Having covered the major facets of BHOs [mis]conduct via [believe-it-or-not] 2476 pages of hyperlinks

[generated during the past year, initially as a prelude to pushing for Guzzardias a bcc-list was being

accrued], its a bit easier to reinforce prior conclusions simply by providing self-explanatory headings;

nevertheless, the priority will remain encompassing all contrary arguments [noting that I watch MSNBC

and CNN more often than FNC, as will be detailed when updating the Dream Team for Deserter Swap].

The underlying goal is to satisfy concerns raised by my favorite internal-critic, my son, who wants me

offer Holocaust and genocide instruction to students in grades six

through twelve.

4. If offered by the school entity, the instruction will be integrated withinthe social studies and language arts courses of study and may be

integrated into other appropriate courses of study as well.

5. The Department of Education must establish curriculum guidelines, buta school entity choosing to offer Holocaust and genocide instruction

may use any curriculum that is consistent with the laws requirements.

6. Each school entity offering the instruction must provide in-servicetraining concerning the Holocaust, genocide and human rights violations

for those educators who will teach in these areas.

7. The State Board of Education must adopt any rules or regulationsnecessary to implement the provisions.

His memo has been divided into numbered-sentences to allow for its cogent analysis;

the emphasis has been placed upon potential points-of-contention [explored in thefirst

Blast e-mail], recognizing what has animated our lobbying [per the second one],

despite concerted efforts by lobbyists and staff-people to obfuscate [per thethirdone].

Indeed, some are intuitive [#1 & #4], some are easily accommodated [#5, #6, #7], one is

particularly of-interest [#2] and one is the key-source of contention [#3]. Specifically,

we concur with integrated instruction of a unit [Holocaust, other forms of genocide

and human rights violations], and we would certainly not disagree with involvement of

the PDE when composing a curriculum, helping to provide in-service training, and/or

implementing key-facets thereof by composing rules or regulations. On the other hand,

however, after recognizing that such a curriculum-topic is imperative for students in

grades six through twelve [although age-specific modules could be introduced earlier],

we cannot then appreciate why legislation would merely encourage such instruction.

THAN ANSWERS [per Politico]: "President Barack Obama's decision to swap long-missing Sgt. Bowe

Bergdahl for five Taliban prisoners held at Guantanamo Bay has unleashed a fusillade of criticism from

lawmakers, who have blasted BHO's move as both reckless and lawless. For the White House, it means

answering uncomfortable questions about why Congress wasn't told of the deal before it happenedas

2. What did Congress know and when did it know it? Over the weekend the

administration seemed to flaunt the fact that they had not complied with legislation

requiring the president to give Congress 30-days notice before transferring prisoners

out of Guantanamo. In a statement issued Saturday night, Defense Secretary Chuck

Hagel said he had just notified Congress of the transfer. In fact, the formal notification

did not take place until Monday.

3. Will Bergdahl be prosecuted for desertion? The prisoner swap has generated a

mixed reaction from those who served with Bergdahl, with some saying he's guilty of

desertion because he apparently walked off his base in Afghanistan unarmed in 2009

after expressing doubts about the U.S. mission. While the White House is trying to

cultivate a celebratory atmosphere around the soldier's release, it's less clear whether

he could eventually be prosecuted for abandoning his guard post prior to his capture.

4. What of other U.S.-held prisoners? The Bergdahl deal has grabbed headlines

because of the involvement of the long-held American POW, but the war of words

between Obama and Congress could just be a preview of fights to come over evenbigger batches of prisoners at Guantanamo and at a U.S. run detention facility in

Afghanistan.

5. If it's Sunday, is it a problem for Susan Rice? The White House national security

adviser once again finds herself in the middle of a controversy over comments on a

Sunday talk show about what the administration did or didn't do - and how it's selling

the story."

The furious search for Sergeant Bergdahl, his critics say, led to the deaths of at least two soldiers and

possibly six others in the area, feeding growing anger against him.[Pentagon officials say those charges

are unsubstantiated and are not supported by a review of a database of casualties in the Afghan war.]'Yes, I'm angry,' Joshua Cornelison, a former medic in Sergeant Bergdahl's platoon, said in an interview

on Monday arranged by Republican strategists. 'Everything that we did in those days was to advance the

search for Bergdahl. If we were doing some mission and there was a reliable report that Bergdahl was

somewhere, our orders were that we were to quit that mission and follow that report.' - The anger

toward Sergeant Bergdahl increased exponentially after Sept. 4, when they learned that two members

of Third Platoon [Pfc. Matthew Martinek and Lt. Darryn Andrews, both of them friends of Mr.

Cornelison], which routinely went on tandem missions with Second Platoon and who they believed were

also searching for Sergeant Bergdahl, had been killed in an ambush. [A Defense Department official said

it was unclear whether the two men were killed directly because of the search for Sergeant Bergdahl.]

Clapper was not alone. Leon Panetta, who was then the Secretary of

Defense, declined to certify that the United States could mitigate the

risk to national interests of releasing the Taliban commanders.

A lot has changed since 2012. To start, President Obama won reelection.

Panetta is gone, and in his place is Chuck Hagel, a Republican former

senator who has been much more in sync with Obama's views on the

War on Terror than his predecessors.

But current U.S. intelligence and defense officials who spoke to the

Daily Beast on Monday say the process for exchanging Taliban for

Bergdahl this time was rushed and closely held, in some instances

leaving little room for any push back against a policy clearly favored by

the White House.

For what it's worth, Clapper's spokesman said he is on board with the deal now.

Massive Problem Number Two:The whole deal wasn't legal.

CNN legal analyst Jeffrey Toobin declared on Monday that President

Barack Obama "broke the law" when his administration failed to give

Congress notice of at least 30 days before releasing five ranking Taliban

members from Guantanamo Bay. Toobin said that a presidential signing

statement did not absolve Obama from culpability for failing to abide by

the law mandating congressional notification.

"I think he clearly broke the law," Toobin said. "The law says 30-days'

notice. He didn't give 30-days' notice." Toobin added that Obama'sopinion expressed in a signing statement "is not law."

"The law is on the books, and he didn't follow it," Toobin added.

Massive Problem Number Three:Fresh off violating our national obligation to take care

of our veterans when they return, our government is violating its national obligation to

the families of fallen soldiers. Or at leaststirring fresh pain anew:

Robert Andrews believes his own son might still be alive if U.S. Army

Sergeant Bowe Bergdahl had not gone missing from his Afghan guard

post on June 30, 2009.

As Bergdahl emerges from five years of Taliban captivity, former

comrades are accusing him of walking away from his unit and prompting

a massive manhunt they say cost the lives of at least six fellow soldiers,

including Andrews' 34-year-old son, Darryn, a second lieutenant.

"Basically, my son died unnecessarily, hunting for a guy that we

shouldn't even have been hunting for," Andrews told Reuters.

What on earthcan anyone say to these families?

Sondra Andrews' son, 2nd Lt. Darryn Andrews, is one of six soldiers

killed reportedly while searching for Sgt. Bowe Bergdahl.

The sergeant's return to captivity has stirred "very raw emotions."

"It gets really hurtful when I think, this guy was worth my son's life? My

son who was patriotic? Who was a true soldier? Who defended his

country with his life?" Andrews told Army Timesvia phone on Monday.

"That guy was worth that? I don't think so."

Massive Problem Number Four:Meet the guy we rescued,before he disappeared from

his post:

"The future is too good to waste on lies," Bowe wrote. "And life is way

too short to care for the damnation of others, as well as to spend ithelping fools with their ideas that are wrong. I have seen their ideas and

I am ashamed to even be American. The horror of the self-righteous

arrogance that they thrive in. It is all revolting."

The e-mail went on to list a series of complaints: Three good sergeants,

Bowe said, had been forced to move to another company, and "one of

the biggest s*** bags is being put in charge of the team." His battalion

commander was a "conceited old fool." The military system itself was

broken: "In the US army you are cut down for being honest . . . but if

you are a conceited brown nosing s*** bag you will be allowed to do

what ever you want, and you will be handed your higher rank . . . Thesystem is wrong. I am ashamed to be an American. And the title of US

soldier is just the lie of fools." The soldiers he actually admired were

planning on leaving: "The US army is the biggest joke the world has to

laugh at. It is the army of liars, backstabbers, fools, and bullies. The few

good SGTs are getting out as soon as they can, and they are telling us

privates to do the same."

Massive Problem Number Five:Here's adisturbing report of the captivity:

A captured American soldier is training Taliban fighters bomb-making and ambush skills,

according to one of his captors and Afghan intelligence officials.

Private Bowe Bergdahl disappeared in June 2009 while based in eastern Afghanistan and

is thought to be the only U.S. serviceman in captivity.

The 24-year-old has converted to Islam and now has the Muslim name Abdullah, one of

his captors told the Sunday Times.

A Taliban deputy district commander in Paktika, who called himself Haji Nadeem, told

the newspaper that Bergdahl taught him how to dismantle a mobile phone and turn it

into a remote control for a roadside bomb.

It is about time that pundits stop describing President Obamas foreign policy as weak.

There is a straight line between emboldening Syrias Assad by calling him a reformer,

Egypts Morsi a democrat, Turkeys Erdogan a friend, Irans Rouhani a moderate, and

now a Palestinian government that includes Hamas, a peace partner.

Monday's speedy announcement that the United States will work with and pay for a

PLO-Hamas coalition government is a strong and predictable step in an alarming

pattern.

Every one of these moves has deliberately driven a wedge between Obama and Israel.

President Obamas priority is, and always has been, the Muslim world. It has made no

difference to this partiality that in the latter world American hostages are languishing in

prison cells, the killers of Americans are government insiders, official anti-Semitism is

flourishing, and the locals are brutalized.

At the same time, President Obama has a recurring problem with his choice of best

friends. There is an inconvenient discord between the terrorism and violence emanating

from his BFFs and his putative job as commander-in-chief.

The difficulty presents itself, for example, in the context of Benghazi. The anger over

Benghazi is more than justified, but not because it is still a mystery why the president

sent no one to bomb Libya in order to save Americans under attack. He may have hurt

somebody on the ground who was not American, or he may have stirred up local

resentment.

2013 he said quite clearly that even in the face of terrorists who pose a continuing and

imminent threat to the American people, before any strike is taken, there must be

near-certainty that no civilians will be killed or injured.

Speaking at West Point on May 28, 2014 he reiterated that in taking direct action

against terrorism, we may strike only where there is near certainty of no civilian

casualties.

The problem is not that hes unclear. Its that he isnt right. International law does not

require planning for zero civilian casualtieswhich would simply encourage combatants

to use more civilians as human shields. The Geneva Conventions test is one of

proportionality: An attack which may be expected to cause incidental loss of civilian life

[or] injury to civilians is prohibited if it would be excessive in relation to the concrete

and direct military advantage anticipated.

So international law is not what is driving President Obamas foreign policy. Whats

really eating him is that he believes we are our own worst enemy. As he said at West

Point: our actions should meet a simple test: We must not create more enemies thanwe take off the battlefield. He is worried that if we defend ourselves, we stir up local

resentments.

Thats a green light for the political enablers of terrorists everywhere to start writing UN

speeches, mount new phony demonstrations, and concoct more bogus Islamophobia

charges. If we are the ones responsible for creating more terrorists by fighting terrorists,

then we may as well just go golfing.

The Presidents release of top five Taliban terrorists from Guantanamo this past

weekend fits the dogma. As early as May 21, 2009, the President told us: the existence

of Guantanamocreated terroristsIt is a rallying cry for our enemies. Unsurprisingly,they prefer their terrorist buddies back in the field.

Similarly, our drone program is dwindling nothing in Pakistanstribal areas since last

Decemberbecause our enemies dont like it either. But then, why would they?

Which brings us back to the Presidents embrace of a Palestinian government that

includes the terror organization, Hamas just hours after the PLO-Hamas deal was

done.

Why the rush? Why was the issue of legitimizing a terror organization, dedicated to the

annihilation of one of our closest allies, not worth more than a few seconds thought?

The answer is that for President Obama, it was just business as usual. His top priority is

not delegitimizing terrorists and fighting to win, but avoiding stirring up local

resentments. And Palestinians have made fabricating resentment for every imaginable

affront into an art form. A house is being built! is a favo rite, while Palestinian rocket-

launchers and kidnappers and would-be suicide bombers are plying their wares.

Furthermore, the President never seriously tried to stop it. He could have threatened

and ensured harsh economic and political repercussions, which Congress would have

supported. But he didnt. Just as he didnt make any such threats when the Palestinians

went to the UN in November 2012 to become a non-member observer state. And just as

he didnt when the Palestinians started signing treaties this past April that legally are

only open to states.

The ugly truth is that President Obama is happy to let the UN turn Palestine into a state,

and thereby allow Palestinians to avoid negotiation, avoid recognition of the Jewish

state, and avoid genuine commitment to peaceful coexistence with its Jewish neighbor.

Unilateralism and the UN was always the back-up plan to Kerrys egoistic globe-hopping.

Pentagon Official: Why Obama Made The Taliban Trade

The deal to trade five senior Taliban detainees to secure the release of Sgt. Bowe

Bergdahl was political. It was publicly justified with lies, it breaks decades of U.S. policy,

it breaks American law, it puts Americans at risk, it undermines the government of

Afghanistan, and it passes responsibility on to the next administration.

But first of all, it was political.

But no, it was not to take the spot light off of the failures at the Department of Veterans

Affairs.

Simply stated, it was because so long as Bergdahl remained in Taliban captivity in

Pakistan, the Obama administration would never be able to close the chapter of the

failed Afghanistan campaign it has owned since approving and then under-resourcing

a surge of U.S. forces in the country.

Bergdahls captivity served as a constant reminder of President Barack Obamas

strategic failures while U.S. forces prepare to withdraw from Afghanistan. Thats

something the Democrats cannot allow going into 2014 and 2016 elections. So the

president agreed to an unprecedented deal in blatant violation of U.S. law and

established precedent that undermines the safety and security of the United States and

aboard the waiting helicopter. He was mentally sound enough to recognize what was

going on around him and to communicate with American forces. And none of the

medical or psychological issues that he has displayed symptoms are life threatening. So

this was just another example of the administration trying to justify its actions.

Additionally, the decision breaks with a decades-old standing U.S. policy to never

negotiate with terrorists. Bergdahl was being held by the Haqqani Network in the

Federally Administered Tribal Areas of Pakistan. The Obama administration designated

the Haqqani Network a terrorist organization just a few years ago. By negotiating with

the Haqqani Network through the government of Qatar, the administration violated the

policy.

we do know that the VAs performance is deplorable and has not adequately served our

veterans, who deserve much better than this. My colleagues and I continue to stand for

our veterans, despite the lack of action from the White House. Last week, the House

passed a package of Veterans Affairs accountability bills. Additionally Congressman Jeff

Upholding free speech

My colleagues in the RSC and I continue to defend free speech against abuse by the

President's IRS. The IRS recently announced that it would restart the writing process of

a rule which will severely restrict the free speech rights of certain nonprofit civic

organizations. Congressmen Meadows, Wenstrup and I wrote to the IRS urging them to

abandon any future attempts to harass hard-working taxpayers. While we applaud their

admission that the first proposal was flawed and needed to be abandoned, we callon the IRS to completely abandon any attempt to rewrite these longstanding

rules and refrain from finding another way to harass American taxpayers. Instead, we

call on the IRS to focus on ensuring that the substantial backlog of 501(c)(4) applications
