Now. n l.ERHORE, BE IT ENt\CTED by the Legislature of the Co lony and Protectorate of Kenya, as fOUow5:-

1. (I) T illS O n.linance may be dted as the East African Common Services Organization Ordinance, J961.

(2) This Ordinance shall come into opcr.t tion on the day upon which the Agreeme nt comes into force.

2. In this Ordinance, except ..... here the conte};t ot her­wise requires-

"Act of the Organization" means an Act of the cast African Common Services Organi7 .. ation enacted in accord­ance with tht:: pro"l-i!!.ium. or Part Tn of the Constitut io n of the Organization;

"the Agret::ment" means the Agret::ment cntered into by the Governments of Tang:.lOyika, Kenya and Uganda in the terms set out in the Schedule to this Ordit1:l11Ce;

"the Assembly" me~tns the Cent ral Legislative Assembly of the East African Common Services Organi7.ation established hy Article 1(, or the ('on~li t ution of 111C Organitation:

"the Authority" means the Fn.,t Africnll C.ommon Services Aut hori ty c")!ablishcd by Article 3 uf the Constit ution of the Org.aniLalion;

"the Constitution of the Organ ization" means the Constit ution annexed to the Agreement.

(3) T he provisions of subsection (2) of [his sectiun relate on ly to the cap .. 'lcity of the Aut hority as a body corporate and nothing in tha t subsect ion ~ h a l1 be cons trued ns authorizing the d isregard by the Au thority of any wril(en law, or as affecting any power of th e Authority conferred by ~iny written taw.

4. ( J) The provisions of an Act of the Organization with respect to any matter thaI is included in the Second Schedule to tbe Constitution of the Organizat ion sh:lll. from the date of the publica tion of the Act in the Gazette of the Organi 73' lion. have the force of law ill Kenya.

(2) An Act of Ihe Orga ni 7 .. .<Ltion shaH come into opera tion on the date of its publiClttioll in the Ga zette of the Organiza· ti on or, if it is provided either in tha i Act or some other Ac t or some law of the Higb Commission that some or alt of its provisious shall comc into operation on some other date (lAi hether before or a fter the t.Ia lc of publication), those provisions shall come inlo operat ion on that other date.

(2) On th e annu lment of :tn Act of the Organi za tion under this section , any enactment repealed or amendet.l by or in pursuancc of that Act sha ll ha"·e effect as from the date of the annulment as if Ih:lI Act had not been enacted, and. sa\'C as prov ided in the foregoing provisions uf Ihi s section, the provision<; of subsection ()) of sec tion 23 of the Interpreta· tion and General P rovi~ i o n ~ Ord inance. 1956, shall apply to tha I annulment as they ap pl y lu the rcpeal of an Ordinance.

3. For the purpose!! of this Article the public debt of the Authority includes the amount outstanding on all loans raised by the High Conunisslon or any authority of the High Co mmission.

Article 7 TIle contracting GOllcrnmcot$ undertake that powers and duties

l'vill nut be conferred or imposed upon an officer or authori ty of the Organization, as such, by or under enactment~ of the legisla tures of tbe Territories except WITh the consent of the Authori ty.
