SCOTLAND 2019 - an invitationCalling all lads and lassies! Ouida and I are excited to invite you to bonnie Scotland for the 78th Annual

Meeting of the Association of Defense Trial Attorneys. From Edinburgh to St. Andrew’s in the Kingdom of Fife, you will enjoy not only great CLE programs but incredible history, culture, and celebrations. Our meeting hosts, Bill and Jane Perry of London, England, have planned a wonderful meeting in Scotland and a post-meeting trip to their own beloved city. Our Executive Director, Peggy Schultz, has worked hard to provide an exciting, fun-filled week of education and activities.

The Annual Meeting kicks off on Monday, April 29th with a Welcome Reception at Edinburgh Castle (ADTA badges required). Attendees will want to check into the Apex Waterloo Hotel in Edinburgh before the reception in order to grab badges and welcome bags (and a jacket or shawl!). Arrive early to experience ancient Edinburgh before the Monday night castle event. Tuesday there is sight-seeing on your own and then in the afternoon on to St. Andrew’s by coach bus for an All Things Scotland celebration that night. The week continues with engaging programs and speakers, excursions, golf, scotch tastings and more! The Gala on Friday night, May 3rd features renowned band White Dove plus traditional revelry in kilts and tams. Meeting hosts, Bill and Jane Perry, invite you to join them for a “Post-Trip to London” starting on Saturday, May 4th.

Our meeting hotel, the Fairmont, St. Andrews, is nestled between links golf courses with a view of the ancient university town and the North Sea. The opening session and CLE programs begin there on Wednesday morning.

Lori Berke and the CLE Committee have put together an exceptional CLE program, the theme of which is “Mastering the Solution in Advance of the Problem.” Wednesday’s programming will start off with a dynamic panel of attorneys from four different countries discussing the intricacies of their respective legal systems. The day will continue with presentations on insurance coverage issues civil litigation attorneys need to be aware of and best practices when retaining financial experts. On Thursday, we will have speakers on avoiding malpractice claims and what to be aware of in lawyer professional liability insurance policies, what civil litigators need to know about white collar corporate investigations, and use of technology to create value for your client. On Friday, Scotland native Nicolas Brooke, General Counsel and Global Head of Investigations and Litigation at the French bank Société Générale, will share with us his recent success in resolving government probes of his bank into Libor manipulation and foreign bribery, which led to his winning the 2018 GIR award for Outstanding In-House General Counsel. Immediately thereafter, Dave O’Brien will share his inspirational story of becoming the oldest man in

the world, at age 56, to complete 4 Desert Runs in one year. A Desert Run is five marathons (250KM) over seven days with all of your gear on your back, sleeping in shared tents and running in actual deserts around the world. Dave will address how to prevent our immune systems from being compromised and how we can best avoid illness due to stress, fatigue, poor diet, mental & physical health, environment and technology.

Mornings at the Fairmont for spouses, guests, and significant others will highlight special themed events in “royal British style”, such as the Book Club’s review of Highclere Castle (the famous “Downton Abbey”) and the Red Carpet Rendezvous experience of a genuine Afternoon Tea.

During the week, you will also have an opportunity to immerse yourself in Scotland’s history and culture with off-site excursions – famous castles and tours, and an abbey distillery and one at Kingsbarn. Make time to see the Old Course, shrine of avid golf-lovers, or experience the two golf courses on the grounds of the Fairmont hotel. The dine-around on Wednesday night promises to be a fun “pub crawl” down in the village of St. Andrews! Every day of the Annual Meeting will offer something truly special so that your Scotland experience is unforgettable.

So mark your calendars for April 29 – May 4 for an incredible journey to Scotland with ADTA. Make sure to practice your “brogue” and pack your adapters, kilts and tartans (if you already own one), cameras, and woolens! We look forward to our time together and to this chance of a lifetime in bonnie Fife!

Nicolas Brooke, General Counsel & Global Head of Investigations & Litigation, Société Générale Bank, FranceNicolas Brooke is the General Counsel for Litigation and Investigations at the French bank Société Générale. In his role, he notably

focuses on investigations, financial crime, international arbitration, banking and finance, fraud, and supervises proceedings that are launched worldwide against the bank. While at Société Générale, Nicolas has often been in contact with the US, sometimes in extraordinary circumstances. He worked on the first joint resolution between the US DOJ and French public prosecution services in the LIBOR/Libya investigation, and notably received the GIR Outstanding In-house Counsel of the Year 2018 award in this respect. His team was further recognized with the award of the Most Important Development in Investigations 2018. In his presentation, he will be sharing with you his experience when dealing with government probes into Libor manipulation, foreign bribery and US sanctions violations. He will tell you how he dealt with cultural gaps, how he organized his team, how he approached a completely novel type of investigations and how he selected and worked with his outside Counsel. Lots of war stories to look forward to!

9:45 am – 10:00 am Break

10:00 am – 11:00 am Fueling Your Passion With Good Health

Dave O’Brien – Cork, IrelandTaking ownership and responsibility of one’s health is not a given - one has to work at it. In 2010, at age 56 Dave O’Brien

became the oldest man in the world, the only Irish man ever and one of only a handful of people on the planet to complete 4 Desert Runs in one year. A Desert Run is five marathons (250KM) over seven days with all of your gear on your back, sleeping in shared tents and running in actual deserts around the world.

Dave will impart what was behind the drive, focus and passion that pushed him to attempt what had never before been achieved by someone his age. In 35 years of running and with over 600 races completed worldwide, he has never been injured or sick, or missed a race due to sickness or injury. According to Dave, “it is not just good luck or good genes . . . it’s good health. If you cut your finger, it heals. If you get a cold, it goes away. We have a trillion dollar body and yet so many put more time and effort into a shopping list than they do their own health. It is a sad fact that large numbers of people on this planet do not worry about their health, until they haven’t got it.”

Dave will be addressing the key issues leading to compromised immune systems and ill health as a result of stress, fatigue, poor diet, mental & physical health, environment and technology. Dave’s talk will be a roller coaster, a journey of emotions that will trigger something deep within all of us in our quest for longevity with quality of life. “It is time to look after you, so you can look after many.”

aDTA 2019 ACTIVITIES

Bundled ActivitiesLindores Abbey Distillery and Falkland CastleWednesday, May 1, 2019, Noon – 5:00 p.m.

Sip, sample but don’t stumble. We will explore the Lindores Abbey Distillery, a medieval structure, believed to be one of the world’s oldest whisky stills. Then over to the Falkland Palace, where you can tour the historic castle and gorgeous gardens, a “must visit” from hundreds on TripAdvisor.Day includes: Transportation, Guides, Boxed lunches, Tours.

Lindores Abbey DistilleryLindores Abbey was founded in 1191 by

David Earl of Huntingdon on land given to him by his brother King William. It is believed William Wallace rested in the abbey after the Battle of Black Earnside in 1298 with 300 of his soldiers after they defeated the English.

Recently archaeologists found what they believe to be an installation used for the distillation process at Lindores Abbey in Fife making it the oldest whisky still ever found.

The first ever written record of Scotch whisky distillation took place in the abbey in 1494, according to the exchequer rolls of King James IV. It mentioned a Brother John Cor, a Lindores monk, who was commissioned by King James IV to turn 8 bolls of malt into Aqua Vitae (about 400 bottles of today’s whisky). History at its best.

Falkland PalaceLocated in the heart of Falkland’s conservation

village and surrounded by extensive gardens, this partly restored Renaissance palace is the perfect place to visit. A Certificate of Excellence winner, part of the palace is in ruins, but the original and reconstructed rooms are packed with 17th-century Flemish tapestries, elaborate

painted ceilings and antique furnishings. The beautiful, tranquil grounds are worth a visit alone.

Before Falkland Palace was built, a hunting lodge existed on the site in the 12th century. This lodge was expanded in the 13th century and became a castle which was owned by the Earls of Fife – the famous Clan MacDuff.

One of Falkland’s most famous royal residents – Mary, Queen of Scots – was enchanted with the palace, and took advantage of Falkland’s vast estate to pursue falconry and hunting, while also enjoying a game of tennis in what is now the oldest surviving real (or royal) tennis court in the world.

Glamis Castle and Scone PalaceThursday, May 2, 2019, 12:30 pm - 11:30 pmWhat a day we have planned for you! One castle is not the same as another palace or castle. Each has its own rich history and heritage. Today you may feel like you’ve transported back in time with castles and ships – the elegance and hard times make for unbelievable stories. The day wraps up with a reception and dinner at Discovery Point. Day includes: Transportation, Tickets, Tours, “Afternoon Tea” style refreshments, Guides, Reception, Dinner Glamis Castle

Glamis Castle is absolutely stunning with a rich history and is reportedly haunted. Located in the heart of Angus and witness to over 1000 years of history. Ancestral seat to the Earls of Strathmore and Kinghorne and childhood home of Her Majesty Queen Elizabeth The Queen Mother, wife of King George, VI. Glamis Castle has witnessed a wealth of history. It is a living breathing monument to Scottish heritage, hospitality and enjoyment for all.

In 1034 AD King Malcolm II was murdered at Glamis, where there was a Royal Hunting Lodge. In William Shakespeare’s play Macbeth (1603–06), the eponymous character resides at Glamis Castle. During the Commonwealth of England, Scotland and Ireland, soldiers were garrisoned at Glamis.

Glamis Castle is amazing with so much to see you will want more time.

78th Annual Meeting St. Andrews, SCOTLAND

Discovery Point (Reception & Dinner)Thursday, May 2, 2019

Ever wished you could go to Antarctica, with this expedition you can pretend you’ve been while enjoying a reception and dinner at Discovery Point.Located in Dundee, this spectacular building houses a museum that helps describe the interlocking stories of a native of Dundee, the Royal Research Ship Discovery, the man who became famous while

in command of her, Robert Falcon Scott, and the continent they were both born to explore: Antarctica.

In the 1800s the Royal Geographical Society needed a ship specifically designed to allow the exploration of one of the Earth’s last unexplored areas, Antarctica. Much of the UK’s whaling fleet at the time was built and based in Dundee, and it was to the Dundee Shipbuilders’ Company that the RGS turned to produce their ship.

Discovery was launched on March 21, 1901. It was one of the last wooden three-mast ships built in Britain and the first built specifically for scientific research. On August 6,1901 the Discovery set sail to Antarctic from Cowes, Isle of Wight, under command of 33 year old Naval Commander, Scott.Discovery spent over two years locked in the ice at Ross Island. During this time scientific research was undertaken, and Scott and two colleagues set a new record for the most southern latitude ever reached.

Kingsbarn DistilleryFriday, May 3, 2019, Noon - 5:00 pm

On this day we will offer loop transportation f rom the hote l to Kingsbarn Distillery to the city of St. Andrews where you can explore the shops and have lunch. We will be dividing everyone into groups so that we do not overcrowd the Distillery. There will be plenty of time to spend in St. Andrews to enjoy the day and take it all in.

Kingsbarn opened in 2014 by the Wemyss family who already have a whisky interest in Wemyss Malts, a boutique spirits company who’s range comprises blended malts, single malt single cask bottlings and a blended Scotch.

At Kingsbarns Distillery, Fife grown barley and water from an aquifer 100m below the distillery and through their process of milling, mashing, fermentation and distilling fill just 33 casks a week of their fruity and floral spirit. The spirit must mature in oak casks for at least 3 years and a day before it can be called Single Malt Whisky.

Kingsbarns has a culture that is solidly grounded in producing a true Fife single malt Scotch whisky that is light, delicate and fruity and that uses only barley grown locally in Fife and is only matured in Fife.

This tour will interest even those who are not into the tasting of such beverages as you will learn the history of the area as well as the history of making of Scotch Whiskey. There is also a nice café onsite.

St. AndrewsSt. Andrews is a town on the east coast of Fife in

Scotland, 10 miles southeast of Dundee and 30 miles northeast of Edinburgh. St Andrews has a recorded population of 16,800 in 2011, making it Fife’s fourth largest settlement and 45th most populous settlement in Scotland

The city offers a welcome change from department stores and shopping malls, has a selection of independent shops offering clothes & shoes, books, food and drink, gift shops, galleries of artwork, and of course, (who would ever have guessed) golf shops.

You won’t go hungry, that’s for sure. With over 60 outlets, including takeaways, coffee shops, fish & chips, pubs & bars, hotels and restaurants offering the best in traditional and fine food, plus the usual international fare of Italian, Chinese, Indian and Thai.

There are a few historical ruins in the town, including St Andrews Cathedral West Port, Blackfriars Chapel, Martyrs Monument and St Andrews Castle.
