10:00 – 11:30 a.m. CLE Session: The Magna Carta: "What if . . . . ?" Counter-Factual Perspectives on U.S. Legal History

Grosvenor House, A JW Marriott Hotel – Court Suite, Ground Floor

Sponsor: ABA Judicial Division

What if . . . there had been no Magna Carta? Join this panel of legal luminaries and explore (in a highly-interative, roundtable format) "alternate history" -- i.e., a series of counter-factual hypotheticals probing how the common law might have developed absent the Magna Carta. As the panelists travel back in time, they will weigh competing visions of what-might-have-been, and audience members will use hand-held technology to "vote" on the likely course of history. The outcome of each audience "vote" will set the stage for subsequent visions presented by the panel (and the audience will vote again, and again), as panelists trace the history of the law to the present day. This provocative, engaging, and highly entertaining presentation will prompt all to grapple with the power of an idea, the difference that a few individuals can make, and how very different today's law, and life, could have been. As Oliver Wendell Holmes said: "A page of history is worth a volume of logic."

Moderator: Professor Jonathan Turley, The George Washington University School of Law, and Legal Analyst NBC and CBS News, Washington, DC

10:00 – 11:30 a.m. CLE Session: Where In The World Is Your Evidence? The Challenges of Gathering Electronic Information Worldwide For Litigation, Arbitration and Investigations

Grosvenor House, A JW Marriott Hotel – Grosvenor Suite, Ground Floor

Sponsor: Section of International Law

Your multinational client's General Counsel has received subpoenas from the U.S. Securities and Exchange Commission seeking emails and other data over a four-year period across the company. On the same day, you have received an order from a U.S. federal court directing compliance with litigation demands for production of email, texts and other personally identifiable data from your client's facilities in Europe. It may not be the right time to tell the General Counsel that you need some of that very data to establish your defenses. This interactive session, facilitated by a roving moderator, will explore the challenges of obtaining evidence on a global scale, including privacy, data protection and national security laws. We will then propose practical suggestions for producing data and obtaining evidence from multiple countries.

10.00-11.30 a.m. CLE Session: Legal Ethics in the U.S. and the United Kingdom: Common Goals, Different Approaches

Grosvenor House, A JW Marriott Hotel – Albemarle Suite, Mezzanine Floor

Sponsor: Standing Committee on Ethics and Professional Responsibility/Center for Professional Responsibility

The program will highlight specific differences between the ethical rules in the ABA Model Rules of Professional Conduct and provisions of "The Solicitors Act". The first fact situation will involve a client seeking services from a firm when the firm currently represents the potential adversary. By analyzing this conflict of interest issue, the US and United Kingdom panelists will discuss how the situation would be addressed differently under each set of rules. A second fact situation would be involving the use of expert witnesses. While in the U.S. each side in a matter presents an expert is support of their position, in the United Kingdom, traditionally the expert has been considered a neutral in litigated matters. Moreover, the panelists will then interact with the audience to discover if there are methods that would avoid any conflict of interest discovered. This same pattern will be followed for another ethical issues that divide our common ethical standards, such as aspects of non-lawyer ownership/investment in law firms and/or issues of confidentiality.

2:30-4:00 pm CLE Session: Where Would You Try a Case? A Live Action Primer on Trial Skills in the U.S. and the United Kingdom

Grosvenor House, A JW Marriott Hotel – Audley Suite, Ground Floor

Sponsor: Section of Litigation

Recognizing that civil jury trials are limited in the United Kingdom, this program will focus on the different approaches taken in the U.S. and United Kingdom courts to critical trial skills and the application of those to civil, criminal and commercial cases. Experienced practitioners and U.S. and U.K jurists will be given fact patterns from which they will describe the differences in making opening statements, handling witness preparation, presentation of direct and cross examinations and then finally the closing arguments. The U.S. and United Kingdom judges will alternate in their respective commentary and analysis of the lawyers comparative skills. The goal will be to fully explore the actual differences in a courtroom for each country and to illustrate the nuances in approach when the audience is a judge instead of a jury. A discussion among all participants will follow each trial skill and case discussion. Emphasis will be placed on analyzing the role of the jury in resolution of civil disputes in the U.S. and the significance of its absence in the United Kingdom.

2:30 - 4:00 p.m. CLE Session: Global Trends in the Regulation of Insider Trading & Market Abuse: Europe, the United States and Asia

Grosvenor House, A JW Marriott Hotel – Grosvenor Suite, Ground Floor

Sponsor: Section of International Law International

In the wake of the financial crises that began in 2008, there has been a dramatic uptick in the number and the scope of insider trading enforcement actions and criminal prosecutions brought by regulators globally. In the U.S. the SEC and the DOJ have made it clear that they will aggressively pursue civil and criminal actions against insider trading with increased attention on hedge funds, "expert networks" and other market participants. There has also been a new aggressive stance taken by the regulators in the United Kingdom and Hong Kong on insider dealing and market abuse, where in both markets criminal prosecutions are on the rise. In this program we will review recent developments in the US, the United Kingdom (e.g., the Einhorn/Greenlight Capital case) and at the EU level as well as in key Asian markets and identify some of the key issues that securities law practitioners should be aware of and concerned about in the area of insider trading and market abuse regulation in the international financial markets.

Respect for the Rule of Law, which anchors the effectiveness of legal regimes at the national and international levels, holds important ramifications in the economic sphere. Moreover, the rule of law is implicated when governments are blamed for regulatory or judicial failures, or when companies are accused of circumventing various responsibilities. Members of the legal profession will be offered expert insights into: ways to support the newly-launched UN framework for business and the rule of law (B4ROL), the role of corporate counsel in managing operational and CSR dimensions of rule of law, trends in corporate human rights accountability and litigation, and the latest research initiatives on how rule of law features in investment decision-making and justice sector reforms.

Suggestions will include real-world practical solutions that can allow the Magna Carta’s principles to bear fruit centuries later. Among the areas to be addressed are: ways to effectively educate the public of the criminal nature of human-trafficking enterprises and human-rights violators; proposals to train and better educate an inexperienced judiciary with little exposure to these unique types of crimes with a special emphasis on the unique physiological and psychological victimization of the crime and how that plays out in the courtroom; solutions to combat the undeveloped support system of services for victims; opportunity for private-public partnerships between corporations and government; use of new corporate supply chain laws in the US and the EU as models to encourage the corporate international citizen to self-examine and maintain a corporate environment free of human rights violations; and use of MLATs and Letters Rogatory to gather evidence to support cross-national prosecutions.

Grosvenor House, A JW Marriott Hotel – Court Suite, Ground Floor

Sponsor: Section of Intellectual Property Law

The Magna Carta addressed and memorialized the right of people to own property within the current times of its signing in 1215. Many key concepts within the Magna Carta are still being followed 800 years later. Do today’s global intellectual property trends, policy and legislation effectively meet the challenges raised by the new media and their practices? A panel of intellectual property law practitioners will examine and discuss the areas of concern within today’s current practices. Specifically, concepts that will be addressed include: 1. Patent Reform – adequate enforcement vs. protection against meritless lawsuits 2. Online Infringement across Borders – reaching far-off bad actors through enforcement involving their local facilitators 3. Copyright Reform – ensuring that existing legal paradigms extend appropriately to new media and new communications technologies These issues and more will be assessed and discussed to determine if the global intellectual property system of today is effectively meeting its intended objectives.

2:30-4:00 p.m. CLE Session: The Enduring Influence of the Magna Carta on Contemporary Constitutions

Grosvenor House, A JW Marriott Hotel – Albemarle Suite, Mezzanine Floor

Sponsor: American Bar Foundation

This presentation/panel will demonstrate the influence of the Magna Carta today. It is often said that we are in an age of rights, in which various human rights treaties and national constitutions protect citizens from government abuses. Researchers at the Comparative Constitutions Project have collected data on features of all written constitutions since 1789, and many earlier constitutional texts as well, showing the great diversity of constitutional arrangements. This presentation will show that a surprisingly high percentage of rights found in modern constitutions date back to the earlier period, and that the Magna Carta rights in particular remain among the most popular today. They are among very few rights found in the vast majority of contemporary constitutional texts, and can thus be considered the universal core of modern constitutions. The Magna Carta marks the beginning of English constitutionalism, but has continuing relevance all over the world.

The first bus will depart at 12:15 PM and should arrive in London no earlier than 1:30 PM. The last ABA bus will depart Runnymede promptly at 1:30 PM. Due to security precautions, luggage may not be brought to Runnymede or stored on the buses. For those that have early afternoon flights, it is strongly suggested that you arrange for private transportation to and from Runnymede. You may contact Pamela Laycock at SPECTRA to get a quote [email protected] or work with your Hotel Concierge. It is important to remember that you must arrive at Runnymede, clear security and be seated by 8:45 AM. Private cars with drivers will drop you off at a parking lot near the Pleasure Grounds, about a mile and a half away from the event site. There will be trams for transporting you to the security area from the parking lot and you will need to arrange with your driver for an agreed upon departure time at the Pleasure Grounds parking lot. Your car and driver may not be able to stay in the lot, but instead be sent to a remote area to be held until you call the driver to pick you up. You may depart the event at any time and it is suggested that you give yourself about an hour to call your driver, take the tram back to the lot, meet your car and driver and leave for Heathrow, which is about 5 miles away. Delays may be caused by the movement of Royals and other dignitaries.

You may of course have your luggage held with your private car and driver. C40

New Bus Service added from Runnymede to the London Heathrow Airport We just received approval from Surrey Council Security to allow a limited number of buses with luggage to drop off our attendees at Runnymede and after the event, continue onto London Heathrow International Airport. This allows us to offer bus service at the conclusion of the Runnymede events to Heathrow for those registrants with late afternoon flights.

To sign up for this service, go to the SPECTRA desk located at the ABA registration area at The Grosvenor House Hotel (Great Room Balcony) during normal ABA registration hours, to reserve a spot for you and each of your registered guests. There is a charge of £40.00 per person at the time of your booking and you will also be asked to provide your flight information (including airline carrier and departure time). The ABA Runnymede Heathrow Express Bus service must be booked no later than 6:00 p.m. on Saturday, June 13. Due to space limitations, no further extensions will be provided. On June 15, meet with your tagged luggage at the Park Lane entrance of The Grosvenor House, a JW Marriott Hotel by 6:30 a.m. for a 6:45 a.m. departure. You wil receive luggage tags at the time of purchase, which will identify the terminal from which your flight will be departing. Please be ready for departure from Runnymede at 12:15 p.m. Your bus guide will indicate on arrival where to rejoin the bus at Runnymede. Please note that the bus WILL NOT wait for any late comers either on departure from the hotel or departure from Runnymede. Please affix the tag given to you upon payment to the bag. Please note the arrival times of the buses at London Heathrow Airport to make sure you have enough time to arrive before your flight. ABA Runnymede Heathrow Express Bus Arrival Schedule Terminal 5 - 01:00 p.m. Terminal 4 - 01:30 p.m. Terminals 2 & 3 - 02:00 p.m. We apologyze for this late notice but we were anxiously waiting for security clearance to offer this service.
