.
2. Seventy-fourpercent said they would prefer to use computers.
3. Seventy-sevenpercent want to learn more about computers.
4. Outof a 1 to 10 scale most students ranked Nemo Vista as a 7 or 8 in the over-alltechnology opportunities available.
Results of the parent survey were as follows:
1. The majority of the parents surveyed had ahome computer with internet.
2. Seventy-ninepercent used a computer in the workplace.
3. Allparents surveyed had an email account.
4. Ninetypercent of the parents fell that technology is critical to the learningexperience of the students.
5. Ninety-threepercent agree that the school uses technology to communicate with their home or family.
6. Twenty-threepercent ranked technology as a top priority while 63% ranked technology as very important.

Policies and Procedures
The Children’s Internet Protection Act (CIPA) requires each district to have an Internet Safety Policy thatprotects minors from pornography or activities that could harm them. CIPA compliance is required forE-rate, and Title II Part D of No Child Left Behind. Our school strives to protect students by providinginstructions, direct supervision, and Internet content filtering. Key components of our Internet Safety
policies involve information about Internet dangers, cyber bullying, and cyber ethics.
Nemo Vista School district has district develop technology policies relating to equitable access forstudents with exceptional needs, data and network security, and internet safety. The District currentlyhas an M86 web filter which enables the ability to create web policies. The district also has an EcessaPower link which implements Internet Safety Policies that protects minors from pornography and/or
activities that could harm them.
School staff, parents, and students are kept updated on policies through the student handbooks, theNemo Vista website (http://socs.nemo.k12.ar.us), board meetings, the Parent Teacher Association, and
open house visitation at the beginning of the school year.
Security audits are being performed on the network. Our District is currently securing the network andsafeguarding the privacy of data by technology staff member’s using information from scans to installsecurity updates and find information about potential security threats. The district makes use of thestate provided Cisco router for firewall protection at the network core to protect against unauthorizedaccess from outside the network. This is part of our Internet Safety Policy that contains a “technical
protection measure.” Desktop management software is used to control access on local PCs.

Technology Infrastructure
Technology Infrastructure, Management, and Support
The federal E-RATE program has assisted our district in improving and increasing our technology
infrastructure by helping fund the telecommunications services necessary for running our schools.
Our technology department installs, supports, and maintains the operation of a large network.Documentation/databases exist for network specifications, electronics, equipment and softwareapplications used in the district. Various systems are used to manage, monitor, and supervise thenetwork traffic and usage. The district technology team consists of a purchased service staff, CustomNetwork Solutions, Inc., that has two staff members available to the district, and the district maintainsone staff member to maintain hardware/software issues and that is also involved in the instructionaltechnology components. The purchased service and designated district staff are able to maintain thedistrict's network and technology. District staff support attend professional development trainingsprovided through Arch Ford Coop and other technology related organizations. The district's continuityof operations plan contains a technology component that exists to help staff recover from
circumstances that hinder district operation.
Data Network
The district data network is composed of a fiber-optic backbone that connects school buildings andschool campuses into one metropolitan area network (MAN). E-RATE has allowed the school toconstruct high-speed fiber optic lines in order to connect separate buildings. Most fiber-optic backbonelines are connected at 100 Mbps. 2 lines are connected at 1 Gbps speeds. One goal of the district is toupgrade equipment to allow all fiber-optic backbone lines to be connected at 1 Gbps speeds. In addition,the district plans to install additional fiber-optic lines to replace existing banded copper connections aswell as leased fiber-optic lines. This will allow the district to save considerable money in the future byforgoing lease costs. It will also allow the fiber-optic lines to be utilized more efficiently by using one
line to make multiple connections.
The school district’s network is connected to the state network and the Internet via a 3 Mbps IMAconnection made up of 2 T1 circuits. This connection handles the entire district data network as well asthe Special Services distance learning lab in the high school. The district is in the process of renovatingfacilities Arkansas Department of Education Revised January 2008 Division of Research & technology.Additional T1or DSL lines/circuits will be needed in the future to support this growth. Each schoolbuilding connected to the fiber-optic backbone consists of a local area network (LAN) that includes Cat5/6 cabling and un-managed switches and hubs connecting workstations at speeds of 100 Mbps. Every
classroom is connected to the district network and the Internet.
Our student to computer ratio is (1 to 0.54).
Every school building has multiple networked printers and every classroom has at least one local
printer.
Our technology platform consists of all Windows PCs for end-users and Microsoft Windows servers to
provide all necessary network services.

All district staff members use Microsoft Exchange server for email communication with other staff,
parents and outside parties.
For Internet content filtering a combination of the state provided Internet filter and a local content filter
are used to filter and track Internet usage for all computers on campus.
The district maintains a web server providing web pages that house information about the districtincluding information on each school building. The district web site also offers web resources for staff
and parents, online learning, help desk information and resources for technical staff.
Parents and students can access their grades and homework information online via Pinnacle
All teachers in grades 1-12 use Pinnacle, a teacher grade book system that interfaces with the APSCN
Pentamation student management system.
Each school is outfitted with an automated Food Service system.
Three of (5) server class machines are used to provide services on the network

backup, and workstation inventory.

Teacher and office computers are replaced every five years. Student computers are used until no longer
feasible to use and/or support (anywhere from five to eight years of usable life).

Distance Learning Technologies
A distance learning lab is housed at the Special Services Building giving students course opportunitiesthat cannot be offered by local staff. The following equipment is used in the distance learning lab:Tandberg codec and cameras, Kramer audio modules, Dell computers, Visio monitors, Sony DVD-R
recorder.
Additional distance learning software and hardware technology may be needed in the future to increase
the communications capacity of our infrastructure.

Technology Plan Evaluation
The Nemo Vista School District will use the following process and accountability measures to evaluate theeffectiveness of activities used to integrate technology into the curriculum, increasing the abilities of teachers toteach, and enabling students to achieve challenging state academic standards.
The Nemo Vista School District will have in place a technology team made up of administrators, teachers,technology staff, parents and students. The technology team will meet quarterly to evaluate the strengths andweaknesses of the current plan and to determine if and when changes need to be made. Evaluation measureswill include the NETS frameworks and the individual teacher’s implementation of those frameworks at eachgrade level. These frameworks will help insure that students are gaining the necessary skills needed in-order toachieve on the upcoming online standardized test and to increase their abilities in daily classroom instruction.Other measures will include how much technology is used in daily instruction by students and teachers, thenumber of students with access to technology both during and after the school day. We will look at actualclassroom instruction from all teachers to insure technology is being incorporated into daily lessons. Thetechnology implementation portion of the plan will also be incorporated into the actual teacher evaluation.Individual professional development plans will be evaluated to insure that all staff members have ample accessto professional development to afford them the opportunity to increase and improve their ability to utilizetechnology in the delivery of instruction.
We as a school district realize that our technology needs will change constantly. It’s difficult at this time todetermine exact needs in relation to technology because we do not know what the future assessments look like.We do have enough information to know that technology must be incorporated into daily instruction and needs tobe because of the type of students we are educating. Students today come to us with large backgrounds intechnology for the most part, it’s what they do and it’s how they prefer to learn. We will do constantassessments to insure we meet the technology needs of students and teachers.
Evaluation of the 2009-2012 Technology plan was an ongoing process by the administration and the technology staff.Evaluating the implementation of our districts plan the past three years have been conducted by various means. Byobservations, that were made by anyone with an interest, teachers, parents, students, or administration were noted andaddressed. Student growth, as well as, technology instruction was a factor in the needs of upgrading the business lab andcreating an Elementary computer lab. Classroom Walk-Throughs by administration was also a factor in the evaluation of theplan.
The Goals and Objectives were visited and were used a a basis of what to provide each school year. ProfessionalDevelopment was offered and attended as needed according to the current Technology Plan. Training was provided forteachers in the the parental communications through Pinnacle and basic email training, as well as basic training forcomputers and computer management. PD was provided for teachers to integrate technology into the classroom and useas a tool to enhance the curriculum. Training on basic equipment was provided on projectors, Smartboards, documentcameras, and presentation software needed to use the equipment. The Elementary has upgraded Renaissance Place toprovide online Accelerated Testing in Math and Reading, which was beyond our goals for this time period. As needed theusage and expansion of the Distance Learning Lab and Virtual High School have been made. A program (Apex) waspurchased for the Alternative Education Program to enhance and better these student's education. The staff was trainedyearly in cyber-bullying, copyright, and Internet safety issues. The school web-site has been upgraded to include much moreinformation and resources for the parents and community members. We changed to a web-hosted service for ourweb-page. SOCS is a company that we chose to provide an up-to-date web-page with easy to use components for the staffand teachers.
Based on needs assessed in the 2009-2012 plan, we felt an upgraded infrastructure was needed. All new internet cabling,punch downs, and data ports have been installed. This gives the buildings the capability to meet the further needs of theuse of devices that have been and will be purchased in the future. Additional band-with was also purchased. Thecommittee met yearly to discuss the plan to try and instill the vision of the Technology Plan into the education process of thedistrict.

The LEA, in accordance with the Arkansas Department of Education policies and procedures, by submitting thislocal technology plan, hereby assures that:
1. The Nemo Vista School District makes computers and/or computer Internet access available to students, to permitstudents to perform research and to allow students to learn how to use computer technology. Use of district computers isfor educational and/or instructional purposes only. It is the policy of this school district to equip each computer with Internetfiltering software designed to prevent users from accessing material that is harmful to minors. No student will be grantedInternet access until and unless a computer -use agreement, signed by both the student and the parent or legal guardian(If the student is under the age of eighteen [18]) is on file. The current version of the computer use agreement isincorporated by reference into board policy and is considered part of the student handbook
Student use of computers shall only be as directed or assigned by staff or teachers: students are advised that theyenjoy no expectation of privacy in any aspect of their computer use, including emai1, and that monitoring of studentcomputer use is continuous. Students must not disable or bypass security procedures, compromise, attempt tocompromise, or defeat the district’s technology network security or Internet filtering software, alter data withoutauthorization, or disclose passwords to other students. Students who misuse district-owned computers or Internetaccess in any way, including using computers to violate any other policy or contrary to the computer use agreement, orusing the computers to access or create sexually explicit or pornographic text or graphics, will face disciplinary action, asspecified in the student handbook and/or computer use agreement.
In an effort to help protect student welfare when they navigate the Internet, the district will work to educate studentsabout appropriate online behavior, including interacting with other individuals on social networking websites and in chatrooms and cyberbullying awareness and response.
Students who use technology to violate other policies will be subject to discipline for misuse of technology as well asthe policy violation. Example: A student sends a threatening E-mail message to another student.

The Nemo Vista School District agrees to allow the student identified above ("Student") to use the district's technology toaccess the Internet under the following terms and conditions:
1. Conditional Privilege: The Student's use of the district's access to the Internet is a privilege conditioned on theStudent's abiding to this agreement. No student may use the district's access to the Internet unless the Student andhis/her parent or guardian have read and signed this agreement.
2. Acceptable Use: The Student agrees that he/she will use the District's Internet access for educational purposes only.In using the Internet, the Student agrees to obey all federal and state laws and regulations. The Student also agrees toabide by any Internet use rules instituted at the Student's school or class, whether those rules are written or oral.
3. Penalties for Improper Use: If the Student violates this agreement and misuses the Internet, the Student shall besubject to disciplinary action.
Level A: Minimum: Student – Principal Conference

Level C: Denied access of Internet for the year

Level of consequences will be at the administrator’s discretion .
4. "Misuse of the District's access to the Internet" includes, but is not limited to, the following:
a.using the internet for other than educational purposes;
b.gaining intentional access or maintaining access to materials which are “harmful to minors” as defined byArkansas law;
c.using the Internet for any illegal activity, including computer hacking and copyright or intellectual property lawviolations;
d.making unauthorized copies of computer software;
e.accessing “chat lines” unless authorized by the instructor for a class activity directly supervised by a staffmember;
f.using abusive or profane language in private messages on the system; or using the system to harass, insult,or verbally attack others;
g.posting anonymous messages on the system;
h.using encryption software;
i.wasteful use of limited resources provided by the school including paper;
j.causing congestion of the network through lengthy downloads of files;
k.vandalizing data of another user;
l.obtaining or sending information which could be used to make destructive devices such as guns, weapons,bombs, explosives, or fireworks;
m.gaining or attempting to gain unauthorized access to resources or files;
n.identifying oneself with another person’s name or password or using an account or password of another userwithout proper authorization;

o.invading the privacy of individuals;
p.divulging personally identifying information about himself/herself or anyone else either on the internet or in anemail. Personally identifying information includes full names, address, and phone number.
q.Using the network for financial or commercial gain without district permissions;
r.Theft or vandalism of data, equipment, or intellectual property;
s.Attempting to gain access or gaining access to student records, grades, or files;
t.Introducing a virus to, or otherwise improperly tampering with the system;
u.Degrading or disrupting equipment or system performance;
v.Creating a web page or associating web page with the school or school district without proper authorization;
w.Providing access to the District’s Internet Access to unauthorized individuals;
x.Failing to obey school or classroom Internet use rules; or
y.Taking part in any activity related to Internet use which creates a clear and present danger of the substantialdisruption of the orderly operation of the district or any of its schools.
z.Installing or downloading software on district computers without prior approval of technology director orhis/her designee.
5. Liability for debts: Students and their cosigners shall be liable for any and all costs (debts) incurred through thestudent's use of the computers or the Internet including penalties for copyright violations.
6. No Expectation of Privacy: The Student and parent/guardian signing below agree that if the Student uses the Internetthrough the District's access, that the Student waives any right to privacy the Student may have for such use. The Studentand the parent/guardian agree that the district may monitor the Student's use of the District's Internet Access and may alsoexamine all system activities the Student participates in, including but not limited to e-mail, voice, and video transmissions,to ensure proper use of the system. The District may share such transmissions with the Student'sparents/guardians. . .
7. No Guarantees: The District will make good faith efforts to protect children from improper or harmful matter which maybe on the Internet. At the same time, in signing this agreement, the parent and Student recognize that the District makesno guarantees about preventing improper access to such materials on the part of the Student.

4. “Misuse of the District’s access to the Internet” includes, but is not limited to, the following :
a.using the Internet for other than educational purposes;
b.gaining intentional access or maintaining access to materials which are “harmful to minors” as defined byArkansas law;
c.using the Internet for any illegal activity, including computer hacking and copyright or intellectual propertylaw violations;
d.making unauthorized copies of computer software;
e.accessing “chat lines” unless authorized by the instructor for a class activity directly supervised by a staffmember;
f.using abusive or profane language in private messages on the system; or using the system to harass,insult, or verbally attack others;
g.posting anonymous messages on the system;
h.using encryption software;
i.wasteful use of limited resources provided by the school including paper;
j.causing congestion of the network through lengthy downloads of files;
k.vandalizing data of another user;
l.obtaining or sending information which could be used to make destructive devices such as guns,weapons, bombs, explosives, or fireworks;
m.gaining or attempting to gain unauthorized access to resources or files;
n.identifying oneself with another person’s name or password or using an accountor password of anotheruser without proper authorization;
o.invading the privacy of individuals;
p.divulging personally identifying information about himself/herself or anyone else either on the Internet or inan email. Personally identifying information includes full names, address, and phone number.
q.using the network for financial or commercial gain without district permission;
r.theft or vandalism of data, equipment, or intellectual property;
s.attempting to gain access or gaining access to student records, grades, or files;
t.introducing a virus to, or otherwise improperly tampering with the system;
u.degrading or disrupting equipment or system performance;
v.creating a web page or associating a web page with the school or school district without properauthorization;
w.providing access to the District’s Internet Access to unauthorized individuals;

x.failing to obey school or classroom Internet use rules; or
y.taking part in any activity related to Internet use which creates a clear and present danger of the substantialdisruption of the orderly operation of the district or any of its schools.
z.Installing or downloading software on district computers without priorapproval of technology director orhis/her designee.
5. Liability for debts: Students and their cosigners shall be liable for any and all costs (debts) incurred through thestudent’s use of the computers or the Internet including penalties for copyright violations.
6. No Expectation of Privacy: The Student and parent/guardian signing below agree that if the Student uses the Internetthrough the District’s access, that the Student waives any right to privacy the Student may have for such use. The Studentand the parent/guardian agree that the district may monitor the Student’s use of the District’s Internet Access and mayalso examine all system activities the Student participates in, including but not limited to e-mail, voice, and videotransmissions, to ensure proper use of the system. The District may share such transmissions with the Student’sparents/guardians.
7. No Guarantees: The District will make good faith efforts to protect children from improper or harmful matter which maybe on the Internet. At the same time, in signing this agreement, the parent and Student recognize that the District makesno guarantees about preventing improper access to such materials on the part of the Student.

The Participant, (Cooperative/District/School/Library Name) NEMO VISTA SCHOOL DISTRICT authorizes the Department ofInformation Systems (DIS), State of Arkansas, to act as a consortium lead on its behalf in matters relatedspecifically to any State and Federal discount programs for the purpose of securing E-rate discounts.
The Participant authorizes DIS to engage on its behalf in the procurement process, in the submission of FCC Form 470, FCC Form 471, and other E-rate forms, and in the overall administration of these programs solely for the purpose of facilitating application for those discounts on E-rate eligible services, which shall include, but not be limited to, Telecommunications Services, Internet Access, Internal Connections, and Internal Connections Basic Maintenance.
I, the authorized signer, understand that DIS will be making certifications on behalf of the Participant. By signing this letter of agency, I make the following certifications:
a. I certify that the schools or educational service cooperatives in the Participants district are all schools under the statutorydefinitions of elementary and secondary schools found in the No Child Left Behind Act of 2001, 20 U.S.C.§§7801(18) and(38), do not operate as for-profit businesses, and do not have endowments exceeding $50 million.
b. I certify that the libraries or library consortia in the Participants system are eligible for assistance from a State LibraryAdministrative Agency under the Library Services and Technology Act of 1996, Pub. L. No. 104-208,§211 et seq., 110Stat. 3009 (1996), do not operate as for-profit businesses, and have budgets that are completely separate from any school(including, but not limited to, elementary schools, secondary schools, colleges, or universities).
c. I certify that the schools, educational service cooperatives, libraries, or library consortia in the Participants district havesecured access, separately or through this program, to all of the resources, including computers, training, software,internal connections, maintenance, and electrical capacity, necessary to use the services purchased effectively. Irecognize that some of the aforementioned resources are not eligible for support. I certify that the entities I represent orthe entities listed in this application have secured access to all of the resources to pay the discounted charges for eligibleservices from funds to which access has been secured in the current funding year. I certify that the Billed Entity will paythe non-discount portion of the cost of the goods and services to the service provider(s).
d. I certify that all of the schools, educational service cooperatives, libraries, or library consortia in the Participants districtare all covered by technology plans that are written, that cover all 12 months of the funding year, and that have been orwill be approved by a state or other authorized body, and an SLD-certified technology plan approver, prior to thecommencement of service.
e. I certify that the schools, educational service cooperatives, libraries, or library consortia in the Participants district arecompliant, or will be compliant at the time funded services are provided, with the Childrens Internet Protection Act, Pub.L. 106-554 (2000).
f. I certify that the services the school, educational service cooperative, library, library consortia or district purchases atdiscounts provided by 47 U.S.C. Sec. 254 will be used solely for educational purposes and will not be sold, resold, ortransferred in consideration for money or any other thing of value, except as permitted by the Commissions rules at 47C.F.R. Sec. 54.500(k). Additionally, I certify that the Billed Entity has not received anything of value or a promise ofanything of value, other than services and equipment requested under this form, from the service provider(s) or anyrepresentative or agent thereof or any consultant in connection with this request for services.
g. I certify that the entities eligible for support that I am representing will retain copies of all documents related to E-Rateapplications and funding use for a period of five years from the last date of service covered by this letter of agency.Documents to be retained include, but are not limited to: E-rate forms, technology plans, discount rate support, competitivebids received, bid selection results, inventory records, invoices, and payments.
h. I certify that the entities eligible for support that I am representing have complied with all applicable state and local lawsregarding procurement of services for which support is being sought.
i. I certify that the Participants district, educational service cooperative, library, or library consortia has complied with allE-rate program rules, and I acknowledge that failure to do so may result in denial of discount funding and cancellation offunding commitments.
j. I understand that the discount level used for shared services is conditional, for future years, upon ensuring that the mostdisadvantaged schools and libraries that are treated as sharing in the service receive an appropriate share of the benefitsfrom those services.

Note that this form must be used beginning with Funding Year 2001 (the Funding Year beginning July 1, 2001) and later. II. IMPACT OF CIPA REQUIREMENTS ON FORM 479 The Children's Internet Protection Act (CIPA) was signed into law on December 21, 2000. In order to receive discounts for Internet Access and Internal Connections services under the universal service support mechanism, school and library authorities must certify that they are enforcing a policy of Internet safety. The Internet safety policy must include measures to block or filter Internet access for both minors and adults to certain visual depictions. Beginning with Funding Year 2001 (the Funding Year beginning July 1, 2001), if the Billed Entity who represents an Administrative Authority is applying for Internet Access or Internal Connections, the Administrative Authority must certify on a Form 479 that it is in compliance with the requirements of CIPA or that it is undertaking such actions to comply with the requirements of CIPA prior to the start of the following Funding Year. (If the Administrative Authority is the Billed Entity, the Administrative Authority will certify on the Form 486.) The Billed Entity must receive your completed and signed Forms 479 before it can complete and postmark its Form 486. If the Billed Entity is applying only for Telecommunications Services, the requirements of CIPA do not apply and the Billed Entity is not required to collect Forms 479. (For more information, see the Children’s Internet Protection Act, as codified at 47 U.S.C. § 254(h) and (l).) Applying for funds. For the purpose of CIPA requirements, a school or library that is a recipient of service is considered to have applied for funds in a Funding Year only when a Form 486 for a Funding Request for Internet Access, Internal Connections or Basic Maintenance has been successfully data entered and USAC has issued a Form 486 Notification Letter. Determination of Your First Funding Year for Purposes of CIPA. The first Funding Year after Funding Year 2000 (the Funding Year beginning July 1, 2000) in which a school or library applies for funds (i.e. in which a Form 486 is successfully data entered for Internet Access, Internal Connections or Basic Maintenance and USAC issues a Form 486 Notification Letter) is the First Funding Year for purposes of CIPA. Once your First Funding Year is established, the next two funding years will be your second and third funding years for purposes of CIPA. (See “Applying for Funds” above.) In the first Funding Year, the applicant must be in compliance with CIPA or undertaking actions to comply with CIPA, in order to receive discounts for Internet Access, Internal Connections or Basic Maintenance services. Once the First Funding Year is established, the Funding Year immediately following the First Funding Year becomes the Second Funding Year for purposes of CIPA. If the school or library applies for funds for Internet Access, Internal Connections or Basic Maintenance in the Second Funding Year, it must certify that it is in compliance with CIPA unless state or local procurement rules or regulations or competitive bidding requirements prevent the making of the certification otherwise required. A school or library so prevented may request a waiver for the Second Funding Year. The Third Funding Year for purposes of CIPA is the Funding Year immediately following the Second Funding Year. If the school or library applies for funds for Internet Access, Internal Connections or Basic Maintenance in the Third Funding Year, it must be in compliance with CIPA. You must be in compliance with CIPA for any Funding Year thereafter. The following situations WOULD constitute the Administrative Authority’s First Funding Year: The Billed Entity submits a Form 486 for Internet Access, Internal Connections or Basic Maintenance, the Form 486 is
successfully data entered and USAC issues a Form 486 Notification Letter, but the Billed Entity cancels all of its Funding Requests on a Form 500.
The Billed Entity submits a Form 486 for Internet Access, Internal Connections or Basic Maintenance, the Form 486 is successfully data entered and USAC issues a Form 486 Notification Letter, but the service provider does not receive a corresponding disbursement.
The following situations WOULD NOT constitute the Administrative Authority’s First Funding Year: The Billed Entity receives a Funding Commitment for Internet Access, Internal Connections or Basic Maintenance, but
takes no further action. The Billed Entity receives a Funding Commitment for Internet Access, Internal Connections or Basic Maintenance,
submits Form 486, but the Form 486 is not successfully data entered and no Form 486 Notification Letter is issued. The Billed Entity applies only for Telecommunications Services.

Who Must Submit the Form 479? In general, the Administrative Authority is the entity that must complete Form 479. For a school, the Administrative Authority may be the school, school district, school board, local educational agency, or other authority with responsibility for administration of the school. For a library, the Administrative Authority may be the library, library board, or other authority with responsibility for administration of the library. If the Administrative Authority is also the Billed Entity, the Administrative Authority certifies on the Form 486. If the Administrative Authority is not the Billed Entity, the Administrative Authority must complete Form 479, and submit the Form 479 to the Billed Entity. The Billed Entity then certifies on Form 486 that it has collected duly completed and signed Form(s) 479. How Many Forms 479 to Submit to the Billed Entity? Generally, you will complete one Form 479 for each of your Billed Entities. When to Submit the Form 479? The Billed Entity must receive your completed and signed Forms 479 in time to postmark the Billed Entity’s Form 486 to meet Form 486 deadlines. You should work with your Billed Entity to determine when to submit your Form 479. You must complete Form 479 for each Funding Year in which you receive discounted services beginning with Funding Year 2001 (the Funding Year beginning July 1, 2001) and after. SPECIAL NOTE FOR LIBRARIES AND CONSORTIA CONTAINING LIBRARIES FOR FUNDING YEAR 2003: On July 24, 2003, the FCC released an Order (FCC 03-188) to bring its implementation of CIPA into compliance with the recent United States Supreme Court decision on CIPA. The Order states that library consortium members who filed the September 2002 version of the Form 479 for FY2003 funding requests prior to the effective date of the Order must file the revised Form 479 with their billed entity within 45 days after the effective date of the Order. USAC expects the effective date of the Order to be in August 2003. To determine the effective date of the Order and the deadline for refiling Form 479, applicants should check the USAC website or contact the Client Service Bureau (see “Where to Get More Information?” below). Note to Libraries in Funding Years 2003 and 2004.
For Funding Year 2003, libraries must be in compliance with CIPA or undertaking actions to comply with CIPA in order to receive discounts for Internet Access, Internal Connections or Basic Maintenance.
If a library that applied for funds for Internet Access, Internal Connections or Basic Maintenance in Funding Year 2003 applies for funds for Internet Access, Internal Connections or Basic Maintenance in Funding Year 2004, it must certify that it is in compliance with CIPA unless state or local procurement rules or regulations or competitive bidding requirements prevent the making of the certification otherwise required. A library so prevented may request a waiver for Funding Year 2004. (See “Applying for funds” above and the instructions for Item 6e below.)
If a library has applied for funds for Internet Access, Internal Connections or Basic Maintenance in both Funding Year 2003 and Funding Year 2004, it must be in compliance with CIPA in Funding Year 2005 and any Funding Year thereafter. (See “Applying for funds” above.)
Libraries that apply for funds for Internet Access, Internal Connections or Basic Maintenance for the first time in Funding Year 2004 or any subsequent year should follow the procedures in the “Determination of Your First Funding Year for Purposes of CIPA” above.
Where to Send Form 479? The Form 479 must be filed with your Billed Entity. DO NOT SUBMIT THE COMPLETED FCC FORM 479 TO THE SCHOOLS AND LIBRARIES DIVISION OR TO THE FCC; SUBMIT IT ONLY TO YOUR BILLED ENTITY.

Compliance. Anyone filing false information is subject to penalties for false statements, including fine or forfeiture, under the Communications Act, 47 U.S.C. §§ 502, 503(b), or fine or imprisonment under Title 18 of the United States Code, 18 U.S.C. § 1001. All of the information required in the Form 479 must be completed in order for the Billed Entity to be able to certify as required on the FCC Form 486.

IV. SPECIFIC INSTRUCTIONS Type or clearly print in the spaces provided. Attach additional pages if necessary. Administrative Authority’s Form Identifier: Use this space to assign a number or letter of your own devising to facilitate communication with your Billed Entity about THIS particular Form 479. Your Administrative Authority’s Form Identifier can be very simple; for example, if you are filing three Forms 479, you might label them “A,” “B,” and “C.” The Administrative Authority’s Form Identifier can also be descriptive, such as “Internet.” Choose identifiers that suit your own record keeping needs. A. Block 1: Administrative Authority Information Block 1 of Form 479 asks you for your name, address, and basic identification information. Item 1 - Provide the name of the Administrative Authority. Item 2 - Provide the Funding Year (e.g., 2001 –2002) for which funds were requested or approved and for which the Billed Entity will be submitting a Form 486. Program Funding Years begin on July 1 and end on June 30. For example, Funding Year 2001 runs from July 1, 2001 through June 30, 2002. Cite only one Funding Year in this item. Item 3 - Provide the Administrative Authority’s full mailing address, whether a street address, Post Office Box number, or route number. Provide the Contact Person’s Name; 10-digit telephone number including the area code; fax number; and e-mail address. B. Block 2: Certifications and Signature Block 2 of Form 479 asks you to certify with respect to your status as the Administrative Authority and with respect to your compliance with the Children’s Internet Protection Act. Item 4 – Certify that you are an Administrative Authority for one or more schools or libraries for which Universal Service Support Mechanism discounts have been requested or approved for eligible services. You must make the required certification(s) for the purposes of the Children’s Internet Protection Act in order to receive discounted services. While the Billed Entity will not submit the Form 486 until after discount requests have been approved and a Funding Commitment Decision Letter (FCDL) has been issued, the Billed Entity may ask you to file the Form 479 in advance of approval of the requests so that the Billed Entity is ready to file the Form 486 once the FCDL has been received. Item 5 – Certify to your recognition that you may be audited pursuant to this certification and will retain for five years any and all records that you rely upon to complete this form. Item 6 - This item concerns compliance with the requirements of the Children’s Internet Protection Act (CIPA), as codified at 47 U.S.C. § 254(h) and (l), and the implementing rules as codified at 47 C.F.R. § 54.520. Check the box that describes the status of compliance with the Children’s Internet Protection Act. The certification statements in Item 6 of the Form 479 should be read as if you are addressing them to the Billed Entity.

An Administrative Authority can certify Item 6b only in the first Funding Year after Funding Year 2000 (the Funding Year beginning July 1, 2000) for which it is applying for discounts for Internet Access or Internal Connections services. An Administrative Authority can seek a CIPA Waiver under Item 6d only in its Second Funding Year. If you request a CIPA Waiver, you certify that your schools or libraries will be in compliance before the start of the Third Funding Year. You cannot seek a CIPA Waiver in your Third Funding Year, even if you have a new school or library branch/outlet under your authority in that Funding Year. (See “Impact of CIPA Requirements on Form 479” above for a discussion of First, Second and Third Funding Years.) Note that libraries can request a CIPA Waiver under Item 6e in Funding Year 2004. (See the instructions for Item 6e below.) Schools and libraries receiving E-rate discounts are required to have an Internet safety policy that addresses: (1) access by minors to inappropriate matter on the Internet and World Wide Web, (2) the safety and security of minors when using electronic mail, chat rooms, and other forms of direct electronic communications, (3) unauthorized access, including hacking, and other unlawful activities by minors online, (4) unauthorized disclosure, use, and dissemination of personal identification information regarding minors, and (5) measures designed to restrict minors’ access to materials harmful to minors. There is also a public notice and hearing/meeting requirement. The Internet safety policy must include the use of filtering or blocking technology that protects against access, through computers with Internet access, to visual depictions that are obscene, child pornography, or (in the case of use by minors) harmful to minors. • Item 6a – Check here if you certify to the Billed Entity that the recipient(s) of service under your administrative
authority and represented in the Funding Request Number(s) for which the Billed Entity has requested Funding Commitments has (have) complied with the requirements of the Children’s Internet Protection Act.
• Item 6b – Check here if you certify to the Billed Entity that the recipient(s) of service under your administrative
authority and represented in the Funding Request Number(s) for which the Billed Entity has requested Funding Commitments is (are) undertaking such actions, including any necessary procurement procedures, to comply with the requirements of the Children’s Internet Protection Act for the next funding year, but has (have) not completed all requirements of CIPA for this funding year.
NOTE FOR LIBRARIES: If Funding Year 2003 is your Second or Third Funding Year for purposes of CIPA and you check Item 6b, you are certifying that you are in compliance with the Internet safety policy and the public notice and hearing/meeting requirements and that you are undertaking actions to be in compliance with the filtering or blocking technology requirement by the start of Funding Year 2004. • Item 6c – Check here if you certify that the Children’s Internet Protection Act does not apply because the recipient(s)
of service under your administrative authority and represented in the Funding Request Number(s) for which the Billed Entity has requested or received Funding Commitments is (are) receiving discount services only for Telecommunications Services.
• Item 6d – CIPA Waiver. This item is applicable only to your Second Funding Year. (See “Impact of CIPA
Requirements on Form 479” above for the definition of your Second Funding Year.) Check here if you are providing notification that, as of the date of the start of discounted services, you are unable to make the certifications required by the Children’s Internet Protection Act because your state or local procurement rules or regulations or competitive bidding requirements prevent the making of the certifications otherwise required. You certify that the recipients(s) of service under your administrative authority and represented in the Funding Request Number(s) for which your Billed Entity has requested or received Funding Commitments will be brought into compliance with the CIPA requirements before the start of the Third Funding Year after April 20, 2001 in which they apply for discounts.
For example, if in Funding Year 2001 you certify that you are undertaking such actions necessary to put the measures required by CIPA in place for Funding Year 2002, then in order to obtain discounts in Funding Year 2002, you must fully implement the measures prior to the start of services in that Funding Year, unless you obtain a waiver as a result of procurement/competitive bidding constraints.
• Item 6e – CIPA WAIVER FOR LIBRARIES FOR FUNDING YEAR 2004. Check here if you are providing notification
that, as of the date of the start of discounted services in Funding Year 2004, you are unable to make the certifications required by the Children’s Internet Protection Act because your state or local procurement rules or regulations or competitive bidding requirements prevent the making of the certifications otherwise required. You certify that the library(ies) under your administrative authority and represented in the Funding Request Number(s) for which your Billed Entity has requested or received Funding Commitments will be brought into compliance with the CIPA requirements before the start of Funding Year 2005.

NOTE THAT the certification language in the Form 479 is not intended to fully set forth or explain all the requirements of CIPA. Item 7 requires the signature of the Authorized Person. Item 8 - Enter the date the Form 479 was signed. This date must include the month, day and year. Item 9 - Print the name of the Authorized Person whose signature is provided in Item 7. Item 10 - Provide the title or position of the Authorized Person whose signature is provided in Item 7. Item 11 - Provide the telephone number, including area code, of the Authorized Person whose signature is provided in Item 7. This information is required in order to expedite any communications that may be necessary between the Authorized Person responsible for signing the Form 479 and the Billed Entity. Submit completed forms to your Billed Entity. V. REMINDERS • The person authorized to provide the information required by Form 479 must sign and date Form 479. • Provide data for all information items. • This Form 479 is applicable to you only if you are an Administrative Authority who is not a Billed Entity.
