CaseScenario• MariaisanativeofGuatemala.SheismarriedtoJuan,aLawfulPermanentResident.
TheyliveinFloridaandhaveadaughterincommon,Alexandra,whowasborninGuatemalaandis4yearsold.Duringtheirmarriage,JuanphysicallyassaultedandbeatMariamanytimes.Althoughtheyhadbeenmarriedforalongtime,JuanneverfiledthepapersforMariaortheirdaughtertoobtainlegalimmigrationstatus.
• Throughouttheirmarriage,JuanalwaysthreatenedMariabytellingherthatifshecalledthepoliceshewouldbedeportedandhewouldgetcustodyoftheirdaughter.Healsotoldherthepolicewouldnotbelieveherbecauseshewasundocumented.AfterMariawasbrutallybeatenshecalledthepoliceforhelp.Ontwooccasionspoliceresponded,spokeonlytoJuaninEnglish,andleft.ThethirdtimeMariacalledthepolice,Juanhadbrokenherarm.ThepolicearrivedandarrestedJuan,whowaschargedwithfelonyassaultandreleasedonbail.
• MariawasreferredtoafamilylawyerforaprotectionorderandanimmigrationlawyerforVAWA‐relatedimmigrationrelief.Juanfiledfordivorceandcustody,arguingthatMariaisundocumentedandaflightrisk.
• MariaandAlexandracontinuetolivewithJuan,andMaria’sundocumentedstatusmakesitdifficultforhertoearnenoughmoneytosupportherselfandAlexandraiftheyleaveJuan’shome.
