Replace those original pages with the attached pages that include reference labels. QUESTIONS AND ANSWERS Q l.) On Page 7 of the RFP, the section on Fair Pricing Review states that the "General Contractor may be asked to review another contractor's pricing. Explain how your firm would evaluate proposal to determine errors and misunderstandings isolate variables and exceptions ... " If you could please clarify this in terms of its legality (possibly with the City Attorney's office), that would be very much appreciated. Al.) After speaking with the City Attorney about your concerns, it has been decided that the subject provision will stay in the contract. Q2.) We understand that responses to questions will be addressed via subsequent addenda 5 days before submittal (Nov. 9); however, given the substantial impact of this requirement, we'd really appreciate a response sooner. A2.) It was stated that we have to have it published at least 5 days before submittals are due but we will post it as soon as we have all the answers to the questions asked before questions deadline on November 2nd, Q3.) Could you please confirm that what was communicated in the pre-proposal meeting this morning, is that we submit our proposal in either 8 hard copies or I thumb drive? It is not clear from the RFP (p. 6), as it states, "submit 8 hard copies and/or thumb drivers"? A3.) We need 8 hard copies plus one thumb drive, OR, just one thumb drive. Q4.) Q9.) Did someone formally ask the question about page limit on this RFP? The RFP lists a 35-page limit. Does that include the attachments in Tab A: Transmittal letter? The Diversity/Inclusiveness form (plus its attachments as required in Items 2 & 7 of the form). Certificate of Good Standing Disclosure Form (not provided in the RFP)

A9.) The RFP states that the 35 page limit is not affected by cover pages, comments relating to the Sample Agreements, or any other required forms. Tab A is required (except for the Disclosure Form, see Q5.), so they are not included in the 35 page limit.

As the City deems necessary and appropriate in its sole discretion, the City reserves the right to make any inquiries or other follow up required to verify the information provided.

Diversity and Inclusiveness in City Solicitations: Each bidder shall, as a condition of responsiveness to this solicitation, complete and return the "Diversity and Inclusiveness in City Solicitations Information Request Form" with their Bid (Attachment B).

Using the " Diversity and Inclusiveness in City Solicitations Information Request Form" provided, please state whether you have a diversity and inclusiveness program for employment and retention, procurement and supply chain activities, or customer service and provide the additional information requested on the form. The information provided on the "Diversity and Inclusiveness in City Solicitations Information Request Form" will provide an opportunity for City contractors to describe their own diversity and inclusiveness practices. Contractors are not expected to conduct intrusive examinations of its employees, managers, or business partners in order to describe diversity and inclusiveness measures. Rather, the City simply seeks a description of the contractor's current practices, if any. Diversity and Inclusiveness information provided by City contractors in response to City solicitations for services or goods will be collated, analyzed, and made available in reports consistent with City Executive Order No. 101. However, no personally identifiable provided by or obtained from contractor's will be in such reports.

Insurance Required: The selected Consultant for this Project shall be required to strictly comply with the Insurance requirements set forth in the Sample Agreement (Attachment A). The selected Consultant, all other primary firms and all subconsultant firms performing work or providing services for the Project will be required to obtain insurance coverage in the amounts and under the terms and conditions specified therein. As such, each Submitter shall submit with its Response in the Letter of Transmittal, a statement indicating the firm's intention to comply with the insurance requirements of this section.

Secti011 4 - Required Submittal:

Proposers shall submit eight (8) hard copies and/or a Thumb drives of their completed RFP response containing a PDF of the entire proposal. Proposals must be limited to the following prescribed information and be submitted in an 8 'h'' x 11 " . Pages are to be numbered in sequence and font size will be at least 11 pt. font. Sections shall be labeled for easy reference. Graphics or charts that would not present well on 8 'h'' x 11" size paper may be presented on 11" x 17" size paper. Proposals shall not exceed 35 single-sided pages in length. This page limit is not affected by: cover pages, comments relating to the Sample Agreements, or any other required forms. Proposals shall use the following tabulation and numbering:

A massive submittal is not necessary and is discouraged. All submittals shall adhere to the following tab format:

A. Transmittal Letter, Addressed to: Public Works Finance and Administration 201 West Colfax Avenue, Dept. 614, Denver, Colorado 80202, Attention: Diane Mora. Include affirmative statement acknowledging proposer's willingness to comply contract insurance and indemnity requirements Include completed Disclosure Form Include copy of completed Diversity and Inclusiveness in City Solicitations Form. Include Certificate of Good Standing from Colorado Secretary of State website.

8 . Contractor Profile summarizing the Contractor' s organization and management. Include the number of years in operation, the location of office in the Denver Metropolitan area, size of staff and contact information including e-mail addresses. The General Contractor shall be required to assign sufficient perso1U1el to provide full authority for decision making and immediate availability for ongoing daily contact.

C. Brief Biographies, of principal perso1U1el which will be assigned to the work performed under the contract. Indicate ability to assign sufficient experienced perso1U1el at all levels as needed to ensure manpower availability. At a minimum include brief biographies for one owner I officer of the general contracting company, one construction project manager and one construction jobsite superintendent.

D. Description of the capability of the contracting finn to "self-perfonn" certain work. Include a list of all areas in which the general contractor is able to perfonn and fully execute certain construction work using its own forces. Give examples of past self-perfonned work.

E. Examples of project construction work, within the past five years, highlighting experience in the perfonnance and administration of general construction work on various horizontal projects including sidewalk, curb and gutter. Examples shall be identified by photograph, project name, location, brief description, general construction scope, budget, schedule, and other responsibilities and a reference person, with current address and phone number, which the City may contact. Also include design consultant and I or architect references.

F. Bonding: Provide affirmation of bonding capacity by including letter from Surety affinning bonding capacity of $50,000 for initial bond, and ability for that bond, via riders, to reach $3,000,000.

G. Experience in scheduling, billing, accounting, change management, and other administrative tasks associated with performing construction work and administering construction contract responsibilities for municipalities or other governmental clients.

H . Safety: Provide a resume of the person in charge of safety for your company. Identify specific training that qualifies them for this position. Describe the safety program your firm uses to improve the safety, security and productivity of jobsites.

I. Experience in Single Trade Coordination (Minor Single Trade work orders): Give examples of completed projects which involved supervision of only one or two subcontractors.

J. Fair Pricing Reviews: At times, the General Contractor may be asked to review another contractor's pricing. Explain how your firm would evaluate a Proposal to determine errors and misunderstandings isolate variables and exceptions. Outline where the costs come from and provide alternatives. The City requires that all pricing be transparent. Market transparency is a necessary condition for competition, and competition has a moderating effect on pricing.

K. Bidding Expertise: Describe the methods used by your firm to select and utilize appropriate subcontractors, as necessary to conduct proposal request pricing and bidding. For projects under $150,000 the selected on-call general contractors may be asked to bid the scope of work to subcontractors, to obtain the best Proposal pricing attainable for the work.

L. Quality Control: Describe methods used to achieve quality workmanship and deliver projects that meet or exceed the project requirements and the General Contract Conditions.

M. Contractor Change Requests: Describe the proactive methods, new technologies and technical expertise used by your firm to minimize change orders while providing quality construction. Describe how subcontractor change order requests are reviewed for validity before a Contractor Change Request is submitted. Describe how your finn ensures markup isn't pyramided.

N. Submit a list of the following hourly billing rates for: l . General Contractor Project Manager 2. General Contractor Superintendent 3. On-site General Contractor Supervision 4. Estimating/Pricing Services 5. Clerical Services 6. Financial Accounting Services
