CHECK YOURBRICK-TIES

The SIBA Codes Committee isencouraging all SIBA builders to be surebrick orders are accompanied by brick tiesthat are 22-gage. Ties are typically suppliedautomatically by the brick company, alongwith the brick order. This is required by theIRC 2000, the current building code for newhome construction. See Section R703.7.4.1Size and Spacing.

BUILDERS FOCUS ON MUD AND DEBRISIt’s a dirty job, but the builders (not just anyone) must do it

There are more than 120 buildingcompanies in the Southwestern IndianaBuilders Association. They all work towardone of the most environmentally-friendlyland use – completed homes built incompleted subdivisions. But during theconstruction phases of building homes andsubdivisions, there are obstacles that resultin greater chances for unintentionalsediment or debris to be a problem.

I liken it to breaking eggs to make anomelet. Everyone likes omelets, but no onewants broken shells. In residentialdevelopment, the shells… er… sedimentproblems are very temporary. Soon afterconstruction, sidewalks, streets andnurtured sod secure the sediment anddrainage systems are allowed to handlestormwater in an operative and functionalmanner.

Some builders are better than others inmanaging trash removal and stormwatermeasures. All builders are highlyencouraged to give enough attention to themaintenance of systems that preventsubstantial problems.

Is it a big deal? Yes, it’s very importantfor the construction of new homes to begood stewards of the community and itsenvironment.

Is it a SUPER BIG deal?…….like theregulations make it out to be? In my opinion,not really. And I think most families wouldagree, especially if they had to front the costof the rules and regulations handed downthrough the construction industry.

Keep in mind “EPA’s own data showsthat the environmental risk associated withstorm water discharges from constructionsites is minimal, contributing less than 2%to water quality impairment.” Even with

flawless retention of all sediment on aconstruction site, the benefit is a fraction ofthe 2% improvement. Is that fraction worththe extra costs that also happen to keepworking households from affording theirhome?

In addition, the regulating agenciestypically do not take into account the actualviolator. To them, it might make sense for abuilder to install hundreds of dollars ofsediment fencing and other controls……then drive a truck over it and destroy theirprotection against violations. Back in reality,this doesn’t make any sense.

Finding the actual culprit is part of ourstate’s laws, although it almost never entersthe equation. The developer and builderare almost always held responsible. Andthe best reason for this is they are easy tocatch-up with. They are the only party whoreturn to the site day after day, until it’s sold.

As far as debris from sites, keep in mindalso that there are times that nearby residentsare the culprit in filling trash containers withtheir nonconstruction-related trash. There’ssomething interesting about a trashdumpster in a construction area. For no extraexpense, the dumpster tends to send outinvisible brain-wave messages to theneighbors, telling them to bring their trashand fill the contractor’s bin – typically afterwork hours.

Obviously, this leaves no room forconstruction trash, and increases thelikelihood of debris leaving the building site.Unfortunately, the violations of othersdon’t relieve contractors from theirresponsibility to maintain work siteseffectively and control the debris.

Some contractors have reported theynever have their dumpsters emptied onFridays so containers aren’t left unattendedfor entire weekends. But put your tricksaside! Sometimes they work, sometimesthey don’t.

Let’s remember the builder who tried tolimit all his trash to construction sitematerials only. Frustrated by residentsfilling the contractor’s dumpsters with theirtrash, he was sure to order a dumpster witha locked door at the end. His effort to avoidhauling EVERONE ELSE’s trash rewardedhandsomely - by residents leaving their trashconveniently outside the locked door. The

builder was forced to put the trash into thedumpster and have it hauled away.

Successful building and remodelingcompanies are deserving of everyone’srespect. Fair or foul, the builder is requiredto play by the rules – some of which I’m notconvinced are worth their respective cost.Afterall, rules are rules and by the way, noone guaranteed the Builder would win.

BUILDING DEBRISNow that the heavy construction season

is in full swing, builders are reminded to payextra attention to the trash and debris thatmay be leaving the construction site. Whiledumpsters are known commonly to be filledwith non-construction materials, it can bean extra challenge. Making sure all trashmaterials are handled properly is greatlyappreciated.

Association testified to the State Fire andBuilding Services Commission for theupcoming electrical code.

Overall, the Builders Associationsupport the upcoming code. But there are afew adjustments that are needed to protectaffordable housing.

The Builders Association opposes aneffort being made by the Greensburg,Indiana officials to require the servicedisconnect to be located outside of abuilding or structure. There are obvioussecurity, safety, and health reasons not tohave the electric service disconnectavailable to the outside of the building. Theadded cost is estimated by the BuildersAssociation to be $700 per home. Indiana’scurrent code allows the disconnect serviceto be inside or outside.

IBA also opposed the requirement ofthe arc-fault, which are proving to beunreliable, and giving a false sense ofsecurity to home owners. Reports indicatesome units are being recalled.

The Second Hearing for the IndianaElectrical Code is in July. Anyone interestedin more details, or participating, should contactthe Builders Association at 1-800-377-6334.

JUNE MARKS FINAL MONTH FORPHASE-IN OF QABS PROGRAM

Two years ago, the SIBA Board ofDirectors voted to approve the QualityAssurance Builders Standards (QABS).The vote required all SIBA builders tocomply with the QABS program. Theprogram was phased-in over the next year,and was required as Builder Membersrenewed their membership. This June marksthe final month for Builder Members to signthe Commitment Form. As soon as July,more than 120 building companies will beparticipants in the QABS program.

Many builders reviewed the programand saw immediate benefits. They signedtheir Commitment Form at their firstopportunity.

Going into June, 2005, only a handful ofbuilders have yet to sign onto thecommitment forms.

Builders are required1) To sign the SIBA Commitment Form;2) To change their contract to incorporate

the QABS program;3) To incorporate into the contract the

builder’s choice for a third-partydispute resolution mechanism;

4) To provide a QABS manual to everycustomer at the time of contract signing

for each new construction projectundertaken by the Builder.The QABS program is already

benefiting SIBA builders. One builder hasreported that they started to participate in theprogram as soon as it became available. Andthey have not received a “call-back” from acustomer since. But in all fairness, he spendsseveral minutes with the customer explaininghow to use the manual and the program.

SMALLER HOMESGiven the choice of more space or higherquality features, new home buyers areoverwhelmingly opting for the latter,according to the latest survey data fromNAHB.When asked to choose between a biggerhouse with fewer amenities or a smallerhouse with high-quality products andamenities, 63% of the home owners surveyedby NAHB favored downsizing to the homewith the bells and whistles. To pay for theresidential accoutrements of upscale living,57% said that they preferred having themincluded in the base price of the home; 43%wanted them to be offered as options at extracost.“One particular consumer trend stands out:While homes do not appear to be gettingbigger, they are definitely getting better.There is a marked increase in quality, withupdated features and amenities,” said JerryHoward, executive vice president and CEOof NAHB.The households who were surveyedindicated enthusiasm for just about everyupscale feature available, Howard said, butmade more realistic decisions when theywere asked to choose from amongalternatives.Among several other observations on whatpeople desire in their new homes:· The top kitchen features home owners

want are a walk-in pantry (84%), islandwork area (77%), special-use storage(62%) and built-in microwave (62%).

· Thirty-seven percent said they wantedtheir kitchens visually open to thefamily room, with a half wall; 34% wantthe wall to come down, leaving the tworooms completely open.

· At the top of the list of most-sought-after bathroom features were a linencloset (91%), exhaust fan (88%) andseparate shower enclosure (78%).

· Nine-feet is now the standard height inceilings, up from 8 feet previously.“Consumers say it provides moreopenness, more light and makes thehome feel bigger,” said Howard.

· Younger households prefer their washerand dryer to be located near thebedroom; older households prefer themnear the kitchen.

NEW REQUIREMENTS FORFILING REPORTS WITH THE

SECRETARY OF STATEIndiana corporations are responsible to

file a Business Entity Report with the IndianaSecretary of State every two years. Thisreport is due in the anniversary month ofthe corporation’s date of incorporation. TheSecretary of State used to send a completedform to the corporation’s last registeredaddress and the business owner simplysigned the report and returned with payment.

The Secretary of State no longer sendsthese completed forms. The only notice theSecretary of State now sends is a reminderpostcard. It is the corporation’sresponsibility to go to the Indiana Secretaryof State’s website every two years to either(i) file the report online and pay the fee usinga credit card (www.in.gov/sos/business/index.html); or (ii) complete the form online,print the report form and then mail to theSecretary of State’s office with payment(www.in.gov/sos/business/berf2.html).

If a corporation fails to file the BusinessEntity Report, it will no longer be in “goodstanding” with the Secretary of State. Aftera period of time, the Indiana Secretary ofState will administratively “dissolve” thecorporation and it will no longer beconsidered a corporate entity.

Association in Springfield, Illinois. He has owned EA Knight Construction for over 20 years focusing oncustom home building and remodeling. Knight has been in the building industry since 1955. He will discuss

the benefits of using a computer in customer presentations.

GAS LINE BONDING: Call the Electrician!The SIBA Codes Committee has

reviewed the code requirements to bond gaslines. These drawings are meant to helpadvise builders on the requirements.

The SIBA Codes Committee alsoreviewed the sequence of installation, andwhile builders are ultimately responsible forthe compliance, builders are advised to havetheir Electrician include this bonding as partof their package to wire new homes.Important Points:1) Bonding must be from the customer-side

of the gas line to the grounding rod.2) Both ends of the connection must be

visible for inspection.3) The bonding wire is highly encouraged

to be insulated wire. If wire is notinsulated, there may be othercompliance requirements.

4) Gas meters will not be green taggedunless they are bonded.

EUTS HIRES MILLS AS DIRECTORBrad Mills

was appointede x e c u t i v edirector of theE v a n s v i l l eU r b a nTransportationStudy onWe d n e s d a yApril 20, 2005by the EUTSPolicy Committee. He will keep his positionas the executive director of the Evansville –Vanderburgh County Area PlanCommission. Mr. Mills is pro-developmentand works to help residents, builders, anddevelopers with their projects.

Mr. Mills has chosen to not have EUTSparticipate in the Site Review Committee inEvansville – Vanderburgh County. EUTS willcomment on site review projects whenrequested by the City or County Engineer.

Mr. Mills will focus the efforts of theEUTS staff to perform its duties as theregional transportation planning agency.EUTS will assist localities to plan, design,and identify funding sources fortransportation improvements.

Mr. Mills is a native of southern Indiana.He graduated from Castle High School in1977 and received his civil engineeringdegree with an emphasis in transportationengineering from the University of Arizonain Tucson. He is a registered professionalengineer in Indiana and Kentucky. Heserved in the Air Force and was stationed inTucson, Arizona.

Mr. Mills has worked for three nationalconsulting firms as a transportationengineer; Harland Bartholomew andAssociates in Richmond, Virginia; Kimley-Horn and Associates in Virginia Beach,Virginia; and Bernardin-Lochmeller andAssociates in Evansville. In addition, he wasthe founder and president of CapstoneEngineering & Environmental, Inc. inNewburgh that designed residential andcommercial subdivisions. In that capacity,he had the opportunity to work withnumerous builders and developers insouthern Indiana.

Mr. Mills will guide EUTS to promote acomprehensive transportation network forthe Tri-State that provides for the safe andefficient movement of people and goods.

The Indiana Builders Association isworking to improve the effectiveness ofstormwater regulations on construction siterun-off. And it needs help from builders anddevelopers to provide constructive commentsto IDEM – the agency that creates thestormwater regulations for Indiana.

EPA’s federal data show that constructionsite run-off is minimal – contributing less thantwo percent to water quality impairment.Meanwhile, the stormwater regulations addabout $1400 – $4500 to each and every buildinglot. Those costs are passed on to thehouseholds who are trying to purchase a newhome.

Based on the median income and medianhouse price for our MSA, for an increase ofonly $2000, one thousand (1,000) householdscan no longer afford that home.

Most of the regulations generated fromthe Phase II of the Clean Water Act focus oncompany paperwork – not controls of actualsediment. Also, the construction industry isgoverned by a penalty-based policy, differentfrom other industries that are involved withalmost-identical efforts to protect theenvironment.

Builders and developers regulated by thestormwater regulations should be sure toprovide comments on improving theregulations and the affordability of housingfor Hoosiers by contacting Bill Pedtke at theSIBA office (812-479-6026).
