I hope 2017 has been smooth sailing for you and your business. We haven't had the best weather with all the rain, but at least it isn't snow. Builders are hard at work, trying to make sure that their homes will be ready by June for the Parade. If you think that you may have a home that could be ready by Parade (June 3rd-11th), you have until February 24th to get a contract into SIBA. If your home won't be ready by June 3rd, and you still want the community to see what you are working on there is always the Spring Tour. The Spring Tour of Homes will be March 4-5th, noon-4 pm. Make sure to contact Katie at the SIBA office to find out more information. February 27-28th is IBAs Legislative Conference in Indianapolis. This is a great time to get together with lawmakers at the statelevel. I would encourage all of you to take the time to go to one. I always find them very interesting filled with valuable content. At the last board meeting on January 17th the board passed the motion to raise dues to $583.00/year. This simply passes along increases anticipated from the state and national association. It also means any dues increase is very unlikely until 2019. The new dues price has gone into effect

immediately, starting with any new members that join the association. The board decided a single increase now was preferable to increase over the next 3 years. I hope to see everyone out at the next Membership Meeting on February 14th. I will be making a presentation on the of Jacobsville project. Jacobsville is a network of neighborhood residents, businesses and industry, the professions and government working together for progress and a positive community image in areas of housing, public safety, economic development, justice, health, education, quality of life, and the promotion of neighborliness. The goal is to promote improvement of the area through education, community participation and exertion of influence on the public and private sectors. I would love to see you all out there, so make sure you RSVP with Katie at the SIBA office!

Builders’ Legislative Day = February 27 @ Statehouse, Indianapolis

Builders are in business to sell homes. SIBA is in business to help builders sell safe homes at the most affordable price. And the MOST VALUABLE of all the SIBA benefits is giving individual contractors a collective voice in government affairs and the political arena. As builders realize this, they quickly figure the impact of government has more zero’s on the end, than many of their company expenses. And they know one bad policy can break their business. And hopefully, builders and developers participate in the policy-making process. Don’t get me wrong! The Parade of Homes in June is the biggest event of the year for SIBA. But I do tell home builders, February 27 may be the most important day this year. The Builders Legislative Day is arranged by the Indiana Builders Association (your state affiliate) for members to meet with lawmakers during session. It is critical that SIBA members get to Indianapolis to participate and meet with lawmakers to represent and safeguard our industry. Detai ls wi l l be made available soon. I hope you can make the trip to Indianapolis to be part of it. It is a wise investment! The Southwestern Indiana Builders Association represent the

building industry in local policy-making activities too. Members have unique access to be part of the policy-making process through the Association’s efforts. Here are a few governmental affairs on some matters related to your business and governmental affairs.

Builders Call for Combined Inspections.

Did you know the Evansville Building Department now allows builders to call-in for their rough-in and final inspections? As well as combined final-inspections? Building Commissioner Ron Beane says he’s glad to help by combining inspections, but cautions contractors to be sure their job site is really ready for all three inspections. Save a trip and time by requesting all rough-ins in a single inspection. Ron also wants to hear from you if you have any trouble getting a Certificate of Occupancy. Ron says, no delays on new home sales due to downtown paperwork!

Confined Feeding Operations.

A proposal to change the Vanderburgh Zoning ordinance - would regulate the location of new Confined Feeding Operations - can be up for approval as early as March, 2017. Due to concerns over the proximity between CFO’s and residential homes, the proposal would require new CFO’s to be 1320 feet from any major subdivision, and have a minimum area parcel of 25-acres. To view all the CFO requirements, you can contact the SIBA office for a copy of the draft

proposal. The proposal comes as the result of meetings between APC staff and Vanderburgh farmers, as well as other representatives for the agricultural community.

Relaxation for building heights, electronic signs.

A n o t h e r p r o p o s e d amendment would provide relief to those with acreage and plan to build a accessory structure. Many times landowners want to build a barn for storage of personal items, but are currently required to come to Board of Zoning Appeals for a variance if the height of the new structure exceeds the primary residence. In addition to providing relief to these owners, this change would clear unnecessary applications from the BZA agenda, enabling other applications more attention. A daft of this proposal is expected soon. Already adopted is a new standard for electronic messaging signs. The change relieved applicants from the need to get a zoning change, and then a special use for an electronic sign. Now, some zonings include the use of an electronic message sign.

Va n d e r b u r g h C o n t r a c t o r Licensing and Permitting Under Further Review.

T h e V a n d e r b u r g h Commissioners voted to create a Task Force to review licensing and permitting requirements. Meetings are expected to begin in February. SIBA has representation, and will report on any developments from

these discussions as they proceed.

Water and Sewer Handbook Moving Toward Final Adoption.

SIBA has worked with the utility for over 2 years to re-write standards and specs for the Evansville Water & Sewer Utility Manual. SIBA members were successful in keeping upgrades affordable, and were glad to implement a process for approving in-the-field changes without delaying work on projects. The manual is expected to be used by the utility, system wide. This means developers will benefit from changes, and the City will also benefit as they spec and award capital projects.

The draft document is now ready for review and comment by all SIBA members. Contact the Builders Association for your copy. It is expected to have its 1st hearing on February 14, a follow-up/review meeting with SIBA reps on February 22, and Final Adoption on February 28.

NAHB Asks for Halt to EPA’s New Permit

January 27, 2017 Despite a Jan. 20 White House Memorandum from Chief of Staff Reince Priebus directing federal agencies to withdraw or postpone recently finalized regulations, the Environmental Protection Agency (EPA) has not withdrawn the Jan. 19 Construction General Permit (CGP) for review.

That’s unfortunate – and troubling – to NAHB builders and developers worried about the permit’s controversial new language that considers all builders on a shared site “jointly and severely liable” for compliance with permit terms, including violations of “shared” treatment ponds and other features.

While EPA worked diligently with NAHB to make many other aspects of the permit more workable in the field, the association feels the new liability language is a major overstep in agency authority, and not the best way to go about addressing violations on shared sites.

Today, NAHB sent a letter to EPA and the White House Office of Management and Budget (OMB) arguing that the 2017 permit–though much improved–is just the type of regulation that should be reviewed by the incoming administration. However, it needs a quick fix, as the permit is set to go into effect Feb. 16, less than one month from now.

The letter sets the expectation that the agency meet its obligations, asking the EPA Acting Administrator to:

• acknowledge that the Priebus memo applies to the 2017 CGP.• delay the effective date of the CGP by at least 60 days to allow sufficient time for regulatory review and possible notice and comment.• maintain, through whatever means necessary, the availability of CGP coverage so that no builder or developer is left without the means to apply for a permit on Feb. 16.

January was a great kickoff to get us thinking about the Parade of Homes! Parade Preview is always a lot of fun with great food, people, and exhibitors. The 43 builders who came also got a special treat. Each builder company that attended got $500 off each Parade entry. got their name put into a drawing for door prizes ,and a Parade of Homes Entry. The winner of the Parade of Home Entry was Tom Haas, of Haas Homes. This was his first time winning an entry, he was so excited! We live for this excitement from our members. The Parade of Homes will be June 3rd-11th. Builder packets have already been sent out to all builders! If you have not received a builder packet yet or want more information you can contact me at the SIBA office. The last day

to enter a home in the Parade is February 24th with a late fee. Make sure you get your homes in, so you don't have to pay the fee. Along with the builder packets we have also sent out the Parade of Homes advertisement menu. This menu breaks down all the advertisement packets and ads that we offer for 2017. Becoming an advertiser with the Parade gives you great exposure for your business, and at a great price! Visit pages 14-15 for more information. Business Contracts under the New Consumer Review Fairness Act

Businesses who sell goods and services may need to revisit their contracts following the passage of the Consumer Review Fairness Act. The Act, which was signed into law on December 14, 2016, aims to protect consumers and their rights to communicate about the goods and services they receive. Beginning on March 14, 2017, provisions in form contracts that prohibit consumers from publishing reviews will be void. The Act also voids clauses that give businesses the property rights in consumer reviews. Beginning on December 14, 2017, the Consumer Review Fairness Act will be enforceable by the Federal Trade Commission. Any contracts that include prohibited provisions will be punishable as an unfair or deceptive act or practice. Many are hailing the Consumer Review Fairness Act as an important step in protecting consumers. However, the law is not as sweeping as some might suspect. The law does not apply to employer-employee contracts or contracts that have been meaningfully negotiated. Nothing in the law prevents a business from removing or refusing to display reviews that are libelous, slanderous, obviously false and misleading, or abusive. Furthermore, the law does not protect communications that disclose trade secrets and privileged information.

Trump Administration Cancels FHA Mortgage Premium Cuts

( January 23, 2017) The Trump administration, in one of its first policy actions, issued a mortgagee letter from HUD on Jan. 20 cancelling a decision made by the Obama administration to lower Federal Housing Administration (FHA) annual mortgage insurance premiums by 25 basis points to 0.60%. NAHB supported the lower insurance premium rates because it would make home loans more affordable, particularly for creditworthy young families and first-time

buyers. FHA’s financial reserves have improved during the past two years, and NAHB believes the lower premium structure would help to ease stubbornly tight credit conditions in the mortgage market as well as mitigate the rise in mortgage rates during the past few months. While the association strongly supports the new administration, NAHB was aware that President Trump would not see eye to eye with us on all housing-related issues. NAHB remains in constant contact with the administration

and will work with the Trump team on this issue as they do their own analysis on the strength of the Mutual Mortgage Insurance Fund. The association will encourage HUD to reinstate the premium reduction in the months ahead. M e a n w h i l e , N A H B remains fully engaged with the administration regarding important housing concerns, including regulatory reform, housing finance reform and tax reform.

Housing Will Continue Gradual Climb to Higher Ground in 2017

( J anua ry 10 , 2017 ) Fueled by a growing economy, solid employment gains and rising household formations, single-family production will continue on a gradual, upward trajectory in 2017, according to economists speaking at the National Association of Home Builders (NAHB) International Builders’ Show in Orlando, Fla. “ W h i l e p o s i t i v e developments on the demand side will support solid growth in the single-family housing sector in 2017, builders in many markets continue to face supply-side constraints led by the three ‘Ls’ – lots, labor and lending,” said NAHB Chief Economist Robert

Dietz. He added that 64 percent of builders nationwide report low or very-low lot supplies; the rate of unfilled jobs in the construction sector is now higher than the building boom; and that acquisition, development and construction loans for builders—while on the rise—needs to grow faster to meet demand.“The industry needs to recruit more workers and get more land in the pipeline, but it will take time,” Dietz said. However, these supply-side challenges are more than offset by continued economic growth, ongoing job creation, rising wages and favorable demographics. Moreover, builder

confidence is up on anticipation that the incoming Trump administration will help to lower regulatory costs going forward.“Regulatory requirements make up nearly 25 percent of the cost of a new home,” said Dietz. “Given those constraints, it is hard to build a $200,000 entry-level house.” But in a sign that more millennials are getting off the sidelines and jumping into the market, Dietz noted that townhome construction, which can be a useful bridge for millennials to transition to homeownership, is showing impressive growth and now constitutes 12 percent of all single-family starts.

A Solid Outlook As the economy continues to grow, NAHB expects mortgage interest rates will average 4.5 percent in 2017 and 5.3 percent in 2018.NAHB is projecting 1.16 million total housing starts in 2016, up 4.9 percent from the previous year’s total of 1.11 million units. Single-family production is expected to rise 10 percent in 2017 to 855,000 units and increase an additional 12 percent to 961,000 next year. Setting the 2000-2003 period as a benchmark for normal housing activity when single-family production averaged 1.3 million units annually, single-family starts are expected to steadily rise from 56 percent of what is considered a typical market in the third quarter of 2016 to 75 percent of normal by the fourth quarter 2018. On the multifamily front, NAHB is anticipating multifamily starts to hold steady in 2017 at 384,000 units, which would be 1,000 units above last year’s pace. While this level is slightly above trend, Dietz noted this pace is sustainable due to demographics and the balance between supply and demand.M e a n w h i l e , r e s i d e n t i a l remodeling activity is expected to register a 1 percent gain this year over 2016.

Affordability and Demographics CoreLogic Chief Economist Frank Nothaft also expects mortgage rates to rise and home

prices to moderate in the coming year. “We anticipate a stronger economy will translate into higher mortgage rates,” said Nothaft. “Meanwhile, we expect moderation in 2017 for rent and home price growth, but it will still be higher than inflation, reflecting the tight inventory in the housing market.”He added that home purchase originations should rise 5.7 percent in 2017, and that the credit risk for home loans is substantially lower than 10-15 years ago. The biggest housing issue in 2017 will be affordability, according to Nothaft. “Mortgage rates are up three-quarters of a point since last summer and house prices are up. That starts to pinch a household budget,” he said. On the flip side, demographics will be very positive for housing and home sales going forward. “As millennials age from 25-to-30, that is a big potential base to expand the home buyer market,” said Nothaft.

Supply and Demand David Berson, chief economist for Nationwide Mutual Insurance Co., also expects mortgage rates to rise in the coming year, but he said this should not have a negative impact on housing demand. “Higher mortgage rates will be offset by stronger wage gains and job growth, which suggests that housing demand will increase this year,” said Berson. “The question is, how much will supply go up?” He noted that most metro areas across the nation are relatively healthy, marked by solid job growth, mortgage delinquencies down near normal levels and house price gains

that are strong, but not excessive.A major concern going into 2017, he said, is that demand will exceed supply, which will put upward pressure on home prices. “If there aren’t enough homes on the market, that will be a problem,” said Berson. “Price gains need to moderate. We can’t have six, seven or eight percent gains. That is not sustainable.” He added such a situation could downgrade many markets from “healthy” to “neutral.”

RESIDENTIALSIBA’S LICENSE EXAM PREPARATORY CLASSES

BACKGROUND: Vanderburgh County requires an individual to take and pass an open-book test before they can be issued a license to work as a Residen�al Building Contractor. The test includes 100 ques�ons, and applicants are required to score 70 or be�er. Individuals interested in taking the test may be interested in taking a class that prepares them to take the test with providing informa�on, as well as quick-reference skills to pass the test.

PROGRAM: SIBA is now providing a class for individuals preparing to take the exam for the Residen�al Contractor. The 2-hour classes will be held on 3 consecu�ve a�ernoons. The class will review basic code informa�on, quick-reference skills, and a prac�ce test – all to prepare registrants for the actual test.

Builders To Meet New IDEM LeaderThrough the Indiana Builders Association, SIBA builders and developers may soon have the opportunity to meet directly with the new commissioner of IDEM. Builders may get the face-to-face as early as late February, perhaps in conjunction with the Builders Legislative Day on

It’s only February, but things are looking to warm-up for the Spring Tour of Homes (hopefully, crossing our fingers). Over a single weekend, the Spring Tour will target advertising to attract buyers searching for their new forever home. Homes entered by SIBA builders will be included on the promotional map, which will beincluded in the Evansville Courier and Press on Friday, March 3rd. The map will also be available on the Spring Tour of Homes website, which is built to help promote the builders’ homes. Featured on the new website will be loads of additional information for each house, and up to five photos per home. Bringing traffic to new homes is one thing that builders need – and that’s how the Association has designed this event. The Spring Tour of Homes is a less formal event that usually delivers good results for traffic. In contrast to the Parade of Homes, these smaller events are known to do without the on-lookers, and get more actual buyers. Promotional packets with Builder Agreements were sent to all SIBA Builders on February 1st. The committee set the entry fee at $350 each, and there is a price-break for builders who enter more than five houses. Entries can consist of any stage of new construction – available building lot, under construction, or a completed home. Special thanks to Bill Kattmann, Kattmann Construction for his time in serving as theChairman of the Spring Tour of Homes.

remodelers riding Wave of steady Optimism (January 19, 2017) The remodeling market has enjoyed a solid stretch of growth since 2011. And despite economists forecasting that growth will likely become more gradual in the years ahead, there remains a sense of confidence among most remodelers. NAHB’s Remodeling Market Index (RMI) posted a reading of 53 in the final months of 2016, down slightly from the previous quarter, but on par with the first half of 2016. T h i s m a r k s 1 5 consecutive quarters in which the majority of remodelers report that business activity in their market has increased from the previous quarter. “Many remodelers are seeing consumers commit to larger, long-term home improvement projects,” said

2017 NAHB Remodelers Chair Dan Bawden, CAPS, GMB, CGR, CGP, a remodeler from Houston. “As Americans are seeing wages and home values rise overall, it gives them greater confidence to go ahead and invest in their homes.” Among the RMI’s most notable components, major addit ions and alterations dropped one point to 53, demand for smaller remodeling projects decreased by four points to 52, and the home maintenance and repa i r component declined by five points to 54. The index measuring future market indicators reached 52, about the same level as early 2016, but six points lower than in the third quarter. Among its four components, calls for bids and appointments for proposals fell to 49 and 54, respectively, the

backlog of remodeling jobs dropped three points to 55, and the amount of work committed declined five points to 50. “At 53, the Remodeling Market Index is consistent with NAHB’s forecast that remodeling market activity will continue to grow over the next two years, but at a more moderate annual rate of 1% to 2%,” said NAHB Chief Economist Robert Dietz.
