Considerant qu'il impor.te de soumettre les bombardements par des forces navales a des disposi­tions generales qui garantissent les dro1ts des habitants et assurent la conservation des principaux edifices, en etendant a cette ope­ration de guerre, dans la mesure du possible, les principes du Re­glement de 1899 sur les lois et coutumes de la guerre sur terre;

TI est interdit de bombarder, par des forces navales, des ports, villes, villages, habitations ou ba­timents, qm ne sont pas defendus.

Une localite ne peut pas etre bombardee· a raison du seul fait que, devant son port, se trouvent mouillees des mines sous-marines automatiques de contact.

ARTICLE 2.

Toutefois, ne sont .Pas compris dans cette interdiction les ou­vra.ges militaires, etablissements militaires ou nave.ls, dep6ts d'armes ou de materiel de guerre, ateliers et installations propres a etre utilises pour les besoms de la flotte ou de l'armee ennemie, et les navires de guerre se trou­vant dans le port. Le com­mandant d'une force nave.le pourra, a.pres sommation avec delai raisonnable, les detruire par le canon, si tout autre moyen est impossible et lorsque les autorites locales n'auront pas procede a cette destruction dans le delai fixe.

ARTICLE 3.

Mter due notice has been given, the bombardment of undefended ports, towns, villages, dwellings, or build~ may be commenced, if the local authorities, after a formal summons has been made to them, decline to comply with requisitions for provisions or sup­plies necessary for the immediate use of the naval force before the · place in question.

These requisitions shall be in proportion to the resources of the place. They shall only be de­manded in the name of the com­mander of the said naval force, and they shall, as far as possible, be J>aid for in cash; if not, they shall be evidenced by receipts.

ARTICLE 4.

Un9efended ports, towns, vil­lages, dwellings, or buildings may not be bombarded on account of f~ilure to pay money contribu­tions.

CHAPTER II.-General Promsions.

ARTICLE 5.

In bombardments by naval forces all the necessary measures must be taken by the commander to.spare as.fa~ as possible sacred edifices, bmldmgs used for artis­tic, scientific, or charitable pur­poses, historic monuments, hos­pitals, and places where the sick or wounded are collected, on the understanding that they are not used at the same time for military purposes.

In the cases contemplated in the preced­ing paragraph, the said Govern­ment shall inform them at the same time of the date on which it received the notification.

ARTICLE 10.

Non-Signatory Powers.may ad­here to the present Convention.

The Power which desires to ad­here shall notify its intention to the Netherland Government, for­warding to it the act of adhesion, which shall be deposited in the archives of the said Government.

This Government shall imme­diately forward to all the other Powers a duly certified copy of the notification, as well as of the act of adhesion, mentioning the date on which it received the no­tification.

ARTICLE 11.

The present Convention shall come into force, in the case ,of the Powers which were a part.,. to the first deposit of ratifica­tions, sixty days after the date of the proces-verbal of that deposit, and, in the case of the Powers which ratify subsequently or which adhere, sixty days after the notification of their ratifica­tion or of their adhesion has been received by the Netherland Gov­ernment.

ARTICLE 12.

In the event of one of the con­tracting Powers wishing to de­nounce the present Convention, the denunciation shall be notified in writing to the Netherland Gov­ernment, which shall at once communicate a duly certified copy of the notification to all the other Powers informing them of the date on which it was received.

And whereas the said Convention h88 been duly ratified by the Government of the United States of America, by and with the advice and consent of the Senate thereof, and by the Governments of Germany, Austria-Hungary, Denmark, Great Britain, Mexico, the Netherlands, Russia, Sweden, Bolivia, and Salvador, and the ratifica­tions of the said Governments were, under the provisions of Article 9 of the said Convention, deposited by their respective plenipoten-tiaries with the Netherlands Government on November 27, 1909; ·

Adhesion of China. And whereas, in accordance with the f rovisions of Article 10 of the said Convention, the Government o China gave notification to the Netherlands Government on January 15, 1910, of its adherence to the said Convention;

Now, therefore, be it known that I, William Howard Ta.ft, President of the United States of America, have caused the said Convention to be made public, to the end that the same and every article and clause thereof may be observed and fulfilled with good faith by the United States and the citizens thereof.
