GENERAL INFORMATION

The APVMA (Australian Pesticides and Veterinary Medicines Authority) Gazette is published fortnightly and contains details of

the registration of agricultural and veterinary chemicals products and other approvals granted by the APVMA, notices a s required

by the Agricultural and Veterinary Chemicals Code (the Agvet Code) and related legislation and a range of regulatory material

issued by the APVMA.

Pursuant to section 53(1) of the Agvet Code, the APVMA has decided that it is unnecessary to publi sh details of applications

made for the purpose of notifying minor variations to registration details. The APVMA will however report notifications activ ity in

quarterly statistical reports.

SUMMARY OF THE APVMA’S EVALUATION OF BISTRIFLURON ACTIVE CONSTITUENT

The APVMA has evaluated the chemistry aspects of bistrifluron active constituent (manufacturing process, quality control

procedures, batch analysis results and analytical methods) and found them to be acceptable.

On the basis of the data provided, and the toxicological assessment, it is proposed that the following APVMA Active

Constituent Standard be established for bistrifluron active constituent:

Other compounds of toxicological significance are not expected to occur in bistrifluron technical grade active constitient

(TGAC) as a result of the raw materials and the synthetic route used.

The Office of Chemical Safety (OCS) has considered the toxicological aspects of bistrifluron TGAC, and advised that

there are no toxicological objections to the approval of this chemical.

Neither an acceptable daily intake nor an acute reference dose has been established for bistrifluron at this stage, as it is

not proposed for use in food producing crops or animals.

Bistrifluron is exempt from scheduling and listed in Appendix B of the Standard for Uniform Scheduling of Medicines and

Poisons.

The OCS has not specified toxicologically significant impurities in technical grade bistrifluron.

to the safety of people exposed to it during its handling and use.

BISTRIFLURON. The product is XTERM™ DEFENCE AGAINST TERMITES. The product is for the control of

subterranean termite species.

SUMMARY OF THE APVMA’S EVALUATION OF XTERM DEFENCE AGAINST TERMITES IN ACCORDANCE WITH

SECTION 14(3)(E) AND (F) OF THE AGRICULTURAL AND VETERINARY CHEMICALS CODE (THE ‘AGVET

CODE’), SCHEDULED TO THE AGRICULTURAL AND VETERINARY CHEMICALS CODE ACT 1994

The APVMA has evaluated the application and in its assessment in relation to human and environmental safety under

section 14(3)(e) of the Agvet Code, it proposes to determine that:

(i) The APVMA is satisfied that the proposed use of XTERM™ DEFENCE AGAINST TERMITES would not be an

undue hazard to the safety of people exposed to it during its handling and use.

The Office of Chemical Safety (OCS) in the Department of Health and Ageing has conducted a risk assessment on

the product and concluded that it can be used safely.

Information on worker exposure to bistrifluron or the product XtermTM

Defence Against Termites was not available,

and no model is available to estimate worker exposure for the proposed product use pattern. However, both the

product and bistrifluron have a low acute toxicity profile, and no toxicologically significant effects were seen at the

limit dose of 1000 mg/kg bw/d (the no observable effect level) in a 28-day dermal study in the rat, which was

chosen for the occupational health and safety risk assessment.

In view of the nature of the product formulation (eg tablets in plastic cartridges, a bait canister) and its specific use

pattern, the user’s hands are likely to be exposed to only a very small amount of the chemical which may become

dislodged from the tablet. Furthermore, this exposure will be significantly reduced further (up to 90%) when the

worker wears latex gloves as required on the product label to prevent contamination of the tablets. Hence, based

on the low toxicity profile, the specific formulation and use pattern of the product, and also noting that wearing latex

gloves is recommended to prevent contamination of the bait which might deter termites from feeding, the use of

personal protective equipment is not considered necessary. Based on the risk assessment, a first aid instruction

has been recommended for the product label.

Based on an assessment of occupational health and safety, it was considered that there should be no undue

hazard to safety of people from the use of XtermTM

Defence Against Termites when used in accordance with the

label directions.

(ii) The APVMA is satisfied that the proposed use of XTERM™ DEFENCE AGAINST TERMITES will not be an undue

hazard to the safety of people using anything containing its residues.

The product is not used in food producing situations; therefore the consideration of residues is not relevant for the

assessment of this product.

(iii) The APVMA is satisfied that the proposed use of XTERM™ DEFENCE AGAINST TERMITES containing the active

constituent BISTRIFLURON is not likely to be harmful to human beings if used according to the product label

directions.

The product Xterm™ Defence Against Termites is formulated as a bait tablet (60 g and 120 g wrapped in plastic)

containing 10 g/kg bistrifluron that is placed in designed above-ground and in-ground bait stations for the control of

subterranean termite species.

In rats, following oral administration, bistrifluron is rapidly and extensively absorbed, and widely distributed to

organs and tissues, with the highest level detected in the liver. It is extensively metabolised and elimination from

the body was relatively slow and predominantly via the faeces with the urine a minor route of elimination. There

was no evidence of bioaccumulation following repeated dosing.

Based on the submitted data, bistrifluron is of low acute oral, dermal and inhalational toxicity in rats, is not a skin or

eye irritant in rabbits, and is considered unlikely to be a skin sensitiser in guinea pigs.

Following repeat oral dosing in rats, mice and dogs, the key toxicology findings were reduced food consumption

and body weight gain, and changes in liver function, liver weight and liver histopathology. Bistrifluron was not

mutagenic in vitro, and the observed weak genotoxic potential observed in vitro was not expressed in vivo. Thus,

bistrifluron is not an in vivo genotoxicant. Bistrifluron was not carcinogenic in rats and mice, a reproductive toxicant

in rats or a developmental toxicant in rats and rabbits. Furthermore, although no neurotoxicity studies were

submitted there was no evidence of a neurotoxicity potential in the oral repeat dose studies in rats, mice and dogs.

Xterm™ Defence Against Termites is of low acute oral and dermal toxicity in rats, is not a skin or eye irritant in

rabbits, and is considered unlikely to be a skin sensitiser in guinea pigs. No acute inhalational study is available for

Xterm™ Defence Against Termites, though its acute inhalation toxicity potential is considered likely to be low given

the product constituents and product form.

Based on an assessment of the toxicology, it was considered that there should be no undue hazard to the safety of

people from the use of Xterm™ Defence Against Termites when used in accordance with the label directions.

(iv) The APVMA is satisfied that the proposed use of XTERM™ DEFENCE AGAINST TERMITES is not likely to have

an unintended effect that is harmful to animals, plants or the environment if used according to the product label

directions.

The APVMA is satisfied that the proposed use of the new termite regulator product, XtermTM Defence Against

Termites, containing 1% of the new active constituent bistrifluron for application in household and professional pest

control arenas, e.g. farm and commercial sites, around bridges, wharfs, poles, fences, tree stumps, logs etc. using

in-ground or above-ground bait stations would not be likely to have an unintended effect that is harmful to animals,

plants or things or to the environment.

The Department of Sustainability, Environment, Water, Population and Communities has assessed data in support

of the proposed use and have concluded that the risks to the environment from this use are acceptable provided

that amendments are made to the draft label.

Bistrifluron is hydrolytically stable under acidic aqueous conditions with an estimated half-life >1 year at room

temperature and at pH 4 and 7, but readily hydrolyses under alkaline aqueous conditions (pH 9) with a half-life of

6.0 days at 25°C. Bistrifluron photolyses readily to moderately in sterile water with the half-life being in the range of

1.7 to 22.4 days in aqueous systems.

Bistrifluron dissipated fairly to slightly in aerobic soils with the time for 50 per cent disappearance values in the

range of 33–128 days. Bistrifluron is immobile in soil based on the determined partition coefficient value of 37480.

Bistrifluron showed no acute or chronic toxicity to birds. Its acute endpoints to fish, daphnids and algae are all

greater than its water solubility limits. It is chronically very toxic to aquatic invertebrates. Bees and earthworms

were not sensitive to bistrifluron.

The proposed use pattern of the product indicates that XtermTM Defence Against Termites is unlikely to be

released to the environment.

Based on the proposed use pattern and the low volume, the potential risks to terrestrial invertebrates exposed to

the bistrifluron in bait stations, birds and honey bees, natural predators from secondary poisoning, terrestrial

vegetation and aquatic life have been considered and assessed. The risk assessment determined that the product

XtermTM Defence Against Termites containing bistrifluron is unlikely to pose an environmental risk under the

proposed use pattern, provided the recommended amendments are made to the draft label.

The APVMA has considered the findings of the Department of Sustainability, Environment, Water, Population and

Communities and accepts these conclusions.

(v) The APVMA is satisfied that the proposed use of XTERM™ DEFENCE AGAINST TERMITES would not unduly

prejudice trade between Australia and places outside Australia as the product is not for use in animals or plants

producing Australian export commodities.

(vi) In relation to its assessment of efficacy under section 14(3)(f), the APVMA is satisfied that data from trials

supporting the efficacy of the product adequately demonstrate that if used according to the product label directions,

the product is effective for its proposed uses.

Continued suspension of quintozene active constituent approvals, products containing quintozene and label approvals of products containing quintozene

The active constituent approval suspensions are in effect from 14 April 2013 until 14 April 2014.

The product and label suspensions apply as a consequence of the decision to continue the suspension of quintozene

active constituent approvals and are in effect from 14 April 2013 until 14 April 2014.

BASIS FOR CONTINUED SUSPENSION

The APVMA became aware of information in 2010 indicating the presence of undeclared dioxins as impurities in

products that contain quintozene as the active constituent. On this basis, the APVMA suspended quintozene active

approvals, effective 9 April 2010 until 12 April 2011. In April 2011, the APVMA acted again to continue the suspension of

all approvals of the active constituent quintozene for a further 12 months, to allow the manufacturer additional time to

generate new data. The manufacturer provided the APVMA with additional data but the APVMA continued the

suspension of all approvals of the active constituent quintozene until 14 April 2013 to allow time to consider this

application. This application is being assessed but the APVMA has not made a decision. The APVMA has decided to

continue the suspension of the active constituent approvals for a further 12 months until 14 April 2014.

In January 2013, one of the active constituent approvals (approval No. 46112) was voluntarily cancelled.

Dioxins are listed as toxicologically significant impurities in the Definition of Standards for Active Constituents (see

www.apvma.gov.au/products/constituents/standards/actives_definition.php). The presence of any impurity that is listed

as toxicologically significant is a matter that the APVMA considers to be a relevant particular to the approval of an active

constituent.

As stated in the Agricultural Manual of Requirements and Guidelines (AgMORAG)

(www.apvma.gov.au/products/constituents/standards/actives_definition.php), an active constituent approval is not

supportable unless any known impurities of toxicological significance have been adequately evaluated. An impurity that

is present at levels above 1 g/kg should be declared and evaluated, and toxicologically significant impurities in the active

constituent should be declared when present, regardless of the level present.

The APVMA considers that the active constituent quintozene may be an undue hazard to the safety of people exposed to

it during its handling and may have an effect that is harmful to human beings. A full assessment of the dioxin impurities

has not been conducted in accordance with section 14 of the Agvet Code Act. On this basis the APVMA has concluded

that it cannot allow the active constituent to be supplied and used in chemical products when it contains undeclared

dioxins. Consequently, the APVMA has suspended the approvals of quintozene active constituents.

The Agvet Code provides that if the APVMA suspends the only approval, or all the approvals, of an active constituent for

an existing chemical product, it must also suspend any registration of that product. In addition, if the APVMA suspends

the registration of a chemical product, it may also suspend any approval relating to a label for containers for the product.

IMPACT ON PRODUCT REGISTRANTS

Suspension action is based on the concern that undeclared dioxins may be present in quintozene active

constituents and formulated products. The APVMA considers that it may be possible to allow some use of

existing stocks of quintozene products during the period of suspension. Continued uses will only be

permitted on the basis of test results for total dioxins in each batch of product proposed for use, and following

evaluation by the Office of Chemical Safety, to ensure that any continued use does not pose a risk to users.

INSTRUCTIONS FOR DEALING WITH SUSPENDED ACTIVE CONSTITUENTS AND PRODUCTS

Unless authorised by the APVMA, the following instructions apply for persons having possession or custody of stocks,

and are considering using or otherwise dealing with suspended active constituents and products during the period of

suspension.

Possession and custody

Possession and custody of existing stocks of quintozene active constituent and/or products is permitted.

Supply

No supply of the active constituent quintozene and/or any product that contains it as an active constituent is permitted.

Use

No use of suspended product containing quintozene is permitted.

Any person who possesses or has custody of, or otherwise deals with the active constituents or products listed in Tables

1 and 2 (above) in accordance with the instructions in this notice is taken to have been issued with a permit to possess,

have custody of, or deal with the active constituents or products during the period of suspension or until further notice.

WARNING

A person must not possess with the intent to supply, or deal with any materials containing quintozene during this period,

except in accordance with the instructions contained in this notice. A failure to comply with these instructions will result in

an offence against the Agvet Codes and the APVMA will take appropriate compliance action. It is an offence for any

person to possess with the intent to supply, use or deal with the active constituent after 9 April 2010 unless authorised to

do so by the APVMA. Similarly, it is an offence for any person to possess with the intent to supply, use or deal with

quintozene products after 12 April 2010, unless authorised to do so by the APVMA.
