0900–1030 How can bar associations support the fight against racial, gender and other discrimination?A State often seeks to justify its interference with or regulation of private relationships on a need to protect cultural heritages, societal mores or righthistoricalinjustices.Theresultineachinstanceisthatagroup,race or gender is subjected to prejudicial treatment based solely on their membership of that particular group or category.

A panel of speakers will focus on these and other types of discrimination, discuss whether such prejudicial treatment can ever be justified and elicit the role a bar association should play in such cases.

In this session, a number of case studies will be examined to illustrate:

1400–1545 political Interference in bar associations (part 2)TheDutchGovernmentisworkingonlegislationthatwillchangethewaythelegalprofessionisregulated.TheNetherlandsBarisdeeplyconcernedby this development because the independence of the legal profession is at stake.

In this session, the Netherlands Bar will examine the proposed changes tothelegislationwhichstipulatethattheMinisterofSecurityandJusticewill have to approve all by-laws and other rules of the Netherlands Bar beforeenteringintoforce.TheproposedlegislationwillalsocreateanewSupervisory Board, consisting of non-lawyers, to have overall responsibility fortheregulationoflawyers.TheSupervisoryBoard,whichwillhaveitsmembersappointedbytheMinisterofSecurityandJustice,willdirectlycontrolthewaylocalbarpresidentsregulatelawyersintheirdistrict.TheSupervisory Board will be able to appoint its own regulators and may directly punish administrative violations with fines. Confidentiality of client information will no longer be assured.

In examining these issues, the session will also refer to other bar associations whicharecurrentlyconfrontingdirectpoliticalinterference,includingTheLaw Society of Ireland which is facing a threat to its independence through theproposedLegalServicesRegulationBill2011.TheEnglishandAmericanviewswillalsobegiven.Theconsequentdeleteriouseffecttothepublicinterest will also be discussed.

1615–1745 Representing Justice: The role of lawyers in establishing international criminal courts and safeguarding their legacySession presented by the IBA ICC Programme

In July 2012, the International Criminal Court (ICC) will celebrate the tenth anniversaryofthecomingintoforceoftheRomeStatute,itsgoverninginstrument. A bastion of international justice and the fight against impunity, the ICC continues the work begun by the international ad hoc and hybrid tribunals. Lawyers have stood at the forefront of this effort playing a key role aspractitioners,legalresearchersandexpertsbeforetheseCourts.TheIBAwill pay homage to this significant milestone in a special session during the BarLeaders’Conference.Anexpertpanel,includingCourtenayGriffithsQC,leadcounselforCharlesTaylor,andKarimKhanQC,leadcounselforFrancisMuthuara(Kenya)andMssrsAbdallahBandaandSalehJerbo(Sudan)willshare the challenges and successes in representing victims and defendants, interpreting novel legal principles and contributing to the building of the jurisprudential architecture of these Courts.
