As you know, the Patient Protection and Affordable Care Act (ACA) is complex, and we have been diligently pursuing all options to satisfy its requirements in a cost-effective manner, including working with insurers and ACA experts to help Express formulate the best plan for our associates and client companies. We are still waiting on cost information from our insurers as well as the U.S. Department of the Treasury regarding the Department’s final interpretation of certain aspects of the ACA. Based on what we know today, we expect by mid- to late November to provide you with our plan, including related ACA costs. However, we want to let you know the following: COMPLIANCE We intend to comply with all provisions of the ACA applicable to our associates assigned to you. EXPRESS INDEMNITY We will indemnify you for all taxes, penalties, and other liabilities arising from our obligations under the ACA. We believe that this commitment, made by a large international company like Express that has been in business for more than 30 years, distinguishes us from many of our competitors. COMMON LAW EMPLOYER It is our position that Express is the common law employer for our temporary associates. This position is supported by the American Staffing Association and many years of well-reasoned court cases. By clearly describing our employment relationship with our temporary associates, Express has taken responsibility for ensuring that the requirements of the ACA’s employer mandate are satisfied, which should also help to alleviate concerns about potential liability for our client companies. STAFFING RATES Our efforts to comply with the ACA in a cost-effective manner are a top priority. In the meantime, we believe it is important to give you advance notice of potential rate changes since many companies undergo their annual budget process on a calendar-year basis. And because of this, we are working diligently on a plan. We will keep you informed and contact you as soon as we are able to finalize our rates.
