ORDER:

` His Excellency The Governor of Tamil Nadu has announced in the

Legislative Assembly during 2008-2009 as follows:

“This Government has always shown key interest towards the welfare

of Transgnders who have been neglected by the society as socially

handicapped persons. Taking with consideration the innumerable hurdles

faced by them in getting social acceptance, this Government implements

welfare schemes, provision of Ration Cards, free sex Reconstruction-surgery

and various welfare measures. In order to safeguard their welfare this

Government would constitute the Transgender Welfare Board”.

As per the above announcement, in order to provide social protection

to Transgenders in Tamil Nadu and to provide necessary schemes and

policies, the Director of Social Welfare has sent a proposal to the Government

to constitute the Transgender Welfare Board.

2. The Tamil Nadu Transgenders Welfare Board consists of the Hon'ble

Minster for Social Welfare as its Chairperson, 11 Official members and 9

Non -official members (Transgenders).

3. The Tamil Nadu Transgenders Welfare Board will function as per the

following guidelines.

(i) The Board will formulate and implement welfare programme for providing

social security and status to the Transgender in the State of Tamil Nadu.

(ii) The Board will meet once in 3 months.

(iii) Based on the discretion of the Chairperson on emergency situation with

prior intimation the Board Meeting could also be conducted within a

period of 3 months.

(iv) TA / DA will be provided as per Government Rules to the Members.

(v) The Board will be registered under Societies Act and while registering the

Objectives, Rules and Guidelines (Procedure) will also be registered by

the District Registrar. Further the Director Social Welfare is requested to

audit the accounts of the board through Chartered Accountant, and the

Audited statement along with the annual report will be submitted to the

Government.

` In the 2008-09 Budget announcement “Formation of separate Welfare

Board for Transgender, issue of Family Card, Training for Employment,

Formation of Self Help Group, Financial announcement to start one Short

Stay Home through NGO” was announced.

2. In continuation to the announcement, in the Government Order 1st read

above, Transgender Welfare Board was formed. The first meeting of the

Board was held under the Chairmanship of Hon’ble Minister (Social Welfare)

on 26.05.2008. Based on the decision taken by the Board to conduct

Transgender survey, Design Format, print, Information Communication and

postal expenditure, the Director of Social Welfare has sent a proposal for an

expenditure of Rs.23,90,000/- as detailed below:

3. The Government after careful examination decided to accept the proposal of

Director of Social Welfare for designing of format to conduct survey of

Transgender, printing, information Communication and postal charges

occurred sanction for Rs.23,90,000/- (Rupees Twenty Three Lakh Ninety

Thousand only).

4. The expenditure sanctioned in para 3 above shall be debited to the following

In the 2008-09 Budget announcement “Formation of separate Welfare Board for

2. In continuation of the G.O. 1st read above, Transgender Welfare Board was

formed, and its first meeting was held by the Hon’ble Minister for Social

Welfare as Chairperson on 26.05.2008. Based on the decision of the Board,

the Director of Social Welfare in the letter second read above, has sent a

request to sanction a sum of Rs.12,11,000/- for starting Short Stay Home for

Transgender.

3. After careful examination the Government accept the proposal of the Director

of Social Welfare and sanctioned a sum of Rs.3,57,500/- (Rupees Three Lakh

Fifty Seven Thousand Five Hundred only) for starting Short Stay Home as

Order:

As per G.O. cited above the Tamil Nadu Transgender Welfare Board with the

Minister of Social Welfare & Nutritious Meals Programme as the Chairperson

has been formed. As ordered the Transgender Welfare Board will meet once

in 3 months and the TA / DA will be disbursed to the members attending the

meeting as per Government guidelines.

2. Following the G.O., the Transgender Welfare Board has met twice on

26.5.2008 and 9.9.2008. The Director Social Welfare has sent a proposal to

sanction Rs.1,08,000/- towards TA /DA and other expenses to ex-official

Transgender members.

Permission was also sought to meet the expenditure from budget

allotment of Rs.50,00,000/- and also to permit to incur the expenditure

towards TA/DA and other expenses from the above head. Further it was

requested to issue necessary amendment in the Tamil Nadu Transgender

Welfare Board G.O to treat the ex-official Transgender members as first class

members and also to sanction a sum of Rs.1,08,000/- (Rs.27,000/- per

meeting for 4 meetings) as per Financial Code Volume 1.

3. The Government on careful examination of the proposal given by the Director

of Social Welfare issued the following order.

a) The Tamil Nadu Transgender Welfare Board will be treated as First

Class Committee and the Ex-official members as First Class Members.

b) A sum of Rs.1.08 lakh is sanctioned towards the TA/DA and other

expenses incurred to the meeting held on 26.5.2008 and 9.9.2008 and

to meet the above expenses in the forthcoming meetings.

c) The Director, Social Welfare is permitted to incur the expenditure from

amount of Rs.50.00 lakh sanctioned in the Budget Estimate.

d) The Director is authorised to draw the amount of Rs.1.08 lakh Article

99 of Tamil Nadu Financial Code Volume 1.

ORDER:

As per the Budget announcement of 2009-10 the following

announcement was made. To alleviate the problems faced by Transgenders,

a separate Welfare Board will be, set up, Ration cards will be provided,

training will be imparted for self employment, economic assistance is will be

provided to Transgenders who can start their own business either as separate

individuals or jointly as Self Help Groups. Those who are not having their own

houses will be provided group houses in the coming financial year at a cost of

Rs. 1 crore.

2. Following the above budget announcement, it has been proposed to construct

group houses for 335 transgenders who have been provided cost free pattas

in 10 districts. In the first phase, it has been proposed to construct 182 group

houses at the cost of Rs.55000/- per house under the Indira Awaz Scheme,

and the proposal has been sent by the Director of Social Welfare for the 10

districts.

3. The group houses will construct by the concerned District Rural Development

Agencies and expenditure to be incurred for the construction of toilets for

these houses which will be provided as grant-in-aid under the scheme “Total

sanitation project”. The Director of Social Welfare has submitted the proposal

for sanctioning the above amount and to also authorise him to disburse the

above amount to the concerned DRDAS.

4. The government on careful examination of the proposal given by the Director

of Social Welfare has accepted to fulfil the budget announcement of 2009-10.

According to para 2 an amount of Rs.1,00,10,000 is sanctioned for the

construction of group houses for 182 Transgenders under the India Awaz

scheme. The group house construction will be taken up by the District Rural

Development Agency and approval is also given to construct toilets for these

group houses under the, Total sanitation Scheme for which the amount is

sanction to DRDA.

ORDER:

In the Government Order read above, in 10 districts Tiruvannamalai,

Trichy, Thanjavur, Sivagangai, Karur, Pudukottai, Erode, Coimbatore,

Krishnagiri and Thoothukudi, out of 335 Transgenders who have been issued

Free Land Patta for 182 Transgender for 1 house. District Rural Development

Authority has been sanctioned Rs.1,00,10,000 (Rupees One Crore and Ten

Thousand only) to build 182 house at the rate of Rs.55,000/- for one house as

constricted under Indira Awas Scheme Group House and expenditure for

constructing toilet should be received as subsidy from Total Sanitation

Programme.

2. The Director of Social Welfare stated that the Collector of Krishnagiri and

Erode have reported that the calculation of cost of construction material and

under Indira Awas Scheme, Kalaignar House Scheme. Construction material

cost has been increased to Rs.75,000/-, since the amount of Rs.55,000/-

sanctioned to constrict Group House for Transgender is insufficient, it may be

increased to Rs.75,000/-. Also during the meeting of District Rural

Development Agency on 07.10.2010, it was stated by the District Social

Welfare Officers that the concerned District Rural Development Authorities

have reported that construction of Group House, with the sanctioned amount

is not possible. Hence the amount of Rs.55,000/- for constructing one house

may be increased to Rs.75,000/- and to issue order to reallocate the houses

from 182 to 133 to 10 districts and to be constricted within the sanctioned

amount of Rs.1,00,10,000/-.

3. After careful examination the Government accept the proposal of the Director

of Social Welfare as read in G.O. above, in the scheme for construction of

Group Houses for Transgender in 10 districts for 182 houses, from the

sanctioned out of Rs.1,00,10,000/-, except Tiruvannamalai and Thoothukudi

for the 8 Districts and 133 Transgender given below increases the

construction cost from Rs.55,000/- to Rs.75,000/- and order that out of

Rs.1,00,10,000/- only Rs.99,75,000/- should be incurred as expenditure.

ORDER:

In order to help the Transgenders to lead a decent life and mainstream

them into the society, the Government of Tamil Nadu has constituted

Transgender Welfare Board vide G.O. first cited.

2. Due to the efforts of Transgenders Welfare Board, the Transgenders

grievance redressal meeting is convened in every district, by the District

Collector. As the Transgenders are expelled by their families they do not get

any support from their families and relatives. In order to remove the Social

Stigma and to promote their economic development it has been proposed by

Director of Social Welfare to Provide an amount of Rs.20,000/- per

Transgender a follows.

1. Amount to be sanctioned to 10 Transgenders per district Rs.20,000/-

2. Starting Business activity for as one group Rs.20,000/- per group

depending on the number of member in each group

3. Rs.1 Lakhs for a group of 5 Transgenders for Rs.2 Lakhs for 2 such

groups

In this context to encourage self employment among transgenders, the

Director of Social Welfare has requested the government to sanction an

amount of Rs.64,00,000/- for the year 2009-10 to Transgenders Welfare

Board at the rate of Rs.2,00,000/- per district and for 32 districts.

The Director of Social of Social Welfare in the letter 2nd read

above.The Director of Social Welfare may be authorised to distribute

Rs.2,00,000/- each District Collector and the district Collectors may asked to

select the deserving and eligible Trangenders and distribute Rs.20,000/- per

Transgender.

The Government on careful examination of the proposal given by the

Director of Social Welfare has sanctioned an amount of Rs.64,00,000/- to

Transgenders Welfare Board. Approval is given to Director of Social Welfare

to draw the amount as advance as per Tamilnadu Finance Rule 99.

The amount sanctioned at para 4 above shall be debited to the

following head of account:

ORDER:

In Tamil Nadu to provide social security, necessary schemes were

devised and in order to implement them effectively the Transgender Welfare

Board as per reference 1st cited above, was constituted and meetings are

held.

2. During Tourism and Culture Department’s demand it was assured that to

develop the interest of Art of Transgenders, a training on Fine Arts would be

given through Government Arts College, Chennai. Based on this, name list of

Transgenders was requested from the Commissioner of Social Welfare by

Tourism & Culture Department by reference 2nd cited above. The

Commissioner of Social Welfare has stated that the Transgender would be

imparted free training along with materials for Fine Arts training. Food and

accommodation has to be arranged by the Transgenders themselves.

Commissioner of Social Welfare has stated that based on the above

assurance, vide reference 3rd cited name list of Transgenders was requested

and it was informed that since the Transgender, separated from parents /

relatives live alone / groups seeking alms, to meet their daily expenses,

therefore, to attend the training for 10 days, they may be given minimum of

Rs.300/- per day towards their food and accommodation.

3. Since the demand is justifiable the Commissioner of Social Welfare has

requested to allot a sum of Rs.10,00,000/- for 50 Transgenders at the rate of

Rs.200/- per day for 10 days and the expenditure may be given as advance

under Article 99 of Tamil Nadu Financial Code Volume 1.

4. The Government after careful examination has accepted the proposal of

Commissioner of Social Welfare and permits the Commissioner of Social

Welfare to draw an advance under Article 99 of Tamil Nadu Financial Code

Volume 1 for a sum of Rs.1,00,000/- to impart training on Fine Arts for 50

Transgenders at the rate of Rs.200/- per day for 10 days.

5. The expenditure sanctioned in para 4 shall be debited into the following head

of account.

ORDER:

In order to provide social security to the Transgenders Tamil Nadu, and

to implement various welfare schemes for the Transgenders the Transgender

Welfare Board has been set up and the Board meetings are being held.

2. In the second meeting of the Tamil Nadu Transgender Welfare Board held on

09.09.2008 and presided by the Honourable Minister of Social Welfare

sanction is accorded to the resolution was passed to promote the livelihood

and increase the income generating capacity of Transgenders by providing

Skill development training to 20 transgenders.

3. As per the resolution read above, the first Skill development

training programme will be provided to a group of 20 transgenders, by the

Entrepreneurship Development Institute, Guindy, Chennai – 32 and cost of

the training programme is given below.

4. To provide Skill development Training to Transgenders the Director of Social

Welfare has requested for orders sanction of Rs.45,000/- Entrepreneurship

Development Institute and Rs.1,80,000/- towards providing Tea, Food

expenses and Transport charges and approval to draw the total amount of

Rs.2,25,000/- as advance as per the Tamilnadu Financial Code Vol.1 rule 99.

5. The Government on examining the proposal of Director Social Welfare issued

orders the following.

The Entrepreneurship Development Institute will be given Rs.45,000/-

to provide skill development training to 10 persons.

Sanction is given to incur Rs.1,80,000/- is towards Tea, food expenses

and Transport charges to be given to trainees (10 members)

The Total training amount Rs.2,25,000/- will be sanctioned from the

amount allotted to Transgender Welfare Board and the Director of Social

Welfare is authorised to draw the amount as advance as per Rule 99 of

Tamilnadu Financial Code Vol I rule.

6. The sanctioned amount in para 5 above will be kept in following Head of

Account.

7. The Director of Social Welfare has to submit to the Government the Utilisation

Certificates for the amount sanctioned in para 5.

8. This order issues with the concurrence of Finance Department vide as

U.O.No. 16720/SW/2010-1. Dated 26.03.2010.

ORDER:

In Tamil Nadu to provide social security, necessary schemes were devised

and in order to implement them effectively the Transgender Welfare Board as per

reference 1st cited above, was constituted and meetings are held.

3. In the 5th meeting of the Board held on 15.10.2009 under the Chairmanship of

the Hon’ble Minister for Social Welfare, in order to help to increase the income

of the Transgenders, the demand for Rs.1,68,360 (Rupees One Lakh Sixty

Eight Thousand Three Hundred and Sixty only) as grant for setting up of

fashion jewellary making centre for the Transgender was accepted.

4. As per the above resolution the Commission, Social Welfare has incurred an

expenditure for Rs.1,68,630(Rupees One Lakh Sixty Eight Thousand Six

Hundred and Thirty only) to set up fashion jewellery making centre to the

Sagodari Foundation to be given through the Principal, Jain College without

permission of the Government incurring expenditure through the Transgender

Welfare Board. The Commissioner of Social Welfare in his letter above has

sent a proposal for ratification and sanction.

5. After careful examination, the Government accepts the proposal of the

Commissioner of Social Welfare to ratify and sanction the amount

Rs.1,68,360/- (Rupees One Lakh Sixty Eight Thousand Three Hundred and

Sixty only) given to Sagodari Foundation through the Principal, Jain College.

6. The amount sanctioned in para-4 above should be dibited to the following

head of account.

Order:

In order to provide complete social security to Transgender and to formulate

and implement schemes for the Transgender, the Tamil Nadu Transgender Welfare

Board has been constituted as per G.O.(1) read above and Board meetings have

been conducted.

2. During the 5th Board meeting convened under the chairmanship of Hon’ble

Minister for Social Welfare, it was decided to support the Transgender to

improve the livelihood by providing resources for augmenting their income by

giving Automatic Embroidery Sewing Machines fitted with motor @ a cost of

Rs.7,500 per machine @ a total cost of Rs.7,50,000 for Transgender

recommended by the District collectors.

3. As per the above resolution the Commissioner of Social Welfare has sent a

proposal to accord sanction for 100 Automatic Embroidery Sewing Machines

free of cost to Transgender @ the rate of Rs.7000 to Rs.7,500 per Machine to

procure 100 Sewing Machines at the cost of Rs.7,50,000(Rupees Seven Lakh

Fifty Thousand only) for distributing to Transgenders recommended by the

District collectors.

4. The Government after careful examination, accept the proposal of the

Commissioner of Social Welfare and accord sanction to procure Automatic

Embroidery Sewing Machines at the rate of Rs.7,000 to Rs.7,5000 per

Machine, and accord a sum of Rs,7,50,000(Rupees Seven Lakh Fifty

Thousand only) from the amount sanctioned for the Tamil Nadu Transgender

Welfare Board. The Government also order that the above Sewing Machines

shall be distributed to the Transgender recommended by the District

Collectors.

5. The Commissioner of Social Welfare shall distribute the Sewing Machines

allotted, based on applications of the districts under the above Schemes and

the Commissioner is also requested to make provision for financial allotment

to the Districts.

6. The procurement of Sewing Machines shall be made by the District Collector

is accordance with the Tamil Nadu Tender Transparently Act 1998 and

Tender Transparency Rule 200.

7. After procure of distribution of Sewing Machine to the beneficiaries the District

Collectors are requested to send a detail report to the Government.

8. The expenditure sanctioned as per para 4 shall be debited into the following

head of account.

2. The above amount sanctioned for the year 2009-2010 for the Implementation

of the welfare of the Transgenders could not be spent within the stipulated

time limit and there are also some practical difficulties in getting the Utilization

Certificate from the District Collectors. Hence, the amount allotted through

Tamil Nadu Transgender Welfare Board may be treated as a Continuing

expenditure like is previous year. Directorate of Social Welfare has sent a

project to Government for this year 2010-11 for a sum of Rs.5.51 Crore under

2. The Tamil Nadu Transgender Society Chennai has requested the

Government to observe April 15 as ‘Transgender Day’ vide it petition dated

10.1.2011 & to give recognition to Transgender. The Director of Social

Welfare in the Letter second read above has requested the government to

issue orders announcing April 15 as Transgender Day since April 15 One

Day on which the Government issued orders for the formation of Transgender

ORDER:

To provide complete social security to the Transgender’s in Tamil

Nadu, Transgender Welfare Board was formed vide GO 1st cited to formulate

schemes and implement them in an effective manner various schemes are

being formulated and implemented through the Transgender Welfare Board.

2. The Hon’ble Minister for Social Welfare among others had made the following

announcement during the demand of Social Welfare Department held on

11.4.2012:

“By introducing Pension Scheme for Destitute Transgender’s monthly pension

of Rs.1000/- will be give to the poor Destitute Transgender who are above 40

years of age”.

3. The Director, Social Welfare vide reference 3rd cited above has stated the

concerned District Social Welfare Officers in all 32 districts have reported that

in Tamil Nadu, so far 3125 Transgenders have received Identity Card issued

Transgender Welfare Board and as on date (26.04.2012) there are

approximately 1069 Transgenders above 40 years of age.

4. In continuation of the above announcement of the Director Social Welfare,

a) Requested to sanction Rs.1,000/- as monthly pension to the identified

1069 Transgenders In the districts.

b) Requested order to issue the pension through Revenue Department as

done for other Social Security pension scheme.

c) In order to incur expenditure under the scheme for 1069 Transgenders

at Rs.1,000/- per head per month (for 11 months) requested

Government sanction a sum of Rs.1,17,59,000/- for this purpose.

5. Further, the Director of Social Welfare has stated that through Social Welfare

Department to obtain ID from Transgender Welfare Board, Age should be

certified by Medical Board, Nativity Certificate, (or) Family Card should be

obtained to get benefit under this scheme. The Director of Social Welfare has

stated that condition applied for other Social Security Pension Schemes

suitable to the present period should be fulfilled the decision as far as these

conditions are concerned, may be taken after obtaining the remarks of the

Commissioner Revenue Administration

6. Commissioner Revenue Administration vide his proposal 2nd cited has stated

the following conditions:

1. Transgenders who are unable to work physical and eara.

2. Transgenders who does get any assistance from either family members or

others.

3. Should obtain Medical Certificate that they are Transgenders from

Government Medical Officer.

7. After careful examination of the above proposal, accordingly orders are issued

to implement monthly pension scheme of Rs.1,000/- to those Transgenders

who are in Below Poverty Line category from this financial year onwards.

Further to get benefit under this scheme the following eligibility conditions are

also ordered.

CONDITIONS:

i) The Transgender should have obtained Identity Cards issued by Tamil

Nadu Transgender Welfare Board, Age Certificate issued by Medical

Board and Nativity Certificate or Family Card for availing the pension.

ii) Should have completed 40 years of age.

iii) Transgender who are unable to undertake any physical work.

iv) Destitute Transgender.

8. Rs.1,17,59,000/- (Rupees One Crore Seventeen Lakh Fifty Nine Thousand

only) have been sanctioned to distribute Rs.1,000/- per month per beneficiary

for 11 months for the year 2012-13 through Revenue Department so as to

benefit 1069 Transgender identified above age of 40.
