INTRODUCTION

Transition Plan Purpose

The St. Cloud Metropolitan Transit Commission, hereafter referred to as Metro Bus, is committed to the

practice of providing programs and services that are fair, inclusive, and equitable for all riders. This plan

is intended to guide Metro Bus’s efforts to ensure accessibility of its facilities, stops, and buses where

public services are provided.

The Americans with Disabilities Act (ADA), enacted on July 26, 1990, is a civil rights law prohibiting

discrimination against individuals on the basis of disability. ADA consists of five titles outlining

protections in the following areas:

I. Employment.

II. State and local government services.

III. Public accommodations.

IV. Telecommunications.

V. Miscellaneous Provisions.

Title II of ADA pertains to the programs, activities, and services public entities – such as Metro Bus --

provide. Title II of ADA states that “…no qualified individual with a disability shall, by reason of such

disability, be excluded from participation in or be denied the benefits of the services, programs, or

activities of a public entity, or be subjected to discrimination by any such entity.” (42 USC. Sec. 12132;

28 CFR. Sec. 35.130).

To comply with the aforementioned regulations, Metro Bus staff have conducted a self-evaluation of the

organization’s building facilities, buses, and stops. With this evaluation, Metro Bus staff have developed

this Transition Plan, detailing how the organization will ensure that those entities and subsequent

services, programs, and activities will be made accessible to all individuals

ADA Relationship to Other Laws

Title II of ADA is companion legislation to two previous federal statutes and regulations: the

Architectural Barriers Acts of 1968 and Section 504 of the Rehabilitation Act of 1973.

The Architectural Barriers Act of 1968 is a Federal law that requires facilities designed, built, altered, or

leased with Federal funds to be accessible. The Architectural Barriers Act was one of the first efforts to

ensure access to the built environment.

Section 504 of the Rehabilitation Act of 1973 is a Federal law that protects qualified individuals from

discrimination based on their disability. The nondiscrimination requirements of the law apply to

employers and organizations that receive financial assistance from any Federal department or agency.

Title II of ADA extended the coverage guaranteed under Section 504 to all state and local government

entities, regardless of whether they receive federal funding.

Metro Bus Requirements

Under Title II, Metro Bus must meet these general requirements:

• Must operate their programs so that, when viewed in their entirety, the programs are accessible

to and useable by individuals with disabilities (28 CFR Sec. 35.150).

• May not refuse to allow a person with a disability to participate in a service, program, or activity

simply because the person has a disability [28 CFR Sec. 35.130 (a)].

• Must make reasonable modifications in policies, practices, and procedures that deny equal

access to individuals with disabilities unless a fundamental alteration in the program would

result [28 CFR Sec. 35.130(b) (7)].

• May not provide services or benefits to individuals with disabilities through programs that are

separate or different unless the separate or different measures are necessary to ensure that

benefits and services are equally effective [28 CFR Sec. 35.130(b)(iv) & (d)].

• Must take appropriate steps to ensure that communications with applicants, participants, and

members of the public with disabilities are as effective as communications with others [28 CFR

Sec. 35.160 (a)].

• Must designate at least one responsible employee to coordinate ADA compliance [28 CFR Sec.

35.107 (a)]. This person is often referred to as the "ADA Coordinator." The public entity must

provide the ADA Coordinator's name, office address, and telephone number to all interested

individuals [28 CFR Sec. 35.107 (a)].

• Must provide notice of ADA requirements. All public entities, regardless of size, must provide

information about the rights and protections of Title II to applicants, participants, beneficiaries,

employees, and other interested persons [28 CFR Sec. 35.106].

• Must establish a grievance procedure. Public entities must adopt and publish grievance

procedures providing for prompt and equitable resolution of complaints [28 CFR Sec. 35.107(b)].

This requirement provides for a timely resolution of all problems or conflicts related to ADA

compliance before they escalate to litigation and/or the federal complaint process.

SELF-EVALUATION CONDITION ASSESSMENT

Overview

Metro Bus is required, under Title II of the Americans with Disabilities Act (ADA) and 28 CFR 35.105, to

perform a self-evaluation of its buildings, infrastructure, policies, practices, and programs. The buildings

and infrastructure examination includes the Operations and Maintenance facility, the Downtown Transit

Center, the Mobility Training Center, bus stops, and revenue rolling stock.

The goal of the self-evaluation is to verify that, in implementing Metro Bus’s policies and practices, the

organization is accessible and not adversely affecting the full participation of individuals with disabilities.

Barriers to public accessibility are identified in the self-evaluation. Addressing these barriers will involve

making reasonable accommodations and/or physical modifications to existing buildings, infrastructure,

polices, practices, and programs.

Building Facilities Summary

In August and September 2018, Metro Bus staff conducted an assessment of its building facilities which

included an accessibility evaluation of the following categories:

• Site: parking spaces, drop-off zones, walkways, ramps, handrails, curb ramps.

• Building: stairs, lifts, elevators, ramps, handrails, doorways, door approaches, corridors.

• Spaces: restrooms, breakrooms, conference rooms, meeting areas.

• Other Elements: Telephones, Drinking Fountains, Counters/Desks

All three of Metro Bus’s primary facilities fall within the guidelines for ADA compliance. MTC will

continue to ensure that facilities maintain this status. Any additional facilities constructed by MTC –

either new construction or significant facility improvements – will meet the ADA requirements as

outlined by Federal regulations.

Recommended Action

Metro Bus will continue to work diligently to provide accessible features as part of its capital

improvement projects for building facilities. The Minnesota Building Code, which sets forth

requirements for building facilities, outlines ADA accessibility requirements at the time of construction

and for major remodeling projects of municipal building facilities. The 2015 Minnesota Accessibility

Code – a subsection of the Minnesota Building Code – provides updated standardized design

requirements to ensure accessibility in building facility construction projects.

Metro Bus will be hiring a consultant to conduct and produce a transit operations feasibility study

looking at the organization’s current and future transit facility needs. This process is slated to be

completed by June 2019.

Vehicles Summary

In order to be ADA compliant, Metro Bus shall ensure its fleet of revenue rolling stock vehicles meet the

guidelines for compliance as stated in Federal regulations.

As of Nov. 1, 2018, Metro Bus has a fleet of 76 buses. The fleet is comprised of 38 New Flyer buses (bus

numbers 701 through 738) used for fixed route operations; five MCI coach buses (bus numbers 808

through 812) used for Northstar Commuter Link operations; 32 Cutaway buses (bus numbers 109

through 136 and 204 through 207) used in both Dial-a-Ride (DAR) and fixed route operations; and one

trolley (number 036) used sparingly.

Mobility Aid Accessibility

Per Federal requirements, all new, used, or remanufactured buses and vans must “provide a level-

change mechanism or boarding device (e.g., lift or ramp) … and sufficient clearances to permit a

wheelchair or other mobility aid user to reach a securement location.”

All 76 MTC revenue vehicles are equipped with either a ramp or lift.

The majority of the fleet – with the exception of the MCI coach buses and the trolley – are outfitted with

a ramp system. Each ramp can support a load of up to 600 pounds and is equipped with a slip resistant

surface. In addition, each ramp’s slope falls within the Federal regulation guidelines outlined in

Accessibility Specifications for Transportation Vehicles (https://bit.ly/2Qm1Km0) 49 CFR §38.23(c)(5).

The five MCI coach buses and the one trolley are equipped with a lift system. This system is designed to

support a load of up to 600 pounds. The platform of the lift is equipped with a slip resistant surface and

barriers to prevent any of the wheels of a wheelchair or mobility aid from rolling off the platform while a

passenger is boarding or alighting. Each lift is outfitted to the specifications outlined in the

aforementioned document and can be specifically located in 49 CFR §38.23(b). Inspection of these

wheelchair lifts is included as part of Metro Bus’s pre-trip inspections and preventative maintenance

process conducted prior to revenue service deployment.

All vehicles within the Metro Bus fleet are designed to secure a minimum of two wheelchairs or mobility

aid devices. The Cutaway vehicles used for both DAR and fixed route operations are equipped with four

securement positions. All securement positions within the fleet are forward facing with clear pathways –

including the location of the fare box within the vehicle – to access these areas.

Other Requirements

Priority Seating

Each Metro Bus revenue vehicle contains a minimum of one sign indicating priority seating for persons

with disabilities. These signs are located at the front of the vehicle and are designed to inform other

passengers that such seats will be made available to those who wish to use them.

Handrails and Stanchions

Per Federal regulations “interior handrails and stanchions shall permit sufficient turning and

maneuvering space for wheelchairs and other mobility aids to reach a securement location from the lift

or ramp.” Metro Bus revenue vehicles are equipped with both handrails and stanchions for this purpose

and for assisting in the boarding and alighting of passengers.

Lighting

All Metro Bus revenue vehicles are equipped with lighting placed along the stepwell and doorways

adjacent to the driver. In addition, the exterior doorways of Metro Bus revenue vehicles are outfitted

with lights to provide at least one foot of illumination on the street surface for safe boarding and

alighting of passengers, specifically those who are utilizing either the lift or the ramp.

Stop Requests

All Metro Bus revenue vehicles provide accessible controls adjacent to the securement locations of

mobility aids for passengers to request the vehicle to stop. These controls provide the driver with an

auditory and visual cue that a request has been made.

Metro Bus revenue vehicles are also equipped with a public address system that will allow either the

driver or a digitized, prerecorded human voice, to announce bus stops.

All Metro Bus revenue vehicles are equipped with an illuminated sign on the front, boarding side, and

rear of the vehicle indicating the route number and/or destination of the service vehicle.

Recommended Action

All 76 Metro Bus revenue rolling stock vehicles fall within the guidelines for ADA compliance. Metro Bus

will continue to ensure that vehicles within the fleet maintain this status. Any additional vehicles

acquired by Metro Bus – either new built, used, or refurbished – will meet the ADA requirements as

outlined by Federal regulations.

Bus Stop Summary

Metro Bus is constantly looking for opportunities to not only improve access to bus stops but also to

improve access from bus stops onto the bus. Due to the diversity of development patterns and road

types served by Metro Bus, different types of stop configurations have been created to serve a variety

areas and conditions.

Inventory

A complete stop inventory and assessment was conducted in August and September 2018 to evaluate

each stop in the Metro Bus network. A master data spreadsheet was created for all stops in the network

which can be maintained and updated as improvements are made, stops become active, or are

removed. The bus stop master data spreadsheet is attached in Appendix A. Requests for copies of

individual bus stop assessments can be made to the Metro Bus Planning Department.

During the inventory process four classifications of stops were determined.

• Class A: Stop with a shelter in place, no barriers (59 stops identified).

• Class B: Stop with a bench or other amenities in place, no barriers (10 stops identified).

• Class C: Stop with a sign on street with no landscape buffer/barrier (370 stops identified).

• Class D: Stop with a sign on street with or without sidewalk, landscape buffer/barrier (281 stops

identified).

Of the 720 stops assessed, 269 (or approximately 37 percent) are located on ADA compliant

pedestrian infrastructure.

Prioritization Process

Priority Areas

Metro Bus has identified specific bus stop locations as priority areas for planned accessibility

improvement projects. These areas have been selected due to existing condition, Capital

Improvement Plan (CIP) building projects for both Metro Bus and its member jurisdictions – St.

Cloud, Sartell, Sauk Rapids, and Waite Park – ease of providing reasonable accommodations, and

feedback from the public.

Member Jurisdiction Capital Improvement Plan Projects

Significant roadway improvements identified within the CIPs of current member jurisdictions are a

priority point for transit access improvements. As noted in Appendix B, a variety of road projects

that are adjacent to transit lines will be constructed from 2019 through 2023. Metro Bus’s Planning

Department will work closely with each jurisdiction to ensure that during these major road projects

transit access is considered. Metro Bus will also target these areas for budgeting its own

improvements so as to maximize the ability make improvements across the St. Cloud metro area.

Recommended Action

Metro Bus will continue to work towards the goal of improving access system wide. This will be

accomplished through independent Metro Bus improvements to the stop network and by partnering

with member jurisdictions during capital improvement projects planned throughout the metro area.

Stop improvements will be prioritized by available budget for improvements, proximity to scheduled

road improvements, and customer needs and requests.

POLICIES AND PRACTICES

Reasonable Accommodations Policy

Metro Bus’s Reasonable Accommodation Policy was approved by the Metropolitan Transit

Commission’s Board on June 19, 2018. The policy states that Metro Bus will make every effort, in

accordance with the law, to provide reasonable accommodations to employees and qualified

applicants with disabilities as defined in ADA regulations and the Americans with Disabilities Act

Amendments Act (ADAAA) of 2008.

In general terms, accommodation is any change in the work environment or in the way things are

customarily done that enables an individual with a disability to enjoy equal employment

opportunities. Reasonable accommodations, as defined in the policy, are steps that would enable a

qualified applicant who has a disability to be considered for a position; perform essential functions

of any position; or enjoy the same benefits and privileges of employment as a similarly situated

employee without a disability.

Other Policies and Practices

Metro Bus provides a wide variety of services through its various departments. All departments

follow Metro Bus policies and have, in several cases, specific departmental policies that address how

accessibility is ensured. Examples include policies for ensuring Somali translators and travel trainers

are on staff to better serve the growing diversity in the metro area.

Pedestrian facilities providing access to Metro Bus buildings will be maintained – to the extent

feasible -- to ensure accessibility when buildings are open for public use.

Metro Bus will consider and respond to all accessibility improvement requests. Requests should be

sent to the ADA Coordinator Nicky Lahr, Operations Manager via email [email protected];

phone at 320-529-4494; or via U.S. mail and/or in-person at St. Cloud Metropolitan Transit

Commission, 665 Franklin Ave. NE, St. Cloud, MN 56304. All accessibility improvements that have

been deemed reasonable will be scheduled consistent with Metro Bus building facility and

infrastructure priorities.

Metro Bus policies and procedures are updated regularly to maintain compliance with the ADA and

to reflect best management practices as they change over time in providing its services to all

community members.

IMPLEMENTATION

Schedule

Metro Bus has set the following goals for improving the accessibility of its building facilities, revenue

rolling stock, and bus stops within its service area. Metro Bus will implement two strategies to

ensure ADA compliance across the organization.

The first, and most comprehensive, are scheduled CIP projects based on available budget. Building

facilities, revenue rolling stock, and bus stops impacted by these projects will be upgraded to

current ADA accessibility standards, to the extent feasible. For building facilities, this process will

more often than not occur during facility construction projects. The acquisition of rolling revenue

stock will be conducted utilizing sound procurement procedures to ensure continued ADA

compliance. Bus stop infrastructure ADA compliance will involve coordination with member

jurisdictions to ensure upgrades are made during already programmed roadway infrastructure

improvements.

The second method includes standalone prioritized ADA accessibility improvement projects. These

projects will be incorporated into Metro Bus’s CIP on a case-by-case basis as determined by Metro

Bus staff, or may be completed by internal Metro Bus staff or contractors.

PUBLIC OUTREACH

Public outreach for ADA issues associated with Metro Bus building facilities, revenue rolling stock,

and bus stops are gathered through regular meetings with the Rider Advisory Committee (RAC) and

through unsolicited comments and requests for improvements from the public.

This plan was made available for public comment period of 30 days from Nov. 16, 2018, through

Dec. 17, 2018.
