Lawful Permanent Resident (LPR)

All LPR applicants must enlist into the RSP for a minimum of 120 days and remain in the RSP until they have Favorable NIAC results.

National Intelligence Agency Check (NIAC) Performed on all LRP Soldiers. ASO will inform state when complete. GC must scan the ASO email into the “Security Clearance Verification”

folder in ERM as verification of Favorable NIAC results.

PS applicants processing on a DD368 or enlisting from IRR have status and may access into a unit or ship to training. PS applicants with no remaining MSO must enlist into the RSP for 120 days and meet the DoD LPR vetting procedures.

• ARNG Strength Maintenance MEPS Processing Guide paragraph 6-5e requirements for the MEPCOM 727: – Verify receipt of FP results (BIR) within 3 business days.

• If no results received, check MEPS Ops first• If MEPS verifies transmission, send email to ASO after 5 days.• If MATCH initiate procedures immediately • Once results received, scan results and mark the 727 to indicate receipt.

– Verify each JPAS submission• If after enlistment is confirmed no JPAS submission has occurred contact the

ARISS Help Desk immediately• Take corrective action for any errors received (see JPAS messages in RZ).• If no adjudication after 48 hours, contact ASO• Once JPAS status is acceptable, mark the 727 to indicate success.

– Do not file the 727 until you have acceptable FPs and JPAS Scheduled status is received

Classifying Charges

For charges NOT on the charge tables: • If the maximum confinement under local law is 6 months

or fewer, the offense should be treated as a non-traffic (200 level) offense.

• If the maximum confinement under local law exceeds 6 months, but does not exceed 1 year, treat the offense as a misconduct (300 level) offense.

• If the maximum confinement exceeds 1 year, treat the offense as a major misconduct (400 level) offense.

***If the local law considers the offense a felony, then treat as a major misconduct (level 400)offense, regardless of its placement in tables 4-1 thru 4-4.

Burden of Proof

• Applicants who do not meet established enlistment standards are not eligible for enlistment unless a suitability review is complete and a waiver is authorized.

• The burden is on the applicant to prove to waiver authorities that he or she has overcome his or her disqualifications for enlistment and that his or her acceptance would be in the best interests of the Army.

• Suitability review authorities will apply the “whole person” concept when considering reviews/waivers.
