Recommended Approval of Bids (Supporting Information) Reject Bid #005-45: Fiber-Optic Wide Area Network for Comsewogue Union Free School District (Supporting Information - Bid Recommendation Memo) The purpose of this bid is to contract with a qualified vendor to provide a fiber-optic wide area network (WAN) solution for the Comsewogue Union Free School District. In addition to advertising, five (5) bids were solicited directly and two (2)

bids were received. The district notified the Regional Information Center that the equipment aspect of the specifications needed to be modified to include multiple levels of equipment. Therefore, it is recommended that we reject all bids.

RECOMMENDED MOTION: “BE IT RESOLVED that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby rejects all bids for Bid #005-45: Fiber-Optic Wide Area Network for Comsewogue Union Free School District.”

Award Bid #005-51: Fiber-Optic Wide Area Network for Longwood Central School District (Supporting Information - Bid Recommendation Memo and Disclosure Forms) The purpose of this bid is to contract with a qualified vendor to provide a fiber-optic wide area network (WAN) solution for Longwood Central School District. In addition to advertising, five (5) bids were solicited directly and two (2) bids were received. Long Island Fiber Exchange Inc. (LIFE) indicated in its bid response that the prices do not include potential increases in pole attachment fees. These references are in contrast to its Base Bid 2, which stated the annual recurring costs are fixed for five years. LIFE’s bid included installation by a sub-contractor, Alcatel Professional Services. The specifications do not provide for assignment without the prior written consent of Eastern Suffolk BOCES. We have determined, based upon the advice of counsel, that the recurring costs are a material element of the specifications, and the Alcatel sub-contracting response is also at variance with the specifications. LIFE’s bid, therefore, is not in compliance with these material specifications of the bid.

RECOMMENDED MOTION: “BE IT RESOLVED that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby rejects Long Island Fiber Exchange Inc.’s bid as being non-compliant with certain specifications, and hereby awards Bid #005-51: Fiber Optic Wide Area Network for Longwood CSD, to Verizon, the low bidder meeting specifications.”

Reject Bid #005-52: Longwood Central School District High Speed Connection (Supporting Information - Bid Recommendation Memo and Disclosure Forms) The purpose of this bid is to contract with a qualified vendor to provide a secure, full duplex and unfiltered aggregate high-speed connection from the Longwood Senior High School to the BOCES Regional Information Center. In addition to advertising, five (5) bids were solicited directly and two (2) bids were received. The bid response from Long Island Fiber Exchange (LIFE) appears to be non-responsive due to the vendor indicating their bid pricing was contingent upon receiving the award for the wide area network bid for Longwood. The bidder alleged that the 45-day time period included in the bid is a violation of the Telecommunication Act of 1996. Board counsel reviewed this law and related judicial cases and indicated that there is no support for LIFE’s position. Moreover, there is no private right of action under the Telecommunication Act. Therefore, the bid response from LIFE should be rejected.

RECOMMENDED MOTION: “BE IT RESOLVED that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby rejects Long Island Fiber Exchange Inc.’s bid as being non-compliant with certain

Award of Cooperative Bids (Supporting Information - Bid Recommendation Memos and Disclosure Forms) As the lead agency for the Cooperative Bidding Program, all program bids require BOCES Board approval.

RECOMMENDED MOTION: “WHEREAS, the Board of Cooperative Educational Services, First Supervisory District of Suffolk County (hereinafter “BOCES”), acts as the lead agency for participants in the Joint Municipal Cooperative Bidding Program (hereinafter the “Program”) organized pursuant to General Municipal Law §119-o and Education Law §1950; and

Resolution to Participate in Onondaga/Cortland/Madison (OCM) BOCES Bid (Supporting Information - Resolution)

The purpose of this resolution is to authorize participation in the Onondaga-Cortland-Madison BOCES cooperative bid for the purchase of computer forms, computers/servers, computer peripherals, networks, and related supplies and software for the Regional Information Center for the fiscal year beginning July 1, 2005. The Regional Information Center has requested participation in this bid.

RECOMMENDED MOTION: “WHEREAS, it is the plan of a number of Boards of Cooperative Educational Services (BOCES) during the 2005-2006 school year to bid jointly for the purchase of computer forms, computers/servers, computer peripherals, networks, and related supplies and software, and

WHEREAS, the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, New York desires to participate with other BOCES in New York State in the joint bidding of the above-mentioned commodities as authorized by General Municipal Law, Article 5-G; and

THEREFORE, BE IT RESOLVED, that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, New York hereby appoints the Onondaga-Cortland-Madison BOCES to represent it in all matters related to the above that are relative to the fiscal year beginning July 1, 2005.”

This agreement with Accu Weather, Inc. is for professional weather services that will provide up-to-the-minute meteorological information that will assist districts in making decisions regarding the opening/closing of school programs in inclement weather. There are currently fourteen districts participating in this service. The agreement will continue the services through June 30, 2006 at an annual fee of $1,970.

W. Recommended Approval of a Leasehold Space Agreement with the Hauppauge School District

(Supporting Information – Agreement)

This leasehold space agreement provides for the use of three classrooms at the Hauppauge High School in the Hauppauge School District commencing on September 1, 2005 and terminating on June 30, 2006. The total annual base rent for the 2005-06 year is $7,492 per classroom. The base rent is frozen for this year unless the Consumers Price Index exceeds three percent, in which case the base rent shall increase by the amount in excess of three percent.

RECOMMENDED MOTION: “BE IT RESOLVED that the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, hereby approves the leasehold space agreement with the Hauppauge School District for the use of three classrooms at the Hauppauge High School commencing on September 1, 2005 and terminating on June 30, 2006.”

This equipment is being leased through the Model Schools Program within the Regional Information Center. The estimated cost for the project is $59,331.96.

The following resolution authorizes Eastern Suffolk BOCES to enter into a financing agreement with Koch Financial Corporation (Koch) to finance the purchase of hardware, software and related services for the Oysterponds Union Free School District in Orient’s Multi-Year Project #29-052605-2006-2009 pursuant to state contract. Approval of this resolution is required to obtain necessary State Education Department approval of the project with Koch.

RECOMMENDED MOTION: “WHEREAS, the Oysterponds Union Free School District in Orient has requested that the Regional Information Center of the Board of Cooperative Educational Services, First Supervisory District of Suffolk County, provide hardware, software, and/or related services for district technology projects, and
