This spring delivered a whirlwind of devastating tornados that brought death, injuries and heartbreak to thousands of people across the Southeast, Midwest and even into Massachusetts. Recovery, as difficult as it is, has begun. The twisted buildings, downed trees, mangled vehicles and infrastructure rubble is being cleared away before recon- struction can be started. The bulk of the debris is being landfilled, but more and more is being recycled in safe, responsible ways. On Saturday, April 16 in Raleigh, North Carolina, a total of 28 confirmed tornadoes ripped through central North Carolina killing 24 people, injured hun- dreds, destroying or damaging thousands of homes and commercial buildings, and knocking down trees and power lines. Five of the tornadoes were listed as EF3, with wind speeds of 136 to 165 mph – the worst tornados the state has seen in more than 20 years. The area in and around Raleigh was one of the hardest hit. As the state capital and second largest city in North Carolina, it has a population just over 400,000 and is known as “The City of Oaks.” The torna- dos killed or damaged many of the city’s famed oak trees. “These tornados were pretty bad. So far we have removed over 200,000 cubic yards of debris from fallen trees from the streets,” said Chris McGee, street superin- tendent for the City of Raleigh, Depart- ment of Public Works. He explained how Raleigh prepared for, and then handled the event after the tornados passed through. “During the first 72 hours, city forces go through the streets and we do cut and shove. We are cutting debris out of the way and shoving it over out of the street to get roads back open for emergency vehicles and allow people to get in and out of their homes. We just deal with the streets and don’t deal with any of the construction debris. That is left up to the property owner and their insurance company.” McGee has responsibility for approximately 1,050 centerline miles of streets. The North Carolina Department of Transportation maintains another 250 miles of streets within the city limits, but relies on Raleigh to clear storm damages. Equipment manufacturers aid in flood relief High-performance equipment from

aggregate, construction and recyclingequipment manufacturers KPI-JCI andAstec Mobile Screens played an impor-tant role in recent flood relief effortsduring an extensive sandbagging opera-tion in Dakota Dunes, South Dakota.

The South Dakota National Guardused a Series 271 Screening Plant,which was engineered and manufacturedat KPI-JCI in Yankton, South Dakota, tofill sandbags that were carried by aUH60 Blackhawk helicopter in anattempt to raise and reinforce leveesalong the Missouri River. The 271KScreening Plant is owned by HaroldGoeden of First Rate Excavate, Inc., inSioux Falls, South Dakota, and was setup by Dean Stalheim, sales representa-tive for General Equipment, a KPI-JCIand Astec Mobile Screens authorizeddealer.

The 271K Screening Plant is a sim-ple-to-use, highly reliable screeningplant capable of processing sand andgravel, topsoil, slag, crushed stone andrecycled materials.

Company president Joe Vig said itwas rewarding to see KPI-JCI equipmentused in such an important disaster reliefmeasure. “The Series 271 ScreeningPlant was designed and manufactured

right here in Yankton,” he said. “Theplant can process up to 250 tons per hourof feed material, making it an optimalmachine to use during this operation.”

Service members from South Dakota’s National Guard use a Series 271 Screening Plant, which was engi-neered and manufactured at KPI-JCI in Yankton, South Dakota, to fill sandbags during recent flood reliefefforts in Dakota Dunes.

AIST presented the 2011 CraneInnovation of the Year Award to John U.Austin, mobile maintenance manager,Gerdau Petersburg, for his paper enti-tled, “Improvement in Operating Effi-ciencies Through Scrap HandlingDevices.”

Austin was hired by Chaparral Steel,now Gerdau Petersburg, in 1999 as amaintenance electrician, and in 2001 hewas promoted to meltshop shift mainte-nance foreman. In 2005, he was given aproject to improve reliability of meltshopcranes, and this opportunity evolved into

the creation of the Cranes maintenancegroup, when Austin assumed responsibil-ity for all cranes in the facility. Then in2010, Austin was promoted to mobilemaintenance manager of all mobile equip-ment at the facility: cranes, trains, loaders,forklifts and automobiles.

2011 Crane Innovation of the Year awarded by AIST

In its first quarter of operation, thesustainable organics program undertakenby Houweling’s Nurseries and Agrominhas diverted 2,156 tons of organic materialfrom Houweling’s greenhouse operationsin Camarillo, California to Agromin’srenewable organics center in Oxnardwhere it was recycled into compost, mulchand soil amendments.

From January 1 through March 31,2011, Agromin processed leaves, vines,coco fiber and tomatoes from Houwel-ing’s, which produces hydroponically-grown, handpicked “tomatoes on thevine,” beefsteak tomatoes, other specialtytomato varieties, as well as seedlesscucumbers. Houweling’s grows its toma-toes and cucumbers hydroponically ingreenhouses on more than 124 acres.

The 2,156 tons of waste would haveotherwise found its way into landfills. Byprocessing the materials into soil amend-ments that are then used locally by farm-ers, landscapers and gardeners, 367 tons ofmethane were kept from entering theatmosphere.

The sustainable organics program ispart of Houweling’s efforts to become azero waste company. In addition to repur-posing its organic materials, the companyuses solar energy and thermal heat collect-ing to provide sustainable energy and heat.Its water recirculation system recaptures,filters and re-circulates its water.

New organicsprogram divertsgreen material

The Miami-Dade County Departmentof Solid Waste Management (DSWM)recently won the 2011 AchievementAward from the National Association ofCounties (NACo). The award was won byDSWM for its Ongoing Curbside Recy-cling Education Campaign.

The DSWM began to transition fromits old dual-stream recycling program tothe new, streamlined, single-stream pro-gram in June 2008. The transition wascompleted by the end of 2008. In the firstfiscal year of the new recycling program,the DSWM collected nearly double thetonnage of recyclable materials as it haddone the last fiscal year of the old program(31,778 tons in FY 2007-08 versus 59,616in FY 2008-09). In FY 2009-10, Miami-Dade curbside recycling customers recy-cled 60,808 tons of glass, plastic,aluminum, steel and paper.

The DSWM’s curbside recycling edu-cation program involves several compo-nents and is done in three languages –English, Spanish and Creole. Print andelectronic advertisements, campaign litera-ture, news articles, presentations, e-mailalerts, educational videos and the internetare all some of the tools used to educateand inform residents about the DSWM’ssingle-stream recycling program.

The DSWM provides curbside recy-cling service to 348,000 single familyhouseholds in the unincorporated areas ofMiami-Dade County as well as all resi-dences in 21 participating municipalities.

Recycling plant fire costs $2 millionA fire at Republic Services’ North

Las Vegas recycling plant in Junecaused an estimated $2 million in dam-ages according to officials.

The smoke from the fire was visibleacross the entire Las Vegas valley.

Fire department spokesperson,Cedric Williams, said flames were

shooting approximately 50 feet intothe air. When firefighters arrived,they found large bales of plastic hadcaught fire.

Employees were able to vacate thefacility and no one was injured.

The fire was ruled accidental.

California Supreme Courtupholds ban on plastic bags

The California Supreme Court ruledthat the City of Manhattan Beach canenforce a local ordinance banning plasticbags in that city. The ruling ends a chal-lenge funded by plastic bag manufactur-ers and paves the way for localgovernments to move immediately toadopt ordinances banning plastic bags.

The court’s unanimous decision in theSave the Plastic Bag Coalition (STPBC)vs. City of Manhattan Beach denies theindustry’s claim that a city must undertakea costly Environmental Impact Report(EIR) prior to adopting ordinances withobvious environmental benefits.

With efforts to ban plastic bagsstatewide temporarily stalled, the court’sdecision will open the opportunity tolocal governments in California to takeon plastic bags.

In the published opinion written byJustice Carol Corrigan, the court states,“Substantial evidence and common sensesupport the city’s determination that itsordinance would have no significant envi-ronmental effect. Therefore, a negativedeclaration was sufficient to comply withthe requirements of the California Envi-ronmental Quality Act.”

The City of Manhattan Beach passedits ordinance in 2008 but has been delayedby litigation in trial and appellate courts.

This victory for plastic bag bansmeans that local governments no longerhave to spend unnecessary time andmoney on EIRs to deal with plastic bag lit-ter for fear of being sued on the grounds ofinadequate environmental review.

Over the last several years, morethan a dozen California cities and coun-ties have adopted bans on plastic bags,including: San Francisco, San Jose,Santa Monica, as well as Los Angelesand Santa Clara Counties. Long Beach,Oakland, Palo Alto and Marin Countyhave adopted ordinances which havebeen challenged by STPBC, a plasticindustry front group.

Several local governments are in theprocess of moving forward or may moveforward with their own plastic bag bansnow that the Supreme Court has ruled infavor of Manhattan Beach, including:

There was a knock at the door. It wasa young boy, about six years old. Some-thing of his had found its way into mygarage, he said, and he wanted it back.

Upon opening the garage door, Inoticed two things: a baseball and abroken window with a baseball-sized

hole. “How do you suppose this ball gotin here?” I asked the boy.

Taking one look at the ball, one lookat the window and one look at me, theboy exclaimed, “Wow! I must havethrown it right through that hole!”

or vice versa, exhibits what is known asthe thermoelectric effect. Thermoelectricdevices can generate electricity whenheated by an external source, or quicklycool or heat their environment when pow-ered with electricity.

“The reason thermoelectric deviceshave so far been limited to niche marketsis that their efficiency is still too low,”explained graduate student Jane Cornett,

Department of Materials Science andEngineering. “The goal of our work is todesign thermoelectric materials that con-vert energy from one form to another moreefficiently so we can promote the wide-spread use of products that recycle wasteheat and effectively reduce our consump-tion of fossil fuels.”

For example, cars manufactured orretrofitted with a thermoelectric deviceplaced around the exhaust pipe can usewaste heat to generate electricity,improving their overall miles per gallon,especially with a power-draining systemlike air conditioning. If the device is toobulky and inefficient, however, it willconsume more energy than it con-tributes.

To tackle the problem, Cornett andher advisor, Professor Oded Rabin,Department of Materials Science andEngineering and Institute for Research inElectronics and Applied Physics, had tochallenge some popular theories.

“Previous models told us that theuse of nanomaterials at small dimen-sions would lead to an improvement inpower generation efficiency,” said Cor-nett. “The models also predicted that thesmaller the nanostructure, the more sig-nificant the improvement would be. Inpractice, people weren’t seeing the gainsthey thought they should when theydesigned thermoelectric devices withnanoscale components, which indicatedto us that there might be an issue withthe interpretation of the originalmodels.”

Cornett and Rabin have presented arevised thermoelectric performancemodel that confirms that smaller is notalways better.

Using advanced computer modelingto investigate the potential of thermo-electric nanowires only 100 to 1000atoms thick (about 1,000 times smallerthan a human hair), they demonstratethat in the set of the tiniest nanowires,measuring 17 nanometers or less inradius, decreasing their radii does resultin the increased thermoelectric perform-ance previous models predict. Innanowires above 17 nanometers inradius, however, an improvement is seenas the radius increases.

“The surprising behavior in thelarger size range demonstrates that a dif-ferent physical mechanism, which wasoverlooked in previous models, is domi-nant,” said Cornett.

“People were looking for solutions inthe wrong places,” said Rabin. “We’ve cre-ated a better understanding of how tosearch for the best new materials.”

Thermoelectric devices are cur-rently used in a few consumer products,including refrigerators and CPU coolersin computers. They could eliminate theneed for fluorocarbon refrigerants, giv-ing rise to fluid and compressor-freecooling systems that pose fewer healthand environmental hazards.

The energy efficiency work at theEmpire State Building, the world’s mostfamous office building, has achievedanother milestone on its journey for sus-tainability leadership in the commercialreal estate community by receiving itssecond ENERGY STAR certificationfrom the United States EnvironmentalProtection Agency. The certification sig-nifies that the property’s energy per-formance is part of a select group ofcommercial office buildings, new andold, across the nation that have receivedthis accolade. ENERGY STAR recogni-

tion was a stated objective in the iconicproperty’s overall sustainability retrofitinitiative launched in April 2009.

EPA takes action on PuertoRico battery recycling facility

The Environmental ProtectionAgency (EPA) has reached an agreementwith The Battery Recycling Company, Inc.in Arecibo, Puerto Rico requiring the com-pany to prevent lead contamination fromleaving the facility on the work clothesand vehicles of company employees andclean up an adjacent property. The BatteryRecycling Company recycles used motorvehicle batteries and produces approxi-mately 30 tons of lead per day. Amongapproximately 150 children tested whomay have been exposed to lead from theBattery Recycling facility, 20 percent havelead in their blood above levels considereda problem among health professionals.

The agreement is the latest in aseries of actions EPA has taken sincebecoming aware of extensive lead con-tamination in the cars and homes ofworkers at the Battery Recycling Com-pany. EPA is working closely with theUnited States National Institute of Occu-pational Safety and Health, the UnitedStates Centers for Disease Control, theAgency for Toxic Substances and Dis-ease Registry, the Puerto Rico Depart-ment of Health, the Puerto RicoEnvironmental Quality Board (EQB),and the Puerto Rico Occupational Safetyand Health Administration to addresshealth and environmental concernsrelated to lead contamination from thefacility. Operations at Battery Recycling

are being investigated under multipleenvironmental laws.

The EPA agreement requires multiplepreventative and cleanup actions by thecompany to prevent lead from being trans-ported to employees’ vehicles and homesfrom the facility. EPA has hired an expertto review facility operations and providerecommendations to the company onmethods to keep lead from leaving theproperty. In the short term, workers willhave access to a clean area for changingclothes and lockers to prevent them frombringing lead into their homes and cars.The company will install a temporarydecontamination station for vehicles enter-ing and leaving facility processing areas.Battery Recycling will also clean lead-contaminated vehicles and homes of cur-rent and former employees and EPA willtake samples after the cleaning to ensurethat the lead has been removed. Rentalcars will be provided and employees andtheir families will be temporarily relocatedwhile the cleaning takes place.

In addition, Battery Recycling willexcavate and remove lead-contaminatedsoil from a cattle pasture adjacent to thefacility, backfill or restore the land, anddispose of any contaminated materials at alicensed disposal facility. The agreementalso requires the company to reimburseEPA for the costs of overseeing thecleanup work.

much anything you can use to push, pullor cut what we have out there,” saidMcGee.

By the end of the second day, 99 per-cent of the streets were cleared. By thethird day most everything was passable,although a few streets took several days toopen because of power line issues.

“After the first 72 hours we call in ourpre-positioned contractor, Phillips & Jor-dan, a debris management company basedin western North Carolina. We put out anRFP two years ago, got bids and structureda contract based on that. Basically, thecontract says that if we have an event, thecontractor guarantees they will be herewithin 24 hours of us giving him a phonecall. They have to roll in with a certainnumber of forces and start removingdebris at a certain rate over a certain num-ber of days.”

Contract crews work 12 hour days, 6days per week removing the cut and shovematerial because it is not safe to cut andload at night. “For the first 70 hoursFEMA (Federal Emergency ManagementAgency) will pay us 100 percent for thecut and shove operation and we workaround the clock. After that the only waywe get a 100 percent recoup of our fundsis if we do it by contract. During the first70 hours if my guys go out and do thepickup, FEMA won’t reimburse me 100percent, whereas if Phillips & Jordan picksup the material we get 100 percent reim-bursement from FEMA,” McGeeexplained.

Raleigh uses a temporary, permitteddumpsite to receive vegetative debris.There the debris is ground up and shippedout to be further processed into bagged

mulch, or sent to local co-generationplants to make electricity.

The most destructive tornado of theyear struck Joplin on May 22. The EF-5rated tornado with wind speeds exceeding200 mph tore through the city of 50,000 tobecome among the deadliest in thenation’s history.

Recently, two more names wereadded to the list bringing the death toll to153. About one-third of the city was eitherseverely damaged or completelydestroyed. News estimates say that at least75 percent of the city has been damaged tosome extent.

David Bryan, spokesman for UnitedStates Environmental Protection Agency(EPA) Region 7 described the aftermathfrom the Joplin mobile command center,“With the volume of materials that we aregoing to have to deal with from this partic-ular event, there’s been quite a bit of inter-est. We are talking about a tornado path of8 to 10 miles of almost a half mile acrossof just absolute destruction.”

EPA Region 7 personnel, includingproject coordinators, technical experts andother support personnel are on site andinvolved in several disaster responseefforts in the Joplin area being coordinatedby FEMA.

EPA and U.S. Army Corps of Engi-neers (USACE) recently began tornadodebris collections. All construction anddemolition debris (C&D) and vegetativematerial being removed by USACE con-tractors is being kept separate from house-hold hazardous waste, white goods andelectronic equipment, which are beinghandled by the EPA.

Due to Joplin’s proximity to southeastKansas landfills, they are the preferredsites over ones in Missouri to handle thevegetative and C&D debris. The KansasDepartment of Health and Environment

(KDHE) estimates that landfills in Chero-kee and Crawford counties will receivebetween two to three million cubic yardsof C&D waste from Joplin. KDHE isworking with the Army Corps and theMissouri Department of NaturalResources to ensure proper disposal ofC&D waste, which includes wood, insula-tion, electrical wiring, rebar, concrete andbricks. Vegetative waste is being managedat a site in Missouri where chipping isbeing used and material recycled.

USACE intends to haul several hun-dreds of loads of debris per day toKansas landfills with expectations ofcompleting most debris removal and dis-posal by mid-August. To ensure safe dis-posal of C&D waste, KDHE’s Bureau ofWaste Management is monitoring land-fill operations. Landfills receiving C&Dwaste are following enhanced wastescreening procedures to ensure thatunauthorized waste is not disposed.

“The collaboration by state agen-cies, local government officials, theArmy Corps and landfill owners hasyielded creative solutions to help maxi-mize the use of Kansas resources inhelping the cleanup efforts in Joplin,”said Bill Bider, KDHE’s director ofwaste.

Bryan reported on the EPA cleanupeffort, “We are not doing constructiondebris or vegetative matter, that’s theArmy Corps. One of the normal disasterresponses for EPA is handling householdhazardous wastes, white goods and elec-tronics.”

“When we have fertilizers, pesti-cides and things like that, we turn thoseover to a company that handles thosetypes of hazardous materials for dis-

posal. These are regulated materials sothere are certain ways they have to behandled. We use certified contractorswho take those materials. For any typesof oils, gasoline and inflammable liquidswe actually supply to bulk handlers whosell that as waste oil or other propertiesthat can be used for their BTU effect.There are probably a half dozen moreways that that we are tracking hazardouswaste trying to make sure that things areeither recycled, remanufactured orreused.”

“With most of the appliances weget, we work with a company that han-dles these goods. When we come into asituation like Joplin we find a companythat does remanufacturing and will takethis on. EPA contractors remove oils,refrigerants and the like and we do whatwe can to make sure they are reused.Remanufacturers will also take damagedrefrigerators, washers, dryers, stoves andtake them completely apart for the cop-per and other metals.”

“For the electronic goods we makesure they are recycled with the rulesassociated for computers and TVs andthings like that. We want to make surethat we have a certified contractor that iseither going to remanufacture, or dis-pose in the proper way.” MRC Recy-cling, a Missouri state certified recyclingcontractor picked up the first two truck-loads of electronic goods on June 13 fordelivery to their processing plant in ParkHills, Missouri.

“In most cases it’s a benefit becausecontractors will take materials off ourhands, sometimes for freight charges;sometimes they come and get it. Sothere’s a trade-off. They get the materi-als and we get proper disposal. It’s agive and take system involving differentaspects of what we recover and what werecycle. We want to make sure thateverything we get has been properlyreused, recycled or remanufactured.We‘ve had good cooperation from ourcontractors,” Bryan concluded.

These are the type of recycling jobsthat no one expected nor wanted, butgovernment agencies, volunteer groupsand private recyclers are working hard toclean up these cities in an environmen-tally responsible way.

ALTERNATIVE ENERGYWaste Management opensfirst public CNG fuelingstation in New Jersey

Waste Management of New Jerseycelebrated the grand opening of the firstpublic-access compressed natural gas(CNG) fueling station in Camden andannounced plans to convert its regionalfleet to this clean-burning, environmen-tally-friendly fuel.

The new “Clean N’ Green Fuel” pub-lic fueling station, to be operated by Petro-Card, is the first such facility in CamdenCounty and will sell CNG to commercialfleets as well as individuals with CNG-equipped vehicles, at prices typically one-third below the cost of gasoline and diesel.In addition to cost savings, the Departmentof Energy estimates that the use of CNGreduces particulate matter emissions by 86percent, carbon monoxide emissions by 80percent, nitrogen oxide emissions by up to32 percent, and greenhouse emissions by25 percent. As an additional benefit, CNGtrucks run 50 percent quieter than dieseltrucks.

Waste Management of New Jerseyrecently acquired 14 CNG collectiontrucks and expects to have 45 CNG vehi-cles in service by the end of the summer,representing nearly half its Camden-basedfleet and covering routes in Camden,Burlington and Gloucester Counties.

Deploying these vehicles will help WasteManagement achieve its sustainabilitygoal of reducing fleet emissions by 15 per-cent and increasing fuel efficiency by 15percent by 2020. Waste Management cur-rently operates the largest fleet of CNGrecycling and waste collection trucks inNorth America.

CNG is sold in gasoline gallon equiv-alents (GGEs), with each GGE having thesame energy content as a gallon of gaso-line. Vehicles using CNG typically havesimilar or better fuel economy ratings thanstandard gasoline or diesel vehicles. Cur-rent pricing at the Camden “Clean N’Green Fuel” station is in the range of$1.759/GGE. The self-service station willbe open 24/7 and will accept major creditcards as well as PetroCard fleet cards.

Diesel and gasoline have jumped 40percent in price over the past year despiteflat demand. In comparison, CNG is adomestically sourced fuel with stable sup-plies and more predictable long-term pric-ing.

The Camden CNG fueling facilitywas built by Clean Energy. Constructionwas funded by Waste Management andPetroCard with financial assistance fromthe New Jersey Clean Cities Coalition.

TVA expands renewableswith solar and landfill gas

A solar power facility in Tennesseeand a landfill gas-to-energy site in Mis-sissippi have joined the Tennessee ValleyAuthority’s (TVA) growing initiative formid-size renewable energy generatorssupplying green power to TVA.

Sharp Manufacturing Co. of Amer-ica’s solar site in Memphis and WasteManagement Renewable Energy’s land-fill gas facility in Houston, Mississippiare TVA’s latest Renewable StandardOffer projects.

Started last fall, TVA’s RenewableStandard Offer pays renewable energygenerators based on the time of day thepower is produced and the demand onthe TVA system. The initiative is open togenerators with a capacity of up to 20megawatts using biomass, methanerecovery, wind or solar energy sources.No single technology can exceed morethan 50 percent of the program’s totalcapacity of 100 megawatts.

The Renewable Standard Offercomplements TVA’s Generation Partnersprogram, which purchases power fromsmaller generators with a capacity of upto 200 kilowatts at varied rates.

The Sharp solar project in Mem-phis, with a capacity of 201 kilowatts, or0.2 megawatts, began producing elec-tricity in June. The power will connectto the TVA system through MemphisLight Gas and Water. Sharp also is aTVA Generation Partner and operatesother solar generation facilities at itsMemphis plant site.

Waste Management’s landfill gasfacility will provide 1.6 megawatts ofcapacity from methane produced at thecompany’s Prairie Bluff RenewableEnergy Facility. Generation at the site isscheduled to begin in March 2012. Thepower distributor is Natchez Trace Elec-tric Power Association.

The Houston, Mississippi, project isWaste Management’s second RenewableStandard Offer site and the third overallin the TVA program. The company’s 4.8megawatt-capacity landfill gas facility inCamden, Tennessee, became TVA’s firstprogram participant in January. It isscheduled to begin delivering power inSeptember through Benton County Elec-tric System in Camden.

Bids sought for largest solar installationAlready the nation’s largest munici-

pally owned user of wind energy, SanAntonio’s CPS Energy signaled its intentto build what would be the largest solarinstallation in the United States, notify-ing bidders that an originally proposed

50 megawatt project has been expandedto potentially 400 megawatts.

The project would be 4 times largerthan what is currently the largest solarinstallation in the world, a 97 megawattproject in Ontario, Canada.

First Wind announced a Power Pur-chase Agreement (PPA) with NewBrunswick Power to sell all of the energyfrom First Wind’s Mars Hill wind farmsite. The four year deal replaces the PPAset to expire in December of this year.Mars Hill’s energy output will stay localand be distributed to homes and businessesin Northern Maine by New BrunswickPower, which won the opportunity earlierthis year to provide standard offer serviceto all customer classes in Northern Maine.At the time, the Maine Public UtilitiesCommission called the 10-21 percent pricedecreases under NB Power’s standardoffer supply a “sharp reduction” in elec-tricity prices.

“Ratepayers and businesses in Mainewill be the direct beneficiaries of this deal.Northern Maine consumers have seen their

electric bills go down, and locally-pro-duced wind power is one of the energysources being used,” said Michael Alvarez,president and CFO of First Wind.

Mars Hill Wind, which features 28turbines with the capacity to generate up to1.5 Megawatts (MW) each, was the firstutility-scale wind energy project in NewEngland. The 42 MW project was com-missioned on March 27, 2007. The priorPPA entailed the power being sold to NewBrunswick Power, and then to ISO-NewEngland, where it was distributed to NewEngland homes and businesses.

The new arrangement will distributethe power directly to local ratepayers inNorthern Maine. The transmission feesthat First Wind has been paying – $1 mil-lion per year since 2007 – will continue tobe paid under this new arrangement.

Partnership formed toturn recycled plastics to oil

Greenstar Recycling, Houston, Texas,has signed a Memorandum of Understand-ing to form a joint venture with VadxxEnergy, LLC, Cleveland, Ohio, to convertrecovered plastic into synthetic crude oil.Through this joint venture, Greenstar andVadxx will work to provide a domesticfuel while repurposing recovered plastic.

“Vadxx will help us recover plasticsfrom the material stream and repurposethem as feedstock for the production ofoil,” said Matt Delnick, Greenstar chiefexecutive officer. “This joint venture willincrease recovery rates by pulling moreplastics out of landfills.”

Using proprietary processes, Vadxxmanufactures synthetic crude oil andnatural gas by using raw material feed-stock consisting of petroleum-basedplastics in a process called thermaldepolymerization. Greenstar choseVadxx as its partner in plastics to energybecause of Vadxx’s potential to scale tocommercial size and capacity based onVadxx’s continuous feed process, flexi-ble design and expandable system.

Greenstar and Vadxx expect that thejoint venture will begin producing crudeoil in mid-2012 with the target locationfor the project in Ohio.

Nebraska awards over $1 millionfor tire collection and clean up

Nebraska Department of Environ-mental Quality (NDEQ) director MikeLinder said that the state is awarding $1.15million to support 63 tire recycling andclean up projects across the state.

“Nebraskans pay a $1 fee for everynew tire they purchase,” said Linder.“These grants put that money into uselocally to help manage scrap tires.”

Nebraskans generate over one and ahalf million scrap tires each year, about

one tire for every person in the state. Thegrants awarded will reimburse individualsand organizations for crumb rubber andequipment purchases, and will help pre-vent public health and environmentalproblems by eliminating tire piles, Lindersaid.

The grants are part of the WasteReduction and Recycling Grants program,which is administered by NDEQ. Thegrants support both the collection of scraptires and the purchase of new tire-derivedproducts. 2011 grant recipients include:

•Sidney High School – $28,968 topay 25 percent of the cost of an athleticrunning track surface.

•Lincoln Pius X High School –$74,123 to pay 25 percent of the cost of anartificial turf football field.

“This action is a necessary first stepin realigning the box plant system ofRockTenn following the acquisition ofSmurfit-Stone. We plan to take manyactions in the next year to maximize theefficiency of our manufacturing processesas well as to reduce costs and eliminateredundancies throughout our operations aswe move forward to achieve the operatingsynergy that we anticipate from the Smur-fit-Stone acquisition,” stated Jim Rubright,chairman and chief executive officer.

The American Forest & Paper Asso-ciation released its May 2011 UnitedStates paper reports. Containerboardproduction rose when compared to April2011, with month over month averagedaily production up 0.3 percent. Thecontainerboard operating rate for May2011 was down 1.5 points over May2010 to 93.8 percent.

Additional key findings from thereport include:

•Linerboard production decreasesover last year.

•Medium production rose slightlyover May 2010.

The paperboard report indicatedthat total boxboard production decreased

by 1.5 percent compared to May 2010,but increased 1.0 percent from lastmonth.

•Unbleached Kraft Folding produc-tion increased over the same month lastyear, and increased over last month.

•Solid Bleached Boxboard andLiner production decreased over May2010.

•The production of Recycled Fold-ing decreased compared to May 2010,but increased when compared to lastmonth.

•Inventory of Solid Bleached KraftPaperboard fell in May.

South Carolina Governor NikkiHaley, the South Carolina Departmentof Commerce, Berkeley County and theCharleston Regional DevelopmentAlliance said that Tire International, atire recycler and maker of rubberproducts, is establishing a newrecycling and manufacturing facility inBerkeley County. The $25 millioninvestment is expected to generate 150new jobs.

Tire International has established athird-generation recycling and manufac-turing operation in Moncks Corner. Thecompany is currently in the process ofupgrading its facility there to preparefor full operations. The company previ-ously based its tire recycling and rubbermanufacturing work in China, but nowis bringing all of those operations toBerkeley County.

Gov. Nikki Haley said, “Tire Interna-tional’s $25 million job-creating invest-ment in the Lowcountry – that is expectedto generate as many as 1,000 jobs – issomething we’re going to celebrate.”

At the plant, Tire International willrecycle tires by breaking them down intoraw materials and will produce finishedconsumer products including environ-mentally responsible and high qualitycommercial and residential flooring,artificial fields, playgrounds, landscap-ing materials and rubberized asphalt.

Tire International will be rampingup during the summer and fall andexpects to have the plant fully opera-tional by the end of the year. The com-pany plans to begin hiring for the newpositions at the end of September andwill work with readySC during the hir-ing process.

Based on the Commerce Depart-ment’s most recent Steel Import Moni-toring and Analysis (SIMA) data, theAmerican Iron and Steel Institute (AISI)reported that steel import permit applica-tions for the month of June totaled2,734,000 net tons (NT).

This was a 3 percent decrease fromthe 2,807,000 permit tons recorded inMay and a 2 percent increase from theMay preliminary imports total of2,692,000 NT. Import permit tonnage forfinished steel in June was 2,109,000 NT,up 15 percent from the preliminaryimports total of 1,838,000 NT in May.The estimated finished steel importmarket share in June was 23 percent, andthe year-to-date share increased to 22percent.

In June, the largest finished steelimport permit applications for offshorecountries were for Korea (318,000 NT,up 49 percent from May), China(154,000 NT, up 29 percent), Japan(141,000 NT, up 8 percent), Russia(100,000 NT, up 102 percent) andTurkey (94,000 NT, up 36 percent).

Finished steel import permits formajor products that registered increasesin June versus the May preliminaryinclude sheet and strip – all other metal-lic coated (up 90 percent), reinforcingbar (up 64 percent), cut length plates (up40 percent), line pipe (up 24 percent),cold rolled sheets (up 22 percent), oilcountry goods (up 17 percent) and platesin coils (up 17 percent).

Aluminum can recyclingrate reaches highest levelin more than a decade

The United States recycling rate foraluminum beverage cans has reached itshighest level in a decade, with 58.1 per-cent of all cans recycled last year – a ratethat is nearly double that of any otherbeverage container, according to theAluminum Association, Can Manufac-turers Institute (CMI) and Institute ofScrap Recycling Industries (ISRI).

Nearly 56 billion aluminum canswere recycled in 2010, leading to a usedbeverage container (UBC) recycling rateof 58.1 percent — the highest in 11years. Because it takes 95 percent lessenergy to produce a can from recycledmaterial, the high recycling rate alsoresulted in significant energy savings.The amount of energy saved just fromrecycling cans in 2010 is equal to theenergy equivalent of 17 million barrelsof crude oil, or nearly two days of allUnited States oil imports.

“There’s a huge difference betweenwhat’s recyclable and what’s actuallyrecycled,” said CMI president RobertBudway. “Not only are cans infinitelyrecyclable back into new cans, they actu-

ally are being recycled at a rate nearlytwice that of every other beverage pack-age. This, coupled with the fact that alu-minum cans have the highest recycledcontent and provide the longest shelf lifeof any beverage package, underscoreswhy the can truly is the sustainable solu-tion for twenty-first century packaging.”

“As the first link in the manufactur-ing supply chain, the scrap recyclingindustry provides vital feedstock mate-rial sought after by industrial customersaround the world, including more than4.6 million metric tons of aluminumscrap processed in the United States andshipped throughout the United Statesand more than 50 countries in 2010,”said Robin Wiener, president of theInstitute of Scrap Recycling Industries.

In 2008, the Aluminum Associationadopted a goal of recycling 75 percent ofaluminum cans by 2015. The recyclingrate at that time was 54.2 percent, and ithas been gradually climbing upwardsince then; the 2009 UBC recycling ratewas 57.4 percent.

April 2011 steel shipments down9.3 percent from March 2011

The American Iron and Steel Insti-tute (AISI) reported that for the monthof April 2011, United States steel millsshipped 7,258,534 net tons, a 9.3 percentdecrease from the 8,006,016 net tonsshipped in the previous month, March2011, and a 2.8 percent increase fromthe 7,057,660 net tons shipped in April2010.

Shipments year-to-date in 2011 are29,760,685 a 7.8 percent increase vs. 2010shipments of 27,575,482 for four months.

A month-to-month comparison ofshipments shows the following changes:hot dipped galvanized sheet and strip,down 6 percent, hot rolled sheet, down 11percent, and cold rolled sheet, down 15percent.

The Marion County Prosecutor’sOffice (MCPO) has dismissed all criminalcharges and resolution of civil lawsuitspending against OmniSource Corporation.

Marion County Prosecutor TerryCurry said, “The judge in the pendingcriminal case has ruled that OmniSourcewas improperly charged as a corrupt busi-ness enterprise under Indiana’s law. Hav-ing now carefully reviewed the case,which was initiated by Grand Jury indict-ment under my predecessor, I can say thatthe evidence does not support those allega-tions. There is simply insufficient evidencethat OmniSource or its employees know-ingly engaged in any unlawful transac-tions. This office, therefore, will dismissall pending litigation, and all moneyseized from OmniSource by criminal

investigators will be returned toOmniSource; subject to the terms of theagreement below.”

OmniSource and the MCPO will,instead, work cooperatively together,building upon OmniSource’s training andinternal anti-theft programs and proce-dures, to see mutually beneficial ways toenhance the detection, identification andprosecution of metal thieves in MarionCounty, Indiana, and to develop a moreeffective means, through enhanced lawenforcement, local scrap dealer trainingand advocating for various legislative andlocal ordinance initiatives, to deprivemetal thieves in our county of a market fortheir ill-gotten goods. This might includesuch things as state law or local ordinancestrengthening regarding possible bans on

purchasing certain items, such as automo-bile catalytic converters, clearer defini-tions of what constitutes a “vehicle”requiring the presentation of a title, andrequiring that transactions above a certaindollar amount be paid for other than incash.

“I also want to make clear,” continuedCurry, “that there is no evidence that anyof the Indianapolis Metropolitan PoliceDepartment officers who worked part-timefor OmniSource at its retail facilities aspart of its anti-theft program wereinvolved in any kind of criminal activity.During their service, dozens of arrestswere made and police reports filed. Thereis no evidence that officers either con-doned or facilitated the sale of stolengoods.” Subject to current guidelines and

the approval of the Department of PublicSafety, OmniSource will resume theirpart-time off-duty scrap theft interdictionpositions with OmniSource.

OmniSource and the MCPO will alsojointly train scrap company employeesthroughout Marion County, as well as lawenforcement officers and property crimeprosecutors in how to spot potentiallyproblematic materials offered for sale,how to properly question the would-besellers as to the circumstances surroundingtheir possession of such goods, how tomake responsible purchase determina-tions, and how to properly preserve poten-tial evidence, including a record of whothe seller was, should it turn out that pur-chased materials were in fact stolen.

Indiana prosecutor dismisses all OmniSource charges

The Nucor Strength of Steel Chal-lenge launched on February 22, 2011, dur-ing National Engineers Week. TheChallenge is an effort to encourage middleand high school students to considerSTEM (Science, Technology, Engineeringand Math) disciplines as a course of studyand career choice.

Currently, students in the UnitedStates perform below students from otherindustrialized countries on internationaltests of math and science. This presentsserious challenges to future economicgrowth and employment since jobs requir-

Olympic Steel, Inc. completed theacquisition of all of the outstanding sharesof Chicago Tube and Iron Company (CTI).

Give your banker what they want.Ron: I always tell entrepreneurs

that they have to be prepared to lift thekimono a bit. This means letting thebanker look in. They need to be pre-pared to explain to [the banker] what’sunder there.

Greg: Entrepreneurs get con-cerned about doing that, but bankshave rules that prohibit them fromtelling others what they have seenunder your kimono. Bankers can befired very easily for having loose lips.

Ron: The banker doesn’t want tohear SWAGs or WAGs. A SWAG is aScientific Wild-Ass Guess and a WAGis a Wild-Ass Guess.

The banker doesn’t want to hearthat someone needs a loan because theeconomy is bad or they’re getting adivorce or the weather’s been bad. Thebanker needs to hear legitimate rea-sons why business is down or off –along with solutions.

In a declining market, the busi-nessperson has to figure out how towork harder or smarter to keep thebusiness going. Most business ownerskeep doing what they’ve been doing,so they keep getting what they’ve beengetting or worse.

Greg: That’s a good point. Do notgo into a bank whining about the econ-omy. A banker should know if theeconomy is bad; but when a customercomes in and is all gloom and doom,the banker doesn’t want to hear it. Ifthere’s a problem, I want to knowabout it, but don’t come in just to tellme how bad the economy is.

I also want to know that customersare beating the street. I want them tohave an air of confidence about theirplans. That’s going to go a long way.And don’t confuse confidence witharrogance.

Ron: You want them to come inwith solutions, not problems! My oldboss at Ford Motor Co., Dixon Thayer,liked to say he was positively dissatis-fied with results. He was all about pos-itive energy, but knew we could domore.

Greg: Exactly. Show me the baby,not the labor pains. That’s what I wantto see.

Ron: The banker also likes to seebusiness owners who surround them-

selves with people who are smarter orbetter than the business owner is. Thesmart people on your team are there todo things that you can’t, won’t orshouldn’t be doing. If you aren’t goodat financials, get help from someonethat is. It’s important to show that thereare good people on your team. I cannotemphasize the importance of thisenough!

For example, there was a timewhen I realized (after much handwringing, as I was so frugal) I shouldquit paying a bookkeeper and spendthe extra money to hire a controller. Iwent from paying a bookkeeper$40,000 a year to paying a controller$75,000 a year, but our company madethe entire $35,000 back in less than 60days because he isolated and identifiedexpenses we could cut.

Ron says that if you figure intwice as much time and twice as muchmoney as you think you will need, youmight be safe. But entrepreneurs seemto always “breathe their own exhaust,”and they become infatuated with theirown ideas.

That’s why it’s so important tohave someone else that is capable andobjective to review your plans. Youneed someone who is willing to tellyou how it is (and not what you wantto hear).

ELECTRONICSVermont adopts lampproducer responsibility law

Vermont Governor Peter Shumlinsigned into law a bill requiring manufac-turers of mercury-containing lamps toestablish and finance a recycling pro-gram for spent bulbs from residents andsmall businesses. Vermont became thethird state in the country to establishsuch an extended producer responsibility(EPR) program.

The Governor said the new law is animportant environmental measure, key inhelping protect Vermont’s waterwaysand natural environment from the prob-lems associated with mercury pollution.Under the new law, recycling costs willbe paid by the manufacturer, consistentwith other product stewardship legisla-tion enacted in Vermont and around thecountry.

Mercury-containing lamps, such ascompact fluorescent bulbs, have signifi-cant benefits in terms of energy effi-ciency and cost-savings.

However, these bulbs alsocontain small amounts of mercury – aknown neurotoxin – which makesproper recycling of the lamps criticallyimportant.

Along with earlier laws passed inMaine and Washington, the approachtaken in Vermont provides a financiallysustainable means of preventing therelease of mercury into the environmentby recycling lamps and keeping themout of landfills and incinerators. Thisindustry funded approach will beincreasingly important as state and localagencies around the country face grow-ing budget cuts, while anticipatingincreased use of CFLs under new federallighting efficiency standards, scheduledto take effect in 2012.

There are more than 60 state pro-ducer responsibility laws around thecountry that require product manufactur-ers to provide for the collection andrecycling of electronics, mercury ther-mostats, mercury auto switches, andother products that cause unintendedenvironmental impacts if not properlymanaged. Additionally, like Vermont’snew law, laws requiring mercury contentstandards have been adopted in Califor-nia and Maine, modeled after new stan-dards recently adopted by the EuropeanUnion.

E-Waste export bill to stopglobal e-waste dumping

United States Representatives GeneGreen (D-TX) and Mike Thompson (D-CA) introduced new legislation – theResponsible Electronics Recycling Act - tostop sham United States recyclers fromdumping electronic waste on developingcountries and to promote recycling jobs athome. The bill is supported by environ-mental groups as well as electronic manu-facturers, all of which already havepolicies that prohibit the export of e-wasteto developing nations. The bill also hasbipartisan support, including sponsorsReps. Steven LaTourette (R-OH) and LeeTerry (R-NE).

The bill addresses the toxic exposurescaused by e-waste dumping and primitiverecycling operations in countries likeChina, India, Nigeria and Ghana, whichhave been the subject of recent mediaexposés, and a scathing report by theUnited States Governmental Accountabil-ity Office (GAO).

Twenty five states have passed e-waste recycling legislation, but these lawsdo not ban e-waste exports, which is aninternational trade issue, and not the con-stitutional jurisdiction of the states. OnlyCongress has the authority to legislate thismuch needed restriction.

Currently, electronic waste isexported to developing countries by manycompanies that claim to be recyclers, to bebashed, burned, flushed with acids, andmelted down in unsafe conditions in devel-oping countries. Eighty percent of childrenin Guiyu, China, a region where many

“recycled” electronics wind up, have ele-vated levels of lead in their blood, due tothe toxins in those electronics, much ofwhich originate s in the United States. Theplastics in the imported electronics aretypically burned outdoors, which can emitdeadly dioxin or furans, which arebreathed in by workers and nearby resi-dents.

The bill establishes a new category of“restricted electronic waste” which cannotbe exported from the United States todeveloping nations. Used equipment canstill be exported for reuse as long as it’sbeen tested and is fully functional. Non-hazardous parts or materials are also notrestricted. Other exemptions from therestrictions are:

•Products under warranty beingreturned to the manufacturer for warrantyrepairs;

The acquisition introduces VeoliaES Solid Waste, Inc.’s hauling opera-tions to Bay County including PanamaCity and surrounding areas where it willserve both residential customers andcommercial customers.

The word “dumpster” has evolved tomean different things to different people.For our purposes let us understand it as abroad, generic term for an ever expand-ing universe of large trash receptacleslifted by mechanical means and dumpedinto vehicles. The word dumpster origi-nated from the Dempster-Dumpster sys-tem of mechanically loading standardcontainers onto garbage trucks. It waspatented by Dempster Brothers in 1937.

Today, a dumpster can refer tocapacities of less than a cubic yard up toroll-off containers exceeding 100 cubicyards. They come in shapes and sizesonly limited by the imaginations of theirdesigners.

The more trash generated the moredumpsters we need and we apparentlyalways need more. In 1960, the per capi-ta generation of waste was 2.68 poundsper person per day, but by 2009 it grewto 4.34 pounds per person per day. 2010per capita data waste volume has not yetbeen posted by EPA, but industryexperts believe volume has flattened andsomewhat decreased.

Waste Management, Inc. (WM) thelargest solid waste collection company inNorth America, for example, reported its2010 internal revenue growth from vol-ume was negative 2.6 percent, althoughrevenues increased by 6.1 percent.

The lingering recession is partiallyresponsible for some volume fall off, but

much of the reduction is due to morewaste being transformed into useful ormoney-making commodities. “Whatwe’ve seen is more of a move towardsdiversion. The amount of waste volumecurrently going to landfill has declinedsimply because there is more diversiongoing on,” said Wes Muir, spokesmanfor WM. “Whether or not it’s because ofregulations, or because a company rec-ognizes waste as a resource and wants todivert the material and cut down on dis-posal costs, it’s all coming under thelabel of eco-efficiency.”

Guy Senkowski, the owner ofPoynette Iron Works in Poynette, Wis-consin, a manufacturer of a wide varietyof dumpsters and related waste contain-ers, and his two brothers started thebusiness in 1996 in a 2,400 sq. ft. build-ing refurbishing old dumpsters to extendtheir useful life. Today, Poynette hasannual sales of $16 million, 70,000 sq.ft. of manufacturing space on a 13 acrecomplex, employs 68 and offers a menuof over 40 different product categorieswith hundreds of individual items.Poynette has built dumpsters as small asquarter-yard hoppers to as large as a 107yard roll-off trailers. The companyserves all types of customers – residen-tial and commercial haulers, municipali-ties, specialized industrial applicationsand small and large retailers.

“The recession really did not affectus. A little bit of a slowdown but nothingof concern. We got darn lucky there.Since 1996 we’ve just seen a ton of

growth, about a million dollars a year,”said Senkowski.

Senkowski attributed their contin-ued growth through a tough economy tohis company’s products and customerservice. But major cultural and environ-mental developments have undoubtedlyhelped. Over the past two decades there

has been a strong national demand fordiversified dumpster types for segregat-ing various recyclables to attain a finer,cleaner granulation at the collectionpoint.

The owner of a New Jersey solidwaste management company and threeof his associates were arrested on feder-al charges that they conspired to trans-port and dump thousands of tons ofasbestos-contaminated debris at anupstate New York farm containing wet-lands, announced Ignacia S. Moreno,assistant attorney general for the JusticeDepartment’s Environment and NaturalResources Division and Richard S. Har-tunian, United States Attorney for theNorthern District of New York.

Julius DeSimone, Donald Torriero,Cross Nicastro II and Dominick Mazza

were arrested for the illegal dumping inFrankfort in 2006, as detailed in the

seven count indictment. DominickMazza’s New Jersey-based company,Mazza & Sons Inc., was also indicted.

Arrests were made at residences inNew York, New Jersey and Florida. Thedefendants made their initial appear-ances in federal courts in the NorthernDistrict of New York, Southern Districtof Florida, and District of New Jersey.

The indictment described a schemeto illegally dump thousands of tons ofasbestos-contaminated, pulverized con-struction and demolition debris thatwas processed at Eagle Recycling’s andMazza & Sons Inc.’s, New Jersey-basedsolid waste management facilities. Thatasbestos-contaminated debris was thentransported to and dumped at Cross

Nicastro II’s farm in Frankfort – muchof which contained federally-regulatedwetlands. Dumping and excavatingoperations were managed on-site byJulius DeSimone.

According to court documents,Donald Torriero and other conspiratorsconcealed the illegal dumping by fabri-cating a New York State Department ofEnvironmental Conservation (DEC)permit and forging the name of a DECofficial on the fraudulent permit. Oncethe conspirators learned that they wereunder investigation, they began a sys-

General Motors’ efforts to eliminatethe shipment of plant waste to landfillsis spreading to its non-manufacturingsites, 10 of which now reuse, recycle orconvert to energy all waste from normaloperations.

“Our non-manufacturing facilitiessee the importance of being waste-reduction leaders, and they know theircustomers value it as well,” said JohnBradburn, manager of GM’s waste-reduction efforts. “Being landfill-freehas become a point of pride for our peo-ple and we hope even more facilitiesachieve the goal this year.”

Converting non-manufacturing facil-ities meant rethinking packaging such ascardboard – a significant waste streamdue to volume. GM engineers work tocreate designs with recyclable attributesintended for disassembly. Technical spec-ifications that can be followed on a glob-al basis are being developed.

A landfill-free customer care andaftersales facility in Burton, Michigan isusing environmentally friendly, bio-based packaging foam from supplierLandaal Packaging Systems that blocksand braces products like sheet metal toensure safe arrival. Made from extrudedcornstarch, the foam is both biodegrad-able and compostable.

At the same facility, a supplierhelped GM engineers solve a wastechallenge with a patented technologythat shears and separates cardboardboxes attached to wood pallets. The sep-aration is necessary to manage eachmaterial with the least environmentalimpact and gain significant financialvalue. The technology not only enabledit to earn landfill-free status this year,but the facility now generates $20,000per month from recycling its cardboard.

“We believe GM has more landfill-free facilities than any other automaker,”said Mike Robinson, GM vice presidentof Environment, Energy and Safety Poli-cy. “Our engineers and suppliers arefinding ways to reduce challenging

waste streams, eliminate scrap, anddesign for the environment.”

The non-manufacturing facilitiesare in addition to GM’s 76 landfill-freemanufacturing facilities. The automakerremains focused on converting more ofits manufacturing plants, and has a goalof adding 10 facilities by the end of2011. Last year, it surpassed a globaloperations commitment to make half ofits 145 plants landfill-free. Manufactur-ing is at the company’s core, so convert-ing plants produces the largest environ-mental benefits.

In 2010, all of GM’s worldwidefacilities combined – including regularand landfill-free plants – recycled 92percent of the waste they generated.

This indictment is related to theguilty pleas entered by Jonathan Deckand Eagle Recycling on September 3,2009 and April 11, 2011 respectively.

The conspiracy and substantiveClean Water Act, Superfund, and falsestatements counts of the indictmenteach carry a maximum possible term ofincarceration of 5 years and a fine of$250,000, twice the gross gain to thedefendants, or twice the gross loss to avictim. The obstruction of justice andwire fraud counts of the indictmenteach carry a maximum possible term ofincarceration of 20 years and similarfines.

An indictment is a mere accusationand all defendants are presumed inno-cent until and unless convicted in acourt of law.

This case was investigated by crim-inal investigators with the New YorkState Environmental ConservationPolice, Bureau of EnvironmentalCrimes; special agents from the EPA’sCriminal Investigation Division and theInternal Revenue Service; investigatorsfrom the New Jersey State Police,Office of Business Integrity Unit; theNew Jersey Department of Environ-mental Protection; and theOhio Department of EnvironmentalProtection.

While many sectors of the Ameri-can economy struggle to attract invest-ment capital, it appears that investors –particularly the new breed of sustainableinvestment funds – are enthusiasticabout the future of recycling organicwaste. This vast commodity stream islargely untapped and promises healthyreturns with the right business modeland technologies.

The Environmental ProtectionAgency (EPA) estimates that we pro-duce approximately 246 million tons ofmunicipal solid waste (MSW) per year,of which nearly 60 percent, or 160 mil-lion tons can be roughly categorized asorganic waste – wood, food scraps, veg-etative debris, paper and cardboard. Infood scraps alone, the EPA estimatesthat over 97 percent goes to landfills.

For decades recyclers have beenrealizing profits from paper and card-board, but there is a wealth of other car-bon-rich organic material waiting to beprofitably turned into renewable energy,soils and fertilizers.

One company pioneering organicsrecycling on a large scale is HarvestPower, a North American producer ofrenewable energy and fertilizers fromorganic waste. Since its founding in late2008 as a privately held company, it hasbeen able to attract a number of bluechip investors and is beginning to reapreturns.

In an interview with Paul Sellew,Harvest’s chief executive officer, he hadthis to say:

How much capital have you devel-oped since your founding?

“We’ve used a combination of debt,equity and grants approaching $200 mil-lion dollars.”

Why are investors interested inorganic recycling?

“I think they view it as a resourcethat is under-utilized in our society in aresource-constrained world. It makessense to maximize the value of thesewaste streams/resources through anapproach such as we are bringing to themarket.”

What type of investors are youattracting?

“Along with our management team,our first investor was Kleiner Perkinsout of Menlo Park, California. We havealso attracted significant investmentfrom European investors includingMunich Venture Partners, GenerationInvestment Management and Rabobank,an international Dutch bank. Then wehave a strategic investor as well withWaste Management.”

Are you a technology and processdeveloper, or a market developer?

“We are basically an owner andoperator of organics processing facili-ties. Our approach is to maximize thevalue of organic waste streams. That’sa combination of producing renew-able energy from them and then usingthe residual from our renewable ener-gy technology to further process itinto pelletized organic fertilizers or acompost based soil amendmentproduct.”

What type of customer is interest-ed in your processes?

“Generators of organic wastes –municipalities, food processors, retailgrocery stores, large generators of foodwaste either at the commercial or indus-trial level and certainly at the municipallevel. Right now the vast majority ofstates and communities are separatingout yard waste, leaves, grass and brush.Food waste is now where yard wastewas 15 years ago, meaning it is at thebeginning of being separated out of theMSW stream. Those two streams, yardwaste and food waste, are principle feed-stocks for our process.”

How many projects have youdeveloped to date?

“We have built the largest compost-ing and organics processing facility inCanada, outside of Vancouver in Rich-mond, British Columbia. There we willoperate North America’s largest highsolids anaerobic digestion facility whichis also going to be producing megawattsof renewable energy integrated into ourcomposting operation. Under construc-tion is our bioenergy facility in London,Ontario which will be operational by theend of this year or by the beginning ofnext year. We own and operate a com-posting operation in Tulare County, Cal-ifornia, and we also operate a facility inTullytown, Pennsylvania in partnershipwith Waste Management. There will bea number of other opportunities that wewill be announcing shortly.”

How are organics developing?“We are going into areas where the

organic waste is being separated out.We are now composting yard and foodwaste and then where we have suffi-cient food waste we are building our

renewable energy facilities – right nowwe have the two largest in North Amer-ica under construction. The energycomponent of our story is basically anew model that Harvest is bringing intoNorth America. We anticipate that themodel that we are creating will beduplicated and there are enormousgrowth opportunities. You just have tolook back and see the growth of theAmerican composting industry over thelast 15 to 20 years. There are close to5,000 composting facilities of varioussizes operating today. When I gotinvolved in this business 25 years agothere were only a few hundred. I thinkthat food waste, which ironically is pro-duced in about equal quantities to yardwaste, is going to follow the same pat-tern. There’s a large scale infrastructurebuild-out story here around reprocess-ing food waste.”

What revenues have you generat-ed and what do projections look like?

“We are a company that has about150 employees and we have been pro-ducing about $30 million in revenuesper year. We are profitable. This year weanticipate finishing the year at over $100million in revenue.”

What is the future of organicrecycling?

“I’m bullish. In a way it’s like say-ing we’ve just discovered a new naturalgas field, or a new oil field. Throughtechnology we are releasing the energypotential of organics and unlike solarand wind which is dependent on the sunshining or the wind blowing we are pro-ducing power on a 24/7/365 basis, base-load power…the best kind.”

“A waste receptacle, as a stand-alone collection option, is no longer thedominant force in the collection con-tainer industry. Rather, it is now mostdesirable for the waste receptacle to bepaired with a recycling option to proveeffective. This trend will continue as anintegral part of every collection pro-gram across North America,” statedChris McBrien, marketing manager atBusch Systems. Busch manufactures aline of recycling, waste and compostcontainers.

McBrien said, “All of our productscontain a minimum of 35 percent recy-cled content and are proudly made inNorth America. Busch Systems devel-ops more molded recycling, waste andcompost containers than all of the othermanufacturers combined. Our recyclingreceptacles are specifically manufac-tured to be clear, easy to use, to preventcontamination and to generate thecleanest possible stream of recy-clables.”

The Waste Watcher and SuperSorter are two Busch products that canbe used in multiple collection streamswithin a single unit. “Our product lineaddresses the end user need to consoli-date their collection program. By unify-ing collection of diverse items, webelieve collection becomes easier.When that happens participation ratesincrease and contamination ratesreduce. That is the key to a successfulrecycling program. Busch Systems will

continue to design products with thisfundamental concept in mind,”McBrien said.

Durabac was originally only amanufacturer of metal waste recepta-cles. Then the company received a spe-cial customer request for a polyethylenebin. That was 15 years ago. After evalu-ation and R&D, the first container wasdesigned for a very demanding applica-tion – rendering, or swine collection.“These poly containers were dragged,pushed, and dropped in farmer’s fieldsand also subject to serious wear whendead pigs were dropped into the bins,throughout all weather conditions.Today, this same product design is inuse, in countless settings. A polyethyl-ene container requires no maintenanceand has 2 or 3 times the life expectancyover a metal container, making the polycontainer the best investment. We offera complete line of polyethylene con-tainers for all waste and recyclingneeds,” said Penny Lamarre of Durabacsales and marketing.

Lamarre pointed out that not allpoly containers are thesame, however. “Over theyears and through extensiveproduct testing, Durabac’sDuraplast division hasdeveloped the finest poly-ethylene recipe and manu-facturing process available.Our products are best suitedto withstand the most force-ful impact, hot and coldtemperature variations andour products offer the bestresistance to liquids, oilsand chemicals. To achievethese goals, a 100 percentvirgin, unique resin is usedin our manufacturingprocess. No recycled resinis used.

“When fabricating acontainer with recycled resin, the poly-ethylene molecule properties are greatlyaffected by the loss of strength andresistance. Duraplast containers areroto-molded, not injection molded. Thisprocess was chosen to achieve greaterproduct flexibility while increasingproduct life expectancy. For a containerto last a long time, factors such as wallthickness, container structural design,UV stabilization and powder electro-coated metal components must be taken

into consideration,” saidLamarre.

She added, “The wasteand recycling industry ismoving toward a zero wastegoal. Being green is the wayto go. Now, we see the needfor collection of food wasteand yard clippings. The poly-ethylene container is alsobest suited for these applica-tions. The Duraplast com-mercial organic collectioncontainer is available in 2, 3and 4 cubic yard sizes, with aspecial lid design, as thiscontainer is usually emptiedby a front-load truck or a renderingtruck.”

Shawn Kruse, commercial contain-er business manager at Rehrig PacificCompany said the company’s commer-cial containers are a third lighter thancomparable metal containers, yet areextremely tough and will last for thelong-haul. “Our containers are madewith a high-impact, UV-stabilized poly-ethylene resin that won’t rust or corrodelike metal and our products clean easily.Pockets and hinge supports are integral-ly molded, not fastened-on, while toprims are heavily reinforced to addstrength where it’s needed most. Front-load containers have replaceable pocketsleeves that add sidewall thickness andprotection against puncturing by forktines. Both models have molded-infloor beams that provide support andstepped sidewalls provide stiffness toavoid bottom sagging and sidewallbowing. Lids are crowned so they won’tcollect water and will remain rigid.Fiberglass hinge rods are substantiallysupported over their entire length, pro-viding long-life and smooth lid opera-tion. All containers are dent resistantand easily repairable,” Kruse said.

After noting those product durabil-ity features, Kruse commented abouthow the recession has resulted in a userfocus on reducing costs and managingassets. “Customers constantly look fordifferent ways to reduce operatingcosts. Purchasing a container that isdurable and doesn’t require painting orwelding can save hundreds of dollarsover the life of that container. Contain-ers that can nest inside one another cansave room and free up valuable yardspace for additional revenue-generating

equipment. Because of the plastic con-tainer’s lighter weight and easiermaneuverability, some customers havebeen able to change from using a two-man truck collection method to using

EPA fines metal plater $100,000for hazardous waste violations

The Environmental ProtectionAgency (EPA) fined TMW Corporation$100,000 for violations of the ResourceConservation and Recovery Act.

The violations were discovered at thecompany’s facility, Crown Chrome Plat-ing, a Division of TMW Corporation, dur-ing an inspection conducted by EPA inApril 2009. The facility primarily doesmetal plating for the aerospace industry.

“The toxic wastes and sludges at theCrown Chrome facility have the potentialto pose a danger to employees, the sur-rounding community and the environ-ment,” said Jared Blumenfeld, the EPA’sRegional Administrator for the PacificSouthwest.

TMW Corporation generated multiplehazardous wastes including, paint wastes,alkaline and acidic corrosive liquids, andsludges containing heavy metals such aschromium and lead. These hazardouswastes, and the waste handling violationsassociated with them, are typical of thoseproduced by metal plating shops, which areoften the target of EPA enforcement actions.

The federal hazardous waste regula-tions require companies to properly man-age hazardous waste to prevent harm tohuman health and the environment. EPAdiscovered the following violations atTMW Corporation’s facility:

•Storage of hazardous waste for over90 days without a permit;

•Failure to conduct required inspec-tions;

•Failure to train personnel or maintaintraining records;

•Failure to maintain required emer-gency communications equipment; and,

•Failure to make a hazardous wastedetermination.

As a result of this enforcement action,TMW Corporation has returned to compli-ance with federal law and will pay a fineof $100,000.

EPA’s hazardous waste rules requirefacilities to properly store, label and closehazardous waste containers. Facilitiesmust also have properly trained staff, asimproperly stored hazardous waste canspill and pose a risk to workers and theenvironment.

Federal, state and local regulatory agen-cies have formed a Los Angeles Enforce-ment Collaborative to focus resources over amulti-year effort to ensure that businessesand industries in this area are complyingwith environmental laws. EPA is partneringwith several state and local agencies underthis collaborative including Cal/EPA, theCalifornia Department of Toxic SubstancesControl, the Los Angeles Regional WaterQuality Control Board, and the CaliforniaAir Resources Board as well as local non-profit organizations to improve environmen-tal and public health conditions in Los Ange-les communities.

Cindy Neuroth is the “C” in D&C Solid Waste Services. Co-owner with herhusband Dan, Cindy said that “it depends on when you catch me, what title Ihave at the time.”

The Neuroths have had their residential garbage and recycling business inSioux Falls, South Dakota, for 23 years, but Dan grew up in the industry. Hisfather had his own waste hauling business, and Dan worked there as he wasgrowing up. Later, he worked for one of his brothers who had started his ownwaste business.

Finally, he and his wife founded D&C. Cindy said, “At one time, there weresix family members in the garbage business.”

In the early years, the business was a little easier because “there were a lotless rules, less regulations,” according to Cindy. At that time, they also had twosmall children who went along on the routes with them, and when they got intoschool, the parents would stop by with the garbage truck to drop them off orpick them up when needed. If there were school events, they’d park the trucks,attend the events, and get back to work again.

The recycling part of the business started out with a triple-sort system, butwent to single-stream about two years ago. “We take it to a recycling center intown and they process it,” Cindy explained. “We pick it up – we do thecollecting.”

Besides the regular trash and recycling pickups, D&C will make specialpickups for white goods that go to a landfill where they are processed to removethe Freon and then recycled. They also make separate pick-ups for tires that ini-tially go to a landfill and are picked up from there by a contractor. Yard waste isalso a separate item.

D&C has five trucks and six employees – four of whom are family. “I do aroute and I do roll-offs. I help change the oil and help repair trucks,” Cindy said.“I kind of enjoy being on the road. Customers like that it’s a woman and also anowner – so they can talk to an owner.” She said that being on the truck meantthat “you’re busy all the time – from the time you start until the end of the day.”

“We used to be twice a week,” Cindy said of the residential pickups, “andnow we’re once a week.” The twice-weekly pickups stopped in 1995, whenrecycling started. “Ninety-five percent of our customers participate in recy-cling,” Cindy said. “That’s the highest percentage in Sioux Falls for recycling”among the 35 companies that offer the service. “We educate our customers andsend out information twice a year. We were one of the first ones to offer single-stream in Sioux Falls.”

Cindy is pleased that her kids are taking interest in the family business. Atfirst the kids were just going along for the ride, and later they helped out withbilling, or putting addresses on envelopes. “When my daughter was in highschool, she got her license,” Cindy said, explaining that 14 was the legal age toget a license in South Dakota. As soon as her daughter got her license, she drovea truck while her younger brother helped out. “Because it’s family, insurancewas easier,” she added.

Now, they’re both working for the company. “They came to us for jobs,”Cindy said. Her daughter works in the office, but can drive a truck if one needsto be picked up or dropped off for repairs. Her son drives a route.

While Cindy likes having her kids nearby, and it’s great to have two verydependable employees, there’s another benefit. “Customers remember the kidsfrom when they were little. They like that.”

Nuclear Metals Superfundsite slated for remediation

A new agreement will set the stagefor more work to occur at a Concord,Massachusetts Superfund site, includ-ing the demolition of contaminatedbuildings which are unsound and needto be removed.

The agreement, an AdministrativeSettlement Agreement between Envi-ronmental Protection Agency (EPA),U.S. Army, U.S. Department of Energy,Textron, Inc. and Whittaker Corpora-tion, outlines responsibilities for $70million for performance of a non-timecritical removal action at the NuclearMetals, Inc. Superfund site.

From 1958 to the present, variousowners and operators used the Concordsite for research and specialized metalsmanufacturing, and were licensed topossess low-level radioactive sub-stances. Between 1958 and 1985, theowner/operators disposed of waste,contaminated with depleted uranium,copper and nitric acid, into an unlinedholding basin located at the site. Otherareas of the site were also used for thedisposal of manufacturing wastes.

Starmet operated under the compa-ny name Nuclear Metals from 1972until 1997, when it changed its name toStarmet Corporation. While no longerpermitted to use radioactive materialsin manufacturing, Starmet continues tomaintain a license to possess radioac-tive materials at the site. Starmet and arelated company continue to employ asmall staff at the site, and provide sitesecurity and building maintenance. It isanticipated that Starmet will perma-

nently vacate the facility in the nearfuture.

The site currently includes multiplestructures with a combined footprint ofapproximately 185,000 square feet,including a two-story, five-sectioninterconnected building, several tankhouses, storage huts and storage build-ings. The buildings, nearly 50 years oldand in poor condition, are deterioratingand have multiple leaks, and are con-taminated with high levels of depleteduranium.

Demolition of the buildings willoccur down to their slab foundation,with placement of a temporary cap overthe remaining slab. Construction debriswill either be disposed off-site at anappropriately-licensed disposal facilityor potentially on-site, if EPA deter-mines that such debris does not containhazardous substances.

With ongoing attention and work,EPA and Mass DEP have significantlyreduced the threat of release of haz-ardous substances posed by the facilityand the site. EPA has performed twotime-critical removal actions: first in2002, EPA covered the holding basinand an old landfill on site, and erected afence around the site; the second in2008, removed containers of hazardousand flammable materials from the facil-ity buildings. Mass DEP, with U.S.Army Funding, removed more than3,800 drums of depleted uranium in2006. EPA expects to issue a Record ofDecision for the site within the next 16months.

recycling going on everyday. People arealways looking for different ways torecycle. That’s where we come in. If youcan scribble it on a napkin, we can buildit,” Senkowski related.

Apparently there has been a lot ofcreative scribbling at Poynette. Diver-sion of waste into marketable commodi-ties has spurred a whole new generationof dumpsters dedicated to source sortingwith better security.

“A big part of our growth has beenin recycling containers, separating outcardboard, paper, glass, plastics, metalsand organics. It seems like you cannotjust take your garbage and throw it awayanymore, everything needs to be separat-ed nowadays, even behind your localbar,” said Senkowski. “Organic waste isa big thing for us and we do a lot oforganic containers. They’re not throwingfood waste away and landfilling it, butturning it into energy, feeding livestockor making compost or mulch. You canmake money on garbage by recyclingwith the right dumpsters.”

Poynette has seen a marked increasefor dumpsters in several areas – dividedunits to accommodate multiple recy-clables; locked containers for cardboardwith slots that force the user to collapseboxes to increase container capacity;dumpsters with false bottoms containingliquid collection tanks to prevent groundcontamination; more integral units tokeep out insects and animals; and bettersecurity to prevent unauthorized dump-ing, pilfering and reduce liability for theowner.

Nearly every dumpster Poynettemakes these days has plastic tops thatdecrease overall weight and reduce thedanger of lids coming down and hurtingpeople. Poynette still builds a few dump-sters with steel lids for applications suchas containing fires near buildings.

“We are doing more and more tight-ly sealed containers that help containliquids and prevent infestations ofrodents, bees and bears. The scrap indus-try uses dumpsters that hold metals forweeks or months at a time and we build

containers that prevent rusty waterleaching into the ground water. Peopleare stealing more scrap metals and otherrecyclables, so we are using more locksand sealed lids.”

A design collaboration with a cus-tomer led to Poynette developing a newline of wheeled front and rear load plas-tic dumpsters with up to 4 cubic yardcapacity. “More people are bumpingcontainers up and down curbs and wantmore lightweight containers. That‘s howwe came up with our new, stronger,lighter weight plastic container line, ofwhich we’ve been selling quite a few.”Poynette buys tubs from a plastics man-ufacturer and fabricates steel frameswith casters that hold the tubs. “A cru-cial element in the success of our plasticdumpsters was developing a rugged lid.We worked very closely with the ScottLemajeur, owner of Impact Plastics todevelop a thick, durable hinge line. Scottwas a great help getting our plasticdumpsters on the street. Without a greatlid you do not have a great box.”

Plastic has further invaded the tradi-tional world of the steel dumpster with

the Bagster bag, the first disposabledumpster in a bag now being sold allover North America by Waste Manage-ment. Scott Rhodes, co-founder of theWM Bagster and managing director oforganic growth at WM, an internal ven-ture capital development group said“WM acquired our business in June of2009. When they bought us we were in10 states. Now we are in over 40 statesand most parts of Canada,” said Rhodes.

The Bagster bag is WM’s first retailproduct and designed to serve do-it-yourselfers and small contractors, but isalso quickly finding other niche markets.“Where we see a really big pick up inthe use of Bagster bags, unfortunately,which we never considered, is in disasterrelief, flooding, hurricanes and tornadoswhere people are cleaning up and needto source separate,” Muir commented.

Bagsters can be purchased at homeimprovement and hardware stores,including Home Depot, Lowe’s, AceHardware, True Value and Do-It-Best.

They are flexible, reinforced poly-ethylene dumpsters that are porous toallow rainwater to drain. In the store, itcomes folded in 1.5’ x 2.5’ packageweighing approximately 5 pounds.When unfolded, it can hold up to 3 cubicyards or 3,300 pounds. WM claims thatthe woven material will not tear if punc-tured. It can hold sheets of 4 x 8 footplywood and items as large as a bathtub.When full, WM boom trucks pick up thebags using straps.

“The suggested retail price is$29.95 and our retailers do a nice job ofadhering to that,” said Rhodes. “The col-lection fee varies by market rangingfrom $79 to $159 depending on the area.It’s a fixed collection fee within a metro-politan area. If you are in Boston, it’s thesame fee in that New England area. Andit’s a fixed collection charge no matter ifyou are putting in leaves or steel rebar.The collection rate varies across metro-politan markets. Boston is at the highend of our range at $139. In the majority

of our markets it’s $99 per bag. General-ly, that cost is 50 to 70 percent less thanthe smallest dumpster you can rent.When we came up with the idea we weredefinitely trying to fill a void for projectsthat were too big for the garbage can butnot big enough to justify a dumpster. Ifyou live in an area where the smallestdumpster you can rent is 10 yards andyou don’t need that size, this is a perfectsolution.”

Unlike a traditional dumpster, thereis no delivery cost involved with a Bag-ster bag and no rental time limit. A do-it-yourselfer can do a project over severalweekends and call for a pickup whendone.

Wes Muir, a spokesman for WMexplained collections, “People can callor go on-line for a pickup and we collectwithin three business days. We have acomputer program that shows where thepickups are, the addresses and howmany pickups are being made. Everymonth we are increasing the amount ofpickups, seeing a lot of multiple bagpickups and just saw one household thathad four at the curb. It’s taken off andbecome very popular. It’s a cost effectivemeans to collect this material. Eachboom truck holds 12 to 14 fully loadedbags. The benefit to us is being able topick up 12 to 14 bags on one run andavoid the delivery and pickup of tradi-tional dumpsters. The savings in operat-ing costs are just tremendous and obvi-ously from an environmental point ofview our carbon footprint is significantlyreduced because of the efficiencies asopposed to one bag per load.”

Muir added, “At this point Bagsterbags are single-use. They are recyclableand we are looking at recycling them. Alot of the materials we collect aredeposited at transfer stations so we arelooking at ways to tip the bag and have itrecycled. We have a number of pilotprojects where we are separating someof those materials.”
