ORDER:

The Government have taken various measures to ensure the uninterrupted health services delivery to the public in various levels. Accordingly, in the Government Order first read above, the Government have issued orders for implementing the staffing pattern to the Hospitals so as to strengthen the health care delivery systems subject to certain conditions and delegated the powers to the Directorates to ensure health administration and health delivery at various levels.

2. In the Government Order second read above, the Government have

sanctioned additional posts to the Medical and Rural Health Services side so as to run the Hospitals in the State as whole and also issued certain directions to the Director of Medical and Rural Health Services to implement the said Government Order.

3. In the Government Order fourth read above, orders were issued sanctioning posts and improving the promotion avenues to the Medical Officers working in all the three Directorates of the Health and Family Welfare Department.

4. In the Government Order fourth read above, among other things, in Para

4(I)(xvii) and in Para 4(II)(xix), it has also been ordered for a review of the Government Order initially after three years and subsequently after every five years. Accordingly, after a detailed review, in the Government Order fifth and sixth read above, the Government have issued the clarificatory amendment orders for ensuring smooth implementation.

5. The Tamil Nadu Medical Service is unique that the Medical Officers are

interchangeable across Directorates depending upon their qualifications, vacancy and interest. Hence, a review and restructuring of the posts in the Directorate of Medical Education has positive ramifications for the Medical Officers in all the three Directorates. Further, since the issuance of the Government Order fourth read above, new Medical Colleges, departments and general posts have been created and all these posts have to be included in a comprehensive review of the said Government Order. Also, the norms of Medical Council of India have to be followed to ensure the continued approval of MBBS and PG seats in the Medical Colleges.

6. Accordingly, in Government Order ninth read above, the Government have

issued orders restructuring and sanctioning the teaching posts viz., Professor, Associate Professor, Assistant Professor, Tutor, Senior Resident and Junior Resident as per the norms of Medical Council of India both College-wise and Department-wise subject to certain conditions, which also led to better promotional avenues by way of refitment and promotion to the Medical Officers working in the Directorate of Medical Education side. However, certain discrepancies were noticed in the said Government Order which could have led to disruption of patient care as well as deviation from Medical Council of India norms. Consequently, the said Government Order has been kept in abeyance until further orders vide Government Letter tenth read above.

7. The Government have re-examined the issue in detail and decided to streamline the teaching posts sanctioned in Government Medical Colleges and Hospitals under the control of Director of Medical Education in various Government orders according to the norms of the Medical Council of India and patient care requirements. The following principles have been followed for sanctioning the post matrix College-wise and Department-wise:-

a. For existing Medical Colleges with 100/150/250 MBBS seats, Medical

Council of India has prescribed certain norms of faculty position in the pre clinical / Para clinical / clinical departments in the regulations. The post matrix ensures that the said norms are fulfilled.

b. The post matrix also adheres to norms prescribed by the MCI for MD/MS broad specialities and DM/MCH super specialities in certain departments, including the requirements for the seats proposed from the year 2019-20 for which applications have already been submitted to Medical Council of India (MCI).

c. The post matrix gives weightage to patient care requirements and posts have been proposed to deal with increased load of patients in various broad specialities and super specialities.

d. The post matrix takes into account the infrastructure availability or proposed in the case of specialities which require such scarce infrastructure (e.g. Cathlab, LINAC and other radiotherapy equipment). Complementary specialities, the hub-and-spoke model for a continuum of care, priority areas based on the morbidity patterns were kept in mind so as to ensure comprehensive patient care as well as to form comprehensive teaching units to acquire further PG seats and produce more specialists. The availability of qualified specialists or lack thereof, was also taken into account so as infructuous posts are not sanctioned.

e. Required complement faculty additions were done in certain departments to enable them to apply and face MCI inspection for new PG courses as per the MCI regulations.

f. As in the present practice, the post graduate students shall continue to be recognized as Junior Residents in the newly formed departments wherever available.

8. The Government have also examined the connected issues relating to the general, administrative and teaching posts in colleges and allied institutions under the control of the Directorate of Medical Education and observed that -

i. In Government Medical Colleges, so far it has been the convention to designate a Professor from a non-clinical speciality as the Vice Principal, without it being an independent sanctioned post. Now, it would be appropriate in the interest of better academic results and student welfare to have an exclusive post of Vice Principal from non-clinical specialities to take care of the academic activities of the college under the overall control of the Dean, equivalent to the post of Medical Superintendent for the Hospital side from clinical specialities.

ii. There are existing posts of Director of upgraded institutes, having a higher pay than Professors as detailed in Annexure III. These posts are included in the respective Departments also as they continue to be Professors in the respective Departments satisfying MCI norms. In certain attached hospitals, there is a convention of designating one Professor as the Medical Superintendent. It is appropriate to recognize this convention and designate one post of Professor as Medical Superintendent and Professor without any additional financial implications.

iii. In certain emerging sub-speciality departments, posts of Professor or Associate Professor have already been sanctioned; but these posts are also counted against the parent department specialities also for MCI purposes to ensure the continuance of PG seats. The list is available in Annexure IV. This arrangement is necessary to satisfy MCI requirements in the parent departments. The sub-speciality posts / departments shall continue to operate as usual.

iv. For ease of administration and corordination, the inter-se distribution of posts in the particular Medical Colleges and constitutent / attached institutions is outlined in Annexure V. Broadly, the posts sanctioned above the cadre of Associate Professor are attached to the parent Medical Colleges and the post of Assistant Professor cadre posts and below are attached to the actual institutions where they are working.

v. Many posts have been sanctioned over the years as either permanent post or temporary posts. In respect of temporary posts, there are administrative difficulties in ensuring timely orders of further continuance of posts or pay authorization, leading to difficulties for the individuals in claiming pay. In as much as all these posts are ultimately funded from the state exchequer and absolutely essential for patient care, it would be appropriate to confirm all the posts of Medical Officers under the Directorate of Medical Education given in the post matrix as permanent posts. The only exceptions would be the posts sanctioned under National Health Mission (NHM) and other Central Schemes given in Annexure VI A and VI B which will continue to be temporary as the schemes themselves are of Government of India. Further, the National Rural Health Mission posts in Annexure VI A have been sanctioned for specific departments and filled with qualified specialists, and also have been given teaching experience. It will be appropriate to re-designate these posts as ‘Assistant Professors’ in line with MCI regulations rather than the existing nomenclature. It is clarified that these NHM posts have been created over time to deal with patient load and shall continue to operate as temporary posts under the Scheme, and the core component required for fulfilling MCI norms will be available as permanent posts. Annexure VI B lists the specific temporary posts created for District Early intervention Centres (DEIC - NRHM) and Anti-Retro Viral Therapy Centres (ART). These shall continue to be temporary posts in the same logic. The exercise to identify temporary posts in the other two Directorates and make them permanent as per the requirement is being undertaken separately.

vi. As a whole, the overall number of Professor / Associate Professors will

increase and the posts of Assistant Professor / Tutor / SR / JR will decrease with effect from the date of the order. The non-teaching posts (general and administrative) also have certain changes as outlined elsewhere in this order.

-5- Hence, for an interim period there would be a situation where the junior posts of AP/ SR / Tutor / JR are extinguished before the incumbents can be promoted to the higher posts following existing procedures. Also, there might be re-arrangement required by way of transfers from posts which cease to operate with this order to other existing or new posts. Hence, the order needs to be operationalized in a phased manner, smoothly.

vii. Further, in the speciality of Physiology, the total sanctioned post is 23 in the cadre of Professor and 25 in the cadre of Associate Professor. While examining, there are 7 Professor / Associate Professor serving in the speciality of Physiology over and above, who cannot be deployed in other specialities. Even after the Professors / Associate Professors are redistributed by counselling and transfer, these persons have to be accommodated by creating 7 supernumerary posts as an interim measure. These supernumerary posts can be extinguished as and when other posts of Professor / Associate Professor in Physiology fall vacant for any reason in any of the institutions under the control of Directorate of Medical Education, or the incumbent moves to a general post such as Dean / Deputy Director / Vice Principal. All the supernumerary posts may be attached to Kilpauk Medical College for administrative convenience.

viii. In the speciality of Pathology, it is proposed to sanction 34 posts of Professor whereas at present 37 persons occupying Professors posts in Pathology. However, there are 9 vacant posts in Associate Professor Level. Hence 3 posts of Associate Professors in Pathology to be temporarily upgraded as Professors, and only 6 Assistant Professors have to be promoted to Associate level now. As and when the Professors retire, these three posts will be downgraded as Associate Professors. The Director of Medical Education is directed to identify the 3 senior most Professors occupying the post of Professor and intimate the Government on the date of their retirement so as to issue necessary Government Order for downgradation of post on such occurrence.

9. The Government, after careful examination, have decided to sanction the following post matrix in the Government Medical Colleges and Hospitals and attached institutions under the control of the Directorate of Medical Education. The Government accordingly, do and hereby direct the following:-

i. The post matrix to Directorate of Medical Education is sanctioned as indicated below and the College-wise, Department-wise and the distribution of posts are detailed in the Annexure I and II. The post matrix includes all the posts sanctioned in the Directorate upto September 2018 and also the post sanctioned under PMSSY for Madurai, Thanjavur and Tirunelveli Medical Colleges but does not include the posts sanctioned for Karur Medical College and the posts sanctioned under National Health Mission after September 2018. Hence, the Director of Medical Education is requested to maintain an updated registry of posts sanctioned from time to time henceforth, with this post matrix as the basis.

ii. The general, administrative and other posts are sanctioned in various establishments in Directorate of Medical Education and distributions are detailed in Annexure II A, II B, II C and II D.

iii. (a) The sanctioned posts of Director, Upgraded Institutes having a higher pay than Professors already in existence are detailed in Annexure III A which shall be included in the respective Departments and they shall continue to be Professors in the respective Departments to satisfy the MCI norms. The numbers in the Annexure I include these posts also, and they have been indicated in this Annexure for clarity.

(b) One post of Professor in select attached institutions is now officially

designated as Superintendent and Professor in the same scale of pay as Professor as detailed in Annexure III B. (Pay matrix level 28) and they shall continue to be Professors in the respective Departments. The numbers in the Annexure I include these posts also, and they have been indicated in this Annexure for clarity.

iv. The posts already sanctioned in certain sub specialist of a particular

departments are considered to be in the parent department specialities for MCI purposes. This arrangement shall continue as detailed in Annexure IV. This arrangement shall be necessary to satisfy MCI requirements in the parent departments. The subspeciality posts / departments shall continue to operate as usual.

v. The inter-se distribution of posts in the Government Medical Colleges and attached institutions are detailed in Annexure V.

vi. All the posts sanctioned in the annexures are declared as permanent

posts, except the posts in the Annexures VI A and VI B. The posts sanctioned under the National Health Mission / Central Scheme identified in Annexure VI A be redesignated as Assistant Professors in line with MCI regulations since these posts have been created over time to deal with patient load and shall continue to operate as temporary posts under the Scheme.

vii. The posts detailed in Annexure VI B sanctioned for District Early intervention Centres (NRHM) and Anti-Retro Viral Therapy Centres (ART) are temporary and these shall continue to be temporary posts. …..7

- 7- viii. The Government direct that any promotion and posting shall be done

only in the vacancies available in a department in that college concerned. There shall not be any diversion of Medical Officers between departments and Medical College Hospitals, without any prior approval of the Government.

ix. The Government approve the following operational guidelines for effective and smooth implementation of this order-

In order to transit to the higher number of Professors and Associate Professors, transfer and promotion exercise should be done in the following sequence. For the post of Professors:-

A. Transfer counselling for the post of Professor who are already

refitted and designated as Professors. B. Re-designation of the Associate Professors those who have

completed twenty years of service out of which nine years of teaching experience in their speciality and already drawing pay band IV (pay matrix 28) to Professor, subject to the availability of the vacancies in the cadre of Professors and eligibility as per G.O. (Ms.) 77 Health and Family Welfare (A1) Department dated 23.02.2016.

C. Transfer counselling for the newly re-designated Professors synchronously with (B) for each speciality.

D. Promotion of the Medical officers in the cadre of Associate Professors (those who have completed nine years teaching experience as per the MCI norms and other relevant MCI conditions as prescribed by Medical Council of India) to the post of Professors, subject to the availability of the vacancy and preparation of panel.

E. Promotion counseling for the newly promoted Professors as mentioned in (D) above.

For the post of Associate Professors:

F. Promotion to the Medical Officers in the cadre of Assistant Professor to Associate Professors, as per the MCI norms and rules in force i.e., subject to availability of vacancy and preparation of panel.

G. Promotion counseling for the newly promoted Associate Professors.

For the post of Assistant Professors / Tutors / Senior Residents / Junior Residents

H. Transfer counseling for the Assistant Professors, Tutors, Senior Residents and Junior Residents.

x. As an interim arrangement, the existing posts in the lower categories will be deemed to continue till the operationalization of the higher category posts. This will not entail any additional expenditure as the total number of persons occupying the posts do not change, and the posts will be extinguished after the interim period. The Pay and Accounts Officers / District Treasury Officers are directed to permit the salary bills on an as is where is basis subject to the cut-off dates prescribed.

xi. This operationalization has to be completed before 31.3.2019. 10. This order shall be issued in supersession of the earlier orders of teaching

posts sanctioned in Government Medical Colleges and other allied institutions. 11. This order issues with the concurrence of the Finance department vide its

U.O.No.16/DS(MA)/2019, dated 15.02.2019.
