    Purpose 2.(1)The purpose of this Act is to extendthe present laws of Canada to provide a right ofaccess to information in records under the con-trol of a government institution in accordancewith the principles that government informationshould be available to the public, that necessaryexceptions to the right of access should be lim-ited and specific and that decisions on the dis-closure of government information should bereviewed independently of government.

    4.(1)Subject to this Act, but notwithstand-ing any other Act of Parliament, every personwho is

    (a)a Canadian citizen, or(b)a permanent resident within the meaningof subsection 2(1) of the Immigration andRefugee Protection Act,

    has a right to and shall, on request, be given ac-cess to any record under the control of a gov-ernment institution.

    5.(1)The designated Minister shall causeto be published, on a periodic basis not less fre-quently than once each year, a publication con-taining

    (a)a description of the organization and re-sponsibilities of each government institution,including details on the programs and func-tions of each division or branch of each gov-ernment institution;

    (b)a description of all classes of records un-der the control of each government institu-tion in sufficient detail to facilitate the exer-cise of the right of access under this Act;

    (c)a description of all manuals used by em-ployees of each government institution in ad-ministering or carrying out any of the pro-grams or activities of the governmentinstitution; and

    (d)the title and address of the appropriateofficer for each government institution towhom requests for access to records under

    this Act should be sent.

    8.(1)Where a government institution re-ceives a request for access to a record underthis Act and the head of the institution consid-ers that another government institution has a

    greater interest in the record, the head of the in-stitution may, subject to such conditions as maybe prescribed by regulation, within fifteen daysafter the request is received, transfer the requestand, if necessary, the record to the other gov-ernment institution, in which case the head ofthe institution transferring the request shall give

    9.(1)The head of a government institutionmay extend the time limit set out in section 7 orsubsection 8(1) in respect of a request underthis Act for a reasonable period of time, havingregard to the circumstances, if

    (a)the request is for a large number ofrecords or necessitates a search through alarge number of records and meeting theoriginal time limit would unreasonably inter-fere with the operations of the government

    institution,(b)consultations are necessary to complywith the request that cannot reasonably becompleted within the original time limit, or

    (c)notice of the request is given pursuant tosubsection 27(1)

    by giving notice of the extension and, in thecircumstances set out in paragraph (a) or (b),the length of the extension, to the person whomade the request within thirty days after the re-quest is received, which notice shall contain astatement that the person has a right to make acomplaint to the Information Commissionerabout the extension.

    Where access isrefused

    10.(1)Where the head of a government in-stitution refuses to give access to a record re-quested under this Act or a part thereof, the

    head of the institution shall state in the noticegiven under paragraph 7(a)

    (a)that the record does not exist, or(b)the specific provision of this Act onwhich the refusal was based or, where thehead of the institution does not indicatewhether a record exists, the provision onwhich a refusal could reasonably be expectedto be based if the record existed,

    and shall state in the notice that the person whomade the request has a right to make a com-

    plaint to the Information Commissioner aboutthe refusal.

    Fees 11.(1)Subject to this section, a person whomakes a request for access to a record underthis Act may be required to pay

    (a)at the time the request is made, such ap-plication fee, not exceeding twenty-five dol-lars, as may be prescribed by regulation;

    (b)before any copies are made, such fee asmay be prescribed by regulation reflectingthe cost of reproduction calculated in themanner prescribed by regulation; and

    (c)before the record is converted into an al-ternative format or any copies are made inthat format, such fee as may be prescribed byregulation reflecting the cost of the mediumin which the alternative format is produced.

    ment institution for access to a record that thehead of the institution is authorized to refuse todisclose under this Act by reason of informa-tion or other material contained in the record,the head of the institution shall disclose anypart of the record that does not contain, and canreasonably be severed from any part that con-tains, any such information or material.1980-81-82-83, c. 111, Sch.
